Special Correspondent Jay Guevara On The California Ballot Propositions
Jay Guevara, our intrepid reporter on the ground in the People's Republic of California, has slogged through the miasma of this year's California Ballot Propositions. In addition to his recommendations (I agree with them), he has given us a bit of analysis and...shockingly...some snark!
Here is the first one....there are a couple of more plus a full list below the fold and a link to the rest in pdf form for those California Morons who need a little prodding to go to the polls and vote....early and often please.Prop. 51 - Authorizes $9 billion in general obligation bonds for new construction and modernization of K–12 public school facilities; The Guevara Take: No Wait, didn’t we already do exactly this last time? And the money went to giving teachers raises? Yeah, we did. So they’re just seeing exactly how stupid we really are. “It’s for the children.” Right. Even Jerry Brown opposes this stinker. From SF Gate: “Critics including Brown say the money can be siphoned off by large districts fielding flocks of consultants who are adept at pitching construction projects.” Uh, yeah. If any of it goes to construction at all, that is.
Prop. 53 - Requires statewide voter approval before any revenue bonds can be issued or sold by the state for certain projects if the bond amount exceeds $2 billion. The Guevara Take: Hell Yes May knock high speed rail on the head. It is opposed by the firefighters’ and police unions, which by itself would be good enough for me to support it. According to SF Gate, which opposes Prop. 53, the measure is being bankrolled by a Stockton farmer who “takes dead aim at two targets: the struggling high-speed rail line connecting the Bay Area and Los Angeles, and Gov. Jerry Brown’s twin-tunnel water diversion plan for the delta.” I’m liking this guy already. Let the salmon take the HIGH. SPEED. RAIL. upstream.
Prop. 61 - Prohibits state from buying any prescription drug from a drug manufacturer at price over lowest price paid for the drug by United States Department of Veterans Affairs. Exempts managed care programs funded through Medi-Cal. The Guevara Take: No How about we just let the market sort this out, hmm? Presumably the state already gets the best deal it can on drug purchases. After citing two cases of egregious price hikes, SF Gate in its endorsement goes all-in on populist demogoguery: "Neither the Republican-controlled Congress in Washington nor the Democratic-controlled Legislature in Sacramento has proved willing to stand up to an industry that is determined to bat down any proposal that might threaten its fat profits." Also, for my money, the state shouldn't be in the health care business in the first place. And why is Medi-Cal exempted?• 51 School Bonds. Funding for K-12 School and Community College Facilities
• 52 Medi-Cal Hospital Fee Program.
• 53 Revenue Bonds. Statewide Voter Approval.
• 54 Legislature. Legislation and Proceedings.
• 55 Tax Extension to Fund Education and Healthcare.
• 56 Cigarette Tax to Fund Healthcare, Tobacco Use Prevention, Research, and Law Enforcement.
• 57 Criminal Sentences. Parole. Juvenile Criminal Proceedings and Sentencing.

I mean, apparently it's now no big deal that supposedly State Department emails were on private citizen and serial sexter Carlos Danger's personal laptop. That doesn't raise enough red flags to warrant more than a cursory search.

California has voted on over 200 initiatives in the last 20 two decades and averages 18 per election.
There are two ways initiatives get on the ballot here. By petition from the voters, which is good -- will of the people and all, or by the state legislator placing them on the ballot, which bites the big one, because the ballot becomes the Democrats' wish list to Santa.

No, the only thing that will satisfy *me*, personally, is for Comey to resign, explain why he resigned, then go slink off in to a corner somewhere (most likely a high paying no show job, like most former "public servants") for being such a pussy.
The FBI is supposed to be an independent agency. They can recommend (or not recommend) indictments.
IF the FBI recommends an indictment, it puts a whole lot of political pressure on the DOJ. Yes, Justice is under no obligation to pursue the case, but for the supposedly independent FBI to say "not recommending charges" is functionally the same as the FBI saying "not guilty of any crime".
Because if there was even a slight case to be made, they would (theoretically) recommend indictment and let the DOJ make the call on if they could get a conviction or not.

The only thing that surprises me about this is the timing. Hey said in July that he wasn't going to recommend charges on what he found and unless he found something specifically to the charges of intentional, since he seems to think this is the law for some reason, mishandling of confidential information then how could he charge her now for what Huma did?

And I don't think this clears Huma at all. The letter specifically referenced Clinton and made no mention of Huma's not turning over the laptop when she left State as she swore under oath she did.

