Sefton: sefton at cutjibnewsletter.com | Jury Deadlocked and Can't Decide if It's a Crime for a Mother to Murder Her ChildrenI'm half-joking with that headline because I know the issue is whether she is guilty, or not guilty by reason of insanity. She did do some insane things --beyond bringing her children into the basement to strangle them one by one. She slashed her wrists and jumped out a window to kill herself or, perhaps, to pretend to kill herself. On the other hand she both planned the crime -- googling how to murder children, and sending her husband out on an errand so she could kill them undisturbed -- and took actions after the murders to conceal them. Just the News:
Legal insanity is -- or is supposed to be -- a difficult thing to prove. To be legally insane and not culpable of a crime, you have to be so disturbed that you cannot tell right from wrong. An age-old way of disproving such inability to tell right from wrong is to show the criminal planned the crime in secret and then took steps to cover it up. So we may be talking about the unofficial, non-legal "definition" of insanity, which is just that the criminal has some mental illness and so poof, all culpability is out the window. Almost all killers have something wrong in their brains, from having no moral compass at all, to having low impulse control, to being actual psychopaths. This is not supposed to excuse them, but juries can be persuaded to ignore the law if they feel sympathy for the murderer. Or murderess -- women get the benefit of this fake definition of insanity more than men do. So what do you think: Mistrial where the jury never delivers a verdict, in which case we have to do this all again, or let off the hook on the fake definition of inanity? I doubt the jurors in favor of conviction can persuade the pro-Lindsay jurors to flip. As you know, she's become quite the Misunderstood Hero to some.

I don't think women are going to like what the future holds if this woman walks from murdering her children, strangling them while face down so she couldn't see the horror, the terror, on their little faces.
She had a conversation with her husband, then went back to killing them. She googled how to kill them weeks prior. Personally, I think she needs to fry, but that's just me. Posted by: SMH at God's mercy at September 01, 2026 12:23 PM (Rln0i) 27
This is about certain people on the jury - certainly women - refusing to assign consequences to another woman.
That's it. End of story. Pack it up. We're done. Remove the rule of law, and most men will hang another man for things like stealing a horse. Killing their own kin. On and on. That's just not part of the female psyche. Posted by: Howdy at September 01, 2026 12:23 PM (ZEFzw) 28

The Blade, he saw this coming. Why? Very simple:
1. The best witness for the defense was ... the husband. He would not shut up about what a "great mother" Lindsay was. Not joking. The woman murdered his kids and he was over-the-top sympathetic to her. I had little doubt that at least a few jurors would think "well, if he is giving her a pass, why shouldn't I?" 2. The crime was so heinous, so shocking to any rational-thinking person, that some people will look for ways to rationalize it. Otherwise, it's impossible to believe a mother could do this to her own kids. My dad (a defense lawyer) would say that sometimes it's easier to defend a truly horrific murder than a "normal" one. 3. Too many people think that a woman can't be blamed for anything, ever, no matter how heinous or evil or horrible or premeditated. It must always -- always -- be someone else's fault. I figured the odds were that at least one juror felt like this. Posted by: Elric The Blade at September 01, 2026 12:25 PM (iFTx/) 38

The woman is very clearly mentally disturbed. She has to be. I don’t know what else could have been done for her, though, besides longer inpatient care. She was seeing mental health providers. She was taking meds (though not very compliant here, and I don’t know how to feel about this as anti-depressants have pretty terrible side effects like suicidal ideation). She had help at home. She had support. I also struggle with the reports of her saying she only heard the voice once and acted on it. That seems just really not inline with typical psychotic episodes. It is not normally 0 to 100 like that. All that aside, I know post partum psychosis exists, and it is very, very scary. But it doesn’t mean agency is completely stripped in 99.9% of cases, and she has shown she had agency throughout this horrific act. She needs to be in jail. Forever. Or a very, very long time.

The woman admitted to murdering her children. She was on a cocktail of drugs prescribed by her doctor, who in all intents and purposes, appears to be a quack.
That being said, unless they did a tox screen and can show that she was wacked out of her gourd pharmaceutically, she's a f*cking murderer. They've been given multiple charges to assign....murder, manslaughter......there's no excuse for this jury to not come back with something. She's guilty, admittedly. You just need to SENTENCE her. You can't do that, you're a detriment to society and should be put on your own trial. FFS. She's got the leftist women firmly in her corner, and MA is full of leftist women. I personally think she fully knew what she was doing. She deserves a life sentence. But I doubt she'll get the sentence she deserves in the end.

