WASHINGTON (AP) -- President Donald Trump's administration is suspending tech giant Microsoft from a program to apply for green cards for workers who come to the U.S. to live and work using H-1B visas as it accuses the company of fraud.

Supporters of the Republican president have long argued that various programs like the one Vice President JD Vance accused Microsoft of abusing essentially empower American companies to recruit foreign workers for jobs that end up undercutting Americans. In a wide-ranging announcement Thursday, Vance and other top administration officials also called out universities over their use of J-1 visas for international students and information technology outsourcing firms.

The announcement came hours before Trump was scheduled to award the National Medal of Technology and Innovation to Microsoft CEO Satya Nadella, part of an event at which he is granting some of the nation's most prestigious science and technology awards to his tech billionaire allies.

Vance said the program from which Microsoft is being suspended requires companies to advertise jobs in America before applying to the Department of Labor to show they need to give a foreign worker a green card because of a lack of American workers.

"They'll put an advertisement in a small-town newspaper. They'll go out there and say that 'We have advertised for a position with our company, and nobody is responding to it.' And they will use that lack of response to then go and replace American workers with what is effectively foreign indentured servants," Vance said. "There has been no company in the United States, unfortunately, that has used this system more than Microsoft."


Microsoft is No. 5 among U.S. employers when it comes to using H-1B visas, according data from U.S. Citizenship and Immigration Services. Amazon is No. 1.

Um, the "system" he's referring to includes fraudulently "advertising" for positions where the advertisement is intended to never be seen. So your attempt to "correct the record" with another Democrat party attack line fails.

"Once you have a green card, you're no longer dependent on your employer for your immigration status -- you're a permanent resident who can change jobs and negotiate higher wages without fear."

These are just the figures for a single year:

Vance said Microsoft last year laid off 6,000 American workers but also obtained 6,300 H-1B visas and almost 3,000 green cards.

"If you do the math, for every worker that Microsoft laid off, they replaced that worker with one and a half foreign indentured servants," Vance said in a White House news conference announcing the decision. "Our message to Microsoft is: You're a great American company, but you've got to hire great American workers."

The H-1B program has long been a target of Trump supporters who say that the program undercuts American workers and is rife with abuse.

H-1B visas are meant for high-skilled jobs that are difficult to find American workers to fill. Technology companies are the biggest users, with nearly three-quarters of approvals going to workers from India.

Trump also moved to punish so-called universities for abusing the system. Foreigners come over to study at universities and work at jobs during and after their study. Trump wants colleges to pay $70,000 per student to cover the costs to the government of this pain in the ass.


And also, cut down on abuse -- I imagine that many foreigners are coming just to take a couple of credits per semester, using the program as a backdoor to scam what is effectively another H-1B visa.

Weird thing about Disney (especially in their Animated department) is that their most egregious acts weren't related to H1B1's. It was more a DEI path.

There's a great documentary out there that has probably been banned off the usual platforms where they show the difference between the "masters of animated features" and the people the brought in to replace them.

Disney terminated their most talented and decorated animators and brought into young, liberal (just out of school) kids to do their animation features...and you can see the difference in quality, message, and entertainment. Disney used to be the gold standard on this genre. Now, it's amateurish crap.

They briefly had the undisputed leadership position circa 2012, too. Pixar was still making good movies and John Lasseter was in charge of Disney animation, which got them Wreck-It Ralph and Frozen. That made a lot of ugly women at Disney very angry so they got rid of him and made all of the movies be about fat lesbians. They had Peak Woke 5 years before the rest of the world, which is not an innovation to brag about.

22 As a software manager I could see the abuse of the program in universities. When advertising software positions, approximately 90% of the applicants are Indian nationals in a CS Masters program applying for work, even if they are just in the first weeks of their program. The education VISA gets them into the US and in huge, organized masses they flood the job search sites looking for an employer to sponsor them and will drop out if they get lucky. Schools don't care as long as they get their tuition.

When an employer buys himself an indentured servant through the H1B slave trade, the H1B has an immediate upgrade from whatever shithole they came from to an advanced formerly high-trust society.

Then Microsoft expects that we spend a quarter million dollars for each of their Anchor Babies' K-12 education. That we grant them to bring over their village and put their parents on to our welfare system, that we subsidize the use of our parks, roads, courts; that we pay for their security, their medical bills, all in exchange that our culture is degraded, replaced and marginalized.

