Literally "Unbelievable:" Congressmen Rip FBI's Excuses for "Losing" Strzok Texts; Say This Is Bigger Than Lois Lerner

Unbelievable. Literally.

No one should believe this, because it's an obvious lie.

The revelation that the FBI "failed to preserve" five months worth of anti-Trump agents’ text messages is evoking memories of Lois Lerner, the IRS official whose emails mysteriously disappeared during congressional investigations into her targeting of conservative non-profit groups.

"The [Lois] Lerner thing was huge," Ohio Rep. Jim Jordan told The Daily Caller. "My gut tells me this is probably bigger."

Isn't it funny how misbehaving, weaponized parts of the bureaucracy keep "losing" evidence of their crimes when called to account?

Jordan, who serves on the House Judiciary and House Oversight Committees, sees parallels to the Lerner investigation...

After months of investigation, IRS officials claimed that thousands of Lerner emails from before April 2011 had been lost due to a crash of her email system. The snafu occurred in June 2011, just days after the House Ways and Means Committee requested IRS documents, including emails from Lerner’s division.

During this period when Strzok's/Page's texts were "lost" (deliberately), December 2016 to May 2017, many important things happened in the RUSSIA investigation, which the texts could have shed light on:

Conversations between Trump national security adviser Michael Flynn and Russian ambassador Sergey Kislyak.

The completion and publication of the intelligence community assessment of Russian interference in the 2016 election.

The briefing in which FBI director James Comey told President-elect Donald Trump about the Trump dossier.

This is a huge one, as many suspect, for very good reason, that this briefing was not a briefing of the president but of the press -- the press had passed on reporting on the Pee-Pee Party dossier, so Clapper and Comey decided to "brief the president" about it, for the express purpose of then immediately leaking news of the "briefing" to the press, for the express purpose of making the otherwise-unreportable dossier now reportable.

After all, the dossier had been "briefed" to the president. Doesn't that now make it something that the public should know about (via an illegal leak)?

Other things that happened during the period of the "lost" email:

The president's inauguration.

The nomination and confirmation of new Justice Department leadership.

Flynn's interview with the FBI (conducted by Strzok).

Comey's assurances to Trump that he, Trump, was not under investigation.

A variety of revelations, mostly in the Washington Post and New York Times, about various Trump figures under investigation.

Attorney General Jeff Sessions' recusal from the Russia probe.

Would there have been texts discussing this? Maybe speaking about it in a way that suggested this was a set-up for the exact purpose of getting the more-pliable Ron Rosenstein in charge of making decisions about a special prosecutor?

The firing of top Obama Justice Department holdover Sally Yates.

Trump's tweet alleging he was wiretapped.

Trump's firing of Comey.

And, finally, on May 17, 2017 — the final day of the missing texts — the appointment of Trump-Russia special prosecutor Robert Mueller.

"Strzok and Page had a lot to talk about," Byron York dryly comments.

BTW, York also notes a real hmmmdinger of a new text which the FBI didn't "lose" but is now disclosing. It involves Strzok and Page saying that now that Trump would be the nominee (after Cruz dropped out), the "pressure" to conclude the investigation into Hillary's emails was now even more urgent.

John Sexton also writes about this.

Below, "MYE" refers to "Mid-Year Examination," which is the euphemism the FBI used to refer to the Clinton email investigation.

Ms. Page: And holy s**t Cruz just dropped out of the race. It's going to be a Clinton Trump race. Unbelievable.

Mr. Strzok: What?!?!??

Ms. Page: You heard it right my friend.

Mr. Strzok: I saw trump [sic] won, figured it would be a bit.

Mr. Strzok: Now the pressure really starts to finish MYE….

Ms. Page: It sure does. We need to talk about follow up call tomorrow. We still never have.

And they weren't talking about pressure to bring charges against her, of course. They meant it was now imperative to clear her so she could beat Trump.

The "loss" of key information which would otherwise be turned over to defendants in the dragnet could very well lead to a motion to dismiss charges against Manafort and other members of Trump's team.

Months of text messages don’t just accidentally disappear. One past conversation between Strzok and Page indicated that former Attorney General Loretta Lynch knew there would be no charges filed against Clinton well before that investigation ended. Given the significant evidence of impropriety in the Clinton case, a foregone conclusion of innocence before the FBI wrapped up their investigation looks shady at best. Trump’s lawyers will surely argue that after those messages came to light, the DOJ intentionally "lost" those five months; worth of other messages.

Look for Paul Manafort to jump all over this. He’s already fighting his indictment, claiming that Mueller is overstepping his authority and shouldn’t be running the investigation. Throw in this evidence that the investigation may have been tainted before Mueller even took over, and that the DOJ could be covering up damaging information, and a motion to dismiss alleging prosecutorial misconduct is a near certainty.

