Sefton: sefton at cutjibnewsletter.com | Special Correspondent Jay Guevara On The California Ballot PropositionsJay Guevara, our intrepid reporter on the ground in the People's Republic of California, has slogged through the miasma of this year's California Ballot Propositions. In addition to his recommendations (I agree with them), he has given us a bit of analysis and...shockingly...some snark! Here is the first one....there are a couple of more plus a full list below the fold and a link to the rest in pdf form for those California Morons who need a little prodding to go to the polls and vote....early and often please.Prop. 51 - Authorizes $9 billion in general obligation bonds for new construction and modernization of K–12 public school facilities; The Guevara Take: No Wait, didn’t we already do exactly this last time? And the money went to giving teachers raises? Yeah, we did. So they’re just seeing exactly how stupid we really are. “It’s for the children.” Right. Even Jerry Brown opposes this stinker. From SF Gate: “Critics including Brown say the money can be siphoned off by large districts fielding flocks of consultants who are adept at pitching construction projects.” Uh, yeah. If any of it goes to construction at all, that is. Prop. 53 - Requires statewide voter approval before any revenue bonds can be issued or sold by the state for certain projects if the bond amount exceeds $2 billion. The Guevara Take: Hell Yes May knock high speed rail on the head. It is opposed by the firefighters’ and police unions, which by itself would be good enough for me to support it. According to SF Gate, which opposes Prop. 53, the measure is being bankrolled by a Stockton farmer who “takes dead aim at two targets: the struggling high-speed rail line connecting the Bay Area and Los Angeles, and Gov. Jerry Brown’s twin-tunnel water diversion plan for the delta.” I’m liking this guy already. Let the salmon take the HIGH. SPEED. RAIL. upstream. Prop. 61 - Prohibits state from buying any prescription drug from a drug manufacturer at price over lowest price paid for the drug by United States Department of Veterans Affairs. Exempts managed care programs funded through Medi-Cal. The Guevara Take: No How about we just let the market sort this out, hmm? Presumably the state already gets the best deal it can on drug purchases. After citing two cases of egregious price hikes, SF Gate in its endorsement goes all-in on populist demogoguery: "Neither the Republican-controlled Congress in Washington nor the Democratic-controlled Legislature in Sacramento has proved willing to stand up to an industry that is determined to bat down any proposal that might threaten its fat profits." Also, for my money, the state shouldn't be in the health care business in the first place. And why is Medi-Cal exempted?• 51 School Bonds. Funding for K-12 School and Community College Facilities • 52 Medi-Cal Hospital Fee Program. • 53 Revenue Bonds. Statewide Voter Approval. • 54 Legislature. Legislation and Proceedings. • 55 Tax Extension to Fund Education and Healthcare. • 56 Cigarette Tax to Fund Healthcare, Tobacco Use Prevention, Research, and Law Enforcement. • 57 Criminal Sentences. Parole. Juvenile Criminal Proceedings and Sentencing. • 58 English Proficiency. Multilingual Education. • 59 Corporations. Political Spending. Federal Constitutional Protections. • 60 Adult Films. Lots of ballot initiatives. Posted by: fluffy Fun Fact California has voted on over 200 initiatives in the last 20 two decades and averages 18 per election. There are two ways initiatives get on the ballot here. By petition from the voters, which is good -- will of the people and all, or by the state legislator placing them on the ballot, which bites the big one, because the ballot becomes the Democrats' wish list to Santa. No, the only thing that will satisfy *me*, personally, is for Comey to resign, explain why he resigned, then go slink off in to a corner somewhere (most likely a high paying no show job, like most former "public servants") for being such a pussy. The FBI is supposed to be an independent agency. They can recommend (or not recommend) indictments. IF the FBI recommends an indictment, it puts a whole lot of political pressure on the DOJ. Yes, Justice is under no obligation to pursue the case, but for the supposedly independent FBI to say "not recommending charges" is functionally the same as the FBI saying "not guilty of any crime". Because if there was even a slight case to be made, they would (theoretically) recommend indictment and let the DOJ make the call on if they could get a conviction or not. The only thing that surprises me about this is the timing. Hey said in July that he wasn't going to recommend charges on what he found and unless he found something specifically to the charges of intentional, since he seems to think this is the law for some reason, mishandling of confidential information then how could he charge her now for what Huma did? Doesn't mean that they haven't found some stuff related to the CGI investigation which if you remember is what the information in the leaked articles about what was found on the Weiner's PC were about. Posted by: Make America Great Again at November 06, 2016 08:05 PM (BS8yt) You know what, I got top round and .... uh ...chuck, I think, but never got around to making steak sandwiches. The times when I had a taste for them I didn't have any italian rolls around (and didn't feel like running out to get them). So the meat is still sitting in the freezer waiting for that day when everything I need is around and I have the patience to slice it all out. I've been rather sated with just hamburgers, steaks and other meat dishes in the meantime so the steak sandwiches just slipped my mind for a while. Like right now, I just finished off a pound and a half of great taco meat (too lazy to bother with the shells and stuff so I just threw the meat and tons of cheese in a bowl). Good stuff. I'd guess that fewer than 10% of voters actually do their research and simply vote yes on every single one. Here in Florida, we grant Constitutional rights to everything under the sun: baby pigs, bullet trains, classroom sizes. Yes. We actually amend the state constitution with this bullshit. This year is no exception and one of the initiatives has been charged with being so deliberately deceiving that there was an attempt to remove it from the ballot. The FL Supreme Court denied them the removal. So Comey cleared Clinton again of any wrongdoing. So much for the rumors of an internal mutiny.
