Jack Smith Appears to Have Lied to Congress About His Pretext for Hounding Trump About Missing Documents

Jack Smith seems to have, get this, lied to Congress about his pretext for opening up the criminal prosecution of Trump.

Just like the Russiagate Hoax.

New documents first obtained by the Daily Caller suggest former special counsel Jack Smith may have misled lawmakers and the public regarding the pretext for his investigation into President Donald Trump's retention of classified documents.

The documents reveal the National Archives' internal watchdog did not consider its February 2022 message to the Justice Department (DOJ) about Trump's possession of classified documents a criminal referral, contradicting Smith's account of how the case began. The National Archives and Records Administration (NARA) Office of Inspector General (OIG) case report from February 2022, obtained by Senate Judiciary Committee Chairman Chuck Grassley, notes that its message to the Justice Department was a referral, but not a criminal referral.

Smith had previously claimed in court filings that the investigation was "[p]rompted by NARA's discovery of classified documents in the 15 boxes in January 2022 and a criminal referral from NARA in February 2022."

So first he admitted he predicated opening the investigation on the NARA "referral."

But when it turned out that you can't open a criminal investigation based on a non-criminal "referral," he retconned his story and said it wasn't based on the NARA complaint.

"The OIG determined that this matter and the other relevant matters be classified as -R (referral to DOJ for their assessment and guidance, not the same as a criminal referral for prosecution which is only done for criminal investigations)," the report first made in 2022 and edited throughout 2023 to include such information notes.

FBI messages included in the documents show that the bureau first treated the missing documents complaint as a "spillage" issue with "little likelihood of being pursued as a criminal matter."

...

"Based on the allegations as set forth below and as supplemented by our virtual meeting, Matters 1, 2, and 3 are not matters for which PIN would open a criminal investigation at this time. If you develop additional evidence related to these allegations, especially as to the contents of the underlying documents or any evidence," it continued about the potential case.

...

In June 2023, Smith's office received a massive trove from NARA: 54 spreadsheets of text messages from inside Trump's orbit obtained from the White House custodian.

After obtaining the documents, senior attorney Thomas Windom was eavesdropping on the conversations between Trump and his top advisors in his first administration, including former Chief of Staff Mark Meadows, former Director of National Intelligence John Ratcliffe, former Deputy Chief of Staff Dan Scavino, first daughter Ivanka Trump, Vice President Mike Pence, and many others. It appears the review was done without first separating potentially privileged information.

Republican Senator Jack Haggerty has filed a bar complaint against sleazy Democrat operative Jack Smith.

Sen. Bill Hagerty, R-Tenn., filed a bar complaint against former Special Counsel Jack Smith on Wednesday for his "serious misconduct" in running the Biden-era Arctic Frost lawfare against Donald Trump and other Republicans.

Jack Smith is "a blatantly partisan actor and his prosecutorial misconduct damaged our constitutional order. He should never be able to practice law again," Hagerty wrote in an X post announcing his filing.

The complaint filed with the Tennessee Supreme Court's Board of Professional Responsibility takes aim at Smith's use of subpoenas to obtain the phone toll records of Hagerty and other Republican members of Congress. Not only did Smith and his team seek and obtain non-disclosure orders to prevent the phone companies from notifying the GOP officials that their records were being subpoenaed, but they also reportedly did not disclose to the court approving the NDOs that the subpoenas targeted members of Congress.

Marsha Blackburn has already sued him, and wants him criminally charged.

"I think that it would be a good thing for him to face prosecution," Blackburn told the John Solomon Reports podcast this week just hours before she filed her lawsuit alleging Smith was never lawfully a special counsel and therefore violated her rights as a member of Congress by collecting her phone records.

"I think it would be a good thing for him to have to reveal who all was in on this with him, and I think it would be a very good thing for him to have to return all these records to the people that he [has] victimized," she said.

15 Smith should be hung. What he did was treasonous. The man weaponized the federal government against Democrats political enemies. He abused and subverted the system along with co conspirators in an attempt to destroy a CiNC. Don’t forget he was also lining up the effort to go after Trumps financial supporters.

22 Part of this is, we keep trying to fix the system, alter the system or do this by the rules.

The dems (and commies in general) do not believe in any system or rules that do not allow them power. Their only concern is gaining power. They do not care if they break laws or pervert thevsystem as long as they either can get away with it or break the system enough to where they do not need the trappings of the system any more. It is the same with the UK and EU.

35 I still get hit on in weird ways. Even with my grandchildren. I still sadly still got it, I guess.

Last week we were at a park with the older two kids. Grandson was with me at a picnic table where we had lunch.

Our girlie, who is sadly just like me in looks and behavior, had to use the loo. She'd just used it at the house but needs to examine all restrooms like she's in the dept of health. My husband took her to the men's, which may change her attitude.

We'd already ignored a homeless man who waved the peace sign to us and I'd hoped that was it for weirdness.

Instead, in my dude's absence, a man (older than me and with what appeared to be paint brush bristles in his nostrils) came and sat across from me with a big ole hello. I informed him we were not with a group at the other end of the pavillion. He didn't move and there were plenty of empty spaces on the benches.