Steven Green has a cynical interpretation of this literally unbelievable "loss" of key information -- you're not even intended to believe it.

You're supposed to take it as a warning by the FBI that they can break whatever law they like and perjure themselves to courts and Congress and you can't do a damn thing about it, so you'd damn well better fall in line.

One more thing: A source connected to the House Intelligence Committee says the FBI must now affirmatively prove that the "loss" of these emails is not deliberate wrongdoing.

The source was described by Fox News as a member of the congressional committee investigating the FBI's handling of the Clinton email investigation.

"The FBI must show now that the missing texts are not obstruction of congressional oversight or destruction of evidence," the source reportedly stated

The FBI claims this is a "misconfiguration problem" which affected some Samsung 5 phones.

But per Chuck Ross, the FBI is now refusing to answer the question: How many such phones suffered this "misconfiguration problem"?

Because if the number turns out to be somewhere between 2 and 20, and most of those phones just happen to be those used by Mueller's team and the various partisans whose names we've come to know so well, we've got some serious, hire-a-criminal-attorney problems, lads.

No delete = Proof of impropriety, loss of livelihood and PRESTIGE (e.g., cocktail party invites, twitter followers, invites to write onto Forbes, Medium, HuffPo, Newsweek, et cetera).
Delete = Suggestion of impropriety, worst outcome is circumstantial judgment of impropriety, no worse and can be spun to make bald accusations of political bias and OMGDRUMPF.

Yeah, we already received that warning from Obama's corrupt and weaponized IRS. They'll break whatever laws they damn well please, they'll blatantly destroy whatever evidence of their crimes they damn well please, and congress will roll over on its belly. Lois Lerner got to retire with her pension intact and her testimony hidden from public view, and not one single damn IRS agent or supervisor ever suffered any repercussions for destroying reams of evidence. The taxpayers even get stuck paying for these criminals' legal bills.

Yeah, we already received that warning from Obama's corrupt and
weaponized IRS. They'll break whatever laws they damn well please,
they'll blatantly destroy whatever evidence of their crimes they damn
well please, and congress will roll over on its belly. Lois Lerner got
to retire with her pension intact and her testimony hidden from public
view, and not one single damn IRS agent or supervisor ever suffered any
repercussions for destroying reams of evidence. The taxpayers even get
stuck paying for these criminals' legal bills.

As much as I want to support Law Enforcement, the DC follies and various other egregious and dangerous razzberries given to taxpayers by local law enforcement has me honestly worried.

121 To look at this seriously, this is Trump's true challenge, one that I believe he will be up to.

The question is - how to BEST use these revelations to root out the evil which is nested inside our government, while at the same time achieving our overall goals?

Jumping out emotionally without thinking through the response very carefully is likely to ruin a lot of possibilities. This thing is SO big that there is a LOT of leverage here. What happens to a few individuals who are corrupt is very small potatoes, although of course they need to be cashiered.

But this is now a golden opportunity to reshape and wound the Deep State that I never thought would arise. It has to be done very carefully and cautiously. But I think this may be where Trump will excel most.

122 Astonishing. Truly the Democratic party is the biggest, most effective organized crime operation in American history. What if Hillary Clinton had won? We'd know about none of this, and the Democrats would be cementing their control of the country's internal security apparat. That is, if it isn't already wholly owned property, owned by the Left.

Just as some describe the United States as a propositional nation, that is, one can be an American by accepting the premises which make up the Declaration and the Constitution*, Democrats have become a propostional ethnic group; Enemy-Americans.

*Of course, one can easily spot the flaw in that silly idea. What if someone lies about accepting the premise? Ties of loyalty and trust have to be made of something stronger than just saying what someone wants you to say, and then you get a vote.

To put a positive spin on a very frustrating and tragic situation in this regard, I am consoled that not only did Trump's win prevent Hillary from completely destroying the nation - which I thought that everything after that would be gravy - but that he is doing things that are tantamount to an ocean of gravy, both in tangible political terms but also social and cultural ones as well which will have a salutary effect going forward.

If there's a case to be made for allowing the continued existence of

3) Any part of the executive that qualifies as deep state

I can't think of it.

This really all falls on the Executive Branch.

I guess with Mueller pretending to investigate something bullshit, the Deep State has figured they can paralyze all of this because ANY action disciplining these agencies will be perceived as Trump "obstructing" justice.

The Founders, when they designed our system, made sure that there were competing centers of Power...

Congress, vs the Administration, vs the Courts...AND, Army, vs Marines...

So you would always have some check and balance in case one of the other entities got out of control.

We used to have competing Federal Police as well... Marshall service, FBI, Secret Service, ATF...

and competing Spy groups... CIA, FBI, Def Intelligence folks...