I want a divorce!! Posted by: Sebastian Melmoth at November 06, 2016 07:44 PM (EZkQC) I have no idea why Drudge put that exact wording in the headlines. Clinton has not be "cleared' of anything. Comey, in fact, listed in his original statement, numerous illegal acts on her part and he answered in the affirmative when he was questioned on the hill as to whether Clinton had classified material on an unsecure server. Which is in direct contrast to what she said to Congress, but that is a separate matter. Rather, Comey had reiterated once again, that she will not be prosecuted on any of the investigations findings. Of course, the Democrats will be dancing around the Maypole tonight, telling every camera and microphone, that for a second time, under ENORMOUS partisian pressure from the Republicans, James Comey reviewed her record and found she had done nothing wrong. The most disingenous, lying commercials you will ever see/hear (hitting it hard on radio) are those for Prop 58. They make it sound like every English-speaking kid will be taught a second language. One of the child actors recites a line in French Yeah right, vote yes on Prop 58 and your kid will learn French. Sad thing is, my liberal neighbors are soooooo stooooopid that they actually believe this. No, your kid will sit in a classroom with 30 other kids speaking Chinese or Spanish and the teacher will cater to them... not your kid. Wake up dopes.

*** Nope. It's financed wholly by the utility companies and restricts the rights that homeowners already have to purchase and install solar. In a shocking development, both green orgs, Democrats, Libertarians, several Republican clubs, and a tea party org are all now coming out against it. In the end, it's so convoluted, I will be voting 'no', and it for three reasons: 1. No ballot initiative should be so convoluted that it requires hours of research to get to the heart of the matter 2. Floridians already have the right to purchase and use solar. 3. Posted by: Jen the original at November 06, 2016 08:20 PM (oDUj/) Which is also why Wikileaks is being called "fake" by Hillary and the Democrats. Never mind that the actual emails , with headers from the DNC, etc are in the leaks. The fact that all these emails keep being dumped, yet the huge law enforcement agencies in the Fed Gov. say it's no big deal, lends creedence to that claim. How many Hillary supporters or undecided democrats are actually going to Wikileaks and reading the emails, etc? Few. Most are getting their information from left wing 18 year olds and then posting it on Facebook. Or from ABC news. Just happened to catch Andrea Mitchell, with her serious face on, reporting that James Comey has found nothing in Hillary's emails that are on Weiner's laptop that is new. Then, they switched to the Trump being attacked story, in which she said that Trump was hustled off the stage by SS, after a young man was protesting in the crowd at his rally and.....the crowd attacked him. Someone yelled he has a gun. They interviewed this clown, who said he was being kicked and beaten by the Trump rally crowd. (he has no visible marks on him) So there you have it. I'll go out on a limb.
Midwest and NH = Northern England during Brexit. Cambridge Analytica from London (who are Trumps analysis guys) see it. The Brooklyn Hillary guys (and Google, and extension of their campaign) also see it. There may not be enough black enthusiasm to overcome the low propensity white vote for Trump. Not enough latinos in these states to overcome he difference, and the news from FL and NV that there is a surge in latino voting is likely to scare the crap out of the low income white vote and make them come out even more. That's why the campaign has shifted to the Midwest and NH for the final 48 hours. If the D thought they had it in the bag, they'd be trying more to flip the Senate at this point, which is razor close.. Why shift a lot of your volunteers from OH to PA at the last minute? An overabundance of caution, or genuine fear? Why is every D in Philly tomorrow? Who knows, it may not be enough. But its become very interesting. We didn't see this in 2012 at all. I see lots of people saying that they default to 'no' on voting for a proposition unless they read it.
