The Morning Rant

This week's Art Thread choices have been focused on the glories of motherhood. Yes...there has been a theme! And that theme has been the importance and, actually, the superiority of women in our culture.

Why superiority? Because the unique ability of women is the bearing and rearing of children, and that is the most important thing that humans do. Is that controversial? I certainly hope not. But among the post-modern, anti-family, anti-civilization progressive movement in the West, the concept of "Woman," and the positive aspects of children have been subsumed in a deluge of feminism (all five waves!), increasingly hedonistic sexual mores, economic pressures that force women into the workforce, and recently the ascientific nonsense about transsexualism and gender.

Aside from the obvious goal of making all of humanity cogs in the infernal socialist machine, and destroying our individuality, these movements have diluted the importance of womanhood by making us interchangeable. Women in the workforce? Great, because they are just like men! Women who choose not to have children because of their careers or their desire to be unencumbered? Fantastic! Just like men! Women who choose sexual "freedom" by rejecting traditional social mores (and probably innate drives) for having children? Super! Men have been like that...forever! And most ridiculous but no less dangerous is the laughable idea that a man can become a woman: a bit of surgery, some hormones, a forgiving tailor, and poof!

But these are society-killing trends because of the decrease in the number of children being born in the West. It is civilizational suicide, and we are being replaced by fecund third-world denizens who have no interest in individuality, or for that matter Western Culture.

That is the demographic crisis, but there is a cultural and emotional crisis that is just as destructive. By degrading the position of "Woman" in our culture from the pinnacle, we have diluted the entire concept of womanhood. The glory of child-bearing and rearing has become a perceived burden...one that interferes with the hedonism of a post-modern world.

That link between mother and child -- that hopefully the art of the past four days has illuminated -- has been minimized and degraded and trivialized. It is the most powerful human imperative and emotion, and one that should be celebrated and honored. Instead, our current culture maligns it and laughs at it and stigmatizes women who embrace it. And even worse, culture now says that anyone can bear and raise children. Men? Sure! Why not? The popular definition of a woman is apparently anyone who wants to be one...can be one!

Except...men can never be mothers. Sure, there are many (maybe most?) men who are wonderful fathers and who partner with their wives to create fine children. But the position of "mother" is one that can only be filled by women, because they are designed, by God or evolution or whatever you wish to think, to nurture and defend children in ways that men simply cannot do, or even fathom.

That is as it should be, because the innocence of children needs a defender from the vagaries of the world, And women are simply better at it than men. And we don't need art to show us this! Our world has innumerable examples of the innate superiority of women as mothers. Just wander down to the nearest park and watch the moms.

Or even better, watch the mothers in your life and how they nurture and defend the innocent. Because that is what children are...innocents. And God (or nature) has endowed mothers with exactly the tools to be their defenders, in ways that the rest of us cannot.

Also included in this: women being relegated to baby incubators for primarily gay couples*. Our Left, who is s keen on insisting it is Christian traditionalists who most mirror their "Handmaid" fiction, are much more closely turning women into Handmaids with the new surrogacy boom. As if making poor women incubate babies for a big payout wasn't bad enough, they treat said babies as a product that can be trashed if it proves to be defective. I think what got her convicted was the fact that she sent him to the pond.

Of course, the kid (at 5) is already a competitive swimmer, so I don't see much risk there, but even that is beside the point.

The point is that we've deliberately created a society which sees ANY risk to children as something to be mitigated/condemned/avoided.

THAT is damaging people to an enormous degree, and we aren't even going to realize how badly for at least another generation.

I've had conversations with friends in the past where I say something about 'God's plan' or 'everything happens for a reason' and 'free will' to which he response with "Well, if my life has been according to God's will, then f*ck him. To me this is a category error. The issue is whether she has responsibility, or not, for her actions. You can be compassionate for SENTENCING. First you convict, the let the Judge, and possibly the governor sort the rest of it out. Compassion doesn't mean you are excused of responsibility. You still face the music. Not quite. Mass has a rather stupid state standard set in Commonwealth v. McHoul (1967) where once the burden of proof by showing the judge that a defense of not guilty by reason of insanity is reasonable, then the STATE has the burden of proof to show beyond a reasonable doubt that person was sane enough to comprehend their actions and decided to do it anyway in going forward with the murders at the time when the murders happened. Comes from the idiots at the Model Penal Code project.

M'Naughten std from the 1800's British law, on the other hand, requires a defendant has to prove insanity under the clear and convincing evidence std (highest in civil law) that the defendant was insane at the time of the murder. Most states follow some form of M'Naughten test. A few allow a guilty but insane verdict which commits the person to a mental hospital to serve out their sentence. Personally, I think this is the way.

I would not have convicted mom or even charged mom. But, a 5 year old is not allowed to go to a pool alone. Normally, you must be able to swim and be 9 in my area. And a pool has lifeguards - a pond doesn't.

So, a rethink on sending an older buddy (b/c he had siblings) or sending him where there was no possible water was probably a better idea...

I let my kids roam...but I always did it in stages to get neighbors used to it...

Doubling the number of people in the workforce effectively quashed wages as well. Now you see parents trying to work two jobs, and pay for day care at the same time.

Ellipsis, from legal observers on the trial, the prosecution put forth a case based on logic and facts while the jurors were already trying to browbeat other jurors apparently even before deliberations began by one juror (the anonymous female that supported the holdout). That again is juror misconduct. You cannot deliberate anything on the case before being formally charged with jury instructions and paying attention to the trial.

