So Dumb: Nanny Bloomberg Spends Millions on Compulsory Nevada Gun-Check Initiative, But the Initiative is Unenforceable Due to Poor Draftsmanship

If they're so superior, why the fuck are they so stupid?

The problem was that the initiative directed the FBI to conduct gun background checks -- and a state initiative cannot boss a federal agency into how it spends its money or how it performs its duties.

Like good little liberals everywhere, Nevada’s anti-gun Democrats expected someone else (in this case, the federal government in the form of the FBI) to foot the bill for their edict.

The feds have rejected it outright.

Nevada Attorney General Adam Paul Laxalt has noted it is entirely unenforceable (PDF).

Mike Bloomberg is out the $20 million or so he spent pushing this faulty referendum into being.

4 Read the article, but the problem is that all it would take a second law to pay for the FBI's time. Bloomberg's group will have to wait a while, but they are persistent until the law funding the FBI's extra workload passes.

Hillary would have spent the money and resources on this in a heartbeat. The FBI knows that Obama is done, so they don't care what he says anymore.

The thing that makes this so devastating is that law enforcement now has basically NO WAY to separate the underage prostitutes from their pimps/abusers. Taking them into custody via an arrest gets them into the system, where there are agencies that can get them out of the life.

Of course, in reality the system is pretty fucked up, but at least there is some small semblance of protection for the minor involved. Which is totally non-existent on the street.

A better way to handle it would seem to be to give juvenile court judges more leeway to dismiss those charges AFTER the minor is taken into custody and removed from the dangerous situation.

No they passed a law decriminalizing Child Prostitution. Plain and simple. The effects of that will not be good.

It will make catching the predators near impossible, the organizations trading in children harder to catch, it sends a message to children that it is ok, and opens up the flood gates for both at risk children and pedophiles to seek refuge from across the country.

California has one of the worst track records in the USA of protecting children. After this law passed it is the worst in North America.

What about the young people who might want to do this without a pimp.? If there are no consequences to their actions outside of "counseling" there will be those who decide that this is quick and easy way to make the Benjamins. And since oral sex isn't sex, well that makes it even easier.

I realize the majority of teens in the sex industry are victims. But not all.

This could also make it much easier for those who want access to underage boys and girls, since there is no longer the threat of "punishment" involved on the part of the prostitute.

It will make catching the predators near impossible, the organizations trading in children harder to catch, it sends a message to children that it is ok, and opens up the flood gates for both at risk children and pedophiles to seek refuge from across the country.

Yes, they have decided that since minors can't consent to sex, they can't consent to prostitution. So, they are not offenders, they are victims.

Why a minor should not be responsible if they engage in prostitution, but they are responsible if they steal, murder, rape, etc, is a mystery to me. But, that is the logic of "a child can't consent to sex".

You failed to address how this law will be exploited t turn California into a safe haven for child sex trafficking, and sex tourism for pedophiles. Or how it sends the message to children that sex for money or Sex with adults is ok and legal so they refuse to seek help or report it, this making it all that more difficult for children being abused and exploited to come forward.

Although on extremely rare occasions some young person will hook on their own by their own volition, its almost always that they are forced into it by someone else, basically a slave. Which is the difference; nobody is out there Fabian-style forcing kids to shoplift, murder, rape, etc. But there are plenty of people forcing kids to hook.

Statutory rape is still a crime. All the state's law enforcement tools are available to it for investigating and enforcing those laws.

And though there are many legitimate criticisms regarding this law, I could give a shit about "messaging". Minors who are engaged in prostitution didn't get there because of any message the state did or did not send with its laws. I would like to meet the minor who is willing to prostitute him or herself based on messages they received from this law. There ain't no such people.

That number is undoubtedly higher, since police departments voluntarily submit arrest data and about 20 percent of departments choose not to report.

An exclusive Fusion analysis of FBI data found that California arrested the most child sex trafficking victims of any state in 2013, making 205 arrests. The city with the highest number of child arrests for "prostitution" that year was Las Vegas with 98 arrests. One child under 10 years old was arrested in Minneapolis in 2013, according to FBI data.

207 What bothers me about the California law is that when the children are arrested for prostitution, it is simply a way to get to the adults who are exploiting them. I am very familiar with the system (having worked with offenders) and the arrest of the minor is often times a method to get the people (usually a family member) who was exploiting them. It is also a way of getting them away from the person abusing them. I read this law and I am very concerned about the wording regarding law enforcement's ability to detain them. 72 hours sounds like a lot but it is not and when you add that to the paperwork involved in juveniles and mental health (which is what this falls under now) many are not going to bother. That means that victims are going to fall through the cracks easier. I don't think this protects the child; I think it puts them at greater risk.
