Former Senator Hank Brown Comments on His Former Colleague Joe Biden's Mental Fitness: "I will be surprised if he survives the primaries"

I assume he intended "survives the primaries" to mean "prevails in the primaries," but who knows. Biden is old and fading.


Brown: Senator Biden is a pleasant, outgoing individual. He was consistently one of the most liberal members of the U.S. Senate. To hear him described as a moderate could happen only in Washington, D.C.

Freeman: For an unrelated project, I have just screened six hours of campaign tape on Joe Biden. As you might expect, an original thought did not once interrupt the partisan boilerplate. But there was another problem, a problem not unknown to those of us of a certain age. The word Biden was looking for was, more than occasionally, hidden in the back of a closet. You've watched him for more than 30 years. Is he up to the job he's applied for?

Current US Code and judicial precedent define "persons" as "all human beings", period. Origin or status is irrelevant.
Current US COde and judicial precedent define "Under the Jurisdiction of" as being anyone who is subject to arrest by any officer of the law in this country. Embassy staff who have diplomatic immunity are about the only persons who fit this category.

So those are the things that have to be changed if you want to change the practice. Or just amend the 14th amendment to read differently than it does.

I am pretty tuned in politically and have been for a goodly while. The first I heard of the "blue wall" was through nervously babbling lips of news talkers on election night. The question is, do you believe, as Justice Scalia did, that the Supreme Court should follow the plain language of the Constitution as it is written? I loved W (at the time), but I was always afraid that he would put his foot in his mouth if he were asked more than three questions in a row. I've never had any fear of Trump doing that at any point in his presidency. It does, now. Congress rewrote all of the laws covering Native Americans in the massive Indian Citizenship Act of 1924, and that included bringing them inside the 14th Amendment. That's what causes me to believe that Congressional Action could deal with this situation without the need for a Constitutional Amendment, since Congress did it for the Native Americans.

but the President many NOT change statutory law with an EO. He can only direct how existing law is to be enforced, subject to review by the Judiciary.

The implication that this was necessary is that Indians, being subject to their respective tribe, were not "subject to the jurisdiction" of the US merely by traveling on US lands.

US law is now a mixture of 20th century legal concepts and the much older European legal concepts tied to kingdoms and such. This has lead to many weird results relative to other countries. It's an ugly mish mash but I don't see any reason to favor an obviously obtuse interpretation.

Trump is an anti-globalist and is not a free trade fundamentalist. He seems to like free trade when it's an above-board reciprocal deal but has no use for the "they'll get rich before we go broke" assertion in favor of asymmetrical free trade.

If someone is a college professor who handles international trade, he probably came of age during the "free trade at all costs" era of theoretical dominance and has built his career on it. Trump's positions are antithetical to that.

If this is right (and obviously I don't know the guy), I probably even understand this one. Trump's opposed to the theories on which he probably maintains his survival and lifestyle.

I was pointing out that that principle of the Constitution has a lot of history and tradition. The American Left (not the Internationalist Left) want to treat the Constitution (because of the Supremacy clause) as a Holy Writ. So do a lot of libertarians. As a result, there is a lot of Constitution as a Suicide Pact sentiment on the left/libertarian side.

The Constitution is mostly an agreed-upon way of doing things. For example, Lincoln cited that principle on the House Divided issue.

Resident aliens I have repeatedly stated were clearly included(not as others propose citizens only). It is obvious that the 14th amendment does not reference Indians directly, and so must be considered an addition by the judiciary(the tradition of common law is ultimately one of kritarchy). Given the 14th amendment received a commonsense addition in keeping with our tradition of common law, this would be a logical extension or clarification.

Did the writers of the law intend Indians, tourists, or trespassers to be included? No. Does the 14th amendment mention any of these by name? Also no.

Most law functions based on non (hyper) literalist and common sense understanding.

That sounds plausible - since we don't want ChiComs building airports, then we'd have to do it because the Danes weren't - for that we get some airbases and a port to park the subs needed to block the Artic.

The one simple reason is he needed the money to fight the Napoleonic Wars. Same reason he lost Haiti: he didn't have the resources to fight effectively there AND in Europe.
