Well McConnell & co dragged us over a line in a manner far more dramatic than it ought ever have been.

Lindsey Graham, lacking the influence of McCain for the first time in his Senate career, discovered he had a spine. I found Sen Collins's 45 minute speech tremendously underwhelming and, well, obvious, but others seemed to like it and I suppose if anyone is going to be the voice of common sense, we could have done worse than her.

The Republican senators got it done, finally.

I can't help but wonder if their willingness to coddle that lying wretch of a woman and her coterie of enablers for so long was a cynical ploy to drive up voter engagement this fall. Such is the level of my cynicism.

Whatever, we now have a clear majority on the SC, and as a bonus, McConnell is going to force Schumer & his cohorts to either stay in session during campaign season, or confirm a whole new raft of circuit & district judges.

We'll take this win, ugly as it was, and move on to the next battle.

Stay safe. Maintain vigilance. Things are just going to get more chippy in the next several weeks.

And that's it for today. And me-thinks I shut off the A/C and opened the windows too soon. I am sweltering inside. The temperature is not so bad now, 80F, but the humidity is stifling. Normally the temps here are in the low 80s or high 70s this time of year. We are still running in the 90s. The high here was 93.5F yesterday.

Actually, if you exclude the unnecessary semi-conciliatory remarks about Ford, Collins speech was calm, paced and laid out in plain but detailed language a logical and extremely persuasive case for Kavanaugh. She wasn't the Grahaminator by a long stretch but you could see she was angry about creepy porn shyster and all the other smears. Thank you.

That said, Maine needs to dump her if at all possible and put somebody in there at least nominally NOT bi-partisan and as conservative as possible for Maine.

And Murkowski can go to Hell.

He might have even peeled away a few GOP senators and sunk the nomination right then and there. IIRC, he did sort of back off of that but if the Dems had pressed home that attack, it could've been the end.

We could have a supermajority of Ted Cruz clones, they would not advance advance a bill to complelty remove government influence over the healthcare industry that being said, I never understood the reason why health care providers were locked into regions, states, localities, etc.

Healthcare providers should be able to sell any plan, to anyone, anywhere.

You will never be able to get rid of Obamacare in one fell swoop.

If they could just advance a bill that would providers to sell taylored plans anywhere to anyone that would go a long way to reducing the cost of healthcare and allowing more people to get healthcare in the long run.

Youngstown Ohio used to have a congresscritter named Jim Trafficant. He was a man of that area. Blue collar, tough, cared about his constituents. He was also corrupt as the day is long, probably in the pocket of the mob, but he had the most glorious speeches on the floor of congress. He was a Democrat. Died a few years back. They can have increasingly violent protests, and if a conservative shoots someone, the media and left will freak out, demanding more gun control. We won't jump immediately to a hot civil war, and the left thinks they'll manage significant gun control in any slowly escalating violence environment.

She did switch to running as in independent because she lost the R primary but she switched back to being a Republican soon after and won the Republican nomination in 2016. She is a Republican and switching to being a Democrat gains her nothing.

226 It took my wingman and I over three hours to get in the Kansas Expo Center last night. The line snaked over a mile. It was still out of sight when we got in as some of the last seated, in the nose-bleed area. 11,000 present, and very few empty seats. Over a thousand were standing on the floor.

Presidential security was pretty good, and responsible for the delay getting in.

A very energized crowd. Everyone was in a fantastic mood. I shouted out to the crowd in line when Kavanaugh was confirmed.

We all stood for the Pledge of Allegiance and all sang the National Anthem with a good black preacher / cantor.

Trump did little new, but he seems more at ease, and more polished also. I liked how he yielded time to two local politicians to speak, gubernatorial candidate Kris Kobach and a congressman, with shoutouts to other local and state politicians and SecState Pompeo.

Had fun chatting in line with good people from all over Kansas and Missouri. I was able to overcome my shyness somehow.

President Trump led the crowd, and got a lot of responses. He did make a math mistake on the building cost of the Jerusalem embassy.

