Sefton: sefton at cutjibnewsletter.com | No Cash Bail...What Could Possibly Go Wrong?I recently had dinner in New York City with old and dear family friends. They live near Lincoln Center on the Upper West Side of Manhattan, a vibrant and safe area of the city. So when I jokingly suggested that one of them should replace his cane with a sword cane for self defense, I was surprised that they both expressed concern for their safety on the streets of perhaps the safest part of the city. New York City has been the safest large city in America for a generation. Giuliani cracked down on rampant crime in the early 1990s with a combination of aggressive policing, zero tolerance for petty crime such as turnstile jumping and graffiti, and a contentious but successful policy of searches for weapons that earned the ire of the ACLU but the thanks of most New Yorkers. Bloomberg continued many of Giuliani's policies, and the city remained incredibly safe. So safe that New York became complacent, assuming that low-crime neighborhoods were the default, rather than the product of many years of effort on the part of the police and the city government. But all good things come to an end... Fair or dangerous? Days after ending cash bail, New York has second thoughtsOn Jan. 1, a landmark New York law curtailing the use of cash bail went into effect, signaling a leap in a nationwide movement to reduce the number of people held in jails. But after less than a week under the new system, elected officials are already having second thoughts, rattled by stories of suspects' being set free and committing new crimes ─ including that of a woman accused of an anti-Semitic attack in New York City. This is the culmination of a careful and destructive effort on the part of Bill de Blasio, the crooked socialist mayor of New York, and perhaps the worst big-city mayor in America. Yes, yes, Chicago and Los Angeles are in the running, but crooked Bill is a special case; a marvelous combination of stupidity, tone-deafness, venality and sheer incompetence. New Yorkers are reflexive Democrats; they are apathetic; they like spending other people's money, and now they are reaping the whirlwind of their decisions. Pfft, Newsom is doing this on a statewide basis.
De Commio needs to really up his game if he wants to catch CA. (okay, okay, yeah, bail is still required in Ca, but, property theft under $950 is a misdemeanor) So, people are just walking into stores, loading up with stuff and running. Same with groceries. 39, Bail is one of the things we inherited with the English system as a by product of the idea of the presumption of innocence.
It is a constitutional right under the 8th Amendment so you cannot simply abolish bail by denial of all bail applications. Like a lot of the Constitution and public policy, it requires discretion otherwise because not all people are equally likely to show up for court. Blanket no bail policies remove that discretion and either keep people in jail (which is expensive) for no good reason, or allows hardened criminals to treat arrest as a speedbump to committing new crimes. 50 years ago, the small town I was born and raised in, was one of the safest little towns there was.
Military bedroom community of a SAC base in Central California. Us kids were allowed to go where we wanted, when we wanted, as long as we were home for dinner. NOTHING ever seemed to happen in that little town. Base closed. Immigrants Legal and Illegal moved in. California lost its mind. Now its not safe. You can be shot for wearing the wrong damn color clothes. My 91 year old Mother, who would not even let us have toy guns as a kid (though Dad snuck in a few), now does not say anything about the guns I own. I recently joked (kind of) that next election night, the guns would be loaded, no matter who wins, and her response was 'Good'. Things have changed, and not for the better. The concept behind bail is to release the indicted and charge them a refundable sum of money to ensure the defendant shows up to court. Otherwise everyone sits in a cell until their court date or you release them without bail and hope they show up. It's the best compromise for an imperfect world. Now, who does Prop 13 give advantage to? Oh, LONG term Homeowners.
So they apparently want the elderly to pay more property tax, to drive them out and make them sell? Posted by: Don Q at January 12, 2020 03:02 PM (NgKpN) Close. They want to encourage more building along the coast because the new units will not be grandfathered under Prop. 13, i.e., the state government wants to increase its tax revenue, and that's how they can do it. Repealing Prop. 13 - which is a state constitutional amendment, thank God - is a political third rail, at least for now. 68 I think they actually do think these things through (I mean, how hard is it to foresee the consequences), but they value the opportunity to virtue-signal and scream "racism" more than they do any kind of intellectual rigor. Thus, they simply ignore what they know is going to happen. It's cognitive dissonance, but not really, since they simply choose to ignore reality.
Posted by: pep at January 12, 2020 02:58 PM (T6t7i) Yeah, that could be it, too. The amazing thing is how liberals invariably seem to scratch where it doesn't itch. Here in Cali, we see that with the "homeless" epidemic. Solution? Provide the "homeless" with homes. Problem solved, right? Wrong. The "homeless" are not simply people without a home, they're drug addicts, alcoholics, and/or mentally ill, and that is why they're "homeless." 47, That is separate from the bail issue on the release of witness information. However, once again, there is a constitutional right to confront witnesses against oneself and generally speaking all witness statements, etc. used to try people must be released to the defendant prior to trial. It is common for defense lawyers to contact all potential witnesses in the case as identified by law enforcement.
There is also a constitutional duty for law enforcement to release all exculpatory evidence to the defense. It is safe to say that prosecutors have by and large been ignoring their Brady requirements and courts have went along. Flynn's travails are an example. Chicago PD was notorious for trash canning any evidence not point toward guilt for decades. I am unaware of the scope of discovery required by NY state case law regarding defendants so this may simply be a codification of court decisions. In Minneapolis, you could track the rough neighborhoods based on main bus routes.
Same thing with St. Louis, which built a light rail system from the ghetto (basically) to more affluent areas to help ghetto denizens "get jobs." After it was built, you could trace the light rail route by the crime statistics, kind of like doing coronary angiography with X-ray contrast medium. As bad as DeBolshedick is, he did not pass the bail reform law. It was the State Legislature and Governor Andrew Cuomo. It was hidden in last April's budget bill.
After Tiffany Harris was released twice after twice slapping Chassidic Jewish women in the face, and after dozens of MS-13 gang members in Suffolk County were released, Cuomo made a phony speech that the law needs revision. But last week, the newly Democratic State Senate defeated a Republican bill to repeal the bail reform law, and the Dpesker of the State Assembly, Carl Heastie who is from The Bronx, said New Yorkers need to have "patience" with the bail reform law. The state Assembly has an overwhelmingly Democratic majority, something like 105 seats to the Republicans' 45 seats. So unless Heastie, who is a leftist, relents, or the Democrats lose lots of seats this election, we are probably stuck with this awful law. William Bratton, the former NYPD commissioner, a lifelong Democrat, has been loudly stating his opposition to the law, to no avail. Neither the Legislature nor Cuomo consulted with the NYPD before sneakily enacting it. Never having been to NYC, and really never wanting to, my only experience with huge cities is Chicago, which is a sewer and smells like one. My first week of living there, I saw no less than three men whip it out and pee in public, as if that were normal behavior.
People were never meant to live like that, packed into spaces too small to support themselves, even marginally. I'm not saying everyone needs 40 acres, but breathing space and a few fences make for good neighbors. When I lived in Smalltown WI, we had the same crazy people, but everyone knew them, and took care of them, so they weren't some sort of menace. In big cities, crazy people are ignored and allowed to degenerate into who-knows-what. That's probably enough ranting, but I truly hated that big city by the time I left. It's great that the architecture is awesome, the museums, the big sport events, etc., but the tradeoff is humanity. No thanks. Posted by: tcn in AK at January 12, 2020 03:41 PM (vVOK2) 177

