McConnell Mans Up and Ends "Blue Slip" Vetoes of Judiciary Nominees

A deeply stupid system has been in place for a long, long time. When a judge is nominated, the Senator from his state can put a "blue slip" on the nomination, which is a potentially indefinite hold. One Senator can block a qualified judge forever just because of the happenstance that he got elected in the state the judge lives in.

Mitch McConnell is putting an end to this practice, and will no longer treat the blue slip as an absolute hold on a nominee, but as a "strictly advisory" recommendation -- McConnell told Fred Barnes that going forward, a blue slip will just be taken as a simple "notification of how you’re going to vote, not as an opportunity to blackball.”

Almost exactly a month after Senate Majority Leader Mitch McConnell warned that he would not allow Democrats to use the blue-slip process as a stealth filibuster, McConnell has ordered the Judiciary Committee to treat them as strictly advisory. That will free up two Trump nominees for the appellate court, including current Minnesota Supreme Court Justice David Stras.

Barnes also reports that McConnell will prioritize getting judges confirmed, putting them ahead of lesser executive appointments as far as the voting schedule.

In a development that actually underlines the lawlessness and usurpation that have been the judicial orders on the travel ban, since the outset, SCOTUS dismissed the case due to mootness.
As noted by some wild-eyed commenters, waaaay back when the initial orders were issued, the unlawful interference in clearly legitimate executive actions could only be rectified by repudiation of the judiciary, or immediate action to vacate the idiotic "rulings".

The theory I have heard is that the media is split between the Bernie Supporters/Hard Left and the Clinton/Obama Types/Left. This is a strike by the Bernie Supporting media at one of the stalwarts of the Clinton/Obama Left.

They need to just have a voto-rama. 100 federal vacancies on judges and they continue to play games. Trump should just nominate the 100 and then senate give them direct votes in a week long process. Get it over and done with, it will be a story for about 2 weeks until the next hot take comes along.

Alex, it's not really a constitutional matter - I mean internal rules for the Congress. They make their own. That, I think, is the constitutional design.

Recall that the ultimate controlling authority in all this was always supposed to be the electorate - they are regularly given the chance to evict incumbents, over any issue they please.

As most of the electorate, for a long time, has been mostly passive and sheep-like, we have an unresponsive political branch. The revolt that is Trump needs to continue and extend to the legislature, if it's to have legs and lasting impact.

Like many, many traditions and procedures now being junked, the blue slip was not a particular problem, until it was abused. The intent was never for a one-senator veto on nominations. And it wasn't often used that way, until now. Thus, the blowback (elimination of the blue slip as a "hard" hold on a nominee).

And no, blue slips are not something requiring a change to the rules, I don't think.

And absolutely yes, they can "batch" and put through nominations. In fact it has long been a standard procedure. To batch a few (not 100); purpose was efficiency, dealing with one subject a time.

And there's a parallel in how things *used* to be done, back when politics existed, and 80% of the time and votes in Congress were specifically used to put incumbents on the spot, to aid in differentiation, to provide fodder for their challengers in the next cycle.

The DOD Authorization used to routinely attract up to 300 proposed amendments. Senate leadership would run 10AM to 1AM days, including Saturdays (sometimes Sundays), to "burn" the amendments off. Half ended up being dropped, or changed and incorporated by voice vote. So there were still dozens of votes on remaining amendments.

Again - most of them specifically done in order to boost an incumbent's political stock, or put it in peril in the next election.

Politics. Choices. Things that have been, effectively, mostly eliminated. "Omnibus continuing resolutions" have many attractions to the political class (interested only in remaining in power) - they effectively negate the presidential veto, and they almost entirely shield incumbents from choices, and accountability. Combined with a mostly partisan-gerrymandered House map, and yuuuuge barriers to entry (financial, party closed-shop situation), and you have ...... the last 10 years.

Mortimer, it's not really a waste of time - it's Trump's central challenge (getting the GOP to support his key agenda items).

And I *hope*, by now, the WH realizes there simply is no way to get things done with *this* GOP (esp., but not only, the Senate one).

