IG Report Says Comey Leaked and Violated DOJ Regulations; DOJ Declines to Prosecute

I don't know how the DOJ plans to go to the public seeking convictions of non-Deep-State actors, telling juries that these are serious crimes and stuff, while meanwhile deeming them not so serious whenever one of their own breaks the law.

A scathing inspector general report released Thursday said that fired FBI Director James Comey violated bureau policies by drafting, leaking and retaining memos documenting private discussions with President Trump.

The Justice Department's official watchdog concluded that the memos Comey kept were in fact "official FBI records," and said Comey set a "dangerous example" with his actions.

"By not safeguarding sensitive information obtained during the course of his FBI employment, and by using it to create public pressure for official action, Comey set a dangerous example for the over 35,000 current FBI employees--and the many thousands more former FBI employees--who similarly have access to or knowledge of non-public information," the report stated.

While the findings of the probe were forwarded to the DOJ, the department has declined prosecution, as Fox News reported earlier this month...

The 83-page document outlined a series of violations, including that he broke FBI policies and the bureau's employment agreement "by providing one of the unclassified memos that contained official FBI information, including sensitive investigative information, to his friend with instructions for the friend to share the contents of the memo with a reporter."

Further, the IG determined that Comey kept copies of four memos (out of the total seven he drafted) in a personal safe at home after his removal as director -- and in doing so "violated FBI policies and his FBI Employment Agreement by failing to notify the FBI that he had retained them." The IG said Comey again violated the rules "by providing copies ... of the four memos he had kept in his home to his three private attorneys without FBI authorization," and by failing to alert the FBI once he learned one of the memos contained sections later deemed classified at the confidential level.

Comey's GOP critics slammed the former FBI boss in the wake of the report. Rep. Jim Jordan, R-Ohio, top Republican on the House Oversight Committee, called his actions "disgraceful."

The report repeatedly and pointedly alleged that Comey wrongly violated policies for personal reasons -- in this case, in order to spur a special counsel probe.

The report is here.

3 Where are Comey's "memos" of his conversations with Obama? He met with Obama right before he met with Trump on January 6, 2017 but he typed up a memo only of his convo with Trump.

Why?

========

Because Straight Shooter. Because Lifelong Republican. Because Pine Scent was on sale that day and he forgot.

6 If Comey was ever going to be indicted he would have already been indicted as well as McCabe, Strozk, Page, the Ohrs.etc.

There is simply not enough time to do anything about this now.

Barr is not the one who's going to be making prosecute/don't prosecute decisions, and is not going to step in to over rule subordinates discretion lest he seem political.

And a Barr led DOJ is not going to be bringing highly charged indictments with political ramifications during an election year.

This is over.

The only thing that can be done at this point is for Trump and his allies to beat his Donk opponents over the head, win the election and pick up and pursue big time changes to the LE/IC/FISC so that this never can happen again.

The coup was unsuccessful, the perpetrators have escaped justice, what's most important that changes are made so that a future Deep State cabal can never do this again.

We should look at arranging a national strike. This is exactly the sort of thing we broke from Britain over. The concept of "two-tiered" justice has a single-word name: Tyranny.

15 The bottom line is that, eventually, a two-tiered justice system where those in power see no punishment or at best mild slaps on the hand results in people taking the law into their own hands.

Eventually.

Sometimes that can take generations, though. Right now the best thing we all can do is become nullifiers on juries. No convictions except for the worst crimes. No justice for them? No justice anywhere. No punishment for them? No punishment for people who do anything TO them.

86 As far as an IG goes, their reports will always disappoint someone expecting them to say clear-cut that somebody intentionally did X to break the law. IGs are not prosecuting authorities and really can only refer to prosecutors when they believe a criminal violation has occurred. Since criminal conduct has not been proven until a trial is over and a verdict is reached, an IG will either refer matters to prosecutors and reach no conclusion as to criminal conduct or wait until after a trial is complete and then state what the criminal justice system determined.

This is baked into the audit standards that they have to follow. So, Horowitz may or may not be a great IG, but he is constrained in what he can report. They excerpts I've seen contain very harsh language for an IG report.

91 Where does anyone get the idea that Trump can "order" the DOJ to prosecute? The President can ASK the DOJ to prosecute. If the DOJ says no, then he can fire people there because they pissed him off. He can fire the entire department, if he wants, but he can't bring a prosecution himself.

Let me try to put this as simply as I can.

He's the boss. He controls the executive department. He calls the shots. The Attorney General acts on his behalf, to do his bidding. If the AG can direct the DOJ to prosecute, so can the president, by ordering the AG. He's as much able to order action as the AG is.

Now, obviously, people can simply refuse to do what they are legally told to do, but then they can be removed and replaced. They can do the same to the Attorney General, tell their boss "meh, F off, I'm not doing what I'm ordered."

Why? Inspector Generals do not prosecute. They are like Blue Ribbon Panels appointed to look into something, ie, a way to punt the decision until public attention is elsewhere.

I watched it happen in the military. Two Officers did some pretty hinky stuff, and instead of the command pressing charges, they kicked it to the IG.

Who took so long to make a report that everyone had transferred by the time something could or would be done. Witnesses were gone. Folks had moved on. And the victims were no longer together and so were individual voices, with no support.

At this rate, from watching him awhile, I don't think Barr is a "deep state plant," or that he's "out for justice" either.