Careful there. Some years back, Cincinnati, OH put forth a referendum to put term limits on council members: Simple yes or no vote. A slimy career council member then got another referendum on the ballot that was carefully wordsmithed to appear as a negative of the term limit, so that voting no on it would in effect, nullify the term limit referendum if it did pass. Fortunately, the local media did their jobs and spelled out what was being attempted, so the voters were wise to it. Term limits were put in place. Sadly, the POS that tried to nullify the will of the voters is still floating around local politics. Posted by: ghbucky at November 06, 2016 08:54 PM (D2q91) 289

My two cents on Comey. I believe the rank and file FBI are pretty straight shooters. I've had the occasion to work with a couple concerning hacking at the last company I worked at. Good people. Comey and other top ranking FBI are political appointees and are nominally under the control of the DOJ. Lynch is Obama's puppet much like Holder was. Think of the DOJ winning the case of voter intimidation by the Black Panthers, a case they had won and then dismissed. Lynch is just the female version of Holder.
We can all be outraged and dismayed by Comey not falling on his sword. He has to be under immense pressure from his rank and file on one side, and his political masters on the other. I can't personally think of very many who have fallen on their swords for principle. The CF investigation is still ongoing, but DoJ is doing all it can to quash it. Just like they have with Hitlery's e-mail server. It just proves that there are two different levels of justice anymore. One if you are rich, famous or politically powerful, and the other for all of us rubes. You are either of the Borg, or you are not. You will be assimilated. Resistance is futile. Locally, a bond referendum (for the children) casually mentions, deep in the proposal, that a tax increase may be required to pay of the bonds.
My emphasis. It is utter bullshit. There is absolutely no way to pay off the bond(s) without a property tax increase. The great irony? The bond is being hyped to pay for 'affordable housing'. Of course, there is not a single residence in the city which will not become less affordable on account of the tax increase. Something I wish Trump would bring up. I believe (not sure if it's this one) that the trade agreement with S Korea included a clause that the unions had put in that workers displaced by the agreement would get government sponsored job training to transition to new jobs. That means that the people who negotiated that agreement knew that Americans, and specifically union workers, would be losing their jobs to S Korea.

Jeebus, Comey is "really a straight shooter"? No, there are two options. He is so stupid he can't read a statute and has business in any responsible position. Or he lacks all integrity and seriousness and actually believes what he said about the obvious, unambiguous, systematic, deliberate, most likely damaging, and easily prosecutable violations of the Espionage Act.
Oh - we'll just leave aside the obvious, undeniable, systematic violation of the Public Records Act. Oh - and the multiple examples of obstruction of justice that are slam-dunk merely on *publicly avaialable information*. Oh - and the perjury before Congress (hey Chaffetz, you preposterous clow, where are the charges for that?). Are people now just jaded beyond reaction at what a farce - a farce - the US has become? Yes, Soothsayer, the largest state in the union has exactly one major party choice at the Senate level.
I haven't kept up on how many House seats, and how many state-level or local elections, now feature only one party (guess which one). Someone mentioned a GOP "dark zone" in LA County, something like 400,000 people who will not have any GOP candidates on their ballot - at all, I believe. Literally a one-party state for these voters. That's barely one House district, but I think there are several where there is no GOP/Dem option around the state. So sentient people, people who pass for kind of citizen - as opposed to 80% of the residents, are reduced to arguing about the relative merits of meaningless symbolic votes for/against the two absurd, alien, racist, authoritarian pieces of refuse for a given office (like US Senate). I recall that the ban on bilingual education, approved by proposition what, 20 years ago, was "implemented" grudgingly and with much bad-faith foot dragging and other defiance by the greedy cretins who pass for "educators" in this beautiful Third World monument to ignorance.
The idiotic bullet train bond terms were, of course, brazenly violated (not sure if the courts have actually pushed back on that, successfully, though some action was attempted). I don't think one can seriously argue there is any point to voting on anything beyond county/local small potatoes, which may still go either way and matter in select cases. The state legislature and the congressional districts are among the most partisan-gerrymandered in the country, so your votes in those races are highly unlikely to matter. Voted yes on 53,54,66 and no on everything else.
