Jeff Sessions Announces DACA Will be Rescinded In Six Months -- To Give Congress a Chance to Pass a Legal DACA

Video of his announcement here.

He calls DACA unconstitutional and states it was a deliberate violation of the Constitution to use made-up powers of the presidency to do what Congress had explicitly refused to do.

However, giving Congress six months to change the law indicates -- as Trump himself has indicated a lot of times -- that he is himself willing to sign a DACA bill into law, thus amnestying and legalizing child illegals.

I have several problems with the latter. For one thing, legalizing the children also legalizes -- in practice, if not in law -- the adult illegals living in the country who have the children. The idea of deporting the adult parents while keeping the children in country seems so bizarre that not even the government would do it.

Another problem I've mentioned is this -- if you're going to offer a dovish proposal on child illegals, then at least make it part of a border security bill which funds the wall and defunds sanctuary cities. Don't just give it away for free -- the Democrats never do, after all. They always demand concessions for their priorities.

I predict that Congress will in fact not get around to any kind of border security bill, but will not have the stones to amnesty the child illegals permanently, so they'll pass a temporizing 2-year-limited-duration DACA bill, and then they'll simply renew that in perpetuity. But they'll sell it to the public on the phony idea that one day they'll actually do something permanent, and allow people to make up in their own minds what that permanent thing will be, whether a hawkish border security bill, or a dovish open borders bill.

BTW: An Obama lawyer who worked on DACA admits DACA would probably be struck down if Texas carried out its threat to challenge it in court -- that is, he admits it's probably unconstitutional.

I'd like to see it connected to a system that removes any legal family connection to the parents on American soil and simultaneously charge the parents with child abandonment.

I personally know a Filipina that entered the US on a fiancé visa. The first nite here, her fiancé got her virginity. The next morning he showed her the door. (fucking bastard)

She overstayed her visa and found a real man to marry. Had a child with the husband. She and her child were deported for a period of 6-8 years.

Let's start with defining terms, shall we? Define children. Define brought here as children. Because as people keep pointing out, DACA was applicable to people who are currently 36. Those aren't children.

Also I keep seeing how these are kids who grew up here and have never been to their home countries and they are totally and fully assimilated. Really? Really? Because, you see, given my personal and professional experience with people who would fall into that group, that is not my lived experience at all. Not in the slightest. Oh, sure, the kids may speak English but their parents? Nope. And assimilated? Not unless you mean into a parallel Hispanic culture. As far as not ever having been back to their country of origin? That sounds like not my problem.

I would like to know just how it is that these Dreamy kids who have student loans and mortgages managed to get those without being in the country legally. Did they have a SSN? If so, how was that obtained? How, exactly, did you get a job and pay your taxes and go to college and get a mortgage without ever once being here legally? That's not rhetorical, I want to know.

Also, I am fine with ICE showing up at elementary schools today and picking up entire families and deporting them. No, I don't think it's cruel and I don't think it's heartless. Frankly, I think the people (yes, including the people here) who throw that out there as some kind of terrible action are engaging in the most trite and boring kind of emotional blackmail.

Then again, I just got yelled at for fifth time today by a person on the phone who said why you no have someone who speak Spanish so my sympathy meter is at -10,000.

And you will have to pay back public assistance obtained during the period you were illegal, since you had no right to US taxpayer funds.

I'm not kidding that we get anywhere from 5-10 calls a day from people whose first question is does anyone there speak Spanish. In at least one or two of those calls the question itself will be asked in Spanish.

When I say no, there's no one here who speaks Spanish, 85% of the time I get a very hostile response of why you have no one who speak Spanish in very hostile tones. Because how dare we not have a Spanish speaker on staff! The other 15% I get an apologetic I'm sorry about my English and in almost each and everyone of those cases the person speaks English just fine. Maybe not perfectly but more than well enough to be understood.

It's the attitude of how dare you not speak Spanish that sets my teeth on edge. If I went to a Spanish speaking country to live and I was dealing with businesses there, I would presume it was my responsibility to learn Spanish, not theirs to provide an English speaking person.

Ok, so let's look up the DACA requirements on the DACA page I linked to a couple of threads ago. It has changed in the past hour, reflecting the gov. announcement this morning , but still retains the requirements to be shielded from deportation.

You have to be under the age of 31 as of June of 2012. You must have come to this country before reaching your 16th birthday. You cannot have left this country up until the current date, you must be either enrolled in school, college or are enlisted in the US armed forces and Coast Guard, or have been honorably discharged from said forces, and you either graduated from HS or have earned a GED.

Additionally, you cannot have been convicted of a felony or serious misdemeanor, nor can you have been convicted of three other misdemeanors.
On top of that, you need to present a large cache of documentation of proof of all the above.


