Charles Lipson: Mueller's Sinking Reputation

Must read.

Republicans add three more serious charges against Mueller. First, his team was packed with partisan Democrats, many closely affiliated with Hillary Clinton and strongly biased against Trump. Second, the report itself was shoddy and unfair, they say. It relied heavily on news articles, omitted exculpatory evidence, failed to investigate the infamous "Steele dossier," and never asked why, if Russians were trying to penetrate the Trump campaign, the candidate himself was not told by the FBI. Another serious charge -- deliberate distortion of evidence --comes from president's former attorney, John Dowd. He has shown the Mueller report edited one of his phone calls to change its meaning. Dowd is apoplectic, calling the report a "fraud." Others will join him if additional distortions, misrepresentations, and omissions are found.

Third, Mueller should have known at least a year ago, and perhaps earlier, that Trump and his senior aides never cooperated with the Russians. He had a duty, Republicans say, to disclose that in a timely way to the American public. He failed in that duty, leaving an unnecessary cloud over Trump and impeding his presidency. Why? And why didn’t Rod Rosenstein, who was supervising the investigation for the Department of Justice, step in and resolve these issues?

Of course, Republicans think the real subversion of justice was committed by the Obama administration’s DoJ, FBI, and intelligence agencies, both in their investigations of Trump and in whitewashing the email case against Hillary Clinton. Attorney General William Barr is already looking into those charges, as are DoJ Inspector General Michael Horowitz and U.S. Attorneys John Durham and John Huber. The chief judge of the secret intelligence courts, Rosemary Collyer, has already delivered a report to DoJ saying that the court was not given full, truthful information in warrant applications.

These investigations could burgeon into a catastrophic scandal, involving not only leaking, lying, and illicit spying but possibly collusion by U.S. government agencies to affect the outcome of an election. We don’t know that yet, and we don’t know the role the Obama White House played, but we need to know.

How do these issues affect Mueller’s reputation? First, his entire investigation was based on two fragile pillars, which Mueller never questioned. If they collapse, Mueller is buried in the rubble. The first pillar is the FBI’s dubious "origin story." The bureau states, and Mueller explicitly accepts, that its Trump investigation began in late-July 2016 after a low-level campaign volunteer, George Papadopoulos, spoke about Russia to an Australian diplomat in a London bar. Apparently, Papadopoulos also made exculpatory comments, which were not included (as legally required) in a subsequent search-warrant application.

But there is mounting evidence that Papadopoulos was not the first target and July 2016 was not the real starting date. Counter-intelligence investigations of Trump and his associates apparently began earlier and were never disclosed. Neither was widespread illegal spying on Americans by intelligence agencies and their private contractors. Still more surveillance was outsourced to friendly foreign intelligence agencies, which relayed their findings to Washington. Mueller never mentioned these problems -- and possible crimes.

This last bit is the most important, I think: If the DOJ, FBI, and CIA have to repeatedly lie about when and why this investigation started, that's proof that even they know that what they did was illegal from the start.

They want to claim the investigation only began when Papadopolous mentioned the rumor that Russia had Hillary's emails. But of course that's a lie, and already proven to be one; Josef Misfud, acting as a US agent, mentioned this rumor to Papadopolous, and then Alexander Downer, also acting as a US agent, catfished the rumor out of him and then reported it to his buddies in US intelligence.

But that means, of course, that Papadopolous was already the target of a spying/entrapment effort -- and that means the investigation began before the DOJ, CIA, and FBI will admit it did.

Why?

Well, here's one simple theory: They started the investigation based on the unverified, and often provably false, claims contained in a "dossier" based on Kremlin sources paid for by Hillary Clinton and the DNC. I would wager real money that never before in the history of the US has an investigation into a rival presidential campaign ever been predicated on such a vaporous foundation, and the DOJ, FBI, and CIA know damn well that this was unprecedented and very much Third World in practice, and so they're pretending the investigation began after they got some extraordinarily weak "confirmation" of the "dossier's" claims.

But, in fact, they began the investigation -- the spying, the framing, the inviting-Russians-to-a-dinner-which-Michael-Flynn-was-attending-to-claim-"Michael-Flynn-was-seen-dining-with-Russians" -- before the "confirmation." They began the investigation to get confirmation.

They began hiring spies and calling upon foreign intelligence services to infiltrate/frame the Trump investigation so then they'd have the pretext to investigate.

But that means, again, that investigation preceded "confirmation," and did not follow it, as they continue lying that it did.

At some point, this will become obvious, and the people pushing this lie are going to be exposed to perjury and jail time.

