Uhhh... First hour, great episode, very creepy. Half hour resolution -- horrible, typical Moffat-throw-everything-at-the-screen-when-you-have-no-ending-nonsense RE: Sherlock, I agree completely. Convinced that Biden thought he had Obama's support to run until the Clintons cut a deal. I wonder what the terms of the deal were. I speculate that the Clintons threatened to unleash a scandal on Biden's kids (easy to do) which ended the Mexican standoff that the Clintons and Obamans had on each other, Posted by: Ignoramus at January 05, 2016 07:48 PM (r1fLd) 22

I have long wondered: Is the "gay accent" a genetic trait, as they claim sexual orientation itself is, or is the "gay accent" simply a cultural affectation? Furthermore: Is it only in English? Or do other languages have their own versions of "poofter-speak"? Ace, in your studies of French: is there a French version of ze gay accent? I know for sure that there is one in Cantonese, because I've watched hundreds of old '70s and '80s Hong Kong comedy films, and "gay accent" language jokes crop up pretty often, plus I know Cantonese speakers in real life and they have confirmed it, but were too embarrassed to try to replicate it for me. The way I get it: His dad is a Cuban refugee, his
mom is an American . They met in Canada. Due to a quirk in Canadian law, Cruz held dual nationality, but only ever carried a US passport. Trump isn't saying that Cruz is not eligible. He is saying that other people are going to say it and that it will be part of the discussion and it will be trouble.
So just avoid the trouble and go with someone that doesn't have that problem. I agree. And this looks like all the context for the Trump statement in the WaPo... Donald Trump said in an interview that rival Ted Cruz's Canadian birthplace was a "very precarious" issue that could make the Texas senator vulnerable if he became the Republican presidential nominee. "Republicans are going to have to ask themselves the question: 'Do we want a candidate who could be tied up in court for two years?' That'd be a big problem," Trump said when asked about the topic. "It'd be a very precarious one for Republicans because he'd be running and the courts may take a long time to make decision. You don't want to be running and have that kind of thing over your head." Trump added, "I'd hate to see something like that get in his way. But a lot of people are talking about it and I know that even some states are looking at it very strongly, the fact that he was born in Canada and he has had a double passport." I think Trump teed this up for Cruz to knock it out with his statement.
This has been a classic way for Democrats in the past to defuse a problematic issue, such as Clinton's bimbo eruptions (denying Gennifer Flowers on CBS, then later admitting to an affair under oath in 1997). And Obama burying Jeremiah Wright ...."This is not the Rev. Wright that I knew"....Sure it was, you big phony. Trump is pretty far ahead in most polls, and Iowa....so what. Iowa has not picked too many winners in the past presidential cycles. Likewise New Hampshire. Cruz is one of three possible running mates for Trump. Well, I always wondered how could Cruz not have thought about his dual citizenship until just around the time he decides to run for President.
Did he not pay attention to all the crap about Obama's BC? So that kinda told me that either he isn't so smart or too smart for his own good. (he thought no one would notice or it wouldn't matter.) One of my reasons for questioning his trustworthiness. I do have to say that having seen his Conservatives rating of 97% makes me feel a bit better if I have only him for a choice but I don't know exactly how they figure what's conservative and what's not. They do seem to give some real RINO's some higher marks than I would give them. Either way he should've known and taken steps like a day after the birthers started in on Obama cause you know how the media likes to play turn about for conservatives running for office. North Korea could be preparing to test its ability to produce a hydrogen bomb, the South Korea intelligence services said Sunday based on recent military activity by Pyongyang.
The announcement comes a month after North Korean leader Kim Jong-un mentioned for the first time that his country has an H-bomb, although at the time experts doubted that the Asian pariah state could have developed the highly destructive weapon. The North Korean regime has already completed construction of the necessary installations to test an H-bomb and it could be producing tritium, a nuclear isotope used to make such weapons, according to the report made public by South Koreas chemical, biological and radiological defense unit. The US Geological Survey (USGS) put the tremor at magnitude 5.1, at a depth of 10 kilometres, with its epicentre 19 kilometres east-north-east of Sungjibaegam. It said it struck at 12:30pm (AEDT). "The problem for birthers is that Ted Cruz' s birth mirrors Obama's.