Grandson came at sat by me in case he was a bad man. Then a woman came and sat by me to protect her man.

Husband and girlie returned and I said to have a nice day. All I want is to be left alone. My husband says I am a magnet for crazy people without realizing the irony.

That's when the Collin County lawsuit was filed by a former grass roots gang (Texans for Lawsuit Reform, teamed with a dem group called The Lonestar Project)) that relied on them. The attorneys were from Houston: Brian Wice, Kent Schhaffer and Nicole LaBorde.

They told Collin County their fee would be under $30k. Their first invoice came in at owell over $300k. Collin County dropped the suit.

The Houston attorneys got it moved to Houston. con't

Tactics now, and ongoing for decades, are to invade, repopulate, take over voting blocs, and control without firing a shot. Raping and murder don't count in their playbook of taqiyya.

They've done this in Paris and London since the late '90's there were no go places in Paris the police would not enter.

They've not hid their agenda for the Ummah.

To destroy the West with our democracy, courts and laws...using both for their protection... while throwing the racist and islamophobe cards.

Sheep to a slaughter.

87 President Barack Obama updated federal and presidential record management by signing the Presidential and Federal Records Act Amendments of 2014 into law. However, he Presidential Records Act (PRA) itself has no criminal enforcement mechanism or "teeth."

Because the PRA lacks direct criminal penalties, the Justice Department can't prosecute a former official simply for violating that specific act.

Instead, the stark divergence in how Donald Trump and Joe Biden were treated legally came down to "cooperation versus obstruction," which triggered separate, highly punitive federal laws so said Jack Smith and the rest of the motley crew.

The investigation into Joe Biden—led by a Republican-appointed Special Counsel, Robert Hur—concluded that criminal charges were not warranted.

While Hur's report noted evidence that Biden had retained classified files from his vice presidency, the case lacked the core element required for criminal prosecution: intent to obstruct. In other words, they could not establish the mandatory mental state (mens rea) required to secure a conviction for obstruction of justice because Biden both played around & had dementia, imo. (Not a lawyer.)

88 Here's an interesting data point.

Some muzzie country ( I think the Saudis) are building a large mosque in .....Cuba.

So it appears they are entering the grand battle to take possession of that territory. Iran and Islam have seen S. America as ripe for conquest and are very active. This is part of the red/green alliance that is overlooked -- Socialism destroys a society and especially kills off the church, and then islam move in -- it's pre-ruined so they have fewer building to pull down and burn.

90 In the actual room, we saw claims debunked in real time. Today, viral clips show senators shouting about disbarment, while answers disproving their points were edited out. It's textbook gaslighting

Remember when bbcakes barr wrote his own summary of the mueller report where he lied about "no collusion", released that a month-ish prior to the actual report, so magats had a "credible" source to cite instead of actually reading and citing the actual report that maybe did actually find a bit of collusion?

They were trying to discredit a decent, honest and dedicated government employee who found evidence that Trump committed serious crimes and he was ready to prosecute him.

Smith came out of it with his integrity intact and with the possibility that he may yet actually prosecute Trump.

The people who own the media are Trump cronies. If the public sees Smith as credible it will endanger their place of power.

The peculiar form of psychological damage inflicted by having a billion dollars leads those people to prefer any eventuality where they remain rich and powerful, even if everyone else dies. Destroying the free press barely registers.

94 While it receives almost zero media coverage, because of course it doesn't, there really is a grand jury in Florida hearing testimony about the grand conspiracy to deprive Trump of his rights under color of law.

Just yesterday, Judge Aileen Cannon struck down a request from a group of fired FBI agents and analysts who all participated in the in the Mar A Lago raid to clarify whether or not they could testify about Vol. 2 of Jack Smith's idiotic report against Trump because they once again violated Florida law with their request. Judge Cannon is the same judge who threw Smith prosecution of Trump out and sealed his report in the first place because he was not legally hired.

>>Judge Cannon quickly strikes fired FBI agents' urgent plea for clarification from Mar-a-Lago docket

If there was a conspiracy case against Obama by the government the media would be spooging stories multiple times a day and everyone knows it. But it's Trump so they pretend it isn't happening. But it is. You just have to dig to find what's going on.

Smith's actions are already before a grand jury because he was part of the conspiracy.

Because I think the GOPe types hire the Democrat cheat machine on occasion to win primaries against honest opponents. And that is because the GOP consultant and donor class is well to the left of the average GOP voter. Used to have a fair number sprinkled around AOS as commenters but they have more or less left for other places now.

For example, Thune is cemented in office by big banks that run credit card operations in South Dakota. And Winred analysis indicates that Thune and a few other GOP types are also getting Smurfted donations to the extent in Thune's case, over a million bucks.

My best guess is that everyone in the Uniparty are already at the pillaging stage before they run out of town because they figure the Republic is done. All that is left is for the Dictator to arrive when the fiscal house of cards crashes world wide.

Trump is desperately trying to clear the decks by addressing foreign enemies, trying to grow faster than the debt, reshoring industries, rebuilding our defenses, and protecting this hemisphere for what is to come. And that upsets the Uniparty grifting operation and globo homo masters.