But they won't be charged and won't go to jail -- establishing beyond doubt that we live in a country in which government officials put citizens in jails for crimes that they themselves may blatantly commit and know they have full immunity for any prosecution for those crimes.

So long as those officials are acting in accordance with the Deep State's preferred liberal/Democrat politics, of course.

Scorched Earth': Mueller's Targets Speak Out

Veteran journalist Art Moore was editing a story on the Trump-Russia probe last October when he heard a knock at the door. He saw a couple of men in suits on the front porch of his suburban Seattle home and thought they were Jehovah's Witnesses making the rounds. But they weren't missionaries there to convert him; they were FBI agents there to interrogate him, sent by Special Counsel Robert Mueller.

If Reagan had then launched an unlimited investigation of the Mondale campaign in response to this he would have been impeached, convicted, and imprisoned with many Republicans siding with the Democrat majorities in congress.

61 Great post, Ace.

I want people in jail for what they've done. I don't think that will happen because everything is corrupt. Barring actual justice, I might settle for (not sure, just weighing some things in my mind):
* Dismantle the FBI. Completely. Gone. Everyone in management is fired and their pensions are withheld. Agents may be transferred on a case-by-case basis to other agencies, but with no guarantees.
* Serious house-cleaning at DOJ. Barring that, dissolve the DOJ and try again.
* Repeal the FISA and end the FISC system. Star chambers have no place in the United States. Are the provisions passed in FISA useful? Yes, probably. Are they too dangerous? Also probably yes. We should never have passed legislation that depends on honorable men to not overstep the bounds. Just because you have honorable men now, it doesn't mean the next man will be honorable.
* End warrantless wiretapping and metadata collection and unmaskings. Dissolve the NSA if needed. See also: FBI.
* Explicitly prohibit the use of friendly foreign agencies to spy on American citizens and then feed the information back to domestic agencies. Punishment is life in prison without parole.

We need law enforcers. We do not need these law enforces. We need intelligence agencies. We do not need these intelligence agencies. I want men in prison over this, but I might settle for sweeping reform and curtailment of power to misbehave again. I don't want that outcome, but I might accept it.

Let them finishes the cases they are on now....but no one can be re-hired to the new agency for say...5 years.

The new agency will be mostly populated by state prosecutors/cop and willl be headquartered in the center of the country....say St Louis (God knows they need all the help they can get there).

The head will be appointed by a majority vote of the 50 governors every 2 years.

Since they won't report to anyone in the federal government they won't have the current conflict of interest.

85 JEF started spying on anyone who got in his way long before Trump. He spied on hundreds of AP reporters, he spied on James Rosen and his parents, he spied on the Senate, he spied on opponents of his Iran deal, Lois Lerner sent millions of pages of private IRS information to Holder's DoJ, Comey had unauthorized FBI 'contractors' sifting through the NSA database--probably based on the IRS records--to find dirt on Obama's enemies / political opponents / detractors. The whole Carter Page FISA was an EX POST FACTO cover for the sh*t they'd been pulling for years. This has all been known for quite a while but is going to come out before too long. JEF's name has been pretty unsullied so far in this whole story. He isn't going to be that lucky much longer.

Also, another giveaway that Ace did not mention is that the FBI kept lying about when the investigation started. Originally they claimed it was with Carter Page. 155 We are past the point where even arrests will resolve this.

Even of the usurper Obama.

There are states that need to have that status revoked (California, Illinois, and New York just for starters). Agencies that need to be burned to the ground, their workers banned from ever having anything to do with government. Courts whose judges should likewise be removed, never to return.

The massive changes required to root out the full corruption are impossible in the context of normal politics.

So, what'll it be, America? Knuckle down, or kneel?

Because them's yer options.

156 What are we going to do about it?

Three choices:

1)Article V Convention to reign in the Federal Government.

2) Violent confrontation with our leftist masters.

3) Nothing. Continue to live in a corrupt third world shithole.
--------------
This seems aboutbtight, but I don't see 3 being a long term option because the left won't allow it. They will keep pushing with antifa and blm and lone wolf assassins until eventually a war is touched off.
I still say the 2020 elections will be when it happens. If Trump wins, the left will start a war. If Trump loses, the left will open the re-education camps and begin the political show trials and someone is going to fight back-which will set off a war.
I don't think Leo and the military will oppose the government. At least not in the beginning. The military has been purged of free thinking leaders. The good company and field grade officers were all purged under obama. All that remains in leadership are Obama's henchmen for the most part. Same things with senior nco's. At least in the army.