American mom, foreign dad. If not being born in Hawaii was an issue for Obama, then not being born in America should be an issue for Cruz. I have to admit that is logical." My understanding is that U.S. citizenship law was somewhat different in Hawaii in 1961, when one parent was a U.S. citizen but a resident of Hawaii, and the other parent a foreign national, because of Hawaii's relatively recent accession as a state. There was a short window of time, including '61, wherein different provisions and qualification applied for birthright citizenship. However, here's the kicker. Even if Barack Obama had bona fide U.S. natural-born citizen status at delivery, when he became a citizen of Indonesia briefly, he would have had to formally surrender same (i.e., to have had his parents sign to surrender it, acting for him). The Indos have strict rules against dual loyalties. They want to see the notarized paperwork of renunciation before they'll let you become Indonesian. Obama never refiled to regain his U.S. citizenship. He just came back. And paperwork in Hawaii was so sloppy he got away with it (albeit with some obvious workarounds like his taking on a Connecticut social security number). In the most technical legal sense, the USA has probably had an Indonesian as its chief executive for the last seven years. Posted by: torquewrench at January 05, 2016 09:21 PM (noWW6) 315

Microscopic sample size (4 or 5 friends in MA) polling data tells me that 23.8% of the people in MA who had voted for Scott Brown are supporting Trump. Actually, I have no idea what the numbers are, but there's a connection that I don't think they've realized yet. Many of them are Union/City employees/spouses, so loyalties swing wildly some years. Posted by: Misfortune & Pestilence at January 05, 2016 09:28 PM (RCJ7Q) Factually untrue. The 1790 naturalization act (1st Congress) mentions "natural born citizen"s born abroad, with such extension of who was considered a natural born citizen made by an act of Congress. So, jus soli is not an absolute requirement, nor is being "naturally born" a citizen defined by some unalterable criteria. On the flip side, the common law regocnized jus soli regardless of blood. Shortly after the election of James Garfield, the Democratic National Committee hired a New York attorney Arthur P. Hinman to dig up dirt on the vice president elect Chester Arthur. The Democrats did not believe that Chester was born in Fairfield, Vermont, nor did they believe he was even born in the United States of America. Hinman concluded that Arthur was born in Dunham, Quebec in Canada, not Fairfield, and was therefore not an American citizen. He accused Arthur of traveling to Canada following his election as vice president in 1880 to see if there were any records or evidence of his birth. Finding none, he chose Fairfield, Vermont as his birthplace. He claimed that Arthur knew nobody would be able to prove otherwise and he was supported by the fact that his father was a preacher there around the time of his birth. In 1884, Hinman published his allegations in his book How a British Subject became President of the United States. https://en.wikipedia.org/wiki/List_of_Presidents_of_the_United_States_by_home_state Posted by: Laurie David's Cervix at January 05, 2016 10:10 PM (kdS6q) 464

Listen, from a person who has researched the Art. 2 natural-born citizen requirement for hundreds of hours - I have not found the answer.
I have not found the DEFINITIVE meaning. So, I will not claim to KNOW what was meant by the founders. Yet, and I find this hilarious, people who have only read OPINIONS of others who base their understanding of the term on people who have read the brief and inconclusive research of OTHERS, think that they KNOW that Ted Cruz is what the founders meant when the put the restriction in the Constitution. Second-hand. The people they rely on are researching to support Ted's claim, NOT to discover the actual historic meaning. So, after more than 500 hours of research spanning years, I am an idiot who is a birther. After THEY read a blog article or two supporting their candidate, THEY are the expert. At least I have the clarity to know I am not an expert, for I do not have the last, best piece to this puzzle. The research that I have done does not support Cruzs case to be considered a natural-born citizen, but as I don't have the "holy grail" in historical definition, I do NOT lay claim to knowing that he is not qualified. Yet because I still find a reasonable likelihood that it is an unsettled dilemma, I am a birther. Funny, obama seemed to feel that regardless of his parents citizenship status, as long as he was born ON US SOIL, it didn't matter. Make up your minds on this. Better yet - spend hundreds of hours researching and have the damn HONESTY to admit that you don't have the proof one way or the other. Posted by: GrandeMe at January 05, 2016 10:18 PM (xhawg) 503

