Federal Appeals Court Reverses Illegally-Light Sentence Lower Judge Gave to Rand Paul's Attacker;
Lower Judge Had Given Him an Impermissibly Short Sentence Because He Was "Educated"

Had enough yet?

Federal prosecutors appealed this sentence as not permitted by federal sentencing guidelines. The appeals court agreed, and scolded the lower judge for illegally using the criterion that the attacker was "educated" as a reason for going outside the guidelines to give him the lightest of all taps on the wrist.

He could have gotten ten years; this judge sentenced him to merely 30 days. After all, he wasn't deplorable -- he had a "good background" and "education."

Boucher was originally charged with misdemeanor assault under Kentucky law, but the state charges were dropped in lieu of a federal felony prosecution. Boucher could have received up to 10 years in prison for an assault of a member of Congress that inflicted personal injury, but prosecutors sought 21 to 27 months in light of his acceptance of responsibility.

District Court judge Marianne O. Battani instead sentenced Boucher to only 30 days, arguing that Boucher had an "excellent background," was "an educated person," and "participated in the community in [his medical] practice and in [his] church." The Clinton-appointed judge also cited the character witnesses who testified on Boucher's behalf, including his pastor and the developer of his gated community.

Prosecutors appealed the case, arguing that the light sentence was "substantively unreasonable" compared with similar cases. The Sixth Circuit agreed Monday, noting that Congress specifically instructed courts not to give undue weight to class and education when sentencing defendants.

"To prioritize a defendant's education, professional success, and standing in the community would give an additional leg up to defendants who are already in a privileged position," wrote Obama appointee Jane Stranch for a three-judge panel.

Unfortunately, this case goes right back to the same judge. We'll see if she ups the sentence to 45 days.

I always say "The rules you make for us, you make for yourself as well."

There's a corollary to that: The laws you claim your tribe-members can ignore and have immunity from, are laws that I can also ignore, and which I also have immunity from.

20 >>>Wh -- it goes back to the SAME JUDGE?

yes but that's standard. An appeals court reverses a ruling, explains to the lower judge how she got it wrong, and sends it back to let that judge rule again, this time taking account of the errors pointed out.

When a court says "remanded," that's what they mean -- we've sent this back with instructions.

I think the judge has gotten the message that she cannot mention background or education or wealth as criteria, and she'll come up with other reasons to say he shouldn't have a heavy sentence. But, she might, I hope, at least understand she must give a sentence in line with the guidelines.

Of course, she will give a sentence that is at the absolute lowest end of guideline recommendations.

The story says that the Prosecution asked for 21 - 27 months, significantly less than the maximum 10 years, and I think that after this Judge has been slapped down by the Appeals Court, her safest play is to put her sentence at the midpoint of their recommendation. I'm going to cautiously predict that this case ends up with a sentence of 24 months in Club Fed.

Trump brings a fast moving business exec's approach to his staff, rather than the collegiate/political model that everyone else has always followed. In the Collegiate model, people are groomed for years and decades, tightly knit little fiefdoms are built, *no* *one* is ever fired for anything, no matter how egregious.

In Trump's business model, people are hired for the usefulness at a particular time. If they perform well, then they may be retained for the next project. If not, or if they disappoint, then BAM! 133 One of the reasons that I support reinstating the whipping post in American society: it would remove a lot of these bullshit lenient sentences because the defendant comes from the right family, goes to the right school, or the judge doesn't want to "ruin his future".

The lash treats rich and poor equally. A kid getting 20 lashes for vandalism doesn't have to miss out on their admission to college. A drunk driver getting 100 lashes can be back to work in a week.

168 Yes, sir. It was a very very bad thing to have done and I'm really very ashamed of myself, I can only say it won't happen again. To have murdered so many people in such a short space of time is really awful, and I really am very, very, very sorry that I did it, and also that I've taken up so much of the court's valuable time listening to the sordid details of these senseless killings of mine. I would particularly like to say, a very personal and sincere 'sorry' to you, m'lud, my lud for my appalling behavior throughout this trial. I'd also like to say sorry to the police, for putting them to so much trouble (shot of three heavily bandaged exhausted-looking policemen behind him) for the literally hours of work they've had to put in, collecting evidence and identifying corpses and so forth. You know I think sometimes we ought to realize the difficult and often dangerous work involved in tracking down violent criminals like myself and I'd last like them to know that their fine work is at least appreciated by me.

(The policemen look embarrassed.)

253 @realDonaldTrump:

One of the greatest and most powerful weapons used by the Fake and Corrupt News Media is the phony Polling Information they put out. Many of these polls are fixed, or worked in such a way that a certain candidate will look good or bad. Internal polling looks great, the best ever!

----------

This is something I always try to emphasize about polls: virtually 100% of the media are appendages of the Parties, mostly the Democrats.

