Jury Deadlocked and Can't Decide if It's a Crime for a Mother to Murder Her Children

I'm half-joking with that headline because I know the issue is whether she is guilty, or not guilty by reason of insanity. She did do some insane things --beyond bringing her children into the basement to strangle them one by one. She slashed her wrists and jumped out a window to kill herself or, perhaps, to pretend to kill herself.

On the other hand she both planned the crime -- googling how to murder children, and sending her husband out on an errand so she could kill them undisturbed -- and took actions after the murders to conceal them.

Just the News:

The judge in the Lindsay Clancy murder trial has ordered the jury to return to deliberations after it informed him that they could not reach a unanimous verdict.
"I brought you back out because I know that this was a long trial," the judge said. "Because of this, I'm going to ask you to go back out, keeping in mind all the instructions that I gave you, to go out and continue your deliberations."

The Clancy jury has told the court that it is deadlocked. As expected, Judge Sullivan is now sending them back. That is a common response to push a jury further. Not surprising given the intense divisions in the country, the jury appears to be manifesting those same divisions...
...The prosecution finished strongly with a narrative that emphasized the timeline and the actions taken by Clancy to carry out the murders. Some jurors may find the "not guilty" part of a "by reason of insanity" verdict to be too high a hurdle, given the death of three young children by strangulation...

Legal insanity is -- or is supposed to be -- a difficult thing to prove. To be legally insane and not culpable of a crime, you have to be so disturbed that you cannot tell right from wrong. An age-old way of disproving such inability to tell right from wrong is to show the criminal planned the crime in secret and then took steps to cover it up.

So we may be talking about the unofficial, non-legal "definition" of insanity, which is just that the criminal has some mental illness and so poof, all culpability is out the window. Almost all killers have something wrong in their brains, from having no moral compass at all, to having low impulse control, to being actual psychopaths. This is not supposed to excuse them, but juries can be persuaded to ignore the law if they feel sympathy for the murderer.

Or murderess -- women get the benefit of this fake definition of insanity more than men do.

So what do you think: Mistrial where the jury never delivers a verdict, in which case we have to do this all again, or let off the hook on the fake definition of inanity? I doubt the jurors in favor of conviction can persuade the pro-Lindsay jurors to flip. As you know, she's become quite the Misunderstood Hero to some.

1. The best witness for the defense was ... the husband. He would not shut up about what a "great mother" Lindsay was. Not joking. The woman murdered his kids and he was over-the-top sympathetic to her. I had little doubt that at least a few jurors would think "well, if he is giving her a pass, why shouldn't I?"

2. The crime was so heinous, so shocking to any rational-thinking person, that some people will look for ways to rationalize it. Otherwise, it's impossible to believe a mother could do this to her own kids. My dad (a defense lawyer) would say that sometimes it's easier to defend a truly horrific murder than a "normal" one.

3. Too many people think that a woman can't be blamed for anything, ever, no matter how heinous or evil or horrible or premeditated. It must always -- always -- be someone else's fault. I figured the odds were that at least one juror felt like this.

55 The woman is very clearly mentally disturbed. She has to be. I don’t know what else could have been done for her, though, besides longer inpatient care. She was seeing mental health providers. She was taking meds (though not very compliant here, and I don’t know how to feel about this as anti-depressants have pretty terrible side effects like suicidal ideation). She had help at home. She had support. I also struggle with the reports of her saying she only heard the voice once and acted on it. That seems just really not inline with typical psychotic episodes. It is not normally 0 to 100 like that. All that aside, I know post partum psychosis exists, and it is very, very scary. But it doesn’t mean agency is completely stripped in 99.9% of cases, and she has shown she had agency throughout this horrific act. She needs to be in jail. Forever. Or a very, very long time.

That being said, unless they did a tox screen and can show that she was wacked out of her gourd pharmaceutically, she's a f*cking murderer.

They've been given multiple charges to assign....murder, manslaughter......there's no excuse for this jury to not come back with something. She's guilty, admittedly. You just need to SENTENCE her.

That is a distinct possibility. If the jury finds her not guilty for being insane, the judge can still commit her to a state mental hospital. Jury instructions outlined that.

134 The woman is very clearly mentally disturbed. She has to be. I don’t know what else could have been done for her, though, besides longer inpatient care. She was seeing mental health providers. She was taking meds (though not very compliant here, and I don’t know how to feel about this as anti-depressants have pretty terrible side effects like suicidal ideation). She had help at home. She had support. I also struggle with the reports of her saying she only heard the voice once and acted on it. That seems just really not inline with typical psychotic episodes. It is not normally 0 to 100 like that. She needs to be in jail. Forever. Or a very, very long time.

This is my take. There are issues as to exactly what drugs she was taking -- if any -- and whether it was a truly genuine suicide attempt. She did end up paralyzed and was pretty much dead when they found her. But ... who knows how genuine it was?

But none of this absolves her of any guilt. Same thing with Chris Benoit. Both of them knew what they were doing, planned it out, and did it in a way that would avoid being caught or stopped. That's murder. Period.

I remember several years ago there was a school shooting or some other spree killing. It was relayed that the killer had been on a variety of meds. John Ringo had a tweet where he mentioned that his wife also struggled with mental health. She had decided that some of their neighbors ere pedophiles. She had calmly and rationally planned out, not just their murder, but how to dispose of the bodies. He caught her when she was purchasing some supplies for the plan, got her some more help.

BUT, that is still more sane than this.

Mother In Law won't get that gain, though...I guess she could benefit if her son wins, but that's pretty indirect.

