Prosectuors Nearing Decision on Whether to Indict CNN Contributor Andrew McCabe

Calling him "CNN Contributor" is accurate, but I wouldn't have thought of that without Jack Prosobiec reminding me.

At the SJW NYT:

Federal prosecutors in Washington appear to be in the final stages of deciding whether to indict Andrew G. McCabe, the former deputy F.B.I. director and a frequent target of President Trump, on charges of lying to federal agents, according to interviews with people familiar with recent developments in the investigation.

In two meetings last week, Mr. McCabe's lawyers met with the deputy attorney general, Jeffrey A. Rosen, who is expected to be involved in the decision about whether to prosecute, and for more than an hour with the United States attorney for the District of Columbia, Jessie K. Liu, according to a person familiar with the meetings. The person would not detail the discussions, but defense lawyers typically meet with top law enforcement officials to try to persuade them not to indict their client if they failed to get line prosecutors to drop the case.

An indictment of a former top F.B.I. official is extremely rare and would be the latest chapter in the saga of Mr. McCabe, who was fired last year over the issue now under criminal investigation -- whether he failed to be forthcoming with internal investigators examining the F.B.I.’s dealings with the news media.

6 I don't believe they will indict McCabe, because that would be justice. And when they decide not to indict him, the entire Russian Collusion hoax is over.

No one else will be indicted, and the leftists will get away with the worst scandal in American history.

That may sound Eeyorish, but I'm basing this on decades of Democrats being unpunished for crimes.

33 On Saturday at a party I fell into conversation with a random neighbor who, to my utter shock, expressed disdain for and hatred of old-school '60s communists of the type who still infest the Bay Area. I thought I had FINALLY met someone in meatspace who was "on our side," but then the guy concluded the conversation by noting, "It's ironic how these old commies spend years trying to get the US to be controlled by Soviet Russia, and now their dream at last has come true -- Trump has turned the US into a vassal state of Russia, since he's a Putin puppet! Hahahaha!!'

He really though he had scored some social points by making this anti-Trump stupid attempt at a joke.

All I could muster in response was a monotone, "That'd be funny if it had any truth to it." Then I took another sip of wine and looked at him with dead eyes.

He quickly moved elsewhere and avoided me for the rest of the night.

Why did he have to go and ruin everything by thinking he needed to conform to the anti-Trump narrative, even after proving he was "based" when it came to hating commies? Ugh.

This has always been one of the major problems with any bureaucracy. A sense of entitlement by those who run the show. They figure they're above the rules/laws and they make end runs all the time. Some to their good and some to others misfortune.

I find the easiest retort to that nonsense is the oil and gas angle.

Since Russia relies so much on gas sales to fund its own government (I've read something like 70% of the government is funded by oil sales), why would a Russian vassal like Trump fight to expand oil production in a competitor like America?

Wouldn't a Russian vassal be more likely to stymie energy production in America in order to keep gas prices high and the Russian government funded?

Most people never really grasped why his firing was important, and why it happened 2 days before his planned retirement. It wasn't just vindictiveness; by putting on the record his termination for cause, it impeached his testimony in any future legal proceeding he may ever be involved in, and made all of those issues germane, and things that can be raised to question his credibility in any such case. If he had not been fired, that would not have happened.

It's similar to the real impact of Michael Cohen's conviction for perjury - from now on, nothing Michael Cohen ever says will be believed in court, ever. That's why all the hopes Nadler had of using him as a source have vaporized.

127 The first thing done to bury something in Government is to either investigate it or select a special panel to probe what happened.

That gives them the ability to say there's an ongoing investigation so they can't talk about it.

Then comes the run up to the results. Then they produce a multi-hundred page description of what they did what they found and what needs to be done about it which few people will read.

Then there's an investigation into whether their results should be enacted or acted upon.

You've now eaten up about 4 years and everyone is busy with a new election or some other tragedy/crime.

I think in principle - which may well not be relevant here - is did he break the law, do we think we can convince a jury of that, and is prosecuting him worth the time and trouble?

Essentially, what is the expectation value of prosecuting him: (likelihood of conviction) X (likelihood of meaningful sentence) - (likelihood of acquital) X (cost of prosecution in time and money)?

288 I've been trolling movie reviews for the latest from Tarantino (don't do so if you haven't seen it). It's been a really long time since I've done this - maybe 8 years? And let me tell you even the "movie review" landscape has greatly changed. It's never been populated by amazing people (apologies to James) but there was a deeply independent streak to their thoughts, however observant or banal.

