Sefton: sefton at cutjibnewsletter.com | Overnight Open Thread 05/09/16 - [Niedermeyer's Dead Horse]Welcome to the potpourri version of the ONT where the guest-COB is too lazy to think of a theme for the night. I spent a couple of hours this afternoon watching The Weather Channel and a livestream, concurrently, of the wild weather in Oklahoma. Unfortunately, one elderly man lost his life and a number of homes and livestock were lost. Despite the sad stories that inevitably arise from such storms, I can't imagine how many lives have been saved since the invention of Doppler radar. The number must be significant. Today's storms come on the heels of some major tornadic activity, just a couple of days ago, near Wray, Colorado. This guy has provided some spectacular footage by getting oh-too-close for comfort. The video in this first tweet is a 360 vid so just grab the video and drag it to change the perspective.
It's only fair that I follow up such horrible acts of nature with something much sweeter, so how about one of the cutest (and fastest) kittens on wheels?
Here's a pretty cool invention that I could actually get on board with. GeoOrbital's creators had previously worked at SpaceX and Ford, companies that know a thing or two about renovating traditional transportation. The device replaces the front wheel in bikes with 26-inch or 700c (28-inch/29-inch) size tires; either way, its proprietary foam wheel won't get a flat when punctured. Additionally, its lithium-ion battery boosts your bike up to 20mph for up to 50 miles, has a USB port to charge your devices while you ride, and recharges as you pedal, brake, or coast downhill. And this is one of the more idiotic inventions I've ever seen: Okay. Time for more cuteness. The US Fish and Wildlife Service has another terrific live-cam set up now: The Black-Footed Ferret cam. These creatures are nocturnal so we should be able to see them in action tonight. Look how cute. (Click the link above to watch the live-cam view.) What the heck! Let's toss some medical stuff in here too. This is what a beating heart looks like when it's outside one's chest. Fascinating.
And here's a breakthrough that might make you shed a tear of joy. A pacemaker-like device implanted in the chest of a Parkinson's patient sends electrical signals to the brain and stops tremors in seconds. While it doesn't cure Parkinson's, it does greatly improve the quality of life for sufferers of the wretched disease. Medtronic's DBS therapy uses a surgically implanted medical device, similar to a cardiac pacemaker, to deliver electrical stimulation to precisely targeted areas of the brain to reduce some of the disabling motor symptoms and improve quality of life, activities of daily living and reduce medication usage for individuals living with Parkinson's disease. Dr. Calegan and board-certified neurosurgeon Dr. Paul J. Waguespack were the first physicians in the Baton Rouge area to offer this innovative procedure, launching The NeuroMedical Center's Deep Brain Stimulation Program in 2007. Both Drs. Calegan and Waguespack also have degrees in engineering, so they feel very comfortable combining innovative technology with medicine. To date, over 250 patients have benefited from DBS therapy performed at The NeuroMedical Center. Now, due to the success of the DBS program, The NeuroMedical Center has expanded to 3 board-certified neurologists as well as a neurosurgeon who specialize in movement disorders and DBS.Here's a video of the device in action. The look of surprise and relief on his face brought me to tears. Tonight's ONT brought to you by this reminder of what could have been. (H/T John Rivers) Now, in the words of the world's most trusted news anchor, Goodnight, and have a pleasant tomorrow. Comments(Jump to bottom of comments)1

Yeah, actually an Article V convention could turn into a "runaway convention" but it only would have power to propose amendments, not amend the Constitution itself. So the wacky lunatic left-wing "repeal the 2nd amendment" type amendments would have to get the support of 3/4ths of the state as per usual, which isn't going to happen.