Nah, I stand by the Mother-in-Law sticking by her even though son divorced her had to be powerful testimony to the jury about the mental state. She lost everything (the grandkids), but wasn't protecting anyone like a spouse or even former spouse would.

222 Juries can be really stupid. I served on one where the entire case was about compensation for an auto accident. We basically did accounting work, added up the costs associated and entered that as our verdict.

Some of the jurists couldn't agree on how much a damaged fender or some such shit was worth. Arguing over $50 or whatever.

I don't buy the post-partum psychosis when her baby was 8mo old. The extension of it going well past a few months has changed for women like this.

She was either mental to begin with & hid it, or used this diagnosis to help her actions.

Then, in her psychotic mental state, was able to plan how long it would take to kill those innocents while her husband was running errands for her highness.Premeditated murder.

Also, I think she jumped out of a 2nd floor window. That typically does not kill you. As a RN I know how to cut my wrists to kill myself yet I don't. She should have known a slash or two to her wrists would not do the job.

My question has always been how much did she hate her husband to do this? It's typically in the news as a revenge to the husband. She's guilty & at the very least should spend the rest of her days in prison.

Some of the jurists couldn't agree on how much a damaged fender or some such shit was worth. Arguing over $50 or whatever.

There are real issues about whether the doctors were being ignored or even set up. There was conflicted evidence at trial as to not only what meds she was taking, but whether she was taking them at all. There's also evidence she ignored the doctors' advice.

A friend of mine, his deranged ex-wife claimed abuse from him (false) to get a gofundme going, during their custody hearings. M'Naghten test goes back to 1850s Britain. It was indeed formulated to deal with the incredibly rare circumstance where someone commits a crime while being 100% unable to understand what he or she is doing. I like horror films, even though I flinch at every jump scare. My husband and I had a date night and went and watched Insidious. It had good themes about ending generational trauma, the love of a mom for her kid, and forgiving your parents. Good stuff, amid scares of women dealing with possession in their dreams and psychosis.

Why do we have several posts about Hollywood here each week? Why does TJM have a youtube channel about film? Because culture, and how it is affected via the entertainment its society consumes, matters.

I love the magic of movies. I despise what Hollywood has done to use it as a tool to destroy our society and make people hate themselves and our country. But I will still always love it.

I don't think Andrea Yates should be in prison. She was absolutely not in her right mind, and I had, and still do, compassion for her. She should be in a mental hospital, though. For the rest of her life.
There was another case, can't remember her name, where a neighbor heard a woman screaming in her back yard, " not the baby, Jesus, I can't kill the baby. I can't do it, you have to, I can't " etc, just absolutely hysterical and completely out of her mind, seeing things, etc. And she had killed her other children, but even the cops at the scene talked about how she was clearly and undeniably beyond crazy. They thought she was on Crack, she was so bad. She was not on anything but prescribed psych meds.
Those kinds of cases should be in mental hospitals. I don't think Clancy is one of those, but I'd be ok if she went to the nut house for life, and if she miraculously gets "cured", to prison.

Before social media the people who were like this were contained, quarantined, shamed, corrected, held in check by their communities. Now they get on TikTok with their insanity and gross antisocial behavior and receive adulation, affirmation, encouragement, admiration, "YASSS SLAY KWEEEN" and so forth. It's simple behavioral conditioning. So yes I believe we're getting more of it in addition to it being more visible.

383 I like horror films, even though I flinch at every jump scare. My husband and I had a date night and went and watched Insidious. It had good themes about ending generational trauma, the love of a mom for her kid, and forgiving your parents. Good stuff, amid scares of women dealing with possession in their dreams and psychosis.

Why do we have several posts about Hollywood here each week? Why does TJM have a youtube channel about film? Because culture, and how it is affected via the entertainment its society consumes, matters.

I love the magic of movies. I despise what Hollywood has done to use it as a tool to destroy our society and make people hate themselves and our country. But I will still always love it.

I don't doubt that at all. With newborns you are tired and your hormones are whacked for a couple of months.

The problem(s) is the age of the baby: 8mo. By then babies are at a wonderful age of sleeping all night, smiling, happy. Two toddler siblings add to the general chaos. I know because I had two boys 2yrs apart. Motherhood is rough. My husband traveled a lot & I managed and did not think of harming them, ever.

She was, from what I read,in a psych unit for a brief 5dy stay. Did she fake it was ok, she was just tired,will take her meds and get help, etc?

I saw psychotic people of all stripes in the ED: drugs, drunks, mental illness. Not all of these can "fake it." Or are homicidal. Or could premeditate a murder of anyone.

A RN would know how to "trick" the shrinks in the psych unit if needed. Correct answers. She checked herself in and then regretted it?

They certainly (I would hope) did not see any homocidal tendencies that could not be helped and discharge her.

403 Completely off topic: wife (what a treasure!) and I saw Coyote v Acme yesterday. Do yourself a favor and go see this movie. Okay, I am a boomer-lawyer-Looney Tunes fan, so I was predisposed to love the flick, but still. Very well done, with endless sly Looney Tunes jokes in the background. Looks great on the big screen. And nothing woke, which is amazing considering it was actually made about four years ago.

Saw it over the weekend with a theater full of people. It was great! As a boomer who saw many of the Warner cartoons in the movies in the 50', then on TV in the early 60's, it was a super enjoyable flick. Lots of inside jokes as well, if you were a Loony Tunes fan. My grown son, who grew up watching them on TV was laughing as much as me. Nice to see a movie that left you smiling as you were leaving the theater. The production was very much a labor of love for the people who made the original cartoons.
