Lin Wood Files $250 Million Lawsuit Against the Washington Post for Defaming Innocent Child Nick Sandman

Fifty million here and fifty million there and suddenly Jeff Bezos has to economize on his Penis Filter photoshop suite.



This is just the suit against the Washington Post. He has fifty three other defendants he's looking to sue.

INTRODUCTION

1.ThePost is a major American daily newspaper...

Is it?

... published in Washington, D.C. which is credited with inventing the term "McCarthyism" in an editorial cartoon published in 1950...

2.In a span of three (3) days in January of this year commencing on January 19, the Post engaged in a modern-day form of McCarthyism by competing with CNN and NBC, among others, to claim leadership of a mainstream and social media mob of bullies which attacked, vilified, and threatened Nicholas Sandmann ("Nicholas"), an innocent secondary school child.

3.The Post wrongfully targeted and bullied Nicholas because he was the white, Catholic student wearing a red "Make America Great Again" souvenir cap on a school field trip to the January 18 March for Life in Washington, D.C.when he was unexpectedly and suddenly confronted by Nathan Phillips ("Phillips"), a known Native American activist, who beat a drum and sang loudly within inches of his face ("the January 18 incident").

4.Nicholas stood quietly and respectfully for several minutes after being targeted and bullied by Phillips and Nicholas’body language remained non-aggressive and passive throughout the incident.

7.In targeting and bullying Nicholas by falsely accusing him of instigating the January 18 incident, the Post conveyed that Nicholas engaged in acts of racism by "swarming" Phillips, "blocking" his exit away from the students,and otherwise engaging in racist misconduct.

8.The Post ignored basic journalist standards because it wanted to advance its well-known and easily documented, biased agenda against President Donald J. Trump("the President") by impugning individuals perceived to be supporters of the President.

9.As a 16-year old secondary school student, Nicholas' political beliefs are anything but established and entrenched in his young mind.

10.Nicholas has zero history of political activism or aggressiveness and did not exhibit any such conduct even when confronted with unbridled racist attacks by activist bullies at the National Mall.

11.The Post's campaign to target Nicholas in furtherance of its political agenda was carried out by using its vast financial resources to enter the bully pulpit
by publishing a series of false and defamatory print and online articles which effectively provided a worldwide megaphone to Phillips and other anti-Trump individuals and entities to smear a young boy who was in its view an acceptable casualty in their war against the President.

12.Unlike the Post's abuse of the profession of journalism, Plaintiffs do not bring this lawsuit to use the judicial system to further a political agenda. This lawsuit is brought against the Post to seek legal redress for its negligent, reckless, and malicious attacks on Nicholas which caused permanent damage to his life and reputation.

13.The Post bullied an innocent child with an absolute disregard for the pain and destruction its attacks would cause to his life.

14.The Post proved itself to be aloud and aggressive bully with a bully pulpit.

15.In this country, our society is dedicated to the protection of children regardless of the color of their skin, their religious beliefs,or the cap they wear.

16.But the Post did not care about protecting Nicholas. To the contrary, the Post raced with a reckless disregard of the facts and truth because in this day and time there is a premium for being the first and loudest media bully.

17.The Post wanted to lead the charge against this child because he was a pawn in its political war against its political adversary –a war so disconnected and beyond the comprehension of Nicholas that it might as well have been science fiction.

18.The Post must be dealt with the same way every bully is dealt with and that is hold the bully fully accountable for its wrongdoing in a manner which effectively deters the bully from again bullying other children. In a civil lawsuit, punishment and deterrence is found in awarding money damages to the victim and target of the bully.

19.In order to fully compensate Nicholas for his damages and to punish, deter,and teach the Post a lesson it will never forget, this action seeks money damages in excess of Two Hundred and Fifty Million Dollars ($250,000,000.00) --the amount Jeff Bezos, the world's richest person, paid in cash for the Post when his company, Nash Holdings, purchased the newspaper in 2013.

107 A good start, but blasting each individual that libeled him would have a bigger impact. Hitting Bezos for $250 million is tough, but putting Maggie Haberman or someone else of her ilk in the poor house with a $10 million verdict would get people's attention.

They've got a good case, based only on publicly available information. Before they even sent out their retraction demands, they notified all of the defendants publicly (and no doubt privately as well) to preserve all evidence. Now, if they DO find that any of the Defendants destroyed evidence, that alone creates a presumption of conscious wrongdoing and guilt, which in this case goes to the alleged "malice" of the Defendants, and malice is what let's you get to the punitive damages.

Morons, I'm telling you, this is THE case. It's beautiful AND it's being handled by arguably the best defamation/libel Plaintiffs' attorneys in the Country, who is already ungodly rich from all of his previous Winning. Horst Weasel got into Harvard - but not Cal State Long Beach - because he was a leftist poster boy. Sandman is exactly the opposite. David Duke would have a better shot at getting into Harvard.

So instead of coming out of college and law school and making $300,000/ y (offered to someone I know right after Yale Law), he'd be making maybe $75,000. Integrated over his working life - say, 45 years - that's a cubic shitload of money he's lost.

THAT'S the basis of a whacking great judgment/ settlement.

So people appear to be just making up random fucking justifications for damages that the suit itself doesn't assert. That said, if those investigations turn up credible threats on Sandmann, I'd say it makes the suit worth more. They'd have to be very credible before I'd award anything like the damages sought though. People lose limbs and recover less; people lose loved ones and recover less.