167 I read the article, and am not impressed by its Pollyannaish faith in proper FBI procedure. In case anyone forgot, Mueller:

- perjured himself by editing a voicemail sent to Michael Flynn to convey an impression opposite of the true intention. Deliberately misrepresenting a conversation this way is prosecutorial misconduct.
- hid the child pornography arrests of a key witness that the FBI tried to "associate" with Trump as a spy. He is now under arrest for yet another child porn charge.

This is a truly disgusting man, and that on top of the legal arguments Lipsson makes shows we have a legal system in terminal decline. Regular Americans are more likely to take their chances with the Mafia.

Does no one register what is being done to this country?

169 "They began the investigation to get confirmation."

Hillary was found to be vulnerable on Uranium One and the bribes (and Skolkovo favors also big, still less noticed) ... with her Reset button (and Obama flexible to Russia) ... she had to beef up her "Tuff on Russia" propaganda.

Trump was strong on patriotism ... so one of their geniuses (CIA/FBI/DNC or specific Clinton insiders) .. figured out Framing Trump as a Russian Stooge would work. They knew it was a lie from the start ... the "investigation" might help find something dirty, but mostly it was their old tactic going back to Lerner with the FEC (on behalf of Durbin) ... putting the opponent "Under Investigation" (for a rigged charge).

It was pure smear, they KNEW there was no confirmation to find, because THEY had fabricated the charge out of thin air. imo Rosenstein was as deep in it as Mueller, who went for the ride with the real DeepState "mafiosa". (Blumenthal, Brennan, others that do the dirty tricks, like Creamer) There was never going to be real confirmation, only confirmation they had fabricated. ("oh look, Don Jr met with a Russkie spy", which they sent there)

Scorched Earth': Mueller's Targets Speak Out

Veteran journalist Art Moore was editing a story on the Trump-Russia
probe last October when he heard a knock at the door. He saw a couple
of men in suits on the front porch of his suburban Seattle home and
thought they were Jehovah's Witnesses making the rounds. But they
weren't missionaries there to convert him; they were FBI agents there to
interrogate him, sent by Special Counsel Robert Mueller.

The guy had a stroke after the 'interrogation'.

Jeebus, when you read that article, the Muller team really comes off as complete weasels and quite paranoid about the Hillary Clinton Wikileaks.
That Rhee character is really a piece of work. Why was she part of an investigation where she clearly had a conflict of interest?

What an extraordinary shit show the Mueller thing is. It's literally everything that the left wished they could have hung on the Watergate team.....but instead they did it.

I'd bet money Hillary had little to do with this.

Obama had turned most of the executive branch into an anti-Republican organization. They were doing illegal things everywhere in order to advance progressivism.

If a Republican won the presidency, all of that would come out.

Obama needed a Democratic win to preserve his legacy and, potentially, his freedom.

3. Would LBJ run in 1968 then, and win, or not?

Given how fawning the media was of JFK, and how much more trusting the American public was, I find that hard to believe, especially if the GOP had serious infighting. (Note: the resentment we have toward the GOPee is nothing new, the Goldwater Republicans and Taft Republicans had it too).

So long as those officials are acting in accordance with the Deep State's preferred liberal/Democrat politics, of course.

246 FTA: "Mueller made two vital contributions. The first was an in-depth investigation of Russian interference in the 2016 election. He concluded it was systematic and favored Donald Trump."

Bullshit. There was no investigation of the "hack" of DNC emails - the word of a private firm hired by the Democrat Party was accepted uncritically by the FBI. And the phishing to get Podesta's password out of him hardly constitutes world-class espionage! The other supposed "interference" was the Russians spending about $200K on Facebook ads that were targeted to create division, not boost Trump. That amount is dwarfed by the money spent by Soros, only one of many billionaires for Hillary.

Not only are the very first words of this article a complete lie, but the reputation of Robert Mueller was already in the crapper from years of bad-cop work to anyone not a complete Lo-Fo.

And no mention of the twin 800-pound gorillas in the room... the corruption of the mainstream media that made it all possible, and the fact that it succeeded in changing the 2018 election to give Democrats control of the House.

All in all pretty much a nothing-burger for any reader of AOS or CTH.

I'm convinced at this point that Obama started spying in 2009.

I had dismissed the idea for years that Obama blackmailed Roberts for the ACA ruling, but I believe it now.

I think that when Romney wiped the floor with Obama in the first debate, Obama metaphorically showed Romney a manila envelope with pictures and Romney backed off.

I think that when we get the "real" history of the Obama administration in about 50 years, the world will see Obama as the single most corrupt president of the Republic. He'll be the Hoover of the Democratic Party.