Loperamide is the main ingredient in Imodium A-D. It causes intestinal slow-down, which helps stop diarrhea, but it is an opioid.
"It's an opioid agent and it helps to bind receptors in the brain and cause a similar euphoria or high," Dr. Scott Krakower, a physician who specializes in addiction disorders at Northwell Health, said. Krakower said a person would have to take an enormous dose of anti-diarrhea medication to get high. Addicts are found to be popping anywhere from 50 to 300 pills per day. According to the study, Imodium A-D, in large doses, works in the body the same way as heroin, morphine and oxycodone. However, Imodium A-D is a much cheaper alternative, as big box stores sell 400 tablets for less than $10. Posted by: James T Kirk at May 09, 2016 10:21 PM (e8kgV) 44

Geo-orbital is dumb. Replaces one pair of bearings, with 3 pairs of bearings that have to spin much faster, hence more than triple the friction. Also you lose the gyroscopic effect of the entire wheel spinning, which is one of the things that makes bike riding possible. You could get all the alleged benefits of the Geo-orbital by simply having a wheel with a motorized hub, which, surprise, surprise already exists.

Article 5 The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress; What comes out of the convention still has to be ratified by 3/4ths of the states, but once Congress has called the convention (as they must if petitioned by 2/3rds of the states), they are out of the process. Everyone seems scared of an Article V Convention. I understand why this might be so, but it is one of the last truly legal means left to us by the Founders to turn things around.
It should not be feared, but carefully studied and embraced. It may not work, but at least all options would have then been exercised. I can not even realistically game out how this thing goes after that, because the thought of what it would take after that makes my heart hurt. The convention proposes. Congress can propose. The states can only petition Congress to call a convention for proposing.
Posted by: The Constitutional Hat This reading is not supported anywhere in the text. According to the text, who proposes? "The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution" "a convention for proposing amendments" The verb propose means the same thing. The Framers were not Humpty-Dumpty. It is clear that the conventioin exists "for proposing amendments" Now, lets look at the states who are limited to requiring the Congress call a convention upon "application of the legislatures of two thirds of the several states" The Congress either proposed directly, or calls a convention to do the same when 2/3 of the states apply for the Congress to call one. The states can not call a convention directly, and any such directly called "convention of states" would not be a body that the Constitution would recognize as authorized to propose amendments. 204 Regardless of what anyone thinks here, the question is if a Dem Congress does whatever they want with an Article V convention, with the Supreme Court to back them up?
Is there any doubt tht if this occured that the Left would push a full court press and promise and lie to get exactly what they want ratified? Do you trust any branch of the Federal government, or even any banch of the state governments to not buckle under when the Left unleash EVERYTHING they have? Ignored language is still better than replaced language. No matter how weak, that language is a check upon the people running the government, and serves as a reminder of what was. I dare not gamble everything on a slim bet. Posted by: The Constitutional Hat at May 09, 2016 11:17 PM (vBeA5) ++++ I think it is unlikely that the Left has enough control over 38 state governments so that they would be able to make any changes desirable to the Left to the US Constitution. I think there may be a better shot at getting something the Right would like though this process. In other words, I think that the math is better for the Right using a convention. With that method, you need the initial 2/3 of the states, and then 3/4 of the states. Which in effect means you need 3/4 of the states. Using the traditional amendment process, you need 2/3 of the House plus 2/3 of the Senate, and then 3/4 of the states. Posted by: Anon Y. Mous at May 09, 2016 11:29 PM (R+30W) 243

