Trump: I Am Tired of the Senate Declaring Fake "Pro Forma" Sessions Which Are Not Sessions to Block Me From Making Recess Appointments.
I Will Now Use My Constitutional Authority to Adjourn Congress and Make These Appointments.

Note that Congress is in fact adjourned -- all Congressmen and Senators have been sent home, and Congress is closed for business.

But to keep Trump from making recess appointments, they declare "pro forma" sessions -- which are not sessions. They're fictions. They just enter into the books that a Congress which is actually adjourned is, on paper, in session.

It's a lie.

How much force are we supposed to give a lie?

I'm sure the usual folks are shrieking, but guess what? He does have the power to do this, in an emergency. And of course, we've had a national emergency for a month.

Is the left going to claim it's not an emergency?

Are NeverTrumpers going to suddenly flip from "this is such an emergency we must shut down the US economy (until the day after the election!!)" to "this is not an emergency at all"?

Given the recent flip on the binary nature of elections: I say, yes, they certainly will flip!

nurse, funny thing, I've been working harder than ever from home. Something about these endless teleconferences, one after another all day long.

Adding to that, this is my last week at my current job and I want to get everything wrapped up.

I'm not surprised your place is practically empty. I'd love to get my teeth cleaned, get my yearly skin-scan, and get a wellness check from my GP, but of course that's all out of the question.

Congress, whether both houses or just one of them, has been doing the pro-forma-to-prevent-recess-appointments since the Democrats took over both Houses of Congress in 2007, and it stuck after SCOTUS in 2014 told Obama his NLRB appointments in 2012 during the 3-day gap between pro formas wasn't good enough.

I think you could legislate what an Officer or Council means and limit the approvals to a reasonable number. It's possible that it couldn't have emerged naturally there. There have been reports - including in the Epoch Times' documentary - that this particular wet market didn't sell bats. I don't know if that is true or not, but that's what certain rumor mills are turning out.

My theory has been that someone got infected and because of the high number of asympomatics they infected someone else and never realized it. It then spread around the lab, or their social network for weeks, only becoming apparent when it got to outsiders who were older and got real sick.

I have said that since Feb. But I have not seen that theory anywhere else. Lately (about 3 weeks ago - just before the documentary came out) it was reported that a lab worker dissapeared, but the theory in China was that a crematory worker got sick. So this is a new theory outside my mind (and my HQ and other site postings) and I am curious.

I had one with me but they aren't mandatory. I didn't put it on, because my glasses fog up. The only restriction is you have to wait until the person in front of you is done before you put your stuff on the conveyor.

Got an oil change. Also shipped some stuff through the UPS store. They have boxes in front of the counter to make you keep your distance. And I got lunch at McDonalds, which has a limited menu these days. Can't tell if the world is falling apart yet or not. Oh and I tried to bail out some things at the pawn shop. Turns out I need some form filed with the courts to be able to get those items. It's a community property state, but only for bills it seems.

I think this is intended as a reprimand against Senate Republicans, which is why it is words and not action at this point. Maybe they can legally keep this up, but Trump can pressure them politically for it. Though if they do end up going to court agaisnt Trump they're setting themselves up to be viewed as the enemy of most Trump voters. That play doesn't work quite as well when you're supposedly a member of the same party.

That seems to be the common interpretation I've found on it, but given the historical context it seems odd. Executives and monarchs have needed to adjourn a session of the legislature for various reasons, lack of agreement about when they would adjourn(between two houses) is not among them. Do not the House and Senate adjourn individually to begin with?

They've both held pro forma sessions in every congressional recess during Trump's entire term. Therefore never being "officially" adjourned. You can check the official calenders and during the breaks there's a single item where one member declares a pro forma session and then closes it a minute later, to reconvene in a few days. And repeat for however many weeks the rest are all gone.

It's obvious. He can, as the executive, request they convene, physically, or if they should declare themselves convened, he can request quorum on any emergency matter, which this constitutional article was specifically written form, and the inability for them to do so (quorum requires physical presence) he can declare them adjourned in the absence of such action...although, I am not sure this matter has ever been before the Supreme Court should it go that far...but the executive should win in such case or otherwise Congress could just flee, never return, and never take up the business of the nation.

441 Mitch can request a quorum to show proof of session...or Trump can. Pelosi is not allowed to reject a motion for quorum from either the Senate or the Executive Branch. The Executive, to request quorum, has to declare an emergency, which Trump has already done...he doesn't need Mitch in truth...

From Article 1, Section 5: Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members, and a Majority of each shall constitute a Quorum to do Business; but a smaller Number may adjourn from day to day, and may be authorized to compel the Attendance of absent Members, in such Manner, and under such Penalties as each House may provide.

They need 51 to do business, but they can do pro forma sessions with fewer.

What really needs to happen is for Cocaine Mitch to use that power to compel the presence of the Senate's members and keep them locked in the Senate chamber until all such business is completed.

Additionally, if the Senate wanted to formally recess they could've gone to Trump and said they were in a dispute with the House and Trump could've adjourned them.

With all 50 states being in declared major emergencies, the Stafford Act applies across the entire nation simultaneously.

Obama made 28 in his second year, when Dems controlled Congress. And 4 in his 4th year, under split party control, 3 of which were thrown out because he forced them through during a pro forma session. and the Supreme Court shot him down a couple years later.

It's certainly a far cry from the 100+ each made by Clinton and W, but it did occur.

More importantly, Obama was stymied by the opposition party, not his own, and he made legal challenges as well as actively campaigned against "Republican obstructionism" to create a political cost to their action.

Someone has probably even showed him the text: He "may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper." But "adjourn" does not have the loosey-goosey meaning which men less precisely educated than the Founders have understood of it, and which was passed down to us, the unsuspecting. No, the writers of the Constitution did not give the President a power to end a Congressional session. The Founders used "adjourn" in its original meaning. What do people do when they intend to meet, and what, therefore, do they often do just before ending a meeting, if they intend to meet again? They agree to meet at a certain date. "Adjourn," "ad+journ," as it was originally used in the English language, is to agree to meet "at (a) day." With this meaning in mind, the passage under discussion is fully coherent; that is, it fits together and works together. It means: The President may, on extraordinary occasions, convene both Houses, or either of them, and in case of disagreement between them, with respect to the time of adjournment (i.e. the day at which to convene), he may adjourn them (i.e. set the day at which to convene) to such time as he shall think proper. The President may convene the Congress and set a date for their convening. The President does not have a constitutional power to make the Congress go away.