Actually, you are proving my point. Sort of. It matters, that's why they MADE him revoke his UK citizenship. But since he was born on American soil to an American father I don't think he had any statutory naturalization. He probably is a natural born citizen. I mean, if they weren't born citizens, then they would have had to have gone through the naturalization process. Right? Posted by: V the K at January 05, 2016 10:28 PM (G/+Ma) Wrong. There are more than just two classes of citizen. There is a new class of citizen in the US that was not around when the Founders' "natural born citizen" class was written - dual/multi citizens. Clearly, they were not included in the class of natural born citizens, since the Founders didn't even allow for American dual citizens (as evidenced from then to the same oath of RENUNCIATION and allegiance that every naturalizing American must take, thereby taking away any alien citizenship/allegiance/loyalty that the person might have) it's clear that they didn't include such citizen types in the class of natural born citizen. You can just make stuff up and create new sorts of citizens and then assign them to whatever class you want ... because .. why not? I mean, since naturalizing Americans can, in their first act as Americans, take an oath to renounce all other citizenships ... but then retain those other citizenships, anyway, and everyone cool with that ... well why not just make up more shit about dual citizens being natural born citizens? We allow naturalizing Americans to take the most imp[ortant oath in BAD FAITH as their first act as "Americans" so it just makes sense to shit all over the rest of the citizenship issues, especially the one SPECIAL requirement the Founders had made for the Presidency. In fact there is much evidince that people were either "natural born" or "naturalized". I.e. they were citizens by birth or by aquisition. Posted by: The Common Hat at January 05, 2016 11:11 PM (vBeA5) 606
There are statutes that are a form of naturalization. A natural born citizen is just that natural born and not subject to various statutes regarding circumstances of birth and parentage.
Posted by: Misfortune & Pestilence at January 05, 2016 10:39 PM (RCJ7Q) Actually "natural born citizen" is subject to statutes, as evidenced by the naturalization act of 1790. Posted by: The Common Hat at January 05, 2016 11:14 PM (vBeA5) 607
He probably figured that since he wasn't 'naturalized' there would not be a record or recollection that he was a natural born canadian first.THEN his mother would have had to register his birth abroad, at which point his us citizenship would have recognized after birth. depending on then current regs they have had to endure further examination and received a handsome certificate suitable for framing... maybe not even until after he went stateside after a number of years.

Almost like voting in another style of Bush, but without the government experience. You can call Cruz a liar and an anchor baby all you want- he's still one of the most conservative candidates out there."
I never called Cruz an anchor baby. You incorrectly decided that that was what I thought. You were wrong. Cruz is an American citizen just a naturalized one. Assuming, of course, that his mother never gave up her citizenship to become Canadian before his birth. Anchor babies are those children of foreign women who give birth on American soil. I've never conflated the two. Again you made an incorrect assumption. "You can call Cruz a liar" He is a liar if he said he didn't know he was Canadian when he was born in Canada. And he certainly knows he's not eligible so again - liar. "he's still one of the most conservative candidates out there." How conservative can he be when his first act is to destroy Article II Sec I of the Constitution leaving us natural born citizens at the mercy of foreigners running and becoming president because of his actions? Put me down as one of the hundreds-of-hours+ researchers on the Natural Born Citizen topic. Ah, the free republic threads!
There are several Supreme Court rulings that affirmed the definition of NBC to be juis solis and juis sangre (land and blood). No scotus rulings have ever altered this finding. Furthermore, the founders wrote extensively on this widely understood concept, which was based on natural law (vs man's law, or statutory law). Specifically: a person born to two citizen parents (blood), in the country (land) their allegiance and citizenship is to one country alone. No law is necessary to grant them citizenship; they are "natural born citizens." All other classes of citizens are "citizens by statute." A law was passed to define their citizenship. One immigrant parent, born overseas, naturalization, etc. all by statute, none are NBC. O was disqualified on two fronts, but lied about place of birth knowing the media would cover him. McCain, himself ineligible (sorry, born in Panama hospital- despite his patriotism he was a citizen by statute and not nbc) got his senate cronies to pass a nonbinding resolution declaring him eligible. I believe senate bill 527 (iirc)... Cosponsored by? Obama. My my. What a treacherous land. Cruz is certainly ineligible- but the crazy thing is, he's my #2 choice currently. I consider the US Constitution to be "in exile" these days, and I'm willing to fight fire with fire if only to save our republic. Posted by: Mills044 at January 05, 2016 11:31 PM (sNG31) 614
That act was not operative for long and it was a mistake. Congress does not have the power to define first-level Constitutional language and terms. If it did then Congress could amend the Constitution merely by redefining whatever it liked.