Australian man who smokes up to a gram of cannabis per day has narrowly escaped amputation after becoming the first in the country to be diagnosed with a rare disease linked to cannabis use.
After an ulcer on his toe failed to heal, the heavy cannabis user consulted Frankston Hospital in Melbourne, where he was diagnosed with cannabis arteritis, an extremely rare disease which causes a build-up of plaque around the arteries, thereby decreasing blood flow to the limbs. The patient, who has not been identified, was treated with a balloon angioplasty, where a collapsed balloon, known as a balloon catheter, is placed in the area which is constricted in order to inflate it to a healthy size. Going to the gym tonight I thought we had an active shooter situation with the amount of cop cars hauling ass from multiple directions.
Turns out it was a shooting but just a domestic violence type. No deaths. *** OH! That reminds me. I went off about it on Twitter this afternoon. This morning I received a tweet from a local news station with a link to a livestream of a SWAT situation. A man at a mobile home park had been shot and there were dozens of police units, plus SWAT, and two armored vehicles on site. The local news-fools left the camera and the mic up and running so you could hear all of their chatter. About 1100 one of the reporterettes interviewed a resident who, when asked what he knew, said that he overheard the SWAT guys saying that they would make a decision at 1300 hrs about what to do. Well, I had already been losing my shit on the station via twitter because of all the chatter about the SWAT presence and their weapons, etc... but I really freaking lost it then. I started tweeting to the sheriff's department who tweeted back to me that the man who was interviewed was wrong. Next thing I know I see the Director of Public Relations walking towards the camera and she was not in a good mood. She backed their asses out of there and across a major thoroughfare and made it clear she didn't care if they were inconvenienced by it. I heard the reporterette say "She has an attitude". I felt so proud. Now, keep in mind, that the sheriff's office wasn't even sure if the shooter was even in the home, or the park, but had a huge presence there. After about five hours of residents standing out in the open, in the heat, without access to their homes, the city sent buses to the site to serve as 'cool down' spots. About 1800 hrs the shooter was captured. He was miles away at the time and hadn't been in the park throughout this entire ordeal. Did I mention the man who was shot received only superficial wounds? I wonder how much money was wasted on that clusterfuck today? Posted by: Niedermeyer's Dead Horse at May 09, 2016 11:51 PM (SEXy3) 315

The states can call a constitutional convention (not an Art 5 convention) any time they want, and write a new Constitution, same as this Constitution was written.
The constitutional convention for this constitution was first called by the meeting of five states separately, without the blessing or instruction of Congress. (Look up Annapolis Convention) They then asked Congress for its endorsement after they had already gotten the ball rolling. But THAT kind of constitutional convention IS a total rewrite and WILL lead to a runaway convention. Posted by: chemjeff - Libertarian at May 09, 2016 11:58 PM (dpnZC) 346

No, the Left likely won't. But the overall situation we are in by that point will be dire. I don't know how much rural America will spend doing those things. I'm rural America and I don't think a lot about that. Most water is controlled by municipalities. We have a pump system so I can get water out of stock tanks but I need chlorine to make it drinkable. The most realistic way to assure "no Trump" and "no Hillary" is a 3rd Party candidacy.
Run a 3rd Party candidate who would draw enough votes from the electoral college to assure no majority. Then the choice for president goes to the House. The House is always up for election and they will have to choose someone who will not cost them their own phoney baloney job. Their choice won't be great but it will be better than Don or Hill. Doppler radar.
So there's now a doppler-based chronograph for shooters to measure velocity of their reloads. Pretty handy looking. No screens to shoot through (and not unit to *shoot up by mistake*), no messy set-up. Think it's called Lab Radar. But ..... so far I just haven't found a chrony to be neccessary, and - around $600. So there was this other doppler radar chronograph. It was part of the last upgrade to the fire-control systems on the USS Iowa-class battleships, for the main battery of 16" guns. By measuring projectile velocity (which varied by lot of powder bags used), adjustments could be made to the fire control solution to increase accuracy. Now in this case I feel I MUST have this system. With of course, the guns to go along with it. Must. And cost is no object. So get cracking folks, let's make this happen. 8. Require everyone involved with regulations or legislation found unconstitutional to be removed from public office and forever barred from returning.
++++ Don't think that one would really work. If SCOTUS strikes down a law, that means every congress critter that voted to pass the law, plus the president if he didn't veto and get overridden, would all have to be removed from office. On the say so of 5 justices, at least half of our elected officials would be removed from office. Lots of potential for abuse, plus you would likely have the effect that SCOTUS would be reluctant to find anything unconstitutional because of the huge impact it would have on the government. Plus, what about state governments. SCOTUS says some state law is unconstitutional, like the tranny one in NC, and all of a sudden, most of a state government is thrown out of office. I think you need to rethink that one. Posted by: Anon Y. Mous at May 10, 2016 12:53 AM (R+30W) 476

