50 These decisions not to prosecute are disheartening. That said, not prosecuting might be the right call. Given the partisanship involved, I wonder if convictions could be secured if prosecuted. There are some people - a significant number - who likely are never going to vote to convict based on their political views. It might be worse for the appearance of the rule of law to bring prosecutions and fail. But that's the most sympathetic explanation I can conjure.

68 I know no one wants to hear it, but legally, I understand why a case which could lead to termination but not to a criminal prosecution. It's the problem of having an employee who does a really bad job, and the need to prove intent.

For an example, look at someone who's hired to stock the freezer at McDonald's. Now they go in and wreck the thing, and mess up all the food, and cause thousands of dollars worth of damage. If they INTEND to hurt the store and cause damage, then that's criminal. BUT what it happened because they were a cross between Jerry Lewis and Urkel and the real mistake was in hiring someone that incompetent to do the job? Well then they get fired, and the Employer takes the responsibility.

That's what is happening, I suspect, with these people who are getting let go, but not prosecuted. It is legally very difficult to prove Intent to break the law, when incompetence and simply being an average, brain dead government employee is the other obvious option. And given what Civil Service protections are, it's a real triumph when idiots and incompetents can at least be fired.

I think this tracks along with someone's comment on the last thread that Barr was going to use his investigations to drain the swamp and rid the DOJ/FBI and the IC of leakers and traitors versus prosecuting them.

--------

That was me.

And I believe this for a raft of reasons. Partly who Barr is. Partly who Trump is. Partly who the government are. Partly who we are as Americans.

The time isn't right to disassemble the US government. Not yet. And aggressive prosecution of the coup conspirators would be that very thing.

Look around you. We here are ready. But, are a critical mass of your fellow Americans are ready to say "Fuck it. It's regime-changin' time?"

Are a critical mass of people in the government willing to say "You know what? The jig is up, and it's time to stand down. We give up?"

Does Trump desire to spend the rest of his Presidency locked in mutual combat with the entire government?

Is Barr willing to destroy the DoJ he's served his entire career? And I mean - rip it to pieces and stomp on them?

Because all of those questions need to be answered in the affirmative before you will see the entire top rank of the IC and Federal LE apparatus of the United States staring at you from behind bars.

And how Judge Sullivan could possibly allow the Flynn travesty to stand - if he does - is beyond comprehension. A "guilty" plea from a former DIA director that he misrepresented a conversation that he obviously knew was recorded by the FBI - even joking about this obvious fact during the interview - has always been ludicrous on its face. Whistleblower laws are there to protect the blower from Administrative punishment. Things like getting demoted.

They do NOT shield a whistleblower from prosecution for their own illegal activity.

Thus, a whistle blower, like Eric Snowden, can be prosecuted for releasing classified information.

Which is the EXACT same case, with the current Whistleblower who is going after the President.

Yet, no one is talking about prosecuting him / her for releasing classified information.

charge them, bring it to a grand jury (you generally only need a majority of a grand jury to indict someone), let them see what lawyers charge in cases like this. Charge enough of them and they'll run out of pro bono attorneys (I hope)

210 These decisions not to prosecute are disheartening.

230 We are way down the Rabbit hole.

Posted by: Don Q at October 02, 2019 03:37 PM

Yep, snowden tried to hid behind the whistle blower Statute and was correctly told no friggin way. This won't work that way because there really isn't a whistle blower. He is slowly tightening the reins and giving those that have done wrong a reason to start offering cooperation to make sure the worst evildoers swing.

We he to come in Marine style and start kicking ass and taking names then the deep state cowards would retrench out of fear or go to ground.

It does seem that forcing this resignation was swifter and more matter of fact than others.

345 Pretty good since the Slimes is reporting that the "Whistleblower" went to Schiff before making his complaint.

Posted by: Iblis

There was no "whistleblower". Schiff's people slapped this together and put it on the form as if it were, then figured out the huge hole in the plan, panicked, and got the rules changed to cover them.

It's a fraud from top to bottom. No idea if they ever had someone recruited to be the "face", but if not it explains why they're so hell-bent on "protecting the whistleblower".

346 and yet nobody is tried, nobody goes to jail. Until that starts happening, nothing changes.

We are way down the Rabbit hole.

350 Lamb Stew for dinner makes me wish I had the sourdough ready for tonight, but it will need feeding for a day or two.

On another food note- I recently saw a Marionberry pie at the grocery store here in Utah. I thought it was a joke- a crack pie? But no..its a real thing. No Marion Berries back east, just (dead)Pipe hitting Mayors.