It was contemporary usage by the 1st Congress which has quite a few people at the Constitutional Convention, so I'll take their usage rather than straw-grasping dismissiveness. Historical usage indicates that "natural born" meant nothing more than "born as" or "by birth". There is no actual indicatioin that it was an invariable special term, especially a distinction between "born as" and "natural born". Congress has the power to legislate citizenship requirements, but not the class of natural born citizens. That term is beyond Congress' power to alter or even explicate. Posted by: ThePrimordialOrderedPair at January 05, 2016 11:19 PM (zc3Db) Again, this assumes that it is an invariable term with an exacting meaning, and not how it was actually used, as a term referring to citizenship by birth, especially since I've never seen it used in the former sense as something separete and distinct from citizenship by birth. "I've read up to. There is no evidence for "natural born" being different from "by birth". Zip. Zilch. Zero."
Wrong. I'm not about to go into the facts, court cases, and historical writing which are too voluminous to go through here and for which you will turn a blind eye and deaf ear to because you have an agenda other than historical truths. History is self evident. The founding fathers wrote a grandfather clause for themselves. All presidents (aside from Chester A. Arthur - who hid the fact and Obama - the ongoing criminal usurper) have been natural born citizens with both Jus Sanguine and Jus Solis. You are factually incorrect. Being a natural born subject/citizen by jus soli alone has been recognized by both SCOTUS and in the Common Law. Further, the Constitution is based on the Common Law and not some "natural law" as espoused by some philosopher. All other classes of citizens are "citizens by statute." A law was passed to define their citizenship. One immigrant parent, born overseas, naturalization, etc. all by statute, none are NBC. Again, incorrect. There is citizenship by birth or aquisition after birth. The Common Law recognized those born jus soli were of the former; statutes could extend it, as evidenced by the 1790 naturalization act. Posted by: Mills044 at January 05, 2016 11:31 PM (sNG31) The restriction, thus, of being a natural born citizen was a restriction that one had to be born a citizen, and was not a restriction on who was considered to have been born as a citizen. Looking at history, by the Common Law this included those born jus soli, and by statute, others. Posted by: The Common Hat at January 05, 2016 11:47 PM (vBeA5) 619
@613 Yep. It's amazing what you learn when you do some research. I feel your pain and understand your thinking generally. If circumstances were different, I might not have a choice but thankfully there is a NBC running that I could vote for. With Trump I get a twofer. Well, you have your definition and I have mine. We both have good reasons for our opinions, but, until this is either adjudicated or explicitly defined via Constitutonal amendment (the only ways that this issue can be handled) it will remain fuzzy and unresolved. Sadly, this should have gone through the courts in 2008 but the judges are pathetic pussies and the GOP and Vichy Right were a bunch of pansies who were scared to even talk about eligibility (even though we had descended to the point where a NON-AMERICAN was actually on ballots for the Presidency ... a friggin ALIEN!!!!). Until either of those resolutions is had we are each led to follow our own ideas about what constitutes "natural born citizen" and to vote accordingly. As to that, even a court determination would still leave people with some misgivings, but at least they would have tried and had to come up with some bullshit to support whatever decision they came to. Instead, people thought that merely ignoring the issue and pretending the Constitution doesn't exist was the best course of action ... And so, here is where we remain. I want to like Ted Cruz, but I'm really having trouble trusting him right now. One reason is... just look at what happened to him when he straight-up called Mitch McConnell a liar on the Senate floor.
