A Federal Magistrate Dismisses Charges Against the FBI Agents Who Lied About Interfering in the Hunter Biden Probe

A change of topic for the moment.

One of the FBI agents who lied under oath about interfering in the Hunter Biden probe openly admitted she was running a "shadow government" in the US bureacracy.

A federal judge on Monday dismissed a criminal complaint against two former FBI officials accused of lying to Congress about Hunter Biden, citing what he said was "weaponization" of President Donald Trump's Justice Department just before the midterm elections.

In a scathing, hourlong ruling read from the bench, U.S. Magistrate Judge Zia Faruqui said the investigation that produced the charges against Nikki Floris and Bradley Benavides was rushed, conducted at the behest of Trump and FBI Director Kash Patel and dogged by "critical mistakes" that require the dismissal of the case.

"I am deeply troubled by what has happened here in this case," Faruqui said. "Whathas transpired here cannot be described as anything other than weaponization."

Oh? We'll soon see that this magistrate -- not a real judge, and not confirmed by the Senate -- is zimself a big Weaponizer so long as that Weaponization goes against the right.

The ruling may not bring a permanent end to the matter because the Justice Department still has the option of pursuing an indictment, even though it has struggled during the Trump administration to persuade grand juries in the nation's capital to return indictments in politically charged prosecutions like this one.

The magistrate admits his decision is motivated by the political calendar:

...

"I will not bury my head in the sand and pretend that I cannot read a calendar," Faruqui said, alluding to the proximity of the charges to the elections, which will determine control of Congress for the last two years of the Republican president's second term.

Prosecutors had accused the two former FBI officials of falsely downplaying to Congress their knowledge of investigations into President Joe Biden's son and of a laptop the younger Biden dropped off at a computer repair shop in Delaware in 2019. But Faruqui said the Justice Department had failed to establish in its complaint that any statements made during 2023 testimony were intentionally false and had affected lawmakers' investigation of Hunter Biden or that the former officials had any motive to deceive.

Hans Mahncke
@HansMahncke

This would be comical if it weren't so depressing. FBI officials Nikki Floris and Bradley Benavides were caught dead to rights. Anyone with two functioning brain cells who has read the documents can see that they flatly denied to Congress what they were openly discussing in their own emails. The failure to do anything about the completely out-of-control DC courts, or to at least try to start fixing a system that makes it impossible to hold Democrats accountable, will be the most damning legacy of these past two years.

Oh, and:

A federal judge on Monday dismissed a lawsuit against Harvard University by the Justice Department, which alleged the school failed to provide admissions records that could ensure it had ended affirmative action in admissions.

The DOJ had accused Harvard of stonewalling the investigation into potential racial discrimination and refusing to comply with a federal investigation, ABC News reported. The lawsuit asked a judge to force the university to turn over the requested records.

U.S. District Judge Myong Joun concluded the DOJ failed to take the necessary procedural steps to acquire the data before filing the lawsuit.

Joun added that the ruling doesn't end the dispute over the data, stressing her decision was on the limited question of whether the government had adequately satisfied the prerequisites, at this point, for judicial enforcement to occur.

1 There will be more of this.

This is all about packing the courts.

In 2024 there were five Senate seats that mysteriously went from red to blue after midnight. The numbers on some of the “wins” yesterday simply do not math.

Look for 60 Senate seats in 2028 and a stolen Democrati presidency. The courts get packed, and that is end game.

33 This has been one of the prongs by organizations like those run by Soros: infiltrate prosecutors and judges.
Get Prosecutors in office that won't prosecute crimes (except made-up charges against the Left's enemies) and judges that'll do the bidding of the left by letting go criminals (except throwing the book against the Left's enemies).

I see no easy fix for this, which is to say, all the normal paths to fixing this problem are the same paths lined with Leftists preventing a fix to the problem.

That was a promise made over and over, "they're not after me--they're after you, I'm just in the way." etc.

Two years later, we got ... last-second hail mary charges--in DC no less!--against the smallest of small parts of the 2020 steal.
Not J6.
Not the lawfare against him.
And Flynn, Bannon, his electors and all the others all over the nation bled dry via legal fees defending themselves.

No: The f'ing Hunter Biden laptop.
Ahab Trump just has to prove he would have won 2020.

And that's not on "but Trump was blocked, the Senate coulda, woulda, didn't!"

That's 100% Trump, the boss of the DOJ.
Those guys all sat in prison for 3-4 years for him.
They got a pardon--and that's big.
But he denied them justice.
And that it'll never happen again.

85 An off beat ( probably) take I have about last night is that the biggest winner last night was Collectivism and the biggest loser was individualism. Make no doubt that Islam is collectivist. 86 Oh and this pristine lack of accountability - for many people, defiling/abusing some of the most powerful posts in the country, all in crude political jihads against elected officials or in support of criminal ones - is clearly where the story ends. But the Beltway is not just among the dumbest and most parasitical entities in the country - as a practical matter it is a law-free zone for the racist-totalitarians ("progressives").

87 The gop by and large is still stuck in 1994-2004 where the promise of spending cuts (lol), tax cuts would get voters excited.

Nobody believes them anymore about spending cuts. And tax cuts have pretty much been exhausted since nobody but the very rich pay much in taxes anymore.so tax cuts are now tax cuts for the rich which is exactly a selling point to most people.