You know what, I got top round and .... uh ...chuck, I think, but never got around to making steak sandwiches. The times when I had a taste for them I didn't have any italian rolls around (and didn't feel like running out to get them). So the meat is still sitting in the freezer waiting for that day when everything I need is around and I have the patience to slice it all out.
I've been rather sated with just hamburgers, steaks and other meat dishes in the meantime so the steak sandwiches just slipped my mind for a while. Like right now, I just finished off a pound and a half of great taco meat (too lazy to bother with the shells and stuff so I just threw the meat and tons of cheese in a bowl). Good stuff.

No, they both are. Do you remember the sailor on the sub that was indicted for taking pictures of his sub on his cell phone? He is being charged for illegal possession of classified material. His superior officers aren't, he is.
Huma had a security clearance which is why she was allowed to view classified material in the first place. She is the one who put them on Wiener's laptop, and she is the one legally responsible for that.
He may not charge her, he may find some bizarre non-intent clause but that is not what he said today. He very specifically said "Secretary Clinton" in his letter.

I do not think anyone should have to subsidize solar power. I do think there is a cost to utility companies to maintain the grid.

Careful there. Some years back, Cincinnati, OH put forth a referendum to put term limits on council members: Simple yes or no vote.
A slimy career council member then got another referendum on the ballot that was carefully wordsmithed to appear as a negative of the term limit, so that voting no on it would in effect, nullify the term limit referendum if it did pass.
Fortunately, the local media did their jobs and spelled out what was being attempted, so the voters were wise to it. Term limits were put in place.
Sadly, the POS that tried to nullify the will of the voters is still floating around local politics.

We can all be outraged and dismayed by Comey not falling on his sword. He has to be under immense pressure from his rank and file on one side, and his political masters on the other. I can't personally think of very many who have fallen on their swords for principle.

I haven't kept up on how many House seats, and how many state-level or local elections, now feature only one party (guess which one).
Someone mentioned a GOP "dark zone" in LA County, something like 400,000 people who will not have any GOP candidates on their ballot - at all, I believe. Literally a one-party state for these voters. That's barely one House district, but I think there are several where there is no GOP/Dem option around the state.
So sentient people, people who pass for kind of citizen - as opposed to 80% of the residents, are reduced to arguing about the relative merits of meaningless symbolic votes for/against the two absurd, alien, racist, authoritarian pieces of refuse for a given office (like US Senate).

I don't think one can seriously argue there is any point to voting on anything beyond county/local small potatoes, which may still go either way and matter in select cases. The state legislature and the congressional districts are among the most partisan-gerrymandered in the country, so your votes in those races are highly unlikely to matter.
Even though I hide from this stuff as much as possible, it's to the point where the safe-seat Dem seat-warmers are as idle and corrupt as some of the worst Black Caucus vermin from the midwest and east coast. My own "representative" no-shows at her own events, cancels appearances and debates at the last minute, generally acts like the worthless Supreme Soviet deputy she is.

Voters rejected this in a past election and English proficiency actually increased a substantial amount as a result. If this gets passed things will go right back downhill. I have a feeling that's the goal: to eventually convert CA into a dual-language state.

I think SEIU was on the NO side because they were hoping to lobby for similar legislation that benefits themselves more after this expires. More importantly though, YES on this proposition basically makes this tax impossible to ever repeal (would require 2/3 of legislature). As for 64, I know some conservatives support it under the auspices of "end prohibition so the gangs can't profit", but that argument just doesn't hold water to me. I think it's a net negative on society and gangs will always have other black market goods to turn to. I would rather see harsher enforcement on criminals instead of drug use becoming more normalized.

I think those comments were born entirely out of SEIU expecting to lobby themselves a sweetheart deal once the tax expires.
The bigger problem is that this tax will never be repealed after this proposition. It's being used to keep Medi-Cal solvent so hospitals and politicians are all rallying behind it.
An even bigger annoyance I have is that it is yet another "temporary" tax that is getting an indefinite extension. I'm very tired of this game that always gets played "this is only for a few years to get some extra money for X" and then it's turned permanent before it ever expires. The beast needs to be starved.

To be fair, its not just the classified e-mails and the server. Hillary has been involved in Washington for decades, and has been associated with corruption throughout that tenure.
I don't think you really need to know the ins and outs of the statutory language to have a sense that its wrong (and almost certainly criminal) to, for example, give classified information to your maid.
Perhaps there are some that really don't understand that there could be anything wrong with that. But I believe that part of the reason why Hillary enthusiasm is so low (even though she represents another shot at "making history") is because most of her supporters understand that she is a bad actor. They may give her grudging support, but that's all.

Do you put faith in the LA Times poll? I did that in 2012 putting faith in Gallup and Rasmussen and looked like a fool.

I agree 100%. In a way, Hillary keeps being held to a lower and lower standard. Non-criminal mishandling of classified information should itself be disqualifying. The whole lying to the faces of the Benghazi families should be disqualifying.
But, now we have to seemingly argue that Hillary has to be actually facing a criminal felony indictment for her to be disqualified from office.
It's the media that has done this to us. That is the core of much of the GOP's problems.

