No Cash Bail...What Could Possibly Go Wrong?
I recently had dinner in New York City with old and dear family friends. They live near Lincoln Center on the Upper West Side of Manhattan, a vibrant and safe area of the city. So when I jokingly suggested that one of them should replace his cane with a sword cane for self defense, I was surprised that they both expressed concern for their safety on the streets of perhaps the safest part of the city.
New York City has been the safest large city in America for a generation. Giuliani cracked down on rampant crime in the early 1990s with a combination of aggressive policing, zero tolerance for petty crime such as turnstile jumping and graffiti, and a contentious but successful policy of searches for weapons that earned the ire of the ACLU but the thanks of most New Yorkers. Bloomberg continued many of Giuliani's policies, and the city remained incredibly safe. So safe that New York became complacent, assuming that low-crime neighborhoods were the default, rather than the product of many years of effort on the part of the police and the city government. But all good things come to an end... Fair or dangerous? Days after ending cash bail, New York has second thoughtsOn Jan. 1, a landmark New York law curtailing the use of cash bail went into effect, signaling a leap in a nationwide movement to reduce the number of people held in jails. But after less than a week under the new system, elected officials are already having second thoughts, rattled by stories of suspects' being set free and committing new crimes ─ including that of a woman accused of an anti-Semitic attack in New York City.This is the culmination of a careful and destructive effort on the part of Bill de Blasio, the crooked socialist mayor of New York, and perhaps the worst big-city mayor in America. Yes, yes, Chicago and Los Angeles are in the running, but crooked Bill is a special case; a marvelous combination of stupidity, tone-deafness, venality and sheer incompetence. New Yorkers are reflexive Democrats; they are apathetic; they like spending other people's money, and now they are reaping the whirlwind of their decisions.

It is a constitutional right under the 8th Amendment so you cannot simply abolish bail by denial of all bail applications. Like a lot of the Constitution and public policy, it requires discretion otherwise because not all people are equally likely to show up for court. Blanket no bail policies remove that discretion and either keep people in jail (which is expensive) for no good reason, or allows hardened criminals to treat arrest as a speedbump to committing new crimes.

The concept behind bail is to release the indicted and charge them a refundable sum of money to ensure the defendant shows up to court.
Otherwise everyone sits in a cell until their court date or you release them without bail and hope they show up.
It's the best compromise for an imperfect world.

Close. They want to encourage more building along the coast because the new units will not be grandfathered under Prop. 13, i.e., the state government wants to increase its tax revenue, and that's how they can do it.
Repealing Prop. 13 - which is a state constitutional amendment, thank God - is a political third rail, at least for now. But the liberals are trying to gut Prop. 13 for businesses already, with their "split roll" approach.

There is also a constitutional duty for law enforcement to release all exculpatory evidence to the defense.
It is safe to say that prosecutors have by and large been ignoring their Brady requirements and courts have went along. Flynn's travails are an example. Chicago PD was notorious for trash canning any evidence not point toward guilt for decades.
I am unaware of the scope of discovery required by NY state case law regarding defendants so this may simply be a codification of court decisions.

But last week, the newly Democratic State Senate defeated a Republican bill to repeal the bail reform law, and the Dpesker of the State Assembly, Carl Heastie who is from The Bronx, said New Yorkers need to have "patience" with the bail reform law. The state Assembly has an overwhelmingly Democratic majority, something like 105 seats to the Republicans' 45 seats.
So unless Heastie, who is a leftist, relents, or the Democrats lose lots of seats this election, we are probably stuck with this awful law. William Bratton, the former NYPD commissioner, a lifelong Democrat, has been loudly stating his opposition to the law, to no avail. Neither the Legislature nor Cuomo consulted with the NYPD before sneakily enacting it.

People were never meant to live like that, packed into spaces too small to support themselves, even marginally. I'm not saying everyone needs 40 acres, but breathing space and a few fences make for good neighbors.
When I lived in Smalltown WI, we had the same crazy people, but everyone knew them, and took care of them, so they weren't some sort of menace. In big cities, crazy people are ignored and allowed to degenerate into who-knows-what.
That's probably enough ranting, but I truly hated that big city by the time I left. It's great that the architecture is awesome, the museums, the big sport events, etc., but the tradeoff is humanity. No thanks.

FISC was created by Congress (like all inferior courts, which they also absolutely refuse to police).
Congress can abolish the FISC, make them wear pink tu-tus to work, deny them pay, whatever they want.

There isn't any need to let the DOJ and FISC fix themselves (ha!). Congress can and should take radical action. They won't.
BTW, FBI/FISC situation is an excellent example of how the US has entered the Third World corruption dilemma phase - how do you fix something if people simply don't follow rules or laws, do so with impunity, and not enough people care to do anything about it?
Exactly the dilemma that has confronted (and defeated) generations of advisors from the US and elsewhere who have earnestly tried to help certain countries rescue themselves from robustly corrupt systems.

The con argument is that it will be a trap, with the usual Democrat-controlled city ambush characteristics: violent leftist mob protected by police, selective arrest and prosecution, agents provocateur and fake Nazis infiltrated into the pro-2nd participants, cherry-picked media coverage.
I don't know. I'm inclined to suspect a trap/ambush. And there are other options at the county level, already underway.

You're both subtly wrong, and that's a large component of how things got this bad.
Democrat *voters* often either don't think about the results of these policies, or - increasingly - actually know, but value virtue signalling over results.
Democrat *leaders* know exactly what they are doing. They're not swinging and missing with policies intended to help people. They're fucking people for their own gain, and succeeding. The cities they're building are by and large what they mean to build. Much of what they do is described as "raising the drawbridge behind them"; they don't want others to succeed, because that would limit the utility of their own wealth and power.