My point on this is that people keep making it sound like all the DACA signups are gang banger MS13 threats when they are not. They are still illegals, who were never deported and were actually welcomed and educated in the US school systems, and those who have served in the US military. Because our gov. and particularly Congress has simply refused to make a stand on immigration for years.

I am for lawful immigration. But I am also not a big fan of screwing over a bunch of people to whom the gov has not just turned a blind eye, but has purposefully enticed and encouraged to be here via a totally ignored immigration system.

Let Congress choke on how to fix this.

We may not get the whole pie, but there's no reason we can't improve the situation.

Yes, I know were are talking about Congress here, but why would granting these people immunity from deportation mean they have to be given citizenship? There are many permanent residents of the US who never become citizens.

Let them have green cards that can flow to permanent residency if they abide by those rules and then prohibit them from applying for citizenship for a period of ten or twenty years or however long they were here before whatever new law is enacted.

I honestly don't know. To qualify for DACA status, your "kid" either has to have graduated from HS, college, be currently enrolled, or be in the US armed forces or honorably discharged. ALL of the above require a SS # for enrollement.
Colleges for years now have not only said they won't discriminate due to immigration status, but many states have allowed illegals to pay the same as legal residents.

They simply ignore that requirement. I assume they just make up an ID number, as does the military.

This is why I am saying that the entire US gov is at fault that these people are here .

No, it does not. A Canadian in my unit served several years and he applied for US citizenship and was denied. He was pretty bitter about it. Maybe things have changed since then but I doubt it.

No. I might, if Congress passes a law, begrudgingly admit that if you served the US in the armed forces you can, as a "dreamer, apply for citizenship and get preferential treatment (as long as you leave the US and apply from your home country, then you will not have to wait ten years etc. you can apply immediately) - but absent that - I see no reason to allow anyone who managed to come her illegally as a kid and get into a liberal educational institution a "path to citizenship" - no f-ing way. Did that illegal take a spot in the university away form a US citizen? You btet they did. My daughter just applied and got accepted to a bunch of universities - but not all. Did she miss one or two because some "dreamer" got accepted before her - probably. This not only disgusts me - it infuriates me to no end - to a fury that burns with the heat of a million sons. Oh and is it unfair that they would now have to leave, after getting an education to which they were not entitled to in the first place? Umm . . . no . . it is not. You got a freebie Mr./Miss illegal alien. . . I expect you to say "thank you" when you leave to go back to use that education in your own country (Mexico) and get a higher paying job then your fellow Mexicans - not complain . . . you ungrateful f*ck.

It is like that story the other day of the "nurse" who was being deported after 15 years after "doing nothing wrong" except being an illegal. Well, then you read into it and you find out she lied about her status to get her nursing education and job and then got promoted to better position in front of US citizens who were also qualified ( who understandably reported her). The article was written as "oh how horrible for her" and I am reading it saying . . .what? She gets a free education and job experience, takes good skilled positions away from US citizens (who are literally begging for the same position), is now a nurse and now has to use use it to go back to Mexico and . . . well, get a job as a nurse. That's the down side? This is what is so horrible? F*ck these people . No path to citizenship ever except : leave and apply like everyone else. Period. We know that six month window hits right at the start of the 2018 primary season. By forcing this issue, it forces all GOPe in Congress to take a position, most of which will be in favor of illegals because let's be honest, they're a-holes. Every single one of them in both the House and Senate are on record for/against, and Trump can then step out during the primary season and ask for reinforcements from "the people."

If enough people are able to primary the GOPe and turn them out and then get elected in November, he would have a huge number of reinforcements for the next two years while he campaigns for re-election. It also terrifies the GOPe even more. So which emotion do they follow though, is the question. Fear or hate? They hate Trump but fear him and us too.

We live in interesting times.

What cave? Seriously, I don't understand why people don't go read the actual EO order, or go look at the DACA website which also clearly outlines that NO MORE SIGNUPs are being taken for DACA as of today.

The DOJ and Immigration has said they will not seek deportation requests for current DACA holders for six months. Current deportation cases DACA or non-DACA are moving forward.

You all do realize that if someone is caught here illegally, they have an entire system of legal procedure to go through to be deported? It doesn't happen in a day. An immigration court has to order the person deported and the time frame for deportation after they and their lawyers have presented their side of the case in court.

Imagine how long it would take for several hundred thousand DACA signees to make their way through the immigration courts...

I know many of you expected DACA to be declared null and void and for ICE to immediately begin searching addresses on the data base for DACA to find and arrest everyone on it, including pulling the ones out of their Army units, etc throwing them in holding cells, but that doesn't even happen to run of the mill Jose's caught working in a garage in Texas. They get a date to be in immigration court and get a lawyer to represent them.

Those are our laws and sometimes they work to prevent someone who follows the law, but the law screws up , from being wrongly deported.