58 is the one to be the most careful about, imo. The text claims to preserve the English education requirement, but the intent is to actually gut it by setting up "dual-language" education (read 99% Spanish). Voters rejected this in a past election and English proficiency actually increased a substantial amount as a result. If this gets passed things will go right back downhill. I have a feeling that's the goal: to eventually convert CA into a dual-language state. 52 is tricky and unfortunately this analysis glosses over it a bit too easily. SEIU contributing against it initially (now neutral), but I don't think that's a good reason to automatically jump to the YES side. Most of the Dems (and the CA GOP) are on YES. The reason I voted NO is that it is using fees on hospitals to prop up Medi-Cal and hide the true cost of the program. I think SEIU was on the NO side because they were hoping to lobby for similar legislation that benefits themselves more after this expires. More importantly though, YES on this proposition basically makes this tax impossible to ever repeal (would require 2/3 of legislature). A permanent tax to fund Medi-Cal seems like a bad idea to me, even if some special interests like SEIU might see some temporary benefits because of it. As for 64, I know some conservatives support it under the auspices of "end prohibition so the gangs can't profit", but that argument just doesn't hold water to me. I think it's a net negative on society and gangs will always have other black market goods to turn to. I would rather see harsher enforcement on criminals instead of drug use becoming more normalized. Posted by: Sjg at November 06, 2016 09:45 PM (gDSJf) 438

Despite the FBI fuckery, it still comes down to one of 8 states Trump needs to flip based on current polling (which I pray is still skewed against Trump despite their backpedaling).
Based on 538, each of the 8 states has a one in four chance of giving Trump the win. It's kind of interesting they have almost all the same odds each. I think those comments were born entirely out of SEIU expecting to lobby themselves a sweetheart deal once the tax expires. The bigger problem is that this tax will never be repealed after this proposition. It's being used to keep Medi-Cal solvent so hospitals and politicians are all rallying behind it. An even bigger annoyance I have is that it is yet another "temporary" tax that is getting an indefinite extension. I'm very tired of this game that always gets played "this is only for a few years to get some extra money for X" and then it's turned permanent before it ever expires. The beast needs to be starved. Revenant, you think a substantial portion of Hillary voters have even a
basic familiarity with the facts and "so what" of the criminality she's engaged in? -- To be fair, its not just the classified e-mails and the server. Hillary has been involved in Washington for decades, and has been associated with corruption throughout that tenure. I don't think you really need to know the ins and outs of the statutory language to have a sense that its wrong (and almost certainly criminal) to, for example, give classified information to your maid. Perhaps there are some that really don't understand that there could be anything wrong with that. But I believe that part of the reason why Hillary enthusiasm is so low (even though she represents another shot at "making history") is because most of her supporters understand that she is a bad actor. They may give her grudging support, but that's all. Posted by: Revenant at November 06, 2016 10:11 PM (3DSAh) 494
That is what is frustrating. All of the historical trends coupled with real anger over things like Obamacare premiums should give Trump an easy win.
But then you have most of the polls, and media, and Nate Silver saying Hillary should win. Do you put faith in the LA Times poll? I did that in 2012 putting faith in Gallup and Rasmussen and looked like a fool. I have no idea what will happen on Tuesday, but it comes down to polling models not accounting for voter anger. That certainly fits the way this year feels, but it goes against what we are told is predictive (by a biased media). Posted by: Dave_in_fla at November 06, 2016 10:11 PM (gwJtK) 495

Revenant, all you say is true, I just don't find even a trace of even rationalization going on, just ignorance of the basic facts and esp. of their import.
Of course a large reason for that is the disappearance of any sort of press. I have no idea what will happen on Tuesday, but it comes down to polling models not accounting for voter anger.