The National Committees and candidates to whom these people are beholden spend millions upon millions of simoleons on expensive internal polls.

If they wanted to, they could simply hand those numbers off to their media mouthpieces and give them to the public easily. But they "don't" give them the polling data...

Instead, the media firms all have their own expensive polling units and partnerships with "independent" (LOL) pollsters.

Now "Why," you might ask yourself "are the Parties and their media organs keeping two sets of books?"

I doubt it. Cigarettes didn't do that, I don't see why vaping would. They're not vaping, they've looked like that since kindergarten. I thought they'd hit adolescence and grow, put on some weight. They're getting a bit taller but still look like concentration camp victims. It's mostly the boys. I think it's "gaming." 320 I remember all the arguments for going into Afghanistan, and for staying in Afghanistan. I used to believe them, I used to repeat them. Even now, they still sound good, but... things have changed. I look at that situation now, and I think "18 years? Really? We've been there 18 years?" And the situation isn't changing, it isn't getting better, there's no light at the end of the tunnel. When an American soldier dies there, like happened last week, what is he dying for? What have all of the soldiers who've died there over the last 15 years died for? Certainly not to make that country "better", because that hasn't happened, and that's not going to happen.

Tell me why it's worth sacrificing their lives without end. Tell me what their deaths accomplish.

One of many. The adultery would do it, also. As would the brother-fucking. And the wandering around without a male guardian. And...

Islam has basically the same rules on incest as Judaism and Christianity (some Christian denominations don't allow cousin marriages, others do). Brothers are right out.

They also have some unusual restrictions, for instance you can't marry a woman from whom you've suckled as a baby, nor any of her children. I guess this is considered as a near mother-and-child or near-sibling situation.

However, I'm too lazy to hunt the original post.

The Sixth Circuit did NOT find that the judge "illegally" sentenced Paul's attacker. They found that she made a legal error. That's a helluva different thing.

If every trial judge who made an error at one time or another had acted "illegally," there wouldn't be enough jails to hold them all.

357 The facts in the Rand Paul case are interesting. Paul (or somebody at his house) had put some tree limbs and other lawn debris in a pile near the property line with the neighbor. The neighbor didn't like looking at the pile of branches, and was upset it was there. But he didn't call Paul or walk over to ask him to move it or have it hauled off, he just steamed about it.

When the pile was still there a couple of days later, the neighbor had it hauled away himself. Then a few days later another pile appears, and the neighbor is even more pissed. Again, he goes onto Paul's property and hauls the stuff away himself. Then a third pile shows up, and this time the neighbor decides he's going to teach Paul a lesson. He pours accelerant over the pile and lights it on fire, but in the process he gives himself 2nd degree burns on his face and neck. Now he's really mad, and when he sees Paul on his lawn mower the next day, that's when he runs over and tackles him.

If this neighbor guy had just picked up the phone or walked across the yard and rang Paul's doorbell and politely asked him not to pile tree debris in his yard (or have it hauled away more quickly, or whatever), then none of this would have happened. Paul wouldn't have life-long injuries to deal with, Boucher wouldn't be headed to federal prison and he also wouldn't have a $500k civil judgment to pay Paul. But no, basic civility was too much to expect from this fine, upstanding, well-educated doctor who was a pillar of his community.

One of Fox's WH reporters said that he was hearing off the record, so he couldn't name names, that senior officials in the WH were getting tired of Bolton coming to them with his opinion.
So the above is probably spot on. Trump has said he likes having people who have divergent opinions on his staff as he wants to hear all sides.

But as Mr. Jen said to me , from his experience, once you have given your opinion and the boss decides you are moving in the opposite direction as a team, you better get on that team, keep your opinion to yourself , and do everything you can to move the team forward as per the boss' direction. You cannot have someone on the team crying and whining to everyone else about the decision and doing everything they can to sabatoage the plan by trying to peel others off to their side.

Bolton, I believe, was NOT a team player.

And the situation isn't changing, it isn't getting better, there's no light at the end of the tunnel. When an American soldier dies there, like happened last week, what is he dying for? If one doesn't have his own judge in the pocket, and a murderous gang enforcement agency, one should not consider his "theoretical immunity" a valid license to ignore the law. But establishing the principle equal justice is noble.

Hey black parents and grandparents, remember in the '80s when you demanded equal and minimum sentencing laws because racism and so that white kids wouldn't get a slap on the wrist when they did the same things black kids did?

Isn't it funny how there's a record number of black men* in prison because of minimum sentences, but white folks are still given slaps on the wrist because of "education" or other leftist fetishes?

Congratulations on your victory.

450 > The Left learned along time ago the one branch they can really corrupt quickly is the judiciary.

I don't know about "quickly", but it is definitely the gift that keeps on giving. Administrations are gone in 8 years at the most, but their judges are there for life.