I don't think Trump should be in the WH much over the next year. He should be tirelessly (he does THAT very well) haunting the states where 1) vulnerable Dem incumbents, and 2) useless GOP incumbents, are up for re-election. Hammering away on the central agenda items that got him elected, making each Senate (and select House) race a referendum on those key issues.

Apart from the national security aspect in 2004, Trump is the first president elected on actual, specific issues, in decades (as opposed to personality, or national "mood"). He should try to reshape the GOP best he can, around those issues. No practical alternative I can see.

We've had a string of frivolous, idiotic rulings by Federal judges (voter ID, travel ban, sanctuary cities, etc.), and that needs to stop.

We need to flood the courts with as many good judges (assuming there are enough available) as possible.

Is this enough to earn McConnell penance? Would a replacement do the same to reform the judiciary? I dunno.

I think the use of the service elevator is the biggest reveal lately.

I have heard or read that they don't have cameras in the 32d floor hallway (which may or may not be true) but they do in the elevators (this I think is definitely true, see Ray Rice video). If he used the service elevator, he was with someone, or he had a card that allowed him to use it, and that card usage has a record associated with it in the access system.

First or second day sheriff said that he had help - he had to have help to get in the service elevator. They are after an accomplice (witting or unwitting).

I have heard no cameras on 32d floor - I don't believe it, but that is what they are saying.

Also reported errors in the timing on the systems. Which I find completely plausible. But the systems will be consistently wrong. So they can correct for the error.

BUT - the timing differences should be consistent on the same system. Comments here are ALWAYS 6 minutes in the past. So if the phone system is out of whack, you make a call now, see what the timestamp is, and you adjust the record.

3. Competition. There's gotta be someone who isn't in it for the money, but wants the fame or maybe genuinely help people.

Anyway, my assumption-- and this is based on basically nothing-- is that there's a sort of Rosetta Stone for cancer. Once there's a certain breakthrough, or short series of breakthroughs, a bunch of cancers will be a lot easier to manage.

Cascade effect, basically-- cure (or mostly-cure) one, and maybe you're close to an understanding that unlocks some others.

Or maybe it'll be a long, hard slog, with like nine hundred different things that each mostly-cures a different cancer for some percentage of those afflicted of that one particular cancer type.

Just for arguments sake:

How much is big pharma making today off of smallpox? Or rabies? Or polio?

Conversely, what do those numbers look like compared to "cancer treatment profits?"

People have multiple rounds of cancer. Expensive treatments can last years.

I suppose they could come out with a $10 million dollar cancer vaccine. Then they would make some money out of curing it.

That all being said, I suspect there's not an easy one size fits all cure for cancer.

But... like with the Vegas shooter, we'll never know.

The absurd, unconstitutional "O-care" law has, as one of its distinctive characteristics, unusually sweeping discretionary authority for the secretary of HHS (hilariously, NOT including certain waivers that were granted to Dem constituencies early on, to avoid pain there!).

But it's October 11, and only NOW do we see movement toward (partially) meaningful action by the administration. Sadly Trump has literally never seemed to understand the O-care problem, which is especially baffling as he is focused on removing artificial, govt.-centric anchors around the neck of the economy. And O-care is one of the largest, newest, andby far the most vulnerable (it's tiny, it'sshrinking, it's never been popular, and it's literally collapsing).

The administrationhas, unwisely, continued the illegal subsidy payments thatkeep (a shrinking) O-care barely afloat. Yep, gonna engage in100% Monday morning qb'ing - since itisn't as many have been saying this since the beginning - but the administrationshould have, once it was clear the GOP would not deliver on repeal, "sharpened" the issue and grabbed everyone's attention by using discretion to gut as much of the law as possible, and not pay the subsidies.

Instead, wehave close to 20 million people languishing in a destroyed individual/small group market, and ridiculous battles over the completely separate issue of Medicaid. And to this day, Trump has not used O-care asone of the weapons he needs to wield to re-shape the GOP (and harvest as many vulnerable Dem seats as possible).