And what Microsoft gets is a crappier product that drives people to use Linux.

The education visa is the golden ticket because that visa makes the employee exempt from the employer's contribution to FICA. Built right in is a 15% advantage over an American citizen.

H1Bs, OTOH, do pay into FICA and unless there is a special agreement, that money is never realized unless they end up as US citizens by getting that foothold and a household full of anchor babies and their parents.

This arrangement is better because I'm not picking up the expense of educating and medicating foreigners so that H1B cheating organizations can cut their salary expense while raising the DEI and Diversity scores

DH's company hired some SA draftsmen because they couldn't find anyone here to do the work. So many people left AK during covid and didn't come back, so it is tricky finding workers. At any rate, they charged something like 1/5 what locals would be paid, but he had to check every line for accuracy because they weren't really all that good.

You get what you pay for.

This what someone I know was told. Their job as a Systems Analyst was being outsourced to India. They were not told they got two -three tech workers over for the price of one, but that was the word sub rosa throughout the company. This person was not the only one affected by this. And they ( Indian workers ) probably not as good as the people they replaced .

There was NEVER a shortage of engineers. The entire premise behind the H1B is, was, and always will be, a LIE. It was only ever about importing cheap labor, and on the Indian side it was about waging economic warfare against us by sending American money back to India in the form of remittances. Something like 12% of India's GDP is foreign remittances. These Indians are loyal to Modi, loyal to India, and engage in racist, nepotistic hiring practices to hire more and more indians and send more and more remittances back to India.

And here's the other fact: 95% of Indian "Engineers" can't even code. Not even with the help of AI - and this is why every major corporate software has gotten markedly WORSE over the last 20 years (while open source software has gotten markedly BETTER in that time) - because these Indian "engineers" can't code.


In short: FUCK INDIA. End the H1B and Deport them all. Don't even make them train their American replacements because they can't do the job anyways.

And kudos to the Trump Admin for hitting Microsoft and Adobe. Now hit Amazon and Google next.

There's reporting that says Microsoft filed 3,682 PERM applications after laying off the 6,000 and almost 1,000 of those applications were for positions to backfill the laid off workers.

This what someone I know was told. Their job as a Systems Analyst was being outsourced to India. They were not told they got two -three tech workers over for the price of one, but that was the word sub rosa throughout the company. This person was not the only one affected by this. And they ( Indian workers ) probably not as good as the people they replaced .

Like I said, I have never seen it work. The product is always shit. Maybe things are different in finance or desktop apps, but in the companies I have worked for the results were very bad.
I have seen IT support outsourced, so you call over to india to find out why your document won't open, but that's just customer service. Not programming. And that is very forgiving as if it takes the customer twice as long to get the right answer, no one notices.

They decided to send one of our advanced machines there and let the Indian team handle setting it up.

They kept giving updates that were good...a little too good.

So the Project Manager asked them, then demanded they, send a picture of the machine in the room setup for them...he got a picture of an empty room.

Now this wasn't them screwing up or stealing...the machine was actually stuck in customs outside of their control. They figured though they would get in trouble if they told the truth so they lied hoping they could keep the PM stalled until they actually got the machine.

This is very much the Indian model of working.

Its a lot more complicated than that. For example, during the cheap money low interest days, Big Tech was a casino where for very little money you can do all kinds of stupid things and hire staff at large money. There were many companies that should have never been started because the business model was very pie in the sky. That created an artificial demand for tech talent. Artificial in the sense that after mountains of code were written, the company would fail due to no clients or no real income stream and the investors getting tired of pumping in round after round of money.

So with expensive money, that demand for warm bodies has diminished. The "need" for H1Bs has dropped, but also the demand for workers too.

There is another side to all this. The reason US costs are high is because of the massive regulatory and tax burden. Someone mentioned FICA above, but there is so much more. I have known tech managers who love H1bs because they can't complain. (the managers say that publicly.) No discrimination, no sexual harassment, no 30 hours of legal fees and 3 months of paper trail to give them a bad review. And they are young, so it lowers insurance costs, etc.


