James Clapper Text to Washington Post Reporter/Deep State Stenographer David Ignatius: TAKE THE KILL SHOT ON FLYNN

Sydney Powell had a big morning.

She filed a brief in the Michael Flynn case pointing out that prosecutors hid so-called Brady material from her -- evidence the prosecution must disclose to a defendant -- and in fact pressured Flynn to cop a please quickly because they knew the Strzok-Page texts were about to be publicly released and they knew they'd never get a plea after that.

And more. So much more.

First, some quick stuff via Twitchy, then I'll get to sundance at Conservative Treehouse.



Next: newly-revealed texts -- which should have been disclosed to defendant Flynn years ago -- show Lisa Page admitting she "edited" the 302 interview (which should not be "edited" long after the fact -- it's supposed to be an authoritative record of an interview precisely because it was written just after the interview being memorialized) -- and that the initial 302s showed that FBI agents did not think Flynn was lying.

"Editing" these things long after the fact strips them of their key indicia of reliability -- the fact (now apparently not a fact at all) that they are written directly after the interview.

If it gets out that 302s -- supposedly contemporaneous or near-contemporaneous memorializations-- are in fact "edited" long after the fact... tell me, should juries continue treating them as highly credible?

Wait, the 302s say something inconvenient for the prosecution! So now do some "editing"!



What Flynn actually said: He didn't know if he had spoken to Russian Ambassador Kislyak.

What the edited 302s claimed later that he said: that he definitely did not speak to Kislyak.

Thus a lie is fabricated.



They also "edited" the question that was actually posed to Flynn to make his response appear false, and then charged him for having lied about a question never actually asked.

Well, according to Lisa Page's later "edits" it was asked -- but not according to the original 302 reports, written immediately after the interview when the memory was the freshest.



More "edits"?



Oh, and since we're charging people for lying: Lisa Page claimed she did not edit the 302s, until she was confronted with her own edits, at which point she changed her story and allowed well, maybe...



Oh, and they identified the illegal leaker of the Flynn-Kislyak call.

There is no Deep State, by the way.

We’re going to go through the primary filing and four exhibits to the evidence Attorney Sidney Powell is delivering to Judge Emmet Sullivan which contain some explosive discoveries. Toplines including:

(1) Lisa Page edited the Flynn 302's, then forgot when questioned by DOJ officials, then re-remembered when shown her texts. (2) The 302's themselves were written with lies that do not match notes taken during the interview. (3) The felony leaker of the Flynn-Kislyak phone call is named (James Baker). (4) New texts from Page and Strzok that highlight the entrapment plan. (5) ODNI James Clapper telling WaPo reporter Ignatius to "take the kill shot on Flynn". (6) The purposeful use of Judge Contreras to take the December 1st 2017 plea agreement; and much, much more.


Yeah I know almost all of that is repeated. But your Morons don't even read the blog. And someone told me the key to a good briefing is "Tell people what you're about to tell them, then tell them what you came to tell them, then finish up by telling them what you just told them."

(No seriously -- I laughed when I heard that. It sounds like well-traveled bit of wisdom but it makes sense and it was new to me when I heard it.)

The FBI leaked details of their investigation to the media and then strategized over how they could weaponize the media reports to conduct investigations.

Agent Peter Strzok and FBI Counterintelligence Director Bill Priestap discussed if this approach would work.

The prosecution then intentionally withheld the text messages from Flynn and the public, in their prior releases, showing Peter Strzok and Lisa Page discussing the Strzok & Priestap strategy sessions on using the leaks.

Those texts, clear Brady material, were purposefully hidden by the DOJ, until Sidney Powell went to find them on her own...

Holy cats, this next part is incredible. The 302's were modified to make claims that were never made in the interview. The language was purposefully and willfully made to look like something is wasn’t; and in some cases they made it up completely counter to the actual statement given by Mike Flynn...

CTH has screenshots of the relevant passages posted. I don't want to steal them, but click over to see the parts of the filing that support the claims made.

Sydney Powell filed this timeline of major events of the case and stories in the media about it as part of her filing.

