Lindsay Clancy Trial: Clancy's Lawyer Seems to Dox the Lone Holdout, Identifying Him as a Male In Favor of Conviction
Judge Sends Jury Home Until Tomorrow

Juror intimidation by other jurors? The judge seems to suggest that the jurors passed a note identifying the lone holdout by juror number:

The judge just instructed the jury "If there are any notes in the future... make sure we don't put down where everyone is numerically".

Well, the damage is done. And if it is wrong, going forward, it was wrong to have done in the first place.

Not only did the note indicate specifically ONE lone holdout and put a target on that juror's back, Reddington amplified it and said "the juror has been identified".

If that is not juror intimidation, I don't know what is.

Update: Clancy's lawyer wants to pause the trial so that he can appeal to the Massachusetts Supreme Court, to ask them to kick the lone holdout on the jury. The judge has already refused to exclude this juror.

Update: I think the judge was about to declare a mistrial, because the jury reported they were hopelessly deadlocked, but the c-sucker defense attorney demanded a pause in the trial so he could try to get the holdout excluded and get a win.

That tracks with my one jury experience some 30 years ago in California. I think it was 8:4 female:male. I and one other male were votes to convict because the state literally had video of the suspect wearing the stolen merchandise. One Oprah-wannbe lady made up this whole story in her mind about how the cop -- a young Hispanic dude -- and the suspect -- a young Hispanic woman -- were having an affair and she broke it off so he was out to get her. Absolutely not one word even suggesting anything like that was said in court but she was sure she was right.

66 There’s a list of all the prescriptions Clancy was given on her Wikipedia entry.

A few of antidepressants, a few anti-psychotics, and Ativan and Klonopin for anti-anxiety, I guess.

Clancy had prescriptions from four or five doctors all around the same time because she kept hopping around to a new one every time she felt suicidal.

If she was on that cocktail of drugs I don’t know how she functioned on a daily basis. The Ativan and Klonopin alone would have had her floating around without a care in the world, combined with the other meds she probably slept all of the time.

My one time on a jury it was 5/1 - civil case so we could have called it a day but we all wanted a unanimous verdict. We listened to the holdout's reasoning and, eventually, came to the conclusion that they were correct.

Amusingly, the ultimate outcome didn't change as a result as the holdout believed that both parties were to blame and we decided on a 50/50 split of culpability so no money changed hands. As would have been the case if we'd gone with a 5/1 verdict.

The sample period isn't predictive. Most existing data centers were minor incremental demand on highly urban areas.

Noodling on that, it seems he would be concerned about getting a similar jury in the future and some double jeopardy play on the first degree murder charge. If I understand correctly, options the jury had were: first degree, second degree, manslaughter, not guilty by reason of lack of criminal responsiblity, and plain old not guilty.

That was my first thought too. Did a bit of light digging on AI. If it to be believed, the National Center for State Courts study examined 453 cases from the late 90's that had ended in hung-jury mistrials. Of those:

32.0% were retried before a new jury.
2.4% were retried as bench trials.
31.8% were resolved through plea agreements.
21.6% were dismissed.

Among the cases that actually went to a second jury trial, the outcomes were:

69% conviction
19% acquittal
8% second hung jury
4% mistrial for reasons other than a hung jury.
