Kavanaugh Friend Sues Huffington Post for Defamation

A Gulfport professor and advocate is suing the national news website HuffPost alleging defamation involving a September 2018 story on U.S. Supreme Court Justice Brett Kavanaugh's days at Georgetown Prep school.
Derrick Evans’ lawsuit was filed Wednesday in U.S. District Court in Gulfport against HuffPost and its former journalist, Ashley Feinberg.
The lawsuit said HuffPost and Feinberg repeatedly defamed Evans and friend Douglas Kennedy to a nationwide audience on multiple occasions in September 2018 by falsely asserting that they helped arrange the purchase and delivery of cocaine at Georgetown Prep that resulted in the April 1984 death of David Kennedy, Douglas' brother and the son of the late U.S. attorney general and senator, Robert F. Kennedy.

The lawsuit said in HuffPost's zeal to create a sensational article about Kavanaugh's years at Georgetown Prep and thereby drive traffic to its website, it fabricated the claim that Kennedy and Evans "helped score" the illegal narcotics that killed Douglas Kennedy’s older brother, David, in April 1984.

It looks like Evans and Kennedy are alleging that HuffPo intentionally fabricated the entire story, without talking to one single witness of the actual events. That's how the WaPo got off (so far) - they could say they were just quoting someone else. HuffPo was too lazy to take even that simple precaution.

In point of fact, the Legislature is now a useless anachronism, incapable of any serious initiatives. It exists only to make foolish people think they have some say in things, and it's only purpose is to fill airtime for the networks.

The Supreme Court has become the true Legislative Branch now. All real Law originates there and is decided there. Executive at least still has the option of how to enforce things.

and that's why we fight about the SCOTUS so much.

Substantive due process meant that you had to have your day in court. If somebody wanted to take your property/slave from you, they had to bring you to court, to divest you of your slave. They couldn't just pass laws depriving people of their slaves in their state.

Thus "due process", the process by which the people made laws could not deprive you of your slave--and Taney pronounced every state a slave state--if you entered the state with a slave.

He definitely wasnt perfect in terms of the conservative ideals but he held firm and consistent to a widely disseminated judicial philosophy of taking the constitution as written. If I had to find a fault I'd say it was his dislike for overturning precedent. Any negatives one could point out were far and away overshadowed by his positives.

"The law" consists of (1) rules of procedure dealing with HOW the law is applied, for example courtroom procedures, evidentiary procedures, the steps of a suit, etc etc, and (2) the substantive body of law, ie, what you can and can't do - murder, negligence, breach of contract, etc etc.

I really don't know. He was moving so fast it was hard to understand some of what he was saying.

But I do agree that he seemed to indicate Obama was involved. At the very least Obama had to have been aware. We knew this from the Page/Strzok texts but this seems like confirmation.

That's how he was able to identify the drug dealers and assist in their prosecution. But he did nothing to discourage or stop the sale, and may have been buying himself. So while the claim that he sold Kennedy the drugs may technically be false, it may not be all that defamatory or damaging given the circumstances.