But he talked about a thank you call from the NFL commissioner. It was about a NFL item he spent 2 minutes on during the negotiations with Canada. He said he was expecting a complaint about the standing, but evidently this was a decades-long desire by the NFL WRT Canada.

And he sure had fun with Da Nang Dick. You could tell he was enjoying saying that. But he mentioned Connecticut is a sad place now, even losing GE

The crowd seemed to energize him. In sharp contrast to pbho, he was not protected by glass or other barriers. But I expect that most of the crowd would take a bullet to save President Trump.

Big issue is forced overtime during December. Because of the huge increase in web commerce, UPS is overwhelmed, and someone has to deliver those packages. Nobody wants a late package at Christmas.
They overload the trucks and the drivers hit their daily maximum they can drive by law. 6 or 7 days a week without a break. It is a chronic problem. New hires don't qualify to be drivers, so they off load the other tasks the driver normally does. But that only goes so far. UPS has a lot of problems finding enough competent drivers to keep up with demand.
I drink with a bunch of them once in a while. Haven't in a few months and wasn't aware of the specific labor issue, but it doesn't surprise me.

Departing from intellectual arguments is precisely what got us where we are. And returning to them is exactly what the good justices are doing.

You have to have a reason to say a law is unconstitutional. That is precisely what judicial conservatism means. Just "I understand tath X is unconstituional" is an Earl Warren position.

Roberts's decision sidestepped the question. Yes, it was too cutesie by half. But it did not expand the "constitutional" powers of the feds. He is not a reliable judge, I agree. But it's miles less rotten that Kennedy's horseshit.

Results-oriented law is their game. And this is not just a "we're above that" argument. It is the very core of the conservative view of law.

The same day as the Obamacare oral arguments, Obama held a press conference, and he was visibly angry. I bet that Kagan gave him a call and told him he was going to lose 5-4.
The conservative court wrote an opinion that was written to be a majority opinion, not a dissent. Its 100% clear from the style of the writing. The dissent WAS the majority opinion, but somewhere along the line, Roberts lost his nerve, changed his mind, or what have you, and latched onto an argument that had not been fully briefed and seriously considered before the court (the tax argument) and made it the basis for his opinion upholding the bulk of Obamacare.
Maybe Obama, or his administration got to Roberts. Maybe Roberts just lost his nerve. But that was supposed to be a 5-4 case the other way, and something happened in between.

Moved out is more like it. When the Greenland colonies were re-discovered all of the good household items had been removed and the doors were left open. The climate did get too cold and the place was abandoned.

Sad/funny tale of his 4th voyage - he made it to Honduras, I think, but it was a disaster and he lost a lot of his men and ended up shipwrecked on the coast of what is now Cuba. By this time there was a functioning Spanish colony on Jamaica, I think, and Columbus found a way to get word to them to send a relief ship to pick him and his crew up. The Jamaican Governor got the message and said "Ha! Let that asshole rot!!!" and ignored his request completely. Most of his men starved to death, I think.

In so doing he violated Article 1, and then rewrote the bill again in King v, Burwell, by reinterpreting the text on state exchanges to allow Federal payments (instead of State) as the Obama administration wanted but Congress never intended.

Even the most charitable view would say if the Senate created the tax, they violated Art. 1 section 7 (Origination Clause), which reauires all general taxes to originate in the House.

That is the best argument for your position. However, the question of the origination clause is one that, unfortunately, has been ducked. I doubt anyone but Thomas would really address it. That is the basis from which all argument has to spring. You must always argue from initial assumptions, assumptions which, unfortunately, are shared by almost all the justices, even the ones we like.

(And there are, in fact, conservative arguments for that. If a practice has been completely assimilated into our system, it will do more harm than good to try to rip it out. That's what the Frenchies did, and look at them. Not necessarily correct - I don't buy it in this case - but not liberal.)

And given that, I repeat: he fiddled with the law, not with the constitution, per se. There is a difference between Kennedy-bad and Roberts-bad, and the latter is the lesser of two weevils.
