Sefton: sefton at cutjibnewsletter.com | Rep. Devin Nunes Suing Twitter and Accounts He Claims Are Defamatory for a Total of $250 MillionI don't know if his suit against Twitter will go anywhere, as Twitter has the immunity granted to a "platform" when it obviously is actually a publisher scarcely different from the New York Times' staff choosing what letters to the editor to publish. And Congress will not repeal that -- the Democrats are pro-censorship of conservatives and the Republicans are bribed by the industry to be cool with censorship of conservatives. I don't know about the lawsuits against the individuals. Given how hard it is for a public figure to win on a defamation claim, they'll probably be fine too.California GOP Rep. Devin Nunes filed a major lawsuit seeking $250 million in compensatory damages and $350,000 in punitive damages against Twitter and a handful of its users on Monday, accusing the social media site of "shadow-banning conservatives" including himself to influence the 2018 elections, systematically censoring opposing viewpoints and totally "ignoring" lawful complaints of repeated abusive behavior. In a complaint filed in Virginia state court on Monday, obtained by Fox News, Nunes said Twitter was guilty of "knowingly hosting and monetizing content that is clearly abusive, hateful and defamatory -- providing both a voice and financial incentive to the defamers -- thereby facilitating defamation on its platform."I like the argument, but unlike David French and other liberals, I don't allow my liking of an argument to influence my evaluation of its strength. The Communication Decency Act gives publishers like Twitter the designation of "platform" and says they can't be held liable for a third party's defamations, and that's pretty much the end of that discussion. Congress could modify that at some point but they won't; Democrats want to restrict conservatives' free speech, and too many Republicans are frankly on the take. And also frequently consider conservatives' free speech to be a bother they would rather not suffer themselves. ... In large part because of Twitter's actions, Nunes "endured an orchestrated defamation campaign of stunning breadth and scope, one that no human being should ever have to bear and suffer in their whole life" in the past year, according to the complaint. The complaint also named specific Twitter accounts that spread allegedly defamatory material about Nunes. One defendant, identified as "Liz" Mair, purportedly published tweets that "implied that Nunes colluded with prostitutes and cocaine addicts, that Nunes does cocaine, and that Nunes was involved in a 'Russian money laundering front,'" according to Nunes' lawyers. The complaint quoted a June 22, 2018 tweet from Mair that implied Nunes invested in a winery that "allegedly used underage hookers to solicit investment." Mair did not respond to Fox News' request for comment.
The complaint also charged that Twitter "shadow-banned" Nunes in 2018 "in order to restrict his free speech and to amplify the abusive and hateful content published and republished by Mair, Devin Nunes' Mom [an attack account pretending to be his mother]" and other accounts.Eh. I wish this case were stronger, or that Nunes would hold off on his suit so that a stronger suit can be first to market. Then again, this wouldn't be the first lawsuit. But this would be the one the media talks about a lot, and not in a good way. Meghan Murphy, who runs FeministCurrent, Canada’s leading feminist website, is suing Twitter for banning her for her personal beliefs. The lawsuit, filed on Monday, says she was banned because her beliefs don’t align with the company’s politics. She sued twitter for banning her for stating a truth, that a man born as a man is a man. Twitter, while claiming to be nonpartisan, is enforcing the sexual left's fringiest positions, including the claim that it is a hate crime and Actual Violence to "misgender" someone by correctly stating their gender. You gotta click on that to see the picture of the guy she's saying is a guy. He identifies as a "lesbian transwoman," which means he's attracted to women, and that he's actually a guy who is claiming to be a woman. Here's the thing: He has a full luxurious mustache and beard. It's like this is a baiting performance-act joke. * Though I should say that in my own case, the Obama-appointed judge was extremely unwilling to protect my anonymity. But in general, if you're not a conservative in front of an Obama-appointed judge, courts are supposed to honor the tradition of anonymous speech as part of one's free speech rights. Is This a Theory That Works? 91 Social media makes money off of data collection of the user. Shadow banning would be fraud. They collect data and profits while denying you their service while claiming that they are. Posted by: literally seriousIf they're taking what they want from you (data, eyes for its sponsored posts) and not giving you what they've promised in return (publicly communicating with the world) -- that is either fraud or breach of contract or both. CDA isn't my area of expertise but I think there is a strong case to be made that Twitter is acting outside the scope of a platform and thus loses the protections of Section 230.