Note page 3: On 12/01/17, Judge Contreras -- a friend of Peter Strzok's, something never revealed to Flynn or his lawyers -- signed Flynn's plea dea.

On the very next day, 12/02/07, news broke of Strzok-Page texts.

It's almost as the release of the texts was delayed until Flynn could be pressured to sign a deal.

No, it's not almost like that. That's what fucking happened.

And then on 12/07/17 -- six days after he signed the plea deal -- Judge Contreras finally recused himself from the matter when the Strzok-Page texts themselves revealed that Strzok and Contreras were friends!

Oh, did I mention that Strzok was one of the agents who interviewed Flynn, whose 302s were later "edited" by his lover Lisa Page, who said she was having heart palpitations over the possibility that Trump could become president?

Her adulterous beau promised her an "insurance policy" -- something that was only revealed days after Flynn was pressured (due to Rosenstein going after his son) to sign a fake-ass plea.

All this is going on, and the government knows about it, but refuses to disclose this exculpatory evidence to the defendant -- which US courts have long stated is a fundamental part of the Sixth Amendment guarantee to a fair trial.

2) even if they get caught there's never any penalty
3) the blind zealotry of being certain you're doing the right thing so this petty sin is okay, for the greater cause, the bigger picture.

This aphorism ("Tell people what you're about to tell them...") is an old chestnut. Dates back to the '50s at least. Possibly in some "How to Make Friends and Influence People" pop-psychology book from that era, though at the moment I couldn't name which one exactly.

If he accepts her allegations as true then the charges against Flynn and his guilty plea must be vacated. And then the judge should notify the DOJ of all the charges that MUST be filed against those involved with this FBI crime.

Vic - you may not realize that there is a huge difference between what lawyers can say to the public (anything, just like politicians) and what they can say in a court filing. Any lawyer who files intentionally false or misleading information with a court is subject to severe sanctions. What I don't like is people ending a chapter with some kind of comment about the future which the narrator clearly cannot know about yet, in context. Its breaking you out of immersion into the book and reminding you "hey, you're reading a story!" and adds nothing to the flow of the storytelling.

Starting out with a scene and going back to explain how you got there is classic all the way back to Homer.

And if you can't quote from exhibits, all of which are copies which are attached to the filing, well, I wasted about 35 billable hours and a crap ton of our clients' money this week.

He pled guilty. He was asked again, after Powell signed on, if he wanted to withdraw that guilty plea and the answer was no.

They decided they wanted to try and open this can of worms in the sentencing portion. They realized, correctly that they could get the judge to agree it was relevant to sentencing whether they had withheld evidence of innocence and that's how we are here now. The judge can throw it out if they can prove it was a frame up. If they can't prove its a frame up, then the downside risk of withdrawing the plea is pretty high.

The prosecution can challenge the authenticity of the documents of the defense but that might require a rather difficult public or in camera hearing with a judge and the defense being present. To do so, they might just have to produce the claimed "originals" which presumably are just what Sidney already has copies of.

Frankly, the prosecutors should be disbarred and if they do not produce the originals in short order they should be found in contempt of court. If I was the judge, and they still did not comply, I would hold them for 365 days in jail and refer them to the DOJ for criminal contempt of court.

That's what they told me too and I can't do that. I used to manufacture the outline after I finished writing if it was also a deliverable. Sometimes the argument goes in a different direction than you thought it would at the onset. I also don't write the first paragraph until I'm done.

I started doing this in college cuz written exams in my day were written. If I ever ran out of time I got full credit for knowing the material cuz it was in my outline. That's what they told me too and I can't do that. I used to manufacture the outline after I finished writing if it was also a deliverable. Sometimes the argument goes in a different direction than you thought it would at the onset. I also don't write the first paragraph until I'm done.

672 OMG. If someone in the paper-chain rewrote one of my reports in any fashion I'd have seriously flipped my sh*t. It should always be hammered into boots (rookies) that "your signature on your police report can get someone executed", for that's how high the stakes can be. There needs to be serious jail time over this if proven true. "The end justifies the means" doesn't cut it here nor any other criminal justice matter. Still SMDH over this.
