There are some people - a significant number - who likely are never going to vote to convict based on their political views. It might be worse for the appearance of the rule of law to bring prosecutions and fail. But that's the most sympathetic explanation I can conjure.

68 I know no one wants to hear it, but legally, I understand why a case which could lead to termination but not to a criminal prosecution. It's the problem of having an employee who does a really bad job, and the need to prove intent.

For an example, look at someone who's hired to stock the freezer at McDonald's. Now they go in and wreck the thing, and mess up all the food, and cause thousands of dollars worth of damage. If they INTEND to hurt the store and cause damage, then that's criminal. BUT what it happened because they were a cross between Jerry Lewis and Urkel and the real mistake was in hiring someone that incompetent to do the job? Well then they get fired, and the Employer takes the responsibility.

That's what is happening, I suspect, with these people who are getting let go, but not prosecuted. It is legally very difficult to prove Intent to break the law, when incompetence and simply being an average, brain dead government employee is the other obvious option. And given what Civil Service protections are, it's a real triumph when idiots and incompetents can at least be fired.

Actually, the law is not about lying to Congress, but about lying to 'any agent or agency' of the Federal Government.

Making knowing false statements, even to the President, falls in this category by a strict reading of the law itself.

There was no "whistleblower". Schiff's people slapped this together and put it on the form as if it were, then figured out the huge hole in the plan, panicked, and got the rules changed to cover them.