Nixon was seen by the Goldwater Crowd as another Mee-tooer, and given his record from wage and price controls to affirmative action to eco hysteria, they were right, domestically anyway.

However, in 1964, Tricky Dick earnestly stumped for Goldwater and won a lot of goodwill from that wing of the GOP--which he used to win nomination in 1968.

Your theory that the investigation started earlier is probably true, given
that Mifsud was spying on Papadopoulos. However, that means it wasn't based on
the dossier to start. The dossier's first memo was not written until June 20,
2016. Mifsud met Papadopoulos on March 14, 2016. It was on April 26, 2016, that
Mifsud told Papadopoulos that the Russians had her emails and "dirt"
on her. It was May 10, 2016, that Papadopoulos told Downer about the Mifsud
claim (according to Downer; Papadopoulos says he didn't mention it).

I agree with Ace that no one (at least of importance) will face meaningful consequences, though I hope to be proven wrong.

However, I do see some positive consequences that are possible here.

This might finally, after years of abuse, wake the American people up to the monstrosity our IC has become. A small number (myself included) have been warning about this for close to two decades. A somewhat larger number took notice after the Snowden leaks, but it still largely went unnoticed. A popular President being ratfucked by the FBI/DoJ/CIA/ODNI/State Department in concert may finally be the last straw. We could end up getting desperately needed reforms in the medium to long-term.

In the short term, I think this will be helpful in the coming election. For one thing, it'll just look really, really bad to voters.

But more importantly, the IC is a powerful weapon, and slavishly devoted to Leftist power structures. If this investigation drags out for years (as I hope it will), it should keep the treasonous bastards walking on eggshells, and drastically limit their freedom of movement with regard to assisting the Democrat candidate next year.

326 I agree with Ace that no one (at least of importance) will face meaningful consequences, though I hope to be proven wrong.

I'm very pessimistic that just punishment will be meted out for these traitorous bastards. Re-assignment and a good talkin'-to are not going to sit well with a lot of people, however. Tipping point: engaged.

Breaking: Over 300 Vox Media employees are mounting a one-day walkout today to pressure the company to finish bargaining a contract with them, a union spokesperson tells me. They are not writing or editing stories.

Latest: Vox CEO @Bankoff tells employees he's "disappointed" by @vox_union walkout and, "While paying people a lot more than market wages sounds great on the surface, it's not realistic or smart." Says he wants "fair & highly competitive agreement quickly"

+1.

The economic illiterates who work for Vox pumping out their Marxist bilge don't understand that Unionization is a net drain on any business. It can only be workable when a given industry is flying high on success, or at least consistently turning sizable margins.

When you're looking around at your industry and seeing repeated bloodlettings where workers like you are being let go and trying to learn to code so they can afford pants (unlike Jonah Goldberg), it's the last move you should think of making.

329 If at the end of AG Barr's final actions none of the perpetrators of these crimes are held accountable our nation is lost.

We will have no choice but to gather one or two million veterans and have a meeting in DC.

Let the chips fall where they may.

331 But, in fact, they began the investigation -- the spying, the framing, the inviting Russians to a dinnerwhich Michael Flynn was attending to-claim "Michael-Flynn was seen dining with Russians" -- before the "confirmation." They began the investigation to get confirmation.

This began in 2013, it goes deep and far and they want to bury it.

333 We have passed even beyond not being governed by law.

We live in a country in which about half the citizens no longer wish to be governed by law.

335 This is cute and all, but unless there are very real and very serious consequences for this - and we all know that there won't be - it doesn't mean shit.

336 Patterico says none of this matters, that the only thing matters is orange man bad, and that if you can't see this, you're not a conservative.

He's ex-GOP as of May 3 2016, you know.

This is what I don't understand about NeverTrumpers. I, too, left the GOP around the same time, after Trump won that primary (Indiana?) and Cruz dropped out. I was angry at how Trump had smeared Cruz and his family and that Cruz, who had conservative bona fides, was rejected for this poser, who was basically a Democrat.

So I didn't vote for Trump because hell no I'm not voting for a leftist Democrat. (Although I was thrilled to see him humiliate Hillary.)

I lost touch with politics for over a year. But then I started hearing how he was actually governing conservatively, pushing the things that were important to us. He actually kept his promises about SC justices (which I had doubted) and actually moved the Israeli embassy to Jerusalem! Imagine that, a politician keeping his word.

Then seeing him stand by Kavanaugh - that sealed it for me. This guy was the real deal.

So as far as I am concerned, NeverTrumpers don't actually think conservative goals are important. They are petty people with petty concerns.

At least leftists don't try to pretend to be conservative.
