A federal court on Wednesday rejected claims by an unlicensed “health coach” that the unqualified health advice she provided to paying clients was protected speech under the First Amendment.

In rejecting her claim, the court affirmed that states do indeed have the right to require that anyone charging for health and medical services—in this case, dietetics and nutrition advice—be qualified and licensed. (State laws governing who can offer personalized nutrition services vary considerably, however.)

Heather Del Castillo, a “holistic health coach” based in Florida, brought the case in October of 2017 shortly after she was busted in an undercover investigation by the state health department. At the time, Del Castillo was running a health-coaching business called Constitution Nutrition, which offered a personalized, six-month health and dietary program. The program involved 13 in-home consulting sessions, 12 of which cost $95 each.

You would think that’s what they are supposed to do, right? Go along with the new make-believe definition of male and female, just like the headlines does (because just a reminder, in the real world, men can’t be pregnant).

But now hospital staff are being blamed for failing to realize that this “man” was pregnant…

“He was rightly classified as a man” in the medical records and appears masculine, Stroumsa [lead author of a study published in the New England Journal of Medicine] said. “But that classification threw us off from considering his actual medical needs.”

Sadly, the “man” ended up losing the baby.

Not long ago, hybrids were novelties on roads around the world. The skies may be next.

Ampair, a Los Angeles clean tech company in my neck of the woods, is set to begin accepting orders for a hybrid electric aircraft at the EAA AirVenture airshow in Wisconsin next week. Dubbed the EEL, the aircraft is in fact a retrofit of a Cessna 337, an aircraft that has a forward-mounted prop engine that pulls and a rear-mounted prop engine that pushes. Ampair's retrofit will replace one of those internal combustion engines with an electric motor powered by batteries.

It's the latest example of a long-pursued goal of electrification in air travel. Aviation currently contributes 12 percent of all U.S. carbon emissions and 4.9 percent globally. Benjamin Saurini, 19, says he had trouble seeing out of his windshield on Friday because of the pot smoke fogging up his car windows. Saurini admitted he was trying to flee police near Melbourne, Australia, after smoking cannabis in the car with some friends.

Driving away from the scene, he panicked and side-swiped a police cruiser—pinning a senior constable against the car and breaking the officer's leg. The constable is still in the hospital after undergoing surgery on Monday.

Family can be a PITA. Rant follows.

DIL's Great Grandma/Grandpa are having a 75th anniversary. This is a big deal. Not many folks live long enough for such an event.

The local priest will be coming to celebrate Mass in their home for the family, followed by a brunch. Later in the day there will be an open house party, buffet, a band.

Great Grandma/Grandpa have eight children. One of whom has a spouse who is undergoing treatment for a serious illness. Part of that requires no children/sick people etc. be around them. They want to attend this event and are cool with saying, "We'll come for the Mass and brunch and then leave so everyone else with kids can come for the afternoon/evening festivities." But NO, half the family (mainly grandkids with young great-grandkids) are offended. My DIL offered that her relatives who wanted to go to the Mass could drop off their kids at her house and come back to fetch them after "Ellen and Larry" leave.

NOT good enough - they start bitchin' about why should they have to come back and get the kids, why can't she just drive them all over when it's time. Evidently none of them are smart enough to figure out that this would be a child seat, logistical nightmare. And would require my son and DIL to drive 2 vehicles in order to accommodate all the kids .

Well, it seems like a few things are going on here.

It seems to me that the sick person wants a lot of people to go out of their way to attend only limited parts of an event so they can attend.


Conversely, a lot of the other people want their kids to be part of it, and don't want to make accommodations for anyone.

Is either one right? I don't know; I sympathize with both sides; the sick person wants to be part of a big family event, but can't because of their illness, while the other family members want their children to attend the same event unfettered. Since they're in the position of making many poeple try to accommodate the needs of the one, it would probably be best for the person who is struggling with their health to stay home and attend via Skype or something.

