Federal Judge Orders Rare "Snap" Hearing, Demanding That the Department of Justice Explain Why It Is Keeping Documents About Imran Awan Secret

Is Trump president or not?

Some of this shit, he needs to straighten out personally.

I know the Deep State subverts him. But ultimately, the president has all the power of the Deep State and then some. He can just step into any office and declare that he'll be making all the decisions for the next several hours.

And it's about time he started to do so.

An apparently frustrated federal judge ordered attorneys for the Department of Justice (DOJ) to appear Wednesday in a "snap" hearing to explain why the government is not producing documents sought by Judicial Watch concerning former Democratic information technology aide Imran Awan....

"In a hearing last month, U.S. District Court Judge Amit P. Mehta expressed frustration and ordered the Justice Department to explain its failure to produce records by January 10 and to provide Judicial Watch some details about the delay," Judicial Watch said in a statement Tuesday about the snap hearing.
"Instead, the Justice Department made its filing under seal and has yet to provide Judicial Watch with any details about its failure to produce records as promised to the court," Judicial Watch said.

That last part is the fly in the ointment: getting a judge who'd do so.

I have no doubt that will be the argument, but its flawed in several places. First, states are supposed to control what happens within their borders as long as its exclusive to their states. Who lives there seems a pretty obvious example of this. Granted, that's been enormously eroded, but it is a constitutional principle right from the beginning.

Second, assuming the federal government has absolute control over immigration policy does not end the way the open borders advocates prefer.

It's a blind gamble, and not one I will take. I think it doesn't get fixed and that Trump can't fix it. I think that if Trump did what Ace is describing, they would ignore him. If he fired them, they'd be right back at that desk within six hours on a technicality. It's broken and it can't be fixed.

I still want Trump back in for two reasons:
1) Small victories are good, and the continuous dick-punching he gives to people who suck is nice to see.
2) It is a stay of execution. I wouldn't mind a little bit more time before things get sporty.

CT, as for your points, #1 Plenty of things "within a state's borders" are controlled by the federal government. Where federal law preempts the field, a state can do nothing on its own even within its borders. See: Maritime or Bankruptcy Law.

#2 Congress makes laws, the executive executes those laws. If Congress says: "The States shall take a proportionate share of refugees," then boy howdy, there they go! What you are conflating is the executive's ability to set policy in foreign relations with Congress' plenary (absolute) authority to decide what the policy of the nation is with respect to federal matters. If Congress declares war, the President cannot immediately surrender and draft a peace treaty.

That is why Andrew Johnson was impeached, for specifically defying an Act of Congress passed over a veto.

With respect to this program, it is a question of delegation. If Congress in an enacted law (signed by a president, not necessarily this one) has apportioned refugees in certain areas, then the President cannot then go and re-allocate based on the wishes of some governors. It just doesn't work like that.

Mostly correct; BUT if the President, in implementing that law, states that he wants to include a Governor's wishes in how the law is implemented, then he is using his Federal Power to carry out Federal Legislation. AFAIK, the law in question did not do any apportionment, that was left completely up to the Executive Branch. Since there are no specific implementation guidelines, the Judiciary should defer to the Executive Branch, which has the authority to work with State Governors, if it chooses to do so.

AFAIK, the law in question did not do any apportionment, that was left completely up to the Executive Branch. Since there are no specific implementation guidelines, the Judiciary should defer to the Executive Branch, which has the authority to work with State Governors, if it chooses to do so.

Thx, Tom. You have me at a loss. I have not read the opinion or the act. I will later. What I will say is that I felt the same way about denying funds to sanctuary cities until I read the opinion and the funding act. My underlying objection is that too many of us here think that Trump can do much about the Deep State saboteurs. Or about federal judges. He can't (though he's making good progress on the judge front).
