Kavanaugh Friend Sues Huffington Post for Defamation

Gawkerize these motherfvckers.

A Gulfport professor and advocate is suing the national news website HuffPost alleging defamation involving a September 2018 story on U.S. Supreme Court Justice Brett Kavanaugh's days at Georgetown Prep school.

Derrick Evans’ lawsuit was filed Wednesday in U.S. District Court in Gulfport against HuffPost and its former journalist, Ashley Feinberg.

The lawsuit said HuffPost and Feinberg repeatedly defamed Evans and friend Douglas Kennedy to a nationwide audience on multiple occasions in September 2018 by falsely asserting that they helped arrange the purchase and delivery of cocaine at Georgetown Prep that resulted in the April 1984 death of David Kennedy, Douglas' brother and the son of the late U.S. attorney general and senator, Robert F. Kennedy.

...

The lawsuit said in HuffPost's zeal to create a sensational article about Kavanaugh's years at Georgetown Prep and thereby drive traffic to its website, it fabricated the claim that Kennedy and Evans "helped score" the illegal narcotics that killed Douglas Kennedy’s older brother, David, in April 1984.

A leftwing clckbait/outrage site making up defamatory claims to get clicks?

I shan't believe it, said the Covington Kids. I simply shannot.

9 They may have something here - saying "oh this person sucks, and is a racist" is nasty, but it's still just opinion.

But saying that someone committed a Federal Crime, such as the purchase and delivery of Cocaine, crosses the line into the type of Assertion of Fact that can fuel a libel case. Especially when the people involved are NOT public figures.

But hey, it's Arianna Huffington, AOL- Time Warner and friends.

I actually think that AOL Time Warner is now part of AT&T, as is CNN. Makes me wonder how much cross talk there was behind the lines?

It looks like Evans and Kennedy are alleging that HuffPo intentionally fabricated the entire story, without talking to one single witness of the actual events. That's how the WaPo got off (so far) - they could say they were just quoting someone else. HuffPo was too lazy to take even that simple precaution.

In point of fact, the Legislature is now a useless anachronism, incapable of any serious initiatives. It exists only to make foolish people think they have some say in things, and it's only purpose is to fill airtime for the networks.

The Supreme Court has become the true Legislative Branch now. All real Law originates there and is decided there. Executive at least still has the option of how to enforce things.

It wouldn't. It's another example of legislating from the bench.

And it's a false protection for the people--the ones with the resources to sue for libel are public figures.
The private individual rarely has the funds to fight back.

The media doesn't need protection by the courts

Bad she lied, but the sense that it was perfectly fine ... "we are the DC Praetorian Guards" is prevalent, it is now becoming clear. Yup.

And that alone has such a racist origin, we should be required to pull it down.

Its was Chief Racist Roger Taney, who while saying that the Black Man was never meant to be a full citizen of the United States, said that Illinois had tromped on the right to own Dred Scott in drafting their emancipation law.

But the ACLU made much hay with SDP, and so Communism is more important than actual self-governance and real racism, so they yawn.

Substantive due process meant that you had to have your day in court. If somebody wanted to take your property/slave from you, they had to bring you to court, to divest you of your slave. They couldn't just pass laws depriving people of their slaves in their state.

Thus "due process", the process by which the people made laws could not deprive you of your slave--and Taney pronounced every state a slave state--if you entered the state with a slave.

He definitely wasnt perfect in terms of the conservative ideals but he held firm and consistent to a widely disseminated judicial philosophy of taking the constitution as written. If I had to find a fault I'd say it was his dislike for overturning precedent. Any negatives one could point out were far and away overshadowed by his positives.

"The law" consists of (1) rules of procedure dealing with HOW the law is applied, for example courtroom procedures, evidentiary procedures, the steps of a suit, etc etc, and (2) the substantive body of law, ie, what you can and can't do - murder, negligence, breach of contract, etc etc.

So where does "substantive procedure" fit in? It doesnt - it's either, or.

Posted by: Emil Moresi at August 22, 2019 07:27 PM (ZPJb6)

178 surveillance is probably bad, but I could see why they would want to make sure foreign influence was safeguarded against. But with Trump, they did not give him the (required) briefing on the Russians trying to get in his campaign. (I think Hillary got one on that or some such).

It was going on before the 2012 elections, I'm sure. Nothing was beyond Barky and his junta of Maoists. He knew that normal people were scared to hold him or any of his toadies liable for anything. They were free to do whatever they wanted. And they did.

This isn't new.

236 The suit against HuffPost may not be airtight. According a detective's affidavit quoted in the complaint that HuffPost apparently relied upon, the plaintiff was "involved" in the drug sale to the extent he "was present" when it was discussed with David Kennedy. That's how he was able to identify the drug dealers and assist in their prosecution. But he did nothing to discourage or stop the sale, and may have been buying himself. So while the claim that he sold Kennedy the drugs may technically be false, it may not be all that defamatory or damaging given the circumstances.