Impeachment of judges not at all the thing to do here.
FISC was created by Congress (like all inferior courts, which they also absolutely refuse to police). Congress can abolish the FISC, make them wear pink tu-tus to work, deny them pay, whatever they want. That's why I said above, nice new index of GOP emptiness to see what they (don't) do. There isn't any need to let the DOJ and FISC fix themselves (ha!). Congress can and should take radical action. They won't. BTW, FBI/FISC situation is an excellent example of how the US has entered the Third World corruption dilemma phase - how do you fix something if people simply don't follow rules or laws, do so with impunity, and not enough people care to do anything about it? Exactly the dilemma that has confronted (and defeated) generations of advisors from the US and elsewhere who have earnestly tried to help certain countries rescue themselves from robustly corrupt systems. I think wasting is a better word than spending but you keep spending it Mikey
Posted by: TheQuietMan at January 12, 2020 03:40 PM (SNcqh) That's why I didn't mind Steyer or Bloomie entering the race. They're spending money on their own stupid vanity campaigns that could have gone to other Dems. Posted by: Donna&&&&V. at January 12, 2020 04:25 PM (d6Ksn) 272
Wow, that "no-cash-bail" policy sure frees up anti-Fa and other violent Leftists groups for repeated, consequence-free attacks on Trump supporters, doesn't it?

