Report: Rod Rosenstein Threatened to Subpeona Emails and Phone Records of Congressional Lawmakers and Staffers Seeking Information About the Origins of the Russia Probe

I'm sure Bill Kristol and his Democrat allies and backers will be up in arms about this "norm-breaking" exercise of anti-democratic, anti-transparency tyrannical executive power.

Oh wait -- no they won't.

Catherine Herridge reports:


Deputy Attorney General Rod Rosenstein threatened to "subpoena" emails, phone records and other documents from lawmakers and staff on a Republican-led House committee during a tense meeting earlier this year, according to emails reviewed by Fox News documenting the encounter and reflecting what aides described as a "personal attack."

The emails memorialized a January 2018 closed-door meeting involving senior FBI and Justice Department officials as well as members of the House Intelligence Committee. The account claimed Rosenstein threatened to turn the tables on the committee's inquiries regarding the Russia probe.

"The DAG [Deputy Attorney General Rosenstein] criticized the Committee for sending our requests in writing and was further critical of the Committee’s request to have DOJ/FBI do the same when responding," the committee's then-senior counsel for counterterrorism Kash Patel wrote to the House Office of General Counsel. "Going so far as to say that if the Committee likes being litigators, then 'we [DOJ] too [are] litigators, and we will subpoena your records and your emails,' referring to HPSCI [House Permanent Select Committee on Intelligence] and Congress overall."

A second House committee staffer at the meeting backed up Patel's account, writing: "Let me just add that watching the Deputy Attorney General launch a sustained personal attack against a congressional staffer in retaliation for vigorous oversight was astonishing and disheartening. ... Also, having the nation’s #1 (for these matters) law enforcement officer threaten to 'subpoena your calls and emails' was downright chilling."

Threatening Congressmen with subpoenas to stop them from conducting their lawful, constitutional oversight function sounds like obstruction of justice to me.

And it's grounds for firing.

I think this is a big one. As a businessman (*the* businessman), Trump was probably used to one thing: loyalty. The top chiefs in a company are usually loyal to the boss, or they move on somewhere else. Very rarely do they try to usurp.

It is not so with politics. The top chiefs are often usurpers in government. I think Trump wasn't prepared for that, coming from a place with rules. He seems to have picked up on it quickly, though, and terminated those who needed terminating - thus his record-breaking firing rate at the beginning while he was figuring it out. I do think he was caught flat-footed by disloyalty in politics, but figured it out.

347 Just a reminder that regardless of what the media says Congress does not have a right to every bit of evidence the DOJ might have uncovered.

Exceptions to the rule include any information that is being used in a criminal case or has been presented to a grand jury. There is now proof of what has been pretty obvious for some time now, there is a grand jury empaneled in this case hearing evidence.

Don't know if that's the case here but if you read the article, I know that's a big ask, the Congressional staffer admits deep in the article that Rosenstein was likely reacting to Congressional threats to subpoena him and if so this really is noting more than dueling shots across the bow.

Trump can fire anyone in the Executive branch he wants at any time. He can also declassify any information he wants at any time. He hasn't done either in this case and the story is 6 months old.

IG report will be out on Thursday afternoon. Expect to see more bullshit stories between now and then trying to get people distracted.

Levin was talking about something a while back. The whole Deep State needs to be cleaned out and all their shenanigans exposed. That includes the Spooks as well as the FBI.

POTUS is head of the Executive Branch. Period. All executive power is vested in that office. He can go up their asses with a microscope if he wants to.

488 Article II is very clear on whether the Executive or Judiciary can harass Congress about their lawmaking: they "...shall not be questioned in any other place". If he were to simply interview them about the conduct of their legislative duties, he would be in violation of at minimum the plain text of the constitution. Let alone a subpoena.

I don't know what kind of spaghetti the Supreme Court has twisted this clause into, though. This is very, very clearly and directly related to their legislative duties. At minimum,
it would be clearly and explicitly unconstitutional for him to subpoena those records.

Rosenstein needs to be removed (Sessions at least--and easily---demote him for his remarks)from his position for a number of reasons but this threat would be high on the list for reasons for demotion/ removal
