This is now less of a he-said, she-said and now a he-said, she-said, and he agreed with what she said.
Doesn't mean Justin Fairfax is guilty. But given that this former boyfriend is saying, if you read between the lines a bit, "No, she absolutely refuses oral sex because her father forced that on her," it does suggest that she would not have volunteered to commit the same act on a near-stranger. You really can't prove this kind of serious sexual assault just by testimony, but as far as stories go? This is a really strong one. You know why you're not allowed to ask about prior sexual experiences, in order to establish that if she said "yes" before she's more likely to have said "yes" now, in a rape trial? Such questions are ruled to be impermissible by the Rules of Evidence due to public policy considerations -- singing the reputation of a woman who says (and just might be) a rape victim -- but not because they're irrelevant. They are relevant. It's always noted that it would be relevant that a woman had never before consented to sex before, because that would suggest it would be less likely that she would consent on any particular occasion. And so while previous instances of granting consent would, then, logically suggest that a woman would be more likely to grant it later, they had a look a this question and decided yeah, but this sort of thing tells us so little -- it's barely relevant, in other words -- and the capacity to intimidate a complaining witness is so high, that for public policy reasons we won't let defense lawyers attempt to prove that a claimed victim of rape has had sex before. The slight probative value of such information is greatly outweighed by the public policy considerations of scaring rape victims from bringing forward complaints at all. The reason I bring this up is because this ex-boyfriend's claim -- that she never engaged in oral sex, she was horrified by it due to a past history of abusive incest -- is pretty much that paradigmatic example of why past sexual history actually could be relevant (indeed, very relevant) in a rape trial in which consent is at issue. Again, none of this means this story is true. And Justin Fairfax has not made any claims about what the sexual encounter consisted of; I imagine at this point he might just say "Yeah we didn't have oral sex." I'm just saying: in a trial, this would be very probative testimony, if you believed it. This is a tough call because this happened a long time ago and she did not make contemporaneous complaints about the alleged incident, either officially to the police or unofficially to friends. Fairfax finds himself in the position of having to defend himself against a charge where there is no physical evidence that can be collected to prove it one way or the other, and no contemporaneous witnesses to question. The only thing that it seems could be checked is his claim that she contacted soon after, showing continued romantic interest, versus her claim that she never contacted him again, but even those records are almost certainly now unavailable. It would be very unexpected if proof of either claim could be found. That's why there are statutes of limitations for almost all charges. It's not about letting criminals walk if they can evade the law for a long enough time; it's just recognizing that it is nigh-impossible to adjudicate claims about the remote past after all physical evidence has been lost, all documentary evidence has been lost, and all memories have faded and mutated. But, as I said: The claim that she never performed this act willingly, sworn to by a separate party, is strong evidence, if you believe the other party, and if you believe that this is the act being complained about. The key is "time." You need time to ride it out--for other stories to knock it off the front page-- and the longer he goes without resigning, the more people get used to the idea that wearing blackface 30 years ago did not cause the world to end.

She attended the same Democrat convention that Fairfax did. The alleged rape took place at a convention hotel room. She may not have been "in" politics, but she was certainly interested in politics; why else would she be there?
Her own statement has her "making out" on the bed with Fairfax, so she effectively walked him to second base.
I think it's entirely possible that this was transactional. It's also entirely possible that he did force her into a sex act that was reluctant to engage in.
My real point is that, one way or another, he handled it badly in his response to her accusations.

But this story/issue has now gone over the edge - you could say it's achieved critical mass, you could say it's achieved sentience, whatever - it is now growing itself and gaining power without anyone having to push it. Which is what makes moments like this so much fun, at least when they're happening to their enemies.
The dam broke when Tyson hired a dead on serious law firm, and put out a clear hard hitting account detailing the commission of a felony sexual assault. Once that happened, it was not just a story.
National democrats are realizing tonight that if they don't dump Fairfax quick, they could ruin themselves nationwide. They can't allow that to happen - I imagine if he doesn't move soon, the Boston Dem's will start up a criminal investigation of Tyson's claims just to make Fairfax get the point (whether she wants it or not)

The Democrats vs the Republicans. The GOP has a better pitching staff and hitting, so they tend to win any even and fair game.
So the Democrats have replaced the umpires with their fans and tend to win some more games than they used to because of close calls being always in their favor. And the GOP wants to play fair and be good sports, so they grumble, but put up with the bad calls.
But now the Democrats have decided, meh, now we get 4 strikes and its not an out unless we say so. They've just breaking the rules blatantly and running around the basepaths to where they want regardless of being tagged out. And the umps are calling them safe and throwing people who complain out of the game.
And people want the GOP to play by the rules? Its not a game any longer, its calvinball, and this will end only after a bench clearing brawl or if the GOP rubs the Dems face in broke rules until they call quits on it.

I am against bullshit accusation that don't even bear w whiff of truth or reality. I am against women who clearly gained from a sexual encounter and who were not physically forced to do anything going all #metoo. I am against any criminal law that doesn't require proof beyond a reasonable doubt (even if that means people who actually did what their accusers said they did going free).
I am not against women who were actually traumatized being able to come forward when they are able to... even if nothing happens but them being to lance the poison that they have held in. I don't think people should have to stay silent forever if they can't speak up right when they are violated.
That said, I do look with a very jaundiced eye at accusations that come out years later and I specifically look for any reason the accuser could be lying because years later accusations are less believable. I see no reason for this woman to lie and plenty of reasons why she would keep her mouth shut even if he did attack her.