I have been saying for some time that Comey, Clapper, Brennan, Lynch, Yates, et. al. will never be charged, without regard to people, facts, evidence, or anything else. Because they are people who:

1.) are utterly serving, and

2.) are highly unstable individuals, and

3.) can implicate the former President and Thundershart.

Absolutely nothing will be done to endanger Obama and Hillary, because the political consequences are too severe. The government cannot and will not acknowledge that it's been corrupted from its nose to its toes, and by Our Historic First Black President and The Smartest Woman In The World, no less.

I (think) Barr returned from the private sector for this thankless bullshit, because he wants to "fix" the DoJ he served for decades. I believe he wants to expose the coup, and perhaps indict one or two lower level people, in the hope that this will stop the bleeding of the DoJ in terms of public confidence, and "right the ship" with regard to future misbehavior of this kind.

IOW, to put a stop to this, make the misdeeds public, and then make it all go away. And it wouldn't surprise me if this was also PDT's objective.

I'm not saying this is right, or will be effective. But I think it's what is.

Yes. Every time people say the cops and military will be on our side it makes me sad inside. Very, very few will turn on their fellow soldiers or desert just to help us out. The rest will follow orders and protect their squad, their platoon, etc. In war, its not about the overall big goal or the politics, its about the guy next to you, and if Joe Citizen is shooting at you, you protect yourself and your buddy in the foxhole, no matter how right the citizen is.

Civil War is not the threat, it is the hope. The long time greatest threat has been the globalist overthrow of America and its institutions. That is now evident at the FBI "top men" level, where they run an illegal investigation (coup) on their own faked/deployed narrative of Trump/Russia.

Mattis thinks the greatest threat (to the DeepState) is that the people won't roll over and accept their overthrow. Yes, but what I think we're seeing happen before our eyes is a general distrust for every facet of our political system.
People don't believe any of it is fair. I think a very safe prediction to make is that the 2020 election, no matter how it turns out, will be viewed as illegitimate.

Fraud will be the norm, and it doesn't even have to be any worse than it's always been. The people will view it as such, finally, and more and more people will feel they've been cheated.

So all authority will be suspect. The trust is already gone.

Here's a nasty, not-so-secret tidbit: federal judges, US attorneys, and federal public defenders are some of the laziest, most shiftless and loathsome pieces of shit among the flotsam found in Leviathan. While settlements always are encouraged, hence the number of plea bargains, trials are routinely off the table in the federal system in comparison with the states because all of the actors are layabouts. So they are somewhat insulated from jury repercussions because trials are an endangered species.

I would almost compare it to a family secret, the details of which are so sordid, that the truth must never come out. Sure, the rumors and conjectures are out there, an details and evidence may leak, but the truth must never be confirmed lest the family implode.
Posted by: JoeF. at August 29, 2019 12:29 PM (NFEMn)

The thing about family secrets, and I've professionally encountered this many times over, is that nobody actually doesn't believe it. Everybody "knows" what happened, and all this energy is applied to making the surface appear as normal as possible.

The victims and perpetrators co-exist, and form a sick, twisted alliance, where the conspiracy is to look in each others' eyes and pretend it didn't happen. Not to each other, and not to the outsiders.

But nobody trusts anybody, and when crises occur, no cooperation can happen, so it breaks down eventually, and when it does the whole thing collapses.

Like, say for example, China invades your Thanksgiving dinner. China will role over you like... like a bull in a china shop.

332 Comey violated his Professional Ethical Duty of Confidentiality against his client by leaking his clients confidential information to a party that had no right to have that information and that his employer had not given him permission to leak.

This Rule is outside the ambit of attorney client priviledge and applies to information a lawyer obtains in the course of their work for a client and not from the client directly as that would be protected from dislosure by attorney client privilege which belongs to the client. It is stuff not generally known to the public and can reach information that others know of but the general public does not.

For that violation of his ethic duty of confidentiality Comey is subject to the Bar for discipline in the jurisdictions in which he is licensed to practice law.

Not prosecuting him represents an internal revolution/coup, which in fact occurred some time back. This is not *our* government but degenerate rulers with hostile intent. States need to routinely disregard federal edicts. Sanctuary states and cities already do without repercussion but that's only because open borders are Deep State policy. It will be interesting to see the two-tier thing kick into gear when state police agencies stop having any cooperation at all with the FBI, ATF, DEA, etc. That's going to happen and trigger a nasty federal response despite gloomy prospects for anything approaching a civil reformation.

I recall before the Mueller Report crashed and burned all over the Left, MSM, and DNC's hopes, people were very vociferous on how Trump had to act, to do something, fire someone, announce something, so on and so forth. And as it turns out, that was exactly the wrong tactic, the advice he was given was full cooperation because what Trump's foes were trying to do was goad him into doing something that would support an obstruction charge.

Knowing how that played out I speculate that there is another patient long game being played here rather than a rolling over.

Comey lied and leaked. He should be held to account in his Bar jurisdiction. Someone needs to report him.

Bar Rule violation reports are held confidential unless there is a discipline applied and even then that might be private. It's not a clean transparent system but the Bar doesn't want it's discipline process to be used as a sword by warring lawyers. But that Comey behavior needs stopped cold.

535 Can we please finally just split into two separate countries and be done with it? Because I'd prefer that to having different sets of rules for different "sides" who pretend to be in the same country. I don't mind if they don't want to prosecute perjury. And I don't mind if someone else does. I mind when only one class of people can skirt all the rules, but then ruthlessly enforces them on the other side.