It's tough because we know how angry we are - and we can't figure out how anybody can't be. But there are a shit ton of complacent and stupid voters out there, people who wouldn't care if Hillary killed a puppy on TV because they're getting free shit, or because vag, or because they have so internalized Dem= good and smart, GOP = racistm dumb haters that their whole self image would crash if they voted for Trump.
If Trump can pull in 15% -17% of the black vote (and if the black vote is down), if a significant number of Bernie voters vote Trump or 3rd party - Trump might win. The other WC is blue collar Dems who have not recently or never voted, because I don't think they're being represented in polls.

There is nothing in the Constitution or in our election laws that preclude anyone facing criminal charges from running for office. If Hillary were indicted tomorrow, she would still be eligible to run and if elected, could only be removed from office through impeachment.
The idea for this latitude comes from not giving the judiciary or law enforcement power to block someone from office on drummed up charges.
James Traficant of Ohio , D House Representative, was convicted of taking bribes, racketeering, filing false tax returns, and using campaign money for personal use. He was convicted on 10 felony counts.
The House had to expel him via their process for that to remove him from office. He was expelled by a vote of 420-1. Who was the one vote? Gary Condit.
Traficant ran for the House while he was incarcerated as an independent. His aid actually won the election for the seat , but Traficant received over 24,000 votes. He is one of a handful of people to run for office while incarcerated.
Traficant died two years ago when his tractor he was driving on his farm rolled over on him and axphyixated him.

Typically, state regulators require that electric utilities purchase excess electricity produced by residents (at lower than retail rates they charge you, of course). This is essentially the net metering thing. I'm not sure about whether utilities are also required to subsidize some or all of the nonsense that goes into making these special connections. It depends on the state. (You need electronics to determine power flow, along with safety crap to prevent backfeeds into the power grid - if your section of the grid is down, you don't want your solar panels to electrocute a maintenance worker.) My guess is that a good portion of this is typically subsidized by the utility.
Having said all that, it looks like Amendment 1 puts the cost burden of making a safe connection to the power grid on the private property owner (by prohibiting everyone else from subsidizing it). This would indeed increase the cost to the individual desiring solar, and would tend to discourage households from installing solar.
So, in a roundabout way, this would benefit the utilities by 1) reducing/eliminating their obligation to subsidize connection costs and 2) reducing the net amount of solar installed. And it is all in the name of individualism! Clever!That is why they support this amendment.

Our plucky band was in great form. We were busy, but not swamped. So our cut of the gross was down. We are still on track for our March 2017 Constitution Bee.
The reason the gross was down was the game was so close. Everyone was in their seats or on their feet cheering until the last second of the game.
I had a smile on my face the whole game. Our team was humming, and my wingmen was fantastic. As I like to put it, we have a bunch of great people, and then there is me.
At this stage of the year, we are a retail machine. At a football game, throughput is the second priority to getting the order right. I repeat back what drink they ordered twice to fill once. You do not feel the 10 hours on your feet until the end of clean-up and the walk to the shuttle bus.

This for me is a gray area.I am almost always for individualism, self-reliance, less regulations, etc. However, there are legitimate areas where subsidies are okay, like basic infrastructure (water lines, sewer lines, electrical power, gas, etc.).
Regulated utilities theoretically are guaranteed a certain amount of profit. In exchange, they are required to provide reliable power, and connect to anyone that wants electricity in their designated area, and must file 'rate cases' if they want to change their prices.I see this issue as a bit of a trade off. We would like more people to produce their own clean power, but we don't want to make it cost prohibitive, either.Looking long term, if enough customers produce some power, that may obviate the need for the utility to build a generating station (which is ultimately paid for by the end users). Does that cost savings outweigh the subsidy cost? I don't know.Issues like this give me cognitive dissonance. My first reaction is to vote yes - yay liberty! But then I see that this issue is also one where the utility is trying to limit competition, and escape some of their obligations. So, vote no - screw you, rent seeking utility!
So, bottom line, I'm not sure. I think I'm leaning 'no', just because I am somewhat familiar with how the electrical biz works, and this sort of smacks as a bit of a sop to the utilities, reducing competition.

Had a recent $20M project where the owners decided to drop $1M on PV Panels. FPL balked big time on conditions to allow them to connect to the grid...
FPL would not let them connect to the grid until switchgear was added that disconnected the facility if the grid went down and only FPL had an easement/access to reconnect them. In the interest of life safety of the linesmen it was agreed to. The additional gear was only about hundred thousand$ more.
I think the utilities are getting tired of their own o/h negotiating this for small players.
