Mass has an ass backwards approach to the defense of not guilty by reason of insanity. Something called the McHoul rule. Most states have some version of the old M'Naughten rule which requires the defendant to prove that they were insane (affirmative/justification defense) to such a degree that they could not know right from wrong. Hard test to pass. McHoul rule from the Model Penal Code and a stupid Mass Scotus decision, inverts the burden of proof. First, the defense has to meet relatively low burden of demonstrating past mental illness to the judge, then the STATE has the burden to show the defendant was sane enough at the time of the murders to comprehend the wrongness of their actions and were unable to control their actions. And the state has to prove that beyond a reasonable doubt.

In most M'Naughten states, the defendant has to prove insanity (because they admit they did the crime) using a clear and convincing standard of evidence that they were insane.

I blame Massachusetts' Scotus, their legislature, and their governors. That idiotic standard is designed to produce not guilty by reason of insanity for defendants that in most other states would be put in prison, even executed.

Kansas even has went further with a guilty but insane rule that should be adopted where even if you claim insanity, you get incarcerated in a mental hospital for a term rather than a short restful stay until released. Scotus blessed that statute about a decade or so ago.

They don't. I looked it up. Felony murder gives prosecution and defense twelve strikes each plus one more for each alternate juror seated.

Unlimited strikes for cause--that is where one side or the other motions that a particular juror should not be seated. Reasons are incapacity such as extreme age, blind, etc, barred by law like felons or non citizens, bias, or for bias. Usually for bias, the prosecutor is looking for those biased toward the defense and vice versa and the judge gets involved, sometimes even directly questioning the juror.

But a bias strike just because nurses are more liberal is not something a judge is likely to do. It is almost always based on the individual, not their sociology.

A 31 years old woman pleads to manslaughter in OD death of her infant.

Early 2022, locally living, she contacted emergency responders for her baby. He was found unresponsive. Reportedly, he was unsettled in the days & nights before, and having respiratory issues. An autopsy listed cause of death undetermined.

With her baby's death, her life became more unanchored. May 22, 2025, she called 911 wishing to provide more information & a statement on the death of her son. She had been using heroin prior, found a bag in the bed sheets she shared with the child & thought he may have placed it in his mouth. A toxicology screen of the child was performed & confirmed fentanyl was in his system.

She was charged with third-degree murder, involuntary manslaughter, endangering the welfare of children, endangering another person, possession of an instrument of crime, possession of a controlled substance and use of drug paraphernalia.

In court it was revealed she used heroin & had also been diagnosed with schizoaffective effective disorder since age 15.

41 to 96 months in state prison +. She wants to take advantage of prison training programs.

312 220 I haven't seen anyone questioning whether the prosecutor on this case actually applied himself in juror selection process. In Mass. the prosecutor, obviously, has the opportunity to question potential jurors (within reason). And, let's face it. It's pretty easy to pick out the bias on the jurors we've seen so far.

The prosecutor in Mass gets unlimited challenges to be approved by the Judge (who remarkably seemed to be a staight shooter)....so I wonder if he actually did his job. The prosecutor, also, gets a limited number of "see yah, wouldn't want to be yah" removals, and I wonder if he actually used those.

Finally, at the next trial I can almost guarantee it will be tried by a female prosecutor.

these were both in Philadelphia when I lived in town

the murder trial went long. in the end I did push a little, I felt the 1st degree charge was too rough. I was one of two white people on that jury. let me tell you those older people wanted the kid to get first degree!

I didn't push too hard but got a younger guy on my side and we got it down to manslaughter (it's a long story but it truly was an accident I think and the kid immediately turned himself in. the deceased was his friend)

a few months later the defendant and his mom saw me near City Hall and gave me a huge hug. he promised he was doing his best. I kinda hope he did!

Please stop. The problem is not nurses or teachers or women per se but AWFLs and their cohorts of color. Two out the three male jurors were just fine and dandy with the murders and apparently are not teachers nor nurses.

Our issues stem from pervasive media propaganda designed to destroy Christian faith (not Talafreako's version), destroy the family, and destroy morality. This has permeated our schools, our health professionals, and society in general.

It is a dangerous step to take, but I think as a society we've strayed too far away from it. We need to make it hard and limited to throw someone in an asylum against their will, but it has to be an option. And we need to be willing to find people guilty of things that they may not understand or have the mental capacity to defend.

I have never in my life yet heard a good defense for the "guilty but insane so we'll put them in a doctor's care" or the "we cannot try them, they are too crazy" argument like Iryna's killer. Over and over.
