Usually as soon as you get canned (often before), the lawyers are already in motion. In fact, if you think you *might* get wrongly terminated, you should already have a lawyer and file a raft of complaints about retaliation, etc. This is doubly true for people who work at the DEPARTMENT OF JUSTICE. You know, supposed experts on the law. Yes, it's battlespace preparation because their lawyers have seen the Horowitz report and responded to it. By drawing more attention to yourself, "I was just doing my job" can be said with or without a suit. If you're getting ready to be terminated or think that you might be terminated, then the smart ones already have a file of "when I was talked down to"; "somebody made a joke" etc. The fact that it took this long to get this far before these guys thought about doing this says something. It's not like they are going to get their job back. If they've seen the IG report, better to go quietly. Plus, cases like this never get tried. I have seen an alternate explanation for the timing of these two lawsuits, by McCabe and Strozk. The theory is that they want to have them in the court system, still kicking around at the time of the next election. Then, if a Democrat wins, he or she can order that the DOJ stop fighting these actions and give them both what they're asking for.

Unfortunately, the opposite is likely true.
There's still not even a grand jury empaneled, it's questionable if there ever will be. And the DOJ has already declined to prosecute him on some potential charges, as well as others involved, who were referred by Congress and the IG for criminal prosecution. He feels emboldened. He's going on offense. All of this spygate stuff has been a bunch of breathless excitement that has gone nowhere. Wake me up when there's a grand jury empaneled, subpoenas flying out and witnesses giving sworn testimony in front of it. Until then this is all noise and not worth even thinking about.
