Bill Cosby Will, Unlike Bill Clinton, Stand Trial For Sexual Assault

A judge has ruled that there is enough evidence that the case can go forward.

If convicted, he could be sentenced to ten years in prison.

I think it's very important to remember that these are only charges and nothing has been proven. Whether he is a serial rapist or not is a fact known only to him and all the women he raped.

So about two years ago Hannibal Burress was on the Howard Stern show talking about getting The Call. He was a fairly obscure comic.

He said, "You can google Bill Cosby Rape and you'll get more hits than if you google Hannibal Burress, and this guy is lecturing me?".

And everyone said, "wait, wut?", and the walls came tumbling down.

Like many states, PA has an exception in these kinds of cases to let in testimony about other similar cases, so it'll be several racially diverse testifying about how Cosby drugged them and then fiddled about. Some of these women were given drugs without any knowledge. Some of them are Black. So in effect, this will be an end-run around the shorter statute of limitations applicable in other states.

No matter how the jury gets picked I don't see Cosby getting a jury nullification like the one OJ Simpson got. Cosby didn't racially discriminate with his victims, and the jury won't either.

In the old days, we had a solution for that as well. Parents, schools, and communities.

Not getting into drugs was a fairly easy decision for me when I was 13. I knew that if I came home stoned, my parents would have a shit fit, it'd probably get the shit slapped out of me, and I definately would be deprived of the opportunity to do it again until I was at least 30, even if it meant my parents taking me to the police station and acting as witnesses against me to lock my ass up. I knew I'd get caught because my parents bothered to pay attention to where I was going, who I was with, and would check up on me on occasion. I knew that they and other parents and responsible people conspired to look after us. My parents knew that if they didn't take responsibility for me as a minor dependent, they would be considered complicit in whatever shit I got up to and might end up in prison for it.

Short story: all of this could be fixed by locking up some special snowflake parents, sticking their brats with the grandparents, and some old school, common sense punishments for kids.

Rapist or not, Bill Cosby had it right when he said, "I brought you into this world... and I will take you out!"

Even if they weren't that doesn't imply that he drugged them and had sex with them while passed out. It just means they left the place stoned and messed up. That's all the defense has to point out.

That's why cases like this usually don't get to trial: two people saying contradictory things is just a mess to try to convict. It's not about what you are sure of or know. Its about what you can prove in a court of law. And every lawyer and cop knows the worst kind of evidence is eyewitness testimony.

My opinion legally (not a lawyer, don't want to be one, and did not sleep at a Holiday Inn Express last night... but if I was a juror) is that rapes is an act of someone imposing power over an unwilling victim.

If Person A's agent says, "Hey would you like to get together with Person A for the evening?", Person B consents, Person A says, "Hey, how about coming back to my place where you can do some drugs and get naked?" Person B consents... Person B willingly takes drugs, gets naked, and passes out... I'm of the opinion that Person A is a scumbag but Person B doesn't get to call it rape because they consented to every action that any reasonable person would conclude may result in unethical and immoral things occurring.

Shorter version: if the result of your series of bad decisions and irresponsible behavior is sex and/ or other actions that you come to regret later... it is not someone else imposing power over you against your will and consent.

You still don't get it. You are ascribing motives to these women. They were guests at a party. They didn't give 'implied consent' to sex just by showing up.

If it's just not to your liking, then that is something else. I've had meals that while done properly, I just didn't like, and said so. Sometimes, but not very often, they were replaced at no charge, sometimes at a reduced price.

I think it depends on how badly the meal was butchered (so to speak), and how expensive it was. If I"m at a nice steakhouse and they give me a well-done filet when I explicitly requested medium rare, Yeah, I'll tell them to take it back and make it right. If I'm at Fridays and the chicken dinner is under-seasoned, I'll mention it, but not take a new item.

Exactly. Many years ago, I worked for a law firm and we were on a document production in Philly. One of the paralegals was seen by more than a few coworkers going into the hotel room of the attorney she worked - and it happened more than once. They were both married to other people.

Later on, she was indignant that rumors were flying around the firm that she was having an affair with the lawyer. Those visits were all about work, she insisted.

Maybe they were, maybe they weren't. (She had a tendency to dress in a slightly provocative manner - short skirts and low-cut blouses - nothing really outrageous but noticeable in a firm where most people dressed pretty conservatively and that just added fuel to the fire.) The thing is that it is unwise to put yourself in a situation where at, the very least speculation like that will happen and at the worst, where the attorney could have assumed she was game for a little sport f*ing, because she was in his hotel room at night.

People are conflating consensual with non-consensual.

He wasn't charged in 2005 because Constand could've faced charges for attempted extortion and illegal wiretaps. She wanted money from Cosby and she secretly recorded conversations between her and Cosby to get him to admit wrongdoing.

She sold her story to the National Enquirer, Cosby got wind of it, and to prevent them from exposing her, she sued them and Cosby. They all settled and were signatories to the settlement in 2006.

The other "Jane Does" weren't bound by the agreement, so they pumped the details of the case to their attorneys, including Gloria Allred. They tracked down women who dealt with Cosby and had them read press statements where they surmise they were slipped drugs, carefully avoiding directly making the accusation and instead saying something like "I believe I was drugged and raped".

This won't go to trial. The deposition won't be admissible and none of these women will be allowed to testify. The DA will have no choice but to drop the charges.