If I were graduating from high school today I'd probably go into the military and become a large engine mechanic, and I say that as a guy who had a long and lucrative career as an engineer.

Not as much. When I graduated from college they told us if you stayed at a job less than five years it would count against you when you were back on the market. Ten plus was a bonus.

These days there doesn't seem to be a stigma for job hoppers, so as a consequence companies don't see the point in developing someone's skills just to have him jump to a competitor.

So, I went to the local Best Buy, and they had a WD 8TB external drive for 129!

So, I brought it up to buy it, and they were like, "Yeah, that's $169!" And I said, no, it isn't, it's $129.

The upshot is, they sold it to me for $129, and they were great about it. I was great about it. Everyone was great about it, though I noticed the floor manager guy was crumpling up a price tag thing as he authorized the sale.

The next day, I walked into the same Best Buy and looked, and they had the same drive for $139. So, I think, I won. I guess.

I bring this up only because I am a no-one who will die alone, and comments in websites might be the only way I will be ignored through eternity.

That's not my current experience. In my outfit, if they 'let you go', they will pay some severance. If you quit, you get nothing. So, if they don't want you around, they work hard to get you just simply quit - especially long term employees. The longer the service, the higher payout if you are fired/let go/job eliminated/etc.

I just swapped out the disk in an old 2007 iMac I bought off my sister in 2012 for an SSD because the disk was crapping out. I got a 240GB SSD from Best Buy that was supposed to be in the store (according to the website) but the guy couldn't find it. Then they found it, so I bought it. It's doing a fresh install of OS X 10.11 right now.

My sister took the proceeds from the sale and bought a handbag, of all things. But I was talking with her today and she said she still uses it seven years later. So I guess it worked out all around.

Got my lesson on the proper use of bear spray today. We're renting a cabin at the base of the Bitterroot mountains. Friends that live here gifted us the spray and taught us how to us it. They suggested having it on us when we take the dog out late at night and early in the morning. Also going to carry my Kimber 9mm. Probably will scare the dog and the bear would shrug it off. Still will make me feel better.

290 Once again drove home from The City with a fantastic fireworks show, only this time it was all natural. Loads of lightning ahead of us the whole way.

Just as we pull up to the front gate, the wind starts gusting and as we pull in front of the house and turn off the car, the clouds burst.

What a relief after these scorching days.

There were road crew along the way, evidently repairing some severely buckled pavement - both lanes - everyone had to drive on the shoulder. I rolled down the window and shouted "God bless you guys!" One guy heard and yelled 'thanks.' The storm should just make their work all the more fun.

Daughter is about a half-hour behind us. Little prayer always welcome.

Non-compete clauses aren't enforceable everywhere. Here in CA for normal employees they aren't worth the paper they're printed on, though it's different if, say, you owned a startup which you sold to another company.

Same here, the original drive crashed and I put in an SSD, downloaded a Mint iso, and bingo. It was a bargain basement Toshiba to begin with ten years ago, so speedy it isn't, but perfectly serviceable.

You really appreciate it when you've had to use other, lesser VCS like Subversion. Consider:
In SVN, you can branch and merge repos. But a branch is the entire repo, not just the delta. So branching a 30MB repo, which is hardly uncommon, takes another 30MB. Which isn't much by itself, granted, but it's unwieldy to push the branch out to the server (because it's not distributed, so EVERYTHING must go back to the server) all the time. And pull everyone else's branches.
Then you get to commit your wee little change. Git merges are pretty straightforward. If there are conflicts, resolving them is straightforward and transparent. If you want to commit some changes but not others, you can stash changes to your branch so they won't be considered for the merge. Subversion lines up both branches - each one a full-weight copy of the master - and crashes them into each other at full speed. The wreckage is left in your checkout directory (at least three new files for each conflict) and you get to clean it up before you can work on anything else.

