Taking the Pep out of Pep Boys

I know not all members of Mu.Nu are Military in fact most likely are not, but I am asking for help from all of you.

I just ran a post titled Military Member Loses Job Over Service.

It is the story of a Naval Reservist who was fired by the PEP Boys Automotive chain because he was called to active duty.

As an active duty member myself I was very heated when I heard about this.

I would appreciate any assistance you can provide in spreading the word on this atrocity. Please, please, please, feel free to trackback to my post and help me spread the word.

Thanks for any assistance you can provide.

SlagleRock Out!

If you have anything to help me in my fact search please zip over to my site and let me know. Leave your comments in the actual post here. For some reason I can access my site from work, but no Munuviana. I don't know what the deal is.

Thank you all for your help.

1 SlagleRock: I'm pretty sure it's against the law for them to fire him... you could do a search over at Blackfive's for information on a similar case.

2 I've been boycotting Pep Boys for years but that's because they overcharge and do shoddy work.

3 My understanding was that it's not against the law to let someone go under those circumstances, but it's almost never done. The 'against the law' bit is kind of an urban legend. I seem to recall someone going to court over losing their job during the first gulf war and losing the case.

4 Ted: After doing some research, I found this link: USERRA Overview. I think that it pretty clearly states that you have to be re-employed by that company, provided you meet the listed guidleines.

Many school districts also pay the differential between military pay and their regular teacher pay (http://www.nyu.edu/hr/policies/timeoff8.html)... I haven;t read of any other local/state/federal employers that pay a differential, but it might be a common practice.

As for Manny, Moe & Jack, they appear to be in the wrong or maybe just "upon further review, misstated the soldiers status"...

5 The USERRA was enacted in 1994, so I'm sure you are correct in the outcome of that particular lawsuit... I'd like to know who the employer was so I could be sure not to do any business with them.