Meant to post this last night on VE day:
----- The beaten foe emerged. All over the broad Atlantic, wherever they had been working or lying hid, the U-boats surfaced, confessing the war's end. A few of them, prompted by determination or struck by guilt, scuttled or destroyed themselves, or ran for shelter, not knowing that there was none; but mostly they did what they had been told to do, mostly they hoisted their black surrender flags, and stayed where they were, and waited for orders. They rose, dripping and silent, in the Irish Sea, and at the mouth of the Clyde, and off the Lizard in the English Channel, at the top of the Minches where the tides raced; they rose near Iceland, where Compass Rose was sunk and off the north-west tip of Ireland, and close to the Faeroes, and on the Gibraltar run where the sunk ships lay so thick, and near St. Johns and Halifax and in the deep of the Atlantic, with three thousand fathoms of water beneath their keel. They surfaced in secret places, betraying themselves and their frustrated plans: they rose within sight of land, they rose far away in mortal waters, where on the map of the battle, the crosses that were the sunken ships were etched so many and so close that the ink ran together. They surfaced above their handiwork, in hatred or in fear, sometimes snarling their continued rage, sometimes accepting thankfully a truce they had never offered to other ships, other sailors. They rose, and lay wherever they were on the battlefield, waiting for the victors to claim their victory. - Nicolas Monsarrat ("V.E. I don't know how constitutional it is, but I would sure like every law to include an accountability clause so anyone who suffers from bonehead laws and regulations could sue the people behind it personally. So, for instance, any sanctuary city legislation would have to include the provision that anyone who lost a family member because of an undocumented alien could sue the mayor personally for damages.
I'd also like it if we could level the playing field for certain lawsuits by requiring the government to spend the same amount on prosecution that the defense does. ...and sue journalists for malpractice. Posted by: vivi at May 10, 2016 01:31 AM (11H2y) 512

I know securing peaceful orderly surrender of the far-flung Japanese forces was a large concern for the Allies when Tokyo quit. ... Unecessary. Read the SCOTUS opinion on Kelo. Thomas, Scalia, O' Connor and Renquist side with me. Ginsberg, Kennedy, Breyer and Souter side with Trump. Yes, that's an appeal to authority, but it's a very telling one. Trump should never be president. Posted by: stace at May 10, 2016 01:53 AM (e8nnW) 528
Mike, gonna check into that book right now.
My "stack" is my wish list at the public library (after the wife turned me on to that vs. buying for myself). It's a pretty big stack at this point. Oddly my eastern front reading has been limited, given the language study and the fact I've actually been to some of those battlefields. Found an online site where I can watch Soviet war movies, another good language practice tool. Posted by: rhomboid at May 10, 2016 01:55 AM (QDnY+) 529
God I hope someone is unsure of the safety of the Ferrets, so someone goes to check, and falls and gets stuck under a rock, thus having to drink his own urine for the amusement of tens of thousands of filipinos.

One solution would be to say that your land could be seized, but only if the government owned and operated the tracks. I prefer the solution where the government allows the tracks built and operated and owned by private interests. Posted by: Anon Y. Mous at May 10, 2016 02:26 AM (R+30W) 539

... no one wants the gory details, but if i take more than two or three over a short period of time, i get the jitters, not a high... i'd hate to think what 50 or more would do. the old school Lomotil (diphenoxylate/atropine) allegedly *did* have the ability to generate a high, which is why they added the atropine, which would make taking more than the recommended dose *highly* unattractive. the FDA gets a lot of things wrong, but i'm fairly confident they didn't sneak an opiod analogue onto the OTC market with Imodium. as for pseudoephedrine, no one extracts meth from it: it's a precursor chemical, which has to be transformed, via chemical processes, to become meth. Good Morning Morons. Today is Tuesday, May 10, 2016. On this day in 1869 the First Transcontinental Railroad, linking the eastern and western United States, was completed at Promontory Summit, Utah with the golden spike. The railroad was not actually completed, but like most of the stuff with this railroad they said it was for PR purposes. This was probably the first really massive example of crony corruption in the US. It was started in 1863 during the uncivil war. The building of the railroad was rife with corruption and the companies involved went bankrupt 3 years after the government subsidies stopped. Sound familiar. And like most Washington boondoggles the entertainment industry has glorified it to the sky while never mentioning the corruption that was ongoing.

