When Trump's chief of staff Mick Mulvaney said the " media got it wrong for so long" speculating on collusion in the Mueller investigation, Tapper offered the spit take that "I'm not sure what you're saying the media got wrong....Other than the people in the media on the left, not on this network, I don't know anybody who got anything wrong."I think he's trying to throw Rachel Maddow under the bus with that "other than people in the media on the left" line. (What, Jake? CNN isn't on the left? Are you joking?) Glenn Greenwald, Jimmy Dore, Michael Tracy and other leftwing Russia skeptics have predicted this move from the media, that they would claim that it was all Rachel Maddow's doing. Blaming it all on a lesbian woman? How problematic. Why the cis white het privilege, Jake! She's not a news person - she's an opinion person. She's wrong about everything that she doesn't flat-out make up and she invents "facts" to suit her agenda, but you know where Maddow stands because she tells you up front and repeatedly precisely where that is.
Our good opinion people - like Tucker - don't do all they lying but like Maddow they're also not news people. A lot more can be forgiven from an opinion person than from a news person.
Maddow's not the worst, she's just talking her book. The "news" desks at places like (MS)NBC, CNN, Bezo's Blog, NYT, etc. are *far* worse than Maddow. At least she isn't pretending to be a straight-shooter who deals in objective truth. These other people do claim that, and this makes their actions worse than Maddow's.

Isn't there only way to rule on this? The census is required by the constitution for the purpose of divvying up representatives. Non-citizens are not entitled to representation. Determining representation requires a count of citizens. As we have non-citizens in residence, we must ask.
Given how obvious this seems, I expect that it will be shot down.

A "news organization" only has one real asset - it's credibility. They can talk about distribution, and viewers, but without Credibility they're just the Weekly World News pitching stories about BatBoy hanging out at Hitler's Summer Home in Bolivia.
THAT is why you work so hard to get things right - so that you don't squander the only real asset that you have. But now, it's been squandered. Take this story - one of the reasons I read this blog is to keep up with what people in D.C. are talking about, but in my everyday life, I would be surprised if I know a single person who could tell you who Jake Tapper was without looking up a reference. He's just totally irrelevant to our lives, as we live them. Had lunch with a few workmates today, and the conversation was mainly how the last couple that still had broadcast channels were dropping cable and/or Dish, and going to streaming only for video feeds. Nobody even watches the news channels much anymore, just too much constant blah blah blah. (I'm the nerd because I still enjoy Tucker)
It's not even really a movement of the left or right - it's more of a feeling I can sense amongst ordinary people that all of this is just bullshit, and they're not going to listen to any of it anymore.

If you're following along at home, that was the Trump Administration throwing out something juicy to identify their internal leaks. They gave separate little tidbits to different people they suspected of leaking.
So, not only did CNN blatantly release false information; they inadvertently helped the administration nail a few pieces of excrement inside the White House and helped identify those "journalists" that benefited directly from the leaks. I still don't think they know or believe that scenario. They are that dumb and self-important.
One of the other stories like that was the claim that Trump had a dedicated server to connect with Russian investors through Deutsche Bank. There is a certain democrat congresswoman who still thinks that's true and recently lied about receiving financial records from Deutsche Bank. But, she's dumber than a box of retarded rocks.

But the court case isn't about actually apportioning representatives, it's only about asking a question on the census about citizenship.
The idea is that asking the question will scare non-citizens from answering the census.
And the Left hates that.
It's not like Donald Trump, fresh off of his re-election, is going to suddenly have a large roll of where illegals live in the country, or anything.

2 points: First, recognize that 14th Amen, Sect. 2, overrides the first paragraph, since it comes later in time. The clause with the 3/5 reference has been defunct for about 150 years now.
Second point - (and this will not be a popular one) Since the 14th Amendment specifies "persons", not "citizens", then a Plain Language Reading says that illegal aliens should be counted as part of the State totals.

Good for you on bringing up this point, since a lot of people have missed it - when it was asked before, it was only for INFORMATIONAL purposes. And those people were still included in the total for representation, they weren't subtracted it. Because they were still Persons, even though they weren't citizens.
Even now, the Trump Administration is NOT saying that they won't be included - they just want to know how many are here. And the Left is scared that the illegals will hide and not answer the census because they're scared of La Migra finding out the results and coming to pay them a visit.
and thus they will SELF-SELECT themselves out of being counted.
THAT is what the entire census fight is actually about. All the parties to the fight know this - it's only the reporters and the general public that are clueless.

The last 150 years of case law can be summed up as, if you can be arrested by the local police for a crime, then you are "subject to the jurisdiction of". Foreign Embassy officials are about the only exceptions anymore. Indians on Reservations also used to be exempt, but that's been dealt with through separate legislation.
Plus there's a couple sections of Federal Code that define this more completely, with that same result.

Its not like leaving the boundaries of the United States removes you from US jurisdiction anymore than a person would no longer have been a subject of their respective monarch.
The text is clearly exclusionary. The standard and erroneous interpretation insists that the phrase added nothing to the sentence. You cannot be born or naturalized and not "subject to the jurisdiction" of the country in the sense of police jurisdictions and such. The claim that it includes everyone passing through the US as US subjects is dependent on the statement being meaningless.
Furthermore this was specifically addresssed in the debates leading up to its passage.
So we have a text that can only be interpreted this way if someone is intentionally obtuse and we have the debates where its proponents state it would not create freewheeling birthright citizenship. And yet this interpretation persists.
