Lawyer for Covington Kids Warns Media: You Have 48 Hours to Retract and Correct Your Smears. Otherwise, Lawsuits Will Be Filed Starting Next Week.

I don't need to quote this one because I'm pretty sure you guys will follow the link to Nice Deb.

Important point for the Covington Kids' lawyers:

The media will claim they didn't know and had no reason to know their story was false.

This thread will be helpful in disproving that. Mike Cernovich says he's followed by many, many media types (who are always looking to attack him) and he fully documented the falsity of this story by Saturday afternoon -- before most media jumped on the bandwagon.

This should prove that they knew, or should have known, the story was false, but published a false smear targeting children anyway.

Tim Pool also proved that the story was false early, and his example can show how easy it was to prove the story was false: All you had to do was to watch the fucking video.

But the media didn't do that. They didn't do the most basic thing -- look at the video they were claiming proved that children were evil Nazis -- before smearing them.

That is gross, willful negligence.

Or, in terms the media's legal department might understand: that is malice.

And NBC is still smearing them. Even after Chief Refer Mech's story has been proven to be a lie.

Journalists have a legal responsibility to be accurate and verify their reporting. You see this often as reporters sometimes take days or even weeks to screen stories with their legal teams. There was no immediate need to know or other angle they can push. I hope their retainers are paid up.

This is the only real solution - in libel cases, American law is heavily stacked in favor of the defendant, and against the plaintiff. Libel under British law is much easier to maintain, one of the few areas where I think British Law is much superior to American law. It's not a bright line test but SCOTUS has held that punitive damages must bear some relationship to actual damages. Anything up to 10x the amount of actual damages will be considered acceptable and anything over that will be reviewed based on the facts of the case.

The best example of this is a case from Chicago where a hotel had bed bugs in some of the rooms. The health department told them to shut down those rooms for treatment. Well, there was a very busy weekend and the hotel opened up those rooms and a couple staying there got bit by the bed bugs and sued.

The compensatory damages were around $1,000. The jury awarded the $1,000 compensatory and then $172,000 in punitive (I'm doing this off memory so the numbers may be off a bit) and the hotel appealed (for some idiotic reason, my dudes, you put people in rooms you knew had bed bugs, you aren't going to win).

The appellate court said, hmm, let's see, what possible connection could there be for the 172x punitive award. Hmm. Could it be that there were 172 rooms in the hotel? Why, yes, yes, it could.

Seriously, I have no idea why that even went to trial, let alone was appealed. You were never going to win.


In the kids' case, the actual damages may be small but it would be trivial to put up the sheer arithmetic of retweets and add them all up and say $1,000 per retweet and negative comment in response. Well, trivial once you spend 300+ hours getting all the screen caps counted.

The President has the legal authority to FORCE the media to carry his speech in a time of National Emergency.

Declare a National Emergency due to the Border issues during the SOTU, and DARE the MSM not to cover it.

We lived with my Dad's folks for a while in the '50's and they had a refrigerator that was converted from an actual icebox!!!!!

Weirdest f**king thing. They had a real one too. Grandma used this thing for like a cooler cause the real one was down in the basement no room in the kitchen for it.

You do have to have some actual damages proven. Can be minimal, but it has to be proven to jury that there was actual damage. Here --Bomb threats, moving out of the house, close of business. So its going to be pretty easy.

I happened to be lurking on Reddit during the worst of this, and I saw someone with the handle u/glowingapplesauce trying to dox that kid by linking to a tweet by one encyclopediaproblematica. I thought it it would kind of nice if I could draw a little attention to that.

Now, I'm not even on twitter, just facebook. But facebook has had hashtags for awhile now, no one uses them, but I think they're kind of fun. Anyway, I've been making a lot of posts with #Whoisglowingapplesauce and #Whoisencyclopediaproblematica on them.
