Judge Orders Jury to Find Against David Daleiden in Planned Parenthood Exposee Case

Planned Parenthood could not sue for defamation, for the simple reason that what Dale Daleiden and the Center for Medical Progress was all true.

Instead, they sued on the theory that he had "trespassed" on their property -- he was permitted to be there, but the permission was granted to his undercover alias, and they're claiming that nullifies the permission -- in order to do "harm" to their reputation.

Obviously, if this ruling were to be taken as a real ruling, it would mean that undercover investigations are now illegal in the US.

But this judge does not mean the ruling to mean that. He means it to be a Conservatives-Only ruling. Liberal undercover journalists will of course continue to be immune (on First Amendment grounds) from lawsuit based on the theory that they were "trespassing" on property by securing permission to be there by using a false name and fictitious purpose for the visit.

And Jonah Goldberg will continue talking about Marvel Movies and the "alt-right" which dares to find fault with him.

In a statement released by the Center for Medical Progress, Daleiden said the decision is a threat to citizen journalism and First Amendment rights.

"While top Planned Parenthood witnesses spent six weeks testifying under oath that the undercover videos are true and Planned Parenthood sold fetal organs on a quid pro quo basis, a biased judge with close Planned Parenthood ties spent six weeks influencing the jury with pre-determined rulings and by suppressing video evidence, all in order to rubber-stamp Planned Parenthood’s lawsuit attack on the First Amendment," he said. "This is a dangerous precedent for citizen journalism and First Amendment civil rights across the country, sending a message that speaking truth and facts criticizing the powerful is no longer protected by our institutions."

Earlier in the week, Judge William Orrick ordered the jury to find Daleiden guilty of trespassing at Planned Parenthood conferences and clinics, where Daleiden and others from CMP met with Planned Parenthood executives and staff.

“I have already determined that these defendants trespassed at each of these locations,” the judge said, as he explained to the jury they must accept his rulings and only decide what damages Planned Parenthood should be awarded, if any.

Repulsive.

The media should, of course, be scandalized by this ruling, as it is a direct assault on the process of journalism.

But they are not journalists first; they are partisan liberals first. And they understand this is a Conservatives-Only ruling.

This nation will not continue to exist under two distinct sets of laws.

21 Yes well, Jury Nullification is a real thing. Mind you the judge can ignore them but its a valid form of protest in our legal system and has actually been very useful in the past.

Our entire concept of freedom of speech and how libel laws work is based in a large part on a jury nullification before the revolution. A governor was criticized by the press and back then the truth of the claim was no defense. You either did or did not say something that annoyed a nobleman and if you did, you were guilty even if it was accurate.

The defense attorney argued "F that, he really is all that and you should find the paper not guilty" and the jury agreed.

No, it is not judicial misconduct to have ruled as matter of Law and liability prior to a jury trial. It's actually an unremarkable rolling if that is indeed the law in the state. There's no First Amendment right to trespass. That said, it's still a crappy application of the law, and one that would only happen to a conservative group because the media is ignoring the case.

Can you do that? I think you can get a quick pass if you're over a certain age or with disabilities, etc.

And Jury Nullification has a very long history in this country. Goes back to colony days when the British had to quit trying to have trials here in maritime courts because there was so much nullification going on.

Just mentioning it during jury selection is usually an automatic dismissal. But be careful there are judges that will throw you in the clink for bringing it up. They don't want ANYONE knowing this is a completely valid tactic that anyone can employ.

I was never called to a jury in Fairfax County, but he told us that if you make a special request to be on a jury, you were struck from the rolls.

Judges have more power than many realize - but they know that they'll get in trouble if they use it too openly. If a jury makes a decision that the Judge thinks is contrary to the evidence presented, he/she can often just toss it out. (depends on the state and other things)

But I would point out that in the Oberlin trial, that Judge was very, very careful to do everything by the book, in order to make sure there would be very few, if any grounds for appeal based on his rulings. (He knew an appeal was coming) The Judge in this case has just made a great big sign with flashing lights saying APPEAL! APPEAL!!!

78 I haven't been called for a jury in like a decade. I think its because they aren't sure I even exist any longer, having not filed any taxes for a very long time.

Technically I'm supposed to for state taxes, no matter that I make too little to pay any, but the tax advisor at H&R Block told me not to bother. Feds you don't even have to file unless you make a certain amount. I just don't sell that many books. Came close one year.

I could probably file for Earned Income Tax Credit, but as a single guy, probably not worth much.

93 IIRC, a judge can overrule a jury. But if my recollection is correct, the judge can only overturn a guilty verdict. I don't think I've ever heard of an instance in which a judge was allowed to find for the plaintiff.
If I were a juror on this case, then I'd find for damages of one dollar, though I'm guessing that the judge also ordered a minimum amount of damages that the jury must find.

109 Judges have more power than many realize - but they know that they'll get in trouble if they use it too openly. If a jury makes a decision that the Judge thinks is contrary to the evidence presented, he/she can often just toss it out. (depends on the state and other things)

But I would point out that in the Oberlin trial, that Judge was very, very careful to do everything by the book, in order to make sure there would be very few, if any grounds for appeal based on his rulings. (He knew an appeal was coming) The Judge in this case has just made a great big sign with flashing lights saying APPEAL! APPEAL!!!

Correct. At this point it would be better for the nation to have too many, too trivial impeachments and removals than the almost never impeachments we now see. Legislators have almost entirely abandoned their proper role as a check against judicial overreach, because they find judges too damned handy.

Its politically costly to take certain stances or push for certain laws, so you just let a judge make a new law with some cockamamie ruling and hey, you get what you want without political cost!

I have a process. I have a skeptical nature. I have to reach my conclusions point by point.

However, even so, I saw the converging lines when the lefties would alternate "Hate speech isn't protected" with "So much hate on the right". "Hate speech should be suppressed because it's HATESPEECH" and "All Rush Limbaugh does is PREACH HATE!"

So, I've seen the lines coming closer for a long time. You just are never sure when they are going to converge.

Unfortunately, the same side has been isolating people from reality (it seems to me), so that they can't even be grounded against bolshevism.

Look up Cloudflare and the first site they shut off. The site never got their domain back (separate issue from Cloudflare but its host was GoDaddy, and then later stolen by Google). There's no guarantee the site's current host won't ultimately boot them either. (There's also Gab and 8chan, the latter which had to neuter its free speech policies to return, the former which only might come back under a new name and also with different speech policies.)

Assuming host providers will hold firm on protecting free speech is as shortsighted as not stopping mass immigration when the voters it imports go 70-30 against you. Or mainstream conservatism's strategies towards pretty much any of its stated goals (abortion, gay marriage, family, all complete failures). It's long past time for "get a different provider brah" to go away as a talking point.