It's a reciprocal arrangement. If platform acts x y z then it gets protections 1 2 3. I think it was Sean Davis who posted today that Twitter admitted that it was doing something very nasty indeed. Twitter is now deleting tweets it deems as having "unsafe" content BUT leaving that tweet up for the user. In other words, you see it and have no idea it was deleted but no one else can see it. That's not the actions of a platform. Oh and his horrible action? Posting a portion of Congressional testimony. What ? Twitter empowered people to censor speech, and those people chose to interpret the "standards" in such a way as to push their own agenda ? GTFO !!!
Only the most objective, non-biased person would fail to succumb to the temptation of, sooner or later, controlling the direction of the conversation by controlling who may or may not participate using something as subjective as "standards". I can only assume Ace's take is correct ... they are deemed just a conduit, hence not accountable.
But even the phone company had rules ... they cannot disconnect people because a boss doesn't like the politics of a customer, can they? Their conduit function is one thing, their plugging the conduit of their political enemies is outside their conduit role. But maybe the exemption is broad ... and they were granted Total Diplomatic Immunity or some such, with zero conditions. Would our corrupt GOPe allow that intentionally, being the globalist stooges they are? I guess, yet it still seems plugging conduit does not fulfill their duty of just being conduit, and that is as deep as I get on such corporate law, or whatever it is. We had brunch downtown yesterday with a couple we became friends with in South Africa.
I had no idea of their politics whatsoever, as none of us on the safari discussed things like that at all. Yesterday the husband told us about one of our rangers who picked them up in Johannesburg at the airport, and was like, "How about that Donald Trump?" And they were kind of, "Uh-oh." And he proceeded to tell them he'd give anything to have Trump as president of S. Africa, and how everyone he knows loves PDT. Of course the obvious reply is, "Of course. South Africa." Anyhow, it was funny because during the St. Pat's parade here, there was a vendor selling "Trump 2020" flags, and people were walking around with them, including young people. And that gave me some hope. Posted by: Jane D'oh at March 18, 2019 07:16 PM (ptqGC) 50

SO: tell me again why it is offensive to point out that dude's biological sex?! My previous employer had been making money via online advertising. That stopped being profitable once THAT was looked at (there was a lot of fraud). I cannot believe - well, of course I can believe - that there has been no successful attempt, or maybe even a serious effort, to make ALL of it "opt-in", as opposed to "opt-out". Facebook, and Twitter both 'Edit' content by banning some content, but not other content that clearly is the same as the banned content, but on a different political side. YouTube will demonetize some, while promoting others, based on their political leanings. This is clearly partisan, and once you start editing, you SHOULD be liable for libel and defamation lawsuits. yes, of course it is fraud ... I've argued that for a long time. They said we share all our stuff, they agree to be fair. Then they completely destroy one side and prop up or even fund "social terrorism" for the other.
(social terrorist ... seems like a good definition of what the social justice warriors really are. A mob at Tucker's house, chasing Sarah Huckabee out, anitfa attacks ... none of that is social justice, it is social terrorism. Washington (AFP) - Half of Americans believe President Donald Trump is the victim of a political "witch hunt," nearly two years after the launch of the Russia meddling investigation, a new poll showed Monday. Voters are also broadly opposed, 62 percent to 28 percent, to an impeachment effort against the president in the House of Representatives, the USA Today/Suffolk University poll showed. The suit is a means. It's a tool. Twitter is going to take the very defense you mentioned above...but...Ooops...there are so many examples of the contrary that shows them controlling content and, indirectly the contributors to the forum. Each and every one will be showcased on public record.
I don't think Nunes has any intention of collecting. He's just going to take a sledge hammer to Twitter. Bonus: Wait until he files a complaint with the FEC indicating that certain democrats received the equivalent to "in kind" contributions directly from Twitter (via their selective application of their user policy). The same applies to Google (who admitted in emails to have tried to get Clinton elected)...who, also, provided in-kind contributions to the Clinton campaign. Non-reported. No sir, this isn't a lark. This is step one in taking down the whole she-bang. Posted by: Orson at March 18, 2019 08:20 PM (uWerq) 235