Roberts needs to be impeached, the FISA court needs to be abolished, and the judges need to be in jail.
Posted by: CrotchetyOldJarhead at January 12, 2020 04:27 PM (maiNo) 274
I've talked with a couple of the kind of people who have to prepare submissions to that court, to get permission to do certain things. They like the idea of having oversight to their work, and were trained to consider the case they would have to make in order to proceed. And when they get an approval, they get a strong feeling that they have made their case and are right to go ahead. I don't want the court abolished. I want those gaping holes in the "chain of accountability" replaced with something that doesn't make a strict-constructionist cringe.b

north dakota state university won the ncaa division II championship.
NDSU has won the FCS NCAA football champoship 8 of the last 9 years. Lost in the semi-finals a couple of years ago. They are something like 140 W and 13 L in the last decade. Posted by: free tibet at January 12, 2020 05:07 PM (Ydn2k) 279
NDSU also beat Iowa State, Iowa, Kansas, Kansas State, Minnesota in the last few years. No one in the big10 will play them anymore. NDSU does start next year at Oregon. All of these games have been as the visiting team.

The beatdown of Kansas State by NDSU was so effective that KSU replaced a legendary coach in Coach Snyder with the North Dakota coach, Klieman. Coach Klieman has done well in terms of win/losses in his first year, but is not a builder of better people like Coach Snyder. Posted by: NaCly Dog at January 12, 2020 05:19 PM (u82oZ) 281

Democrats never seem to think through to the possible consequences of their policies. But they're supposed to be the smart guys. Posted by: Hadrian the Seventh at January 12, 2020 02:38 PM (7rVsF) Yep. They never stop to think how policies could go wrong, and they never learn from experience. See, e.g., rent control. They seem to view empirical evidence as flawed, and inferior to their theoretical notions of how things will work. Posted by: Deplorable Jay Guevara at January 12, 2020 02:41 PM (YqDXo)" You're both subtly wrong, and that's a large component of how things got this bad. Democrat *voters* often either don't think about the results of these policies, or - increasingly - actually know, but value virtue signalling over results. Democrat *leaders* know exactly what they are doing. They're not swinging and missing with policies intended to help people. They're fucking people for their own gain, and succeeding. The cities they're building are by and large what they mean to build. Much of what they do is described as "raising the drawbridge behind them"; they don't want others to succeed, because that would limit the utility of their own wealth and power. It may not be "ignoring" reality, but rather "absolute refusal to ACCEPT reality". I'm thinking back to when pussy hats and slutwalks were fresh and new: some brainwashed Feminist coed responded to a normal person suggesting that "Maybe if today's young women refrained from bar-hopping, getting blackout drunk, and going home with total strangers, the 'Rape Culture' you profess to fear wouldn't seem to be closing in from all sides ... " The dear thing responded that by God she's got the RIGHT to do what she wants, when she wants to do it, the WAY she wants to do it, without negative consequences; and if she has to curb her hedonism in order to be safe, well, "That's not the kind of world I want to live in!" (That is the exact, literal quote that made such an impression on me. Essentially, "I refuse to live in your imperfect world!", from a child certain she's entitled to every whim and caprice her imagination can conjure up.) It's yet another demonstration that Progressivism is a religion. Lefties are convinced that by refusing to accept the tawdry realities of the world-as-it-is (and especially the reality of "human nature") a New Reality will somehow take its place, the New Soviet Man (= Mankind Perfected) will emerge, and Utopia is just around the corner.