Nothing. Oh, sure; John McCain said some bad things about conservatives in general, in an event otherwise known as "Tuesday", and named Cruz in particular this time, and then Lindsey Graham piped in with, "yeah, you tell him, John!", and then... yeah, nothing. Look at what happened in the House when some conservative Reps voted for a new Speaker. Boehner had them removed from their committees for merely acting on the idea that it might be better to have someone else in charge. And raucous debate is supposed to be a feature of the House, as opposed to the Senate, where they have these all-important rules of "decorum" and "collegiality" and stuff. Why was there no actual attempt to punish Cruz in some official way for calling the Senate Majority Leader a liar? Suppose Cruz had called Harry Reid a liar two years ago. You think he would've gotten off Scot-free like that? Do you really think McConnell is that so greater a guy than Boehner or Reid? No, they're all the same; entrenched and thin-skinned senior creatures of Washington. I really think think McConnell was 100% on board with this show of troothiness and stuff, because as high-ranking Repugnican he knows we dumb yokels need a bit of red meat thrown our way once in a while just so we can all maintain this illusion that someone in DC actually gives half a shit about us. Some have defines "natural born citizen" as have certain requirements, but have not distinguished it from being a citizen by birth. If you have evidence to the contrary, please be so kind as to state it. Further, that both Jus Sanguine and Jus Solis is not borne out by history. There have been some SCOTUS cases that mused about it or pulled stuff out of their butt in an aside when it comes to jurisdiction, but on the whole this is not borne out. The Wong Kim Ark case gives a well footnoted discussion from both sides. Not even the dissenting judges declared there to be a difference between "natural born citizen" and a "citizen by birth". https://supreme.justia.com/cases/federal/us/169/649/case.html Posted by: The Common Hat at January 06, 2016 12:17 AM (vBeA5) 627

Yeah, Milt, my second choice for President if Trump isn't the GOP nominee? I'll write in Donald J. Trump on Election Day.
I'm hearing a lot of noise right now from establishment guys like Michael Medved and Bill Bennett and the aforementioned Trey Gowdy about how they'll totally support the GOP nominee, even if it's Trump, and they're really counting on conservatives who are angry at the GOP to do the same, because Hillary! At first, I thought they were at the "bargaining" stage of grief, but then I realized something... At this point, the only people who can really keep Trump from being the GOP nominee are the same people who make and enforce the rules in the GOP primary. You know, the GOP establishment. And they have been talking recently about having a "brokered convention" where they pick who they want, voters be damned. And so, they're just laying the rhetorical groundwork to say, "Well, sure, we said we'd support Trump if he's the nominee, but he's not the nominee. It's not our fault we changed the rules at the last minute. You have to support Mitt Romney now, just like we'd have been forced to support Trump if we hadn't personally screwed him out of the nomination against the voters' wishes. Team GOPe! Because Hillary." So, yeah; my first choice is Donald Trump (R). And my second choice is "Donald J. Trump" (write-in). Because screw those hippies. Posted by: Prothonotary Warbler... Well, I'm convinced that Trump is the only GOP candidate who can win this year. Mitt "the only guy who can win" Romney lost every swing state in 2012. John "the only guy who can win" McCain lost every swing state and also two red states in 2008. Meanwhile, Trump puts frickin' New York in play in 2016. I also don't think Trump is our savior or anything; I mostly just see class warfare playing out, in that Trump is clearly not "one of them", and when I see "our betters" react in that way I can't help but feel that the only guy who's clearly not "one of them" is the only choice for me. Presidents 1 thru 7 were all born prior to the founding, but all 7 were born in what became part of the nation so founded (mostly Virginia, and secondarily Massachusetts).
President 8 was the first president to be have been born in the U.S.A. His successor was born before the founding. President 9 is the very last President not born within the U.S.A. as founded, yet nonetheless he was born in territory that became part of a state within the U.S.A. Assuming we don't go ahead and conquer the Great White North between now and when Ted Cruz is inaugurated as POTUS, Cruz would become the very first POTUS not to have been born either within the U.S.A. or else within territory that has as a result of the founding or at some time since it become part of the U.S.A. That's not nothing. That's actually quite a big deal - or would be, if he were to be elected. The only problem is that Cruz will not be elected president, ever. What a stupid issue, meant to take advantage of the ignorance of many voters. "Natural born citizen" = born a citizen of the U.S. As in, did not have to go through the naturalization process that immigrants go through to become citizens. The location of his birth in Canada doesn't matter as his mother was a U.S. citizen.
If he wasn't born a citizen, and he hasn't been naturalized, then what does that make him? Not a U.S. citizen. Really? So he's an illegal immigrant? Do we need to deport him back to Canada? Is that the position Trump et al. want to take? Such stupidity. Posted by: Laugh it up, Fuzzball! at January 06, 2016 12:55 PM (Es7YA) 642

That's why for 230 years (excluding the founding fathers and the two cheats) there has never been a president born on foreign soil. Cruz is a loser and won't get the nomination anyway but he's still defrauding his supporters.