But now? It's not just that there's idiots doing movie reviews but they are almost uniformly a particular kind of idiot, and bent way to the left, airing their social and political grievances and thinly disguising it as film criticism. Chalk up another skin suit.

It's really pathetic. It's not that these people are dumb, its that they are a very stupid kind of dumb, the kind of stupid that only comes with a degree earned being patted on the head for regurgitation, an education well beyond their limited intelligence, and a mind free from any depth of discernment beyond their own tiny facile world.

And their only sense of morality seems to have been baked to a char in class grievance mongering. It's very weird and a little sad.

The negatives usually give their reasons for why they hate it which is useful. Rotten tomatoes is no longer of any use because it's being gamed.

I guess I should take heart with this from Adventureland:

Joel : What's the point of being a writer or an artist anyway? Herman Melville wrote fuckin' Moby Dick, he was so poor and forgot by the time he died that in his obituary they called him Henry Melville. You know, like why bother? They're just going to forget our fuckin' names anyway. I heard Em went back to New York.

James Brennan : I wish it didn't end like that, I should've - I don't know.

[Beat]

James Brennan : Your Herman Melville story that - that's bullshit.

Joel : It's true, they called him Henry.

James Brennan : No, I mean, he wrote a seven-hundred page allegorical novel about the whaling industry. I think he was a pretty passionate guy, Joel. I hope they call me Henry when I die, too.

I'll probably wait for the DVD at this point.

So sorry Jane. It is damn near impossible to insulate from extreme stress that we face whether from family, health issues or job. If she gets too annoying maybe you can come up with reasons that you and hubby have a prior commitment and can limit your time with them. I hope it all works out.

Posted by: Berserker-Dragonheads Division at August 26, 2019 03:11 PM (9Om/r)

384 Here is another reason to believe he might get indicted. Barr has shown himself to be a believer in consequences for bad actors in high places. He demoted the head of federal prisons right after Epstein died. If he lets McCabe walk unscathed after leaking and lying about it, he will allow the precedent to be set for top people at the DOJ/FBI.

Posted by: JoeF. at August 26, 2019 03:05 PM (NFEMn)

Oh its not just that. Seriously if within the first four sentences (or minute if video) of any review mentions that the main character is "white", theres your clue. And run a mile. Click away fast.

It's now racist and insensitive to write about a white male struggling. And certainly without acknowledging the struggles of other classes which is like the worst crime imaginable.

I read film criticism to read about criticism of a film. Politics can be a small part of that. But politics and Marxism is easy. The rest takes work. Saying Robert Richardson's cinematography is "epic" while doing four paragraphs on the underrepresentation of women is not observant. It's lazy. And boring. Telling me what Robert Richardson DID... what choices he made and why you like or dislike them.... what you think his reasoning is.... that is film criticism.

James don't say too much!!!

I'm going to re-up my subscription to give it a try, but not right away. It's going to be a shit show on the servers for the first few weeks. I say let it calm down a bit, then try it for a month. If it's not to your liking, let the sub lapse again.

Mr. MWR was a huge vanilla WoW fan, but he's not planning to play classic because he's already been there, done that. As a vanilla neophyte, I'm looking forward to the challenge.

397 This will never happen.

McCabe seems imo likely to escape without a scratch and retire with a $150k/yr pension to his $3m home in a leafy, gated, armed-guarded suburb of DC. And he'll be on CNN every night calling the President an insane hitlerian traitor.

Posted by: md at August 26, 2019 03:16 PM (D+5jX)

398 Very late to the game here and hope this has not been said before:

I expect AG Barr to require a really intense training regime where everyone in the "rank and file" of the DoJ and FBI is told in very emphatic terms to stop exhibiting a lack of candor in the performance of any of their official duties. Failure to heed this training will result in at least two rather severe slaps on the non-dominant wrist. In really severe violations of this policy, the violator's next step increase may be delayed as much as two weeks!

409 I don't think the defense lawyers would meet with the DOJ if an indictment wasn't coming. That means they failed to convince the front line prosecutors to back off and are moving up the chain.

I don't see a jury in DC convicting anyone of violating the law while trying to bring down Trump though. At best someone will get a slap on the wrist for staging the closest thing this country has seen to a coup attempt.