I keep typing and deleting here. We have a work culture problem in US, and I think a lot of that comes from HR and Legal making it hard to fire people for being shit workers. H1bs solve that, but what I am saying is we have two problems.

- Shortage due to low wages, due to h1bs
- bad work culture
- high regulatory and tax burden making wages seem too high to compete.

I'd almost settle for that, but see if he can lower any part of it. If the DA is firm, take it...but there's probably room for either the fine and/or the ignition blocker to be lowered due to her being personally poor.

Successful delayed adjudication would end up with zero record aka dismissed charges/a lack of conviction - that would be an awesome outcome for her for the long term...

Our helpdesk team is in India. They're the team you ping if you need more AI tokens or if you need new access rights. All of their tasks are drop-dead, brain-dead simple.

Every time I need something like that, I ping people in the US who have rights to do things like that, but aren't on those teams. I only put in a helpdesk ticket as a last resort.

Every time I've dealt with helpdesk, it's the same experience. It takes at least two days for them to acknowledge your request. Then they stall at least three days by asking three word questions they could have answered for them if they read the title or description of the request. They "work" when we're asleep, so it's at least a 24 hour turnaround time when they ask stupid things like, "is this for you?" when you're asking for access to a machine.

Something that should take at most two minutes to click a box or run a script takes at least a work week. It's infuriating.

All true, but you don't want to take this to court b/c she does not want a permanent record.

DAs negotiate less when they know they have someone easily convictable on a charge, so you have to keep that in mind, too.

A good defense lawyer should still get some "compromise" from the DA to get the deal done, but it will be less if the DA knows he/she has a slam dunk case.

Apparently, US Military training flights are using different airspace. I've noticed for the first time plane formations flying over my location in Eastern PA. It's a flight of four Beechcraft Texan II aircraft doing close formation exercises....and a couple of them look a little apprehensive. Still, a nice little show from my patio.

Have her do exactly as the attorney suggests. They know the DA and the traditonal haggle, we don't. If you can dig a copy up, read Bargaining in the Shadow of Law about plea bargaining and how it is conducted. Still relevant today while the book was published in the late 60's.

I was reminded of this last weekend touring museums in Vicksburg, MS. The old court house building is loaded with all kinds of artifacts from around the Democrat's War. The clothes were very finely detailed. The furniture — all of it— is all intricate and detailed. Everything looked like someone spent serious time carving and shaping each piece, including picture frames. The children's tea cups were also very fine, detailed and demonstrated a lot of care in their making.

Now we get IKEA inspired designs or something that looks like it was shaped with a hatchet.

I worked with a software tester who was pretty knowledgeable, but was absolutely devoted to process in everything. If she had her way, 90% of the workday would have been mindlessly filling out documents describing what your were about to do or had done. She usually caught all of the big bugs and was a good resource to ask about nitty gritty details about a functional area. But hoo-boy, every time she missed a big bug, her way to show she really cared was to call for days and days worth of meetings to discuss all of the new processes she wanted to enact to ensure that never happened again. That was her way of "taking responsibility."

Then it was on the rest of us to tell her, "NO!" we're not adding three new daily meetings and seven new mandatory process templates.

This was over X box. Microsoft fired a bunch of citizens and then tried to backfill those fired jobs with H1Bs after they put an Indian dot as head of that division.

They and other big firms have been routinely cutting corners on H1B regulations regarding required job searches, etc. because up until now, they got away with it.

Pixy Misa though indicated the coming doom for Microsoft (and Adobe) but not in so many words.

Some folks used AI to reverse engineer Adobe products for photo editing, video editing, art, etc. Furthermore, it did it in Rust making it more resistant to certain hacking tricks. He is using it to create new languages and emulators almost routinely now.

AI removes the need for a lot of proprietary software as you can get the look and feel by having AI write it up for you from the APIs.

Doom is coming for proprietary software companies. ESR is talking about it openly.

Never make admissions until your attorney tells you to do so is the rule in criminal law. Always let your attorney do any communication because it prevents it from being used against the defendant in court.

I downloaded PhotoContact from pixy's post this a.m.

It is a very good Photoshop clone.
Much, much better than Gimp, and just as free.
It's missing AI features that PShop has but not much else.]

Haven't tried the other apps in their suite but I'm guessing they are just as good.

Adobe is cooked if this takes off.