316 Had a productive day today. Finished the body filler and primer stages of the rust repair to the rocker panels of the F150. Mixed up some "Steel-It" paint with about an equal volume of gasoline in a coffee, and used my engine-cleaning siphon sprayer to blast that mixture into the interior of the rocker panel via the access holes on the inside face. I spread paper to catch what dripped out; surprisingly, very little did. A shot of color-matching silver metallic paint, and some clear gravel guard, and it is done.

Did two bouts of lawn mowing, as break time waiting for stuff to dry. Mower is working real well, too.

Took a box of Keystone beer back to the liquor store, as it was just plain undrinkable; tasted like seawater. Got a box of Old Milwaukee instead, which is good for lawnmower beer.

And chipped a bunch of rust off the steel underparts of the Ford's running boards, and got a coat of black rust one one of them. Sun was getting low in the sky, so I quit.

The original comment was about executives, I replied concerning management under contract, not certain what "normal" employees are, but I believe it's not that. Locally, our livestock vet hires other vets, some coming out of school, the sign a contract not to start a new vet within x amount of miles for 5 years after they leave his practice. No one has started a new practice within that territory even well after the five years. He's a really nice guy and good vet.

I was reading about Torvald's creation of Git. One humorous quote was something he told those working on it with him, "Let CVS be your guide. If there's a question, do the opposite of what CVS does."

He was in need of a version control system for the Linux kernel. THere were problems with the one they were using, BitKeeper.

So he wrote some specs for the version control they needed for the Linux kernel.

THere was no product that met those specs, so he had to write his own.

Another quote that tickled me. Git is written in C, pure C, not C++. Some programmer complained about that, and Linus scorched saying, "...and, if using C serves no other purpose than keeping C++ programmers out of the project, then it's worth it."

It's only strictly legal to turn left on red from a one-way onto a one-way. But we do have flashing yellow arrows for left turns if the oncoming is green. Which is handy, because you don't have to wait through a red arrow if there's no oncoming traffic.

The photo of the car being winched out of the water shows the driver's window down, and the left rear window up. I don't know if the car was air-conditioned, or not. Kennedy might have rolled to driver's window down to escape the car.

IIRC, the car was found, barely submerged, in a nose-down attitude. Front window, open or closed, would make little difference to the persistence of an air bubble in the rear roof area.

The problem I find with that simplification is that if you depict them as wanting to make Man a slave to the government, you have lost them right there.

I can't find in any of their rhetoric the direct implication that they want to make Man a "slave" to the government. They deny so many things about themselves, that of course, if their literature doesn't even touch on it, they are going to outright deny that they want anything like that.

So my emphasis is always on their motivation to delude themselves. What they do is wish heavily that scarcity would become antiquated, that opposition would fade, and in their mind, they want to believe that that progress is already underway. And that people who reserve skepticism are part of the problem.

So they create dogma that must be observed, that must be accepted, that they demand that you not resist.

They only point out that the traditional division of bathrooms discriminates against people who feel alien to the bathroom to which they have been assigned. And in the end, there are not enough bathrooms for all the genders--and as a result, bathroom division by sex is probably superfluous (and discriminatory!) anyway.

481 Just learned that Fern Josephson died age 92. Wow. We work with her years ago in the restaurant industry. She was known for her industrial-strength jello. Nice old gal she always love my wife.

UK diplomacy and avoidance of the region. They keep saying that the UK doesn't have the assets to defend its shipping rights so they need diplomacy. I don't know a lot of the details and don't want to go too far here but something seems off to me. I am trying to remember the last time the UK was no humiliated by the Iran Navy, like in 2007.

I have been doing some research on the Falkland Islands War and what stands out is that the UK was ill equipped there as well. They did not win because of military might, they won because of leadership and fortitude. From the fly by night Vulcan bomber they put together to the Task Force they sent, it was not technological might but a sense of purpose that won. I don't want a war but it is sad when a nation like the UK allows itself to be humiliated over and over and only thinks of diplomacy. That was done prior to WW2 and was pretty much disowned.