But now? After 9/11, they are no longer competing, but under same
bosses... the National Security Advisor... and Attorney General...

Who do you send to investigate the FBI? Who spies on the NSA?

The Constitution is not yet a dead letter, but it is looking more and more to be useless for dealing with a committed movement of the Left which seeks to pull it down. If this is true, it leads to an unpleasant thought; what else must be added to the mix, apart from traditional Constitutional mechanisms, in order to destroy the Left?

248 The one thing that we is average citizens can do is jury nullification every jury trial in any case the FBI brings against an American citizen. I could care less if they haul Hannibal Lecter in to court on a cart chewing on a human ear, if the FBI is one bringing the case their credibility is lower than dogshit and Dr. Lecter is released just in time for dinner.

I want men with guns showing up at these people's homes to take them away and at this point I don't care whether those men are carrying badges or not.

Nope. That's not how this works.

Please - raise your hand if you believe Obama took an FBI full of straight-as-an-arrow folks and turned them into willing tools of the State more than happy to put the screws into John Q Public in eight years ?

Because to do that, Barry would be the biggest criminal mastermind since Blofeld. Spoiler Alert ... Barry was neither that smart or energetic.

The FBI was sending out HRT teams to assassinate people under Clinton. They were raring to go to do domestic surveillance of you and me under Bush.

I have higher hopes than the Lerner situation because a) there are a lot of FBI people who actually do give a shit about their reputation, and will bust ass to see it restored and b) Lerner happened back with Obama was in charge of Justice, which explains...a lot.

If the Obama administration had been perp walked for the blatant illegalities they performed, then the REST of the Government would be afraid of not following the Law.

If there is no anger... then nothing will ever get fixed.

Anger is a POSITIVE force in the World IMO... it motivates us to fight Evil... it makes us right the wrongs...

Its part of the Human condition... to deny it and not use it, denies us a part of ourselves...

There are things we SHOULD get angry about.

324 There needs to be action to stop all this hiding/lost/wiped with a cloth/crashed harddrive bullshit soon because people are legitimately angry. It does not take a huge percentage of the population to get violent and have revolution. The Fed better get a hand on this shit now.

340 Lot's to digest, but before I read the content, I think Trump could readily get a mandate to fire hundreds of people in the Justice Department and prosecute dozens at the top echelons on incompetence alone. Not that what we are witnessing is incompetence because we aren't. This is criminal activity in perhaps immeasurable quantities. But if the defense of those who have partaken in this partisan assault on the state is repeated cases of "the whoopsies", then they should be summarily fired for gross negligence, incompetence, and stupidity.

360 This isn't that hard. Federal Law requires backups of backups of backups of backups of backups of the shit. You identify and subpoena the people that are responsible for safeguarding it. You tell them to bring it to court by a certain date. If they show up and say we don't have it, the judge politely tells them that all of their narrow asses are going to sit in jail cells until they produce it.

If they then give some bullshit excuse about how their dog pissed on the server or there was some incredible coincidence that every hard drive in the building crashed, then the judge politely tells them that it looks like their jail stay will be a long one.

You would be surprised what the actual threat of sitting in a jail so does to one's Focus. This is a deliberate dick in the eye to Congress, the executive branch, the judiciary, the constitution, the rule of law, and the American people from a subsidiary agency at the direction of the President telling Christ and everyone to go fuck themselves because they're above the law. These motherfuckers need dragged out of their offices in the Beltway by their nose hairs nose hairs and brought before the hangman. Either the legitimate Avenues of consequence handle business, or the illegitimate Avenues of consequence are going to have to step up. The choice is theirs.

377 The FBI claims this is a "misconfiguration problem" which affected some Samsung 5 phones.

After what just happened in the Bundy trial, and now this, every single solitary criminal defense attorney worth s/h/it's salt is drafting a motion to dismiss all charges on the basis that the FBI has confirmed that it does not have in place effective backup protection on possible Brady evidence and since the FBI has lost this evidence then the charges must be dismissed.

I mean, how do we know this is confined to the S5? Hmm?

And Green is right, this is absolutely an explicit so what are you going to do about it. And the answer will be nothing. I mean, the FBI lab misconduct investigation is now on year 20 or so.

No, I'm not kidding about that.

Posted by: Jane D'oh at January 22, 2018 06:12 PM (ptqGC)

407 I deal with stories from Tenants from time to time, and I know I have the same attitude that a lot of cops have with traffic tickets. When things have gone south, I kind of expect some kind of story, but I can't help but give a bit of credit to someone who at least tries to come up with a really good story to make it go down easier. That's what I would do, after all.

And nothing pisses me off more than someone who has so little respect for me that they don't even try to come up with a decent explanation. As the saying goes, adding insult to injury. That's REALLY unforgivable.
