Judicial Watch Wins Legal Fees From Antifa Middle-School Teacher Yvette Falarca for Her Frivolous Lawsuit

Judicial Watch announced that a U.S. District Judge in California awarded Judicial Watch $22,000 in legal fees in a case filed by an Antifa organizer in an effort to block Judicial Watch from obtaining information about her activities.

Yvette Felarca, a middle school teacher in the Berkeley Unified School District (BUSD), and two co-plaintiffs were ordered to pay Judicial Watch $22,000 in attorney’s fees and $4,000 in litigation costs. Felarca had sued the BUSD in federal court to keep the school district from fulfilling its legal obligation to provide Judicial Watch with records of their communications mentioning: Felarca, Antifa, and/or BAMN. Judicial Watch also asked for Felarca’s personnel file.

Felarca is a prominent figure in By Any Means Necessary (BAMN), a group founded by the Marxist Revolutionary Workers League that protests conservative speaking engagements. In 2016, Felarca and two of her allies were arrested and charged with several crimes, including felony assault, for inciting a riot in Sacramento. Earlier this year, Felarca was ordered to stand trial for assault.

U.S. District Judge Vince Chhabria, Northern District of California, who had previously ruled that Felarca's lawsuit was "entirely frivolous," wrote in his ruling awarding legal fees to Judicial Watch that Felarca and her co-plaintiffs' First Amendment claims were "premised on the obviously baseless assumption" that the First Amendment condemns the speech of some while condoning the ideological missions of others.

What could have given her that idea? The mere fact that the media, the tech monopolies, and the Ruling Class acts as if that is what the First Amendment says, and is rapidly transforming it into that before our very eyes?

There are eight judges on the Ninth Circuit eligible for "senior status" (i.e. semi-retire, and open up their position for a new nominee).

They're all Clinton appointees (like RBG was). Clinton left office twenty-two years ago. Doubtless they will try to hold on as long as possible, because Orange Man Bad, but time eventually catches up with us all.

You realize the House voting for impeachment is simply "indicting" the president. They have no role in the president's trial, that takes place in the Senate. And there are no rules or constitutional comments stating the president cannot continue to fulfill his role while he is being impeached. So he gets to nominate judges and they go directly to the Senate for confirmation.

This is why the holding the Senate was and is so important.

My guess it is censorship. The Canadian govt. would likely go after any distributor that would provide the movie to theaters, along with the theater owners themselves. My guess is the movie would fall under Canada's hate speech laws and therefore is liable to the Govt. hand. Something about targeting women or some such thing.

This is why we have a Bill of Rights and it needs protected at all costs. Just take a look at laws in even "friendly ' countries, such as Canada and you'll be appalled.

Back in 1993-94, I worked for a small startup computer school called Focus Automation, which later became Focus Institute. At that job I had a fantastic-- and not bad-looking boss, named Anna Brannon.

Anyway ever since that job ended (too soon like all my other jobs), I've wanted to catch up to her. I spent years looking for her online, but she seemed to disappear after 1996; there was nothing about her at all online after that year.

Anyway, I finally found her... but it wasn't good. Turns out she passed away last year, and she was only a year older than me. As I said, I haven't seen or spoken to her in years, but it still feels sad.

I was 26, she was 19. And she was vastly more worldly than I was, or indeed, am now. She spoke nonchalantly about her various numerous friends at Berkeley High who'd died of drug overdoses, what later came to be called AIDS, the drugs she herself had done, how many of her classmates had had abortions, what have you.

She'd see the astonished look on my face, and reply, "What?"

I also knew of the son of a Berkeley faculty member who'd regularly been beaten up because he was Jewish.

172 OK, I'm back from voting. There was no bond issue. The only contested races were for judges and school board members. I picked a couple that weren't GOPe endorsed.

On my way to the polling place I came to a stop sign and saw a woman creeping up slowly on a chihuahua that had gotten loose. I remained stopped until she caught it and picked it up. I was starting to pull out and she came over to my window saying, "I don't know whose dog this is. I was driving by and saw it running around in the street."

I told her the location of the nearest vet's office, and she said she would ask around at some houses on the street. She wasn't there when I got back, so I guess it had a happy ending.

Not really.

When a judge orders sanctions against a lawyer for breaking the rules and the lawyer or firm doesn't pay, you go straight to the state bar association and make a complaint.

The pain of a bar complaint will cause the lawyer to pay, one way or another.