But they’re still using the 2003 playbook. And then are shocked it no longer works.

I don't really have a serious opinion on Vance or any of the other 2028 contenders (none of whom can hope to win on the merits, I think; the GOP is likely to win the presidency in 2028 only if the Dems make themselves radioactive over the course of the next year, which is possible).

But I think Walsh's opinion is goofy. It's the kind of thing that only an ideologue could believe: the GOP and independent electorate is principled, unlike their pols, and are refusing to show up on account of those principles. People by and large are pragmatic; Joe Sixpack is not doctrinaire.

110 Hello, Horde -

I honestly feel like I have aged out of my country.

Let the idiots who are gloating today stew in what is going to be failure for the foreseeable future - they will NEVER figure out that their glee in overturning what had once been a great country is what will doom them to third world status in their lifetimes.

What is coming will look nothing like the USA that I grew up in - hell, what just happened looks nothing like the country I thought I knew.

It's just a matter of time before forced euthanasia comes for those of a certain age (on both sides) - once we no longer make taxable income, we are of no use to those who are going to be in charge. Expect to see Social Security and Medicare for the elderly phased out. And forced abortions for any birth defects that can be diagnosed prenatally. If you have a chronic or terminal illness, they aren't going to waste resources on you.

I am glad that I am old and will not live long enough to see the downfall of this once great nation.

150 My son broke his first metatarsal on his right foot on Sunday. We took him to the doctor that evening and got a boot and crutches. He saw the Osteopath yesterday and got relatively good news.

He can put 10% body weight on the foot now and gradually ramp up to 100% over the next four weeks. Everything looks good for a relatively quick and full recovery.

151 124 But I think Walsh's opinion is goofy. It's the kind of thing that only an ideologue could believe: the GOP and independent electorate is principled, unlike their pols, and are refusing to show up on account of those principles. People by and large are pragmatic; Joe Sixpack is not doctrinaire.

America and the entire rest of the West is soft.

The people don't understand war, don't understand our enemies, and are unwilling to do what is necessary to protect civilization.

Which means civilization is going to suffer a massive, debilitating attack before the people wake up.

Whether it survives that attack remains to be seen.

170 I do believe that there a a significant element of “ Trump fatigue” among more neutral voters that got transferred, probably unjustly, to Republicans all over the country. Unengaged voters DO vote on personality, are notoriously feckless, and, get this, on personal comfort and discomfort. I am sure my viewpoint is not shared by many here but I think there’s an element of accuracy to it.

Posted by: tubal at November 04, 2026 02:01 PM (Gqar8)

171 He also cited the war and fuel prices. He said he doesn’t regret it and it had to be done. Agree, but what most voters were frustrated with was the lack of will to end it. The need to make a deal rather than sending Irans oil facilities into wreckage and letting others fill in the gaps in the oil market. The miscalculation that the mullahs and IRGC would capitulate when decades of war with these fanatics showed otherwise.
==
Its always easy to judge events after the fact. I am sure they thought they could bring this to a close before the elections. They couldn't. It needed to be done and the long term effect will make the oil supply more resilient and less apt to extortion by threatening the straight. This limits the cards in Iran's hand over time. Making the supply more resilient takes years. Which argued in favor of acting now, rather than wait until after the midterm. Waiting raises the issue of them maybe breaking out and getting a working deliverable nuke. It had to be done, and we have to pay the price of doing it. We may well lose the Country anyway due to politics. There are many different ways to get to Armageddon. It may be there is no way to avoid it.

Well, my (40 year old) child told me today that she saw Talerico on Jimmy Kimmel, and "he seemed like a really nice person who has the best interest of the country in him". All of her friends from high school were openly wearing their "Talerico" t-shirts on Facebook yesterday

Mind you, they were ALL raised Conservative in Texas. But they are easily swayed by what they see on social media, and none of them can be bothered to look beneath the surface or to seek out "the truth". Their truth is what they are spoonfed by people who only care about being liked by the cool kids.

And the cool kids are rarely the smartest ones in the room.

What the fuck are y'all talking about "endless war" in Iran? We've squished the most powerful Middle Eastern mohammedan military like a bug, without putting troops on the ground, decapitated their political leadership, and made them impotently expend a shitload of ordnance all in just a couple of months and only losing a tiny handful of troops.

Now if you wanted to label it something else, framing it as immoral or a strategic mistake, that's something else that you MAYBE could make a case for. But the commie cocksucker Donkey-speak Vietnam-nostalgic "endless war" rhetoric deserves to be shoved up Bruce Springsteen's syphilitic asshole.

You wanna talk "endless war"? How about 20 years in Iraq and Ashcanistan by the Bush/Obama/Biden brain trust with thousands of our troops dead. All because they were pussies who refused to do what was necessary, which was to flatten their countries and leave them in the rubble to rebuild by themselves after crushing the Baathists and Taliban.

I don't think there was a choice about attacking Iran. Nuclear weapon, terror funding and support. This situation was cultivated by Democrats and Europeans for decades. Trump is the first Western leader to actually do something about it. What I don't know is if it could have been delayed until after the mid-terms.

I don't think the average voter is very aware of the Iran war as such. They are aware of prices and the economy, amplified by the media. The war matters to the extent it has had an effect on these things.
