State Department Details 23 Security Violations and Possible Hacking Incidents in Hillary Clinton's Illegal Server System

Now they tell us.

All I see here is a big pile of lack of intent.

The State Department revealed Monday that it has identified "multiple security incidents" involving current or former employees' handling of Hillary Clinton's emails, and that 23 "violations" and seven "infractions" have been issued as part of the department's ongoing investigation.

The information came in a letter to Iowa Republican Sen. Chuck Grassley, who is responsible for overseeing the security review.


"To this point, the Department has assessed culpability to 15 individuals, some of whom were culpable in multiple security incidents," Mary Elizabeth Taylor, the State Department's Assistant Secretary in the Bureau of Legislative Affairs, wrote to Grassley. "DS has issued 23 violations and 7 infractions incidents. ... This number will likely change as the review progresses."

The document release revealed numerous episodes in which the Clinton team either suspected it had been hacked or seemingly acknowledged that security measures had come up short.

"omg," top Clinton aide Huma Abedin wrote to Justin Cooper, the technology pro overseeing Clinton's private home-based email servers, when he told her shortly after midnight on Jan. 9, 2011, that "someone was trying to hack us."

If you recall, the Justice Department imposed a ludicrously narrow definition of what emails Clinton had to turn over -- something that looked like the Justice Department was actively on Clinton's side in trying to hide her emails from them, and the public.

It looks more like that now:

And in March, it was revealed that the Justice Department "negotiated" an agreement with Clinton's legal team that ensured the FBI did not have access to emails on her private servers relating to the Clinton Foundation. Former FBI Agent Peter Strzok testified about the arrangement during a closed-door appearance before the House Judiciary Committee last summer, according to a transcript released this year.

"A significant filter team" was employed at the FBI, Strzok said, to "work through the various terms of the various consent agreements." Limitations imposed on agents' searches included date ranges and names of domains and people, Strzok said, among other categories.

Because if it was a criminal investigation, why didn't the FBI just get a search warrant to search her server? Why negotiate an "agreement" that allowed the Clinton team to decide what to turn over?

And if it wasn't a criminal investigation, why was the FBI involved? Why not just run this from inside the state department? Because in that context, it would make sense to have an agreement about what to turn over or not?

This arrangement makes no sense. Police don't usually say to a criminal suspect "hey, let's negotiate an agreement on what you will and won't turn over to us while we're investigating you for possible crimes."

And by "don't usually say," I mean never do because they'd never be able to solve any cases if the criminals and their attorneys got to decide what to turn over and what not to turn over.

Well, let's take her at her word -- she had her own email address that she decided to use out of convenience, and decided not to use the .gov email address.

At the very least, she's violating record retention department rules, and I'm sure there are federal laws related to record retention as well.

Not that someone would serve jail time for that, but, uh -- that should be a somewhat big deal, I would think. We have record retention policies for very good reasons -- when you work for the government, you are representing the Government of the United States, you're not just some private citizen talking to people. So we need records of what was said / done on behalf of the US.

Also, it serves as some minor check against corruption, since in theory everything should be recorded and made public.

I have to imagine that the government has some pretty strict filters on the Presidents email address -- for practical purposes (I can't imagine how many people, malicious or not, try to email the president on any given day.)

And State probably does as well.

So, I'm thinking that Hillarys email address was probably both white listed, and possibly even federated by IT people at both State and in the White House (or whoever runs the presidents email) and whoever else in government she was emailing.

Because otherwise, spam filters and security filters would have been a constant problem for her when trying to email people.

I thought my interview went very well. I really think they were impressed by my background and experience as well as my enthusiasm for intellectual property matters, coming from a technical background.

I have no idea how things will turn out; they're interviewing another couple of candidates and are looking to make their decision sooner than later, so maybe in the next week or so. But even if it doesn't work out, I can say I did the very best I could.

I used to have 2 phones, but now I consolidate both on to one phone, and just have 2 separate (well, 3, including my old school email address, but that's mostly dormant) mailboxes.

From a policy perspective, I'm not sure we'd want the government to be able to give someone immunity, have them give all kind of incriminating evidence, then retroactively pull the immunity when the immunized person spoke in good faith and followed the terms of his immunity.

(I'm talking in the wider context, not in this specific case.)

Logically, it would seem that the government would face punishment, not the suspect.

I agree about getting rid of secret courts like FISA. It's ridiculous, that's not how our court system should work. We have real courts where search warrants can be and are obtained every day in the US.

As for immunity -- it's a valuable tool that prosecutors (and grand juries) have, and is not going anywhere, nor would we want it to. It's also used every day in the US.

..Pro tip; skip all the math, sight through your (zeroed) night vision compatible red dot at something several hundred yards away, and adjust the IR laser to meet the dot.
You'll have the same result as all of the close-in fancy pants parallel zero setup work with about 1/100th the effort.
If you don't have a red dot... well, I'd take NV and a laser over a day optic at this point, but you'll have to confirm zero with live fire and go with a parallel zero. A laser unit w/ slaved visible laser makes this doable on a regular range in daylight.
It's a game changer, but don't forget any schmuck with a pawn shop camcorder with the IR filter cut out can see your IR laser and illumination.