Trump's greatest legacy is likely to be his judicial appointments (and kudos to McConnell for keeping the confirmation train rolling).

The story goes that Eisenhower brought this kind of leadership from the military to the White House. He had an intricate network of loyal workers, who were allowed to operate somewhat independently. As LONG as they remained loyal to the mission and respected the chain of command.

Still, there were snakes in Eisenhower's Administration, and they did much damage.

Since then, especially Republican White Houses have adhered to this type of structure. One of the drawbacks of course, is that often the President has no way of knowing who is doing what, in his Administration.

So... here we are.

497 398 The comparable 30 day sentence under this law was an egg thrown at a Congressman decades ago.
________________

Yeah, the entire defense argument for giving Boucher a 30-day sentence was stupid, and the trial judge should have rejected it out of hand.

This was a federal law case, not a state law case, and the fact that KY state law typically gives 30-day sentences for assaults resulting in minor injuries was completely irrelevant. The injuries Boucher inflicted on Paul were NOT minor by any stretch of the imagination, so the argument that Boucher should only get 30 days was just silly. A competent judge would have ignored it.

Plus the judge completely ignored the federal guidelines and the federal case law that says that factors like a defendant's education, profession, social status, etc., are not factors that should be used to reduce a sentence. She just did what she wanted to do, and to hell with what the law requires. Like all lefties, she thinks that she is the law.

537 Don't want to be a downer, but the Oberlin ruling actually isn't a surprise, and isn't the end of anything, necessarily. Oberlin had made a standard procedural move for the loser in a case like that, they had asked the Judge who presided over the case to overturn the jury verdict and give them a new trial. Judge Mirandi had been extremely cautious throughout the trial, and it was very unlikely that he would make a finding that he himself had made a mistake in how he managed it.

What was significant about this filing is that it was a clear guide as to what arguments Oberlin is going to make when they file an appeal of this decision at a higher level.

Flynn, who was his original pick, had be removed by the corrupt DOJ and FBI and was awaiting his fate( still is), and H.R. McMaster was removed when he disagreed publicly with both Jim Mattis and John Kelly and their feuds kept going.

by the way, Obama had four different NSA during his eight years, the longest lasting was Susan Rice, who was there for almost five years.

585 "And I like the feature that the law violates EqualProtection by being only applicable to the elected"

seems to me the elected should have a special protection ... it is a threat to the republic, not just the individual. But I don't know the "jurisprudence" on that issue.

586 Re Bolton

I know quite a few around here really like him.
Same with Condi.

I don't trust either, at all.

Same 3 letter in their background as the Bushes, Clintons, Barky, too many others to list that have held high positions in our govt.

Those 3 letters stand for a group that has openly called for doing away with national sovereignty.

He'll do a fine job.

One of the great tragedies of our time, seriously, is this notion that only career bureacrats and Harvard educated elite are fit to run anything. They've done incalcuble damage. Which is probably rather the point.

Exactly. To both of your points.

Rather see pipefitters and tool-and-die makers stepping up the career ladder than slugs educated to be saboteurs.

588 Rashid Talib has also upped her presence. She's everywhere on local news, and as I said earlier, has gotten a 9-11 ceremony cancelled tomorrow saying such ceremonies might cause anti Muslim feelings.
======

Of course she did. Because they won on that day 18 years ago. No one has the balls to admit it.

589 They announced it on the radio. A Baptist church in Bloomfield Hills was having a ceremony, but Rashid , a rep from Detroit-not Bloomfield-was offended as it might lead to anti Muslim feelings so they cancelled. She's everywhere on local news.
Posted by: Chillin the most at September 10, 2019 01:15 PM (lonOK)

Assholes. We as a nation should have more anti-muslim feelings. We now have to lie in order spread this Disneyland "small world, everyone's the same " bullshit.

590 According to the latest Vox/CNN poll, 99% of vapers agree that no one needs to vape, and that it is reasonable for the government to compel them to turn in their high capacity vaping equipment.

A tough job, and not one that can be done overnight. It took decades to build The Swamp.

The best part: he's also draining The Swamp in the Federal judiciary, and installing young sensible people. The Reds are going to find the judicial route a much tougher row to hoe going forward.

Cancelling a commemoration of an attack that killed 3000 Americans because it would hurt the feelings of the tribe that attacked us is how many steps away from internalizing the notion that we should not try to stop attacks against us because it would hurt the attackers' feelings?

Fucker should have been charged with arson right then and there. I doubt very much that open burning of yard waste is legal in that community. Should be, but it got nannyed out of existence in most towns.

607 I put the link in my mic about cancelling the 9-11 ceremony. The news is calling it an anti Muslim ceremony. Bloomfield Hills has a lot of Jewish people, and even though the ceremony was scheduled at a Baptist church, the community is not heavily Muslim-as areas in Detroit and Dearborn are.