I suspect too that at least one maybe more were googling shit on the case outside of the evidence presented.

The jury's job is to apply their opinions of the evidence to the "law" as instructed by the judge.

If the judge instructs the jury, "You are to find the defendant not guilty if she wears a revealing dress," and the defendant one day wears a mini with a heavy drop top, then the jury is to apply that to the (obviously nonsensical) instruction and acquit.

MA also appears to have a broader "insanity defense" that is more favorable to the defense than the majority of other states. MA does not follow the classic "M'Naghten rule."

No, I'm not defending the jury verdict in this case. At least one of the jurors was an insane Karen that never should have been on the jury. (The one that gave that interview.) But without knowing the full jury instructions, I can't evaluate the other jurors as to whether they conceivably did their job or not.

But if the prosecution was so incompetent, you and I can't say for certain what people would do had they proven their case. We can surmise. We can have our opinion. Hell we can "know" in ourselves.

But it was the prosecutions job to present the compelling case.

Without it I can't safely blame anyone for acquitting short of them explicitly announcing nothing would ever change their mind. They didn't get the chance to have their mind changed.

I never ever claimed to be a Mother of the Year, but everything I might have 'lost' in having a houseful of kids with interesting age gaps and a full time job for decades - in terms of less money, time, sleep, leisure, travel, even some health - was well worth it - I gained a great deal as it made ME just a little better person - less judgmental, hopefully kinder - dealing with other people. (And the brats survived me and have thrived.)

So many people are exceptional people without being mothers or parents or guardians. I could barely manage as a teen, as the oldest of a bunch of street urchins with a working mother, and a kid who avoid school myself until an adult. I never pictured ever being able to cope well with more babies and/or kids. Took a lot of prayer, some instinct and very good examples, and also conviction I could be okay in THAT chosen 'career' too.

I hesitate on making that assumption because I did not see the trial (murder trials have no appeal to me, for one project, I read about one thousand or so death penalty case reports and their sentencing documents). A lot depends on witnesses presented, cross examination, and so on. And the prosecution faced at least a trio or more jurors that apparently had already made their minds up via media reports before trial started.

About the only thing is sure is that she did it and the husband had nothing to do with it.

And we are talking about the legal standard in Mass which is very lenient on insanity once the threshold is met.

Some states use a similar method on self defense claims btw, usually red states. Defendant has to meet a certain burden of proof to show that they can present a reasonable self defense claim, then the burden of proof flips to the prosecution to show that the defendant did not act in self defense.

Getting into justification and affirmative defenses is too complicated for gray box pontificating.

McHoul (1967) where once the burden of proof by showing the judge that a defense of not guilty by reason of insanity is reasonable, then the STATE has the burden of proof to show beyond a reasonable doubt that person was sane enough to comprehend their actions and decided to do it anyway in going forward with the murders at the time when the murders happened. Comes from the idiots at the Model Penal Code project.

M'Naughten std from the 1800's British law, on the other hand, requires a defendant has to prove insanity under the clear and convincing evidence std (highest in civil law) that the defendant was insane at the time of the murder. Most states follow some form of M'Naughten test. A few allow a guilty but insane verdict which commits the person to a mental hospital to serve out their sentence. Personally, I think this is the way.

Yup. It's insane that nurses were allowed on that jury. You never want medical professionals on a jury in a criminal case turning on medical evidence because the pros will always think they know better and use their own -- out of court -- knowledge and evidence.

You also don't want nurses on a jury where the defendant is a nurse. They will always feel solidarity or at least sympathy with fellow nurses.

Hell, they don't like cops on the jury -- or even family members of cops -- if a cop is testifying because those jurors will usually give fellow cops the benefit of the doubt.

But here, the jury included multiple fucking nurses in a case against a nurse that turned on medical evidence. In-fucking-sane. Judge should have struck them all.

Interestingly, it was originally written for television, and the thing is so holy in the minds of people that it barely gets any updates at all through the years (Friedkin's version changed some races and minor dialogue around it, but that's it).

I think that the quick teleplay writing process is betrayed in every subsequent version. The leaps of logic papered over on television just kind of stand out more in both major film versions.

Simple statements. Mass tilts toward defendants claiming insanity to a degree not present in most states. Most states tilt toward the prosecution where insanity defenses require the defendant to prove that they were insane with varying standards of proof.

At least one state doesn't allow insanity as a defense, I think Kansas is one such IRRC. There, the jury has the option of guilty but insane verdict which puts the defendant in a mental hospital to serve their sentence. Scotus upheld that law mebbe a decade ago but don't know if other states have followed.

Absolutely. But it was mostly due to the inherent superiority of the American system that produced this huge "middle class" in the first place. It took epic marshalling of resources to fight a two front war, produce the armaments to defend "democracy", a skilled labor force to produce millions of tons of ships, planes, boats, tanks, a Manhattan project, it's just incredible to see what was accomplished. They probably sent more material to the Soviet Union alone than most other countries output combined, alone.

And then in the next 50 years they threw it all away for us. It would not have been possible to maintain the market share on a global basis, but what "free trade" agreements and other jiggery-pokery global shit is a crime.

You can’t because it’s just TOO HARD. Maybe stay at home and eat. Maybe clip coupons and raid the bargain bin at the store. Maybe enlist the help of grandparents for babysitting. Live closer to work. Pass on the new car for a good used one, Do your own car maintenance. But doing things like that is simply TOO HARD.