Before we move on to today's news I want to comment on the link and item that Y-NOT put in the sidebar concerning the attack on common sense bathroom laws.
The 4th Circuit Court of Appeals, which holds judicial sway over the Carolinas and four other states, ruled last month in a lawsuit filed by a Virginia transgender student that the federal government has the right to define discrimination as it sees fit. [Y-not] That was a direct quote from the Charlotte Observer which like all big city newspapers is a liberal rag that can not be trusted. It took me a while but I was able to find a pdf file of the written judgment of the court and the dissent. This was 69 pages long and that should give you a hint as to how the liberals buffaloed the court. I have noted during my long practice of following the courts that the longer a written judgment is the more likely it is to be made up BS. This one conforms to that quite well. Note that the appeal which caused this to make it to the 4th circuit was to the lower court ruling which denied the plaintiff an emergency stay of the local school regulations which required this person who was born as a female to use the female bathrooms and dressing rooms. The case was actually brought by that paragon of liberal destruction, the ACLU. The ruling is a long diatribe of conflicting statements all made in legal jargon to confound the average citizen. But you can boil it down to one thing; the Title IX law which the complaint was based on failed to define what sex means with regard to a male and a female. I suppose that the people who wrote that massively crappy law passed in 1972 assumed that was within the realm of historical common sense and when that POS law was written it was. But in the end, the majority of the court ruled that gender identity by the plaintiff controlled what sex the person was and despite the fact that they even referenced that the plaintiff had a mental illness: gender dysphoria, a medical condition characterized by clinically significant distress caused by an incongruence between a person's gender identity and the person's birth-assigned sex. They also openly admitted that Title IX permitted the common sense arrangement of separate facilities for males and females. But they disagreed with the lower court ruling denying a stay. They hinted all over the fact that if left to them they would have ruled that the schools should force the students to have coed bathrooms, dressing room, etc. But they did NOT rule that. They issued a three part order that was really nothing more than sending the case back to the lower court to reconsider its ruling. And I boil all of this down with one statement, the reporter who wrote that newspaper article is a liar. Nowhere in this ruling did it say that the federal government was allowed to define discrimination in any manner it sees fit. Sorry this got so long. If you wish to read this POS ruling you may find it by Binging C.G. v Gloucester County School Board. Now on to the news. Posted by: Vic We Have No Party at May 10, 2016 05:59 AM (vvmPQ) 569
Illegal alien who enlisted in the Marines and was subsequently kicked out and deported because he lied on his Marine Corps enlistment papers now has been reclassified as a citizen. While I agree that after serving in a combat zone (or serving 6 years) under current rules an immigrant can earn citizenship. I disagree with the way this case was handled. Under Obama I am sure that if he had been an illegal who was of white European non-muzzie extraction his case would have never seen the light of day. (Recall that German family who wanted to home school their children that were denied residency until a major flap arose). I also believe unvetted illegals should NOT be allowed to enlist in the Armed services. And by definition all illegals are unvetted.

I debated whether to link this or not, but here it is. Fox is making a big deal out of so-called corruption in Alabama government. One of the cases is not corruption at all, it is a judge who does not agree with SCOTUS's ruling on same sex marriage and who has outraged the SPLC by telling lower court judges not to issue marriage licenses for such. This is not corruption, it is common sense.

I never would have expected this because the tree had grown to be fairly tall now. It is about 8 to 10 feet tall. It is the second one I have planted. The first one was killed by a hard freeze too.