***************************** They're not accounting for a shitload of things. Even though we got ass reamed in 2012, the polls were still off by 3-4 points (undersampling support for Obama) . I'm hoping this time they're off at least 4% in favor of Trump. We'll see. Posted by: #NeverHillary - #SchlongerTogether at November 06, 2016 10:16 PM (G8TO0) 504

Posted by: Dave_in_fla at November 06, 2016 10:11 PM (gwJtK) --In a way, its like 2012 again. In 2012 the polls all said that Obama would win comfortably. Many in the GOP thought that was impossible -- Obama could not generate the kind of turnout he did in 2008 after 4 miserable years. The "unskewers" were wrong. But their point still stands (at least to me): if the basic turnout assumptions used by the pollsters and modelers are wrong, those polls and models will give you information that vastly understates the margin for error. Now we're faced with the same thing again. If you follow most of the polls, Clinton probably wins easily. If you think the pollsters have modeled the electorate incorrectly, they can be missing the Trump "monster vote."For example, black turnout this year seems to be down by 10-20%, while white turnout is up. That's a big difference, and is certain to impact the models. That's why Trump probably has NC, and why he's begun campaigning in Virginia again. We won't know what will happen until Tuesday though. Only conceivable reason Comey did his congressional letter was to head off a mutiny. Obviously nothing, materially, has changed on the merits of the situation. The more we learn of the "investigation" (really, at this point the quote marks are merited), the more we see how completely farcical it was. Violated all sorts of standard procedures. Didn't even bother to examine vast swathes of obvious areas of interest. What of the "7 or 8 foreign or individual" penetrations of the Weiner laptop? Posted by: Revenant at November 06, 2016 10:20 PM (3DSAh) There is nothing in the Constitution or in our election laws that preclude anyone facing criminal charges from running for office. If Hillary were indicted tomorrow, she would still be eligible to run and if elected, could only be removed from office through impeachment. The idea for this latitude comes from not giving the judiciary or law enforcement power to block someone from office on drummed up charges. James Traficant of Ohio , D House Representative, was convicted of taking bribes, racketeering, filing false tax returns, and using campaign money for personal use. He was convicted on 10 felony counts. The House had to expel him via their process for that to remove him from office. He was expelled by a vote of 420-1. Who was the one vote? Gary Condit. Traficant ran for the House while he was incarcerated as an independent. His aid actually won the election for the seat , but Traficant received over 24,000 votes. He is one of a handful of people to run for office while incarcerated. Traficant died two years ago when his tractor he was driving on his farm rolled over on him and axphyixated him. For a more complete picture, Ballotpedia is the source on Amendment 1: http://bit.ly/2cpgA9b Posted by: Niedermeyer's Dead Horse at November 06, 2016 08:32 PM (SEXy3) Typically, state regulators require that electric utilities purchase excess electricity produced by residents (at lower than retail rates they charge you, of course). This is essentially the net metering thing. I'm not sure about whether utilities are also required to subsidize some or all of the nonsense that goes into making these special connections. It depends on the state. (You need electronics to determine power flow, along with safety crap to prevent backfeeds into the power grid - if your section of the grid is down, you don't want your solar panels to electrocute a maintenance worker.) My guess is that a good portion of this is typically subsidized by the utility. Having said all that, it looks like Amendment 1 puts the cost burden of making a safe connection to the power grid on the private property owner (by prohibiting everyone else from subsidizing it). This would indeed increase the cost to the individual desiring solar, and would tend to discourage households from installing solar. So, in a roundabout way, this would benefit the utilities by 1) reducing/eliminating their obligation to subsidize connection costs and 2) reducing the net amount of solar installed. And it is all in the name of individualism! Clever! That is why they support this amendment. Posted by: Deplorable Ian Galt at November 06, 2016 10:49 PM (8iiMU) 585

Bluebell,
Our plucky band was in great form. We were busy, but not swamped. So our cut of the gross was down. We are still on track for our March 2017 Constitution Bee. The reason the gross was down was the game was so close. Everyone was in their seats or on their feet cheering until the last second of the game. I had a smile on my face the whole game. Our team was humming, and my wingmen was fantastic. As I like to put it, we have a bunch of great people, and then there is me. At this stage of the year, we are a retail machine. Which is why you should vote for it. Why should the utility (meaning, of course, other utility customers) subsidize your grid-tie solar toy? Posted by: Alberta Oil Peon at November 06, 2016 11:04 PM (CUYn5) This for me is a gray area.I am almost always for individualism, self-reliance, less regulations, etc. However, there are legitimate areas where subsidies are okay, like basic infrastructure (water lines, sewer lines, electrical power, gas, etc.). Regulated utilities theoretically are guaranteed a certain amount of profit. In exchange, they are required to provide reliable power, and connect to anyone that wants electricity in their designated area, and must file 'rate cases' if they want to change their prices.I see this issue as a bit of a trade off. We would like more people to produce their own clean power, but we don't want to make it cost prohibitive, either.Looking long term, if enough customers produce some power, that may obviate the need for the utility to build a generating station (which is ultimately paid for by the end users). Does that cost savings outweigh the subsidy cost? I don't know.Issues like this give me cognitive dissonance. My first reaction is to vote yes - yay liberty! But then I see that this issue is also one where the utility is trying to limit competition, and escape some of their obligations. So, vote no - screw you, rent seeking utility! So, bottom line, I'm not sure. I think I'm leaning 'no', just because I am somewhat familiar with how the electrical biz works, and this sort of smacks as a bit of a sop to the utilities, reducing competition.