I remember arguing that one YEARS ago, Leftists started that crap back in the 80's. You're right about the Supreme Court decision, but it was ALSO a policy decision by Jerry Brown's dad 2 years before Reagan took over as Governor that started to clear out all of the asylums. If you want to be very strict, based on the facts, the biggest criticism you can make of Reagan was that he didn't bother to reverse Pat Brown's policies when he took over. But you should also note that the AMA and the Psych association and everybody else put out official statements at the time saying it was the Absolute Right Thing to Do, and they supported it completely.

So "blaming" that issue on Reagan is idiotic. It's one of the few issues where the Democrats of the day supported him completely.

Yep! Our newly elected thumb of a governor wants to raise the gas tax 20 cents per gallon. We are the 4th highest taxed state in the nation. We have a 1.2 billion dollar surplus. And the dumb fucker wants to tax us even MORE. Part of me is glad. Let these same fucks crying about a minimum wage who voted for him fill their tanks with tears. We have plenty of money. Our roads suck balls because we put money from the road fund into choo choo trains and bike paths that get used 4 months out of the year. I loathe these fuckers. The only hope is that we are the only state with a two party house system (kind of like the fed govt) The senate is Rep controlled and they already said no way today. This whole "treatment in the community" horseshit started with three Cali politicos, at least one of whom was from the Santa Clara area. From there, it became a thing, and spread over the country, culminating in 1975 with O'Connor v. Donaldson, which IIRC was in Florida.

But Reds here in Cali were very big on the "treatment in the community" horseshit for years before that, and now they blame Reagan for it. I believe that California law may have been the impetus for the whole thing, as California was just experiencing the Great Locust Invasion at that time.

Nothing out of the ordinary here. Federal funds always have strings. Phony costs for phony projects have to be paid back.

CA will come up with some sort of BS change to the Purpose and Need statement and claim the dropped project actually served its intended purpose. Feds will probably let them do it, and even pay for all the time required to change the environmental document as needed to match the actual outcome of the overall fraud.

Two years a local school was almost shot up by a raving nutjob, who but for two Mexican gardeners tackling him would have done so.

His neighbors had reported him to the cops on a monthly basis, but they had no legal grounds to drop the net on him. The standard now I believe is you have to show someone poses an IMMINENT threat to himself or others, or cannot take care of himself. And there wasn't any IMMINENT threat until he showed at the school armed to the teeth and bringing a propane cylinder to blow up the school. Apparently that was "imminent" enough to do the job.

I misunderstood the policy. Sixteen states - including CA, naturally - tax pension income as ordinary income when the income is realized. I think that that's what IL is proposing to do.

Years ago, I was part of a group of moms that would meet once a week to pray for our children, their teachers and schools.

If any of you want to create a prayer group to pray for our children, I would pray with you.

We could just all pick a fixed time and wherever we are, we join each other in prayer.

Technical name is "diversity jurisdiction." 9th Circuit is a court of appeal and doesn't have original jurisdiction.

Trying to remember back to law school.... P sues defendant in State court (Kentucky) in a lawsuit involving more than $75,000 and the plaintiff (Kentucky) and defendant (a Delaware corporation) are from different states.

Defendant has the right, under Diversity of Citizenship principles, to remove the State claim to the Federal Court in the district in which the State claim was filed.

So, WaPo will want to get this case out of the local Kentuck state court jurisdiction, presumably because the plaintiffs picked that court because it's most favorable to the defendant. In Kentucky, if the case stays in State Court, plaintiff needs to convince 5 of 6 jurors by preponderance of evidence. If this moves to Federal Court, plaintiff has to convince 9 of 12 jurors.

I think the above is correct, but another attorney is free to correct me.

This is a client call, not the lawyers', although let's be honest, the clients listen to the lawyers advice. Some lawyers may consciously or unconsciously influence the client to settle because the attorney wants the quick $ without doing all the work required to get to a trial that could be lost and thus net $0.

But here, the attorney is already fabulously wealthy and doesn't NEED the money early or safely, so is unlikely to be the source of any pressure to settle early. Further, this is a great case to keep in the headlines for name recognition to the attorney and law firm. (Raise your hand if you had heard of Lin Woo before Covington.).

From the client's perspective, settle or not, Mr. Sandman is going to be one rich dude. Going to Court and winning earns complete public vindication. A very appealing outcome to this young man. Attorney is no doubt taking the case on contingency, so no out of pocket costs to the Sandman family. Lastly, the attorney knows what he's doing here. THIS is what he does, every day, for the last X years, uber-sucessfully. Lin Woo is not afraid of doing the work to get to trial. In fact, the dude clearly loves it, and excels at it. He's got a lovable client, that was horribly wronged, by multiple deep-pocket defendants, over one of the most important and pressing issues of our time -- the horrible, biased, dishonest, angry bullying media.

Me thinks all the stars have aligned here, folks.

784 628 -- Jewells -- Pretty much the same here. By noon tomorrow, we are supposed to pick up close to yet another 8" of Gorebull Warming. Then more Thursday night and even more Friday night. The only positive is that maybe my butterfly bushes will survive the winter this year because they have plenty of insulation against the warming/ freezing cycles. The wretched freezing but dry winters have been killing them off like flies, so I have to start new ones in the spring again.
