There is literally nothing stopping President Trump from nominating a justice right now to the Supreme Court. He can do it even if there's not a vacancy, although congress generally frowns on it (ask FDR).

Clerks write all judges opinions. Every level. They judge sometimes tells the clerk how they want it to end up, but most of the time they clerk already knows what the judge wants and does it. The judge may change things in drafts, but the clerks pretty much talk to the judge's before they write. They do notes on the briefs that are filed by the parties and summarize them and research the authorities offered by the parties and anything missed. These summaries are then discussed with the judge. The judge with meet with the other justices and discuss and another meeting with clerks takes place after. In that discussion the clerk knows what the Judge wants and does it. The opinions are circulated, other judges jump on or write concurrences etc. THe final then the judge reads it, and maybe changes a few things. Throws in a few petty digs at the other side. Its very much a group process. Driven by the briefs, discussion and group research among the clerks of Judges who are aligned on the decision. There is literally nothing stopping President Trump
from nominating a justice right now to the Supreme Court. He can do it even if there's not a vacancy, although congress generally frowns on it (ask FDR). Doing so would definitely throw the left for a loop and speed things along, since it takes months to get the process completed. I'm going to be unpopular here, but overturning Roe v. Wade, while it should happen as judges are supposed to interpret the law and not make it, won't make much difference.
Well that was the point that Jordan Peterson made; overturning Roe v Wade doesn't make abortion go away. Murdering helpless innocent babies is an abomination but its a cultural problem, and law won't change that. Its just ghastly that the US government officially compels all states to legalize baby murder, and I want that stopped. Then states can decide at least. But I see Pence as made of stronger stuff than the average GOPe and with stronger convictions than Bush the Younger. I think Pence is extremely strong on social issues (like Bush was) and very strongly opposed to abortion, so he would not cave on that. He also would be much stronger than Trump opposing cultural rot like military trannys etc. But he's the kind of Republican that has no problem with big government or big spending, as long as its for the "right" causes. But in practical terms, it would remove it as an issue for the Left. Right now PP and the hard left have convinced the middle left, and especially the young (and stupid, and libertine) that supporting leftest candidates is vital to their view of the world. The left needs roe to stand as an issue. Overturning it will not change much for many states in the short term, but it will change a lot in politics. I want a list of what is actually shut down. If you went by the media you would think this whole thing is about national parks. If that is the case, we are doing this wrong. I say the national parks, particularly battlefields, monuments, historic places, should be much closer to the top of the "essential" list, not the bottom.