Juries have been in-process of becoming 'more lenient' with sentencing decisions for decades now, so we shouldn't be surprised. They didn't give Timothy McVeigh the death penalty - he had to request death by firing squad. Increasing liberalism / progressivism has 'refined' our 'tender sensibiities' to the more subtle nuances of 'Justicia' - which, imho, is a boatload of bullshittery. They killed 'em? Then to each in his/her turn. Why should they retain the right to keep breathing and enjoy the sunshine when their victims met a (probably) brutal end at their hands? ’Splain me, Lucy …

She needs to be in jail. Forever. Or a very, very long time.
Posted by: Piper at September 01, 2026 12:28 PM (ZdaMQ) ______ This is my take. Insanity should only be a defense to abating the sentence--it should not be part of the trial. Mercy to the criminal is cruelty to the victim. All SCOTUS opinions since 1900 on the 8th Amendment should be vacated. Posted by: People's Hippo Voice at September 01, 2026 12:46 PM (3cUTc) 174

They’ve been destroying children and families for decades. Their entire agenda is antithetical to life and hostile towards God. Last time they were in power they destroyed generations of children with their covid fraud. They go after the most vulnerable and corrupt everything they touch. “ He went on: “What comes out of a person is what defiles them. For it is from within, out of a person’s heart, that evil thoughts come—sexual immorality, theft, murder, adultery, greed, malice, deceit, lewdness, envy, slander, arrogance and folly. Also, comforting the same when the deliveries resulted in tragic outcomes. 2) She will, for the rest of her life be helpless and needing care and assistance to sustain her for her survival just like, her young children did. She will receive the care she needs - her children didn't fare so well.

She's insane. Criminally insane. Evil.
I don't buy the post-partum psychosis when her baby was 8mo old. The extension of it going well past a few months has changed for women like this. She was either mental to begin with & hid it, or used this diagnosis to help her actions. I don't buy it that she had three children, was apparently "normal" while looking like a bird of prey, then snapped. Planned. Researched. Then, in her psychotic mental state, was able to plan how long it would take to kill those innocents while her husband was running errands for her highness.Premeditated murder. Sure, sure, sure the med combinations skewed the diagnosis. Sure. However mental she is, she was able to think clearly enough to murder her own children and plan suicide. Also, I think she jumped out of a 2nd floor window. That typically does not kill you. As a RN I know how to cut my wrists to kill myself yet I don't. She should have known a slash or two to her wrists would not do the job. My question has always been how much did she hate her husband to do this? It's typically in the news as a revenge to the husband. She's guilty & at the very least should spend the rest of her days in prison. Juries can be really stupid. I served on one where the entire case was about compensation for an auto accident. We basically did accounting work, added up the costs associated and entered that as our verdict.
Some of the jurists couldn't agree on how much a damaged fender or some such shit was worth. Arguing over $50 or whatever. Miserable experience. I find two things highly ironic: 1) She was a labor and delivery nurse, helping to bring life into the world and sharing the joy of newborn babies with their moms & dads in the delivery room. Also, comforting the same when the deliveries resulted in tragic outcomes. 2) She will, for the rest of her life be helpless and needing care and assistance to sustain her for her survival just like, her young children did. She will receive the care she needs - her children didn't fare so well.

Especially for the first two years and/or when tantrums arrive. I think SCOTUS would go for this. Tantrums can cause mayhem for parents who don't have playrooms with baby gates for them or drink a glass of white whine while making dinner during the chaos (that's what I did vs murder while my dude was out of town). Our first grandgirlie, now age 5yrs, never had a single tantrum when it was normal. Now she's got some sort of (we hope) brief kindergarten psychosis of mood swings. Messing with her older brother til there is a battle. So far not harming herself or others. We assume she's tired from school, changes of her best friends going to other schools, and will adjust. Prison, mental hospital...as long as she's locked up for life, I'm fine with either.
She killed children. Her own children. Even if she was completely unable to withstand the compulsion of her depression or psychosis or whatever the fuck she's claiming, she should be taken out of society. I don't think Andrea Yates should be in prison. She was absolutely not in her right mind, and I had, and still do, compassion for her. She should be in a mental hospital, though. For the rest of her life. There was another case, can't remember her name, where a neighbor heard a woman screaming in her back yard, " not the baby, Jesus, I can't kill the baby. I can't do it, you have to, I can't " etc, just absolutely hysterical and completely out of her mind, seeing things, etc. And she had killed her other children, but even the cops at the scene talked about how she was clearly and undeniably beyond crazy. They thought she was on Crack, she was so bad. She was not on anything but prescribed psych meds. Those kinds of cases should be in mental hospitals. I don't think Clancy is one of those, but I'd be ok if she went to the nut house for life, and if she miraculously gets "cured", to prison. Posted by: LizLem at September 01, 2026 01:27 PM +++ Yes, we human beings are compelled by story. I'm rereading John Eldredge's book "Epic" which explains our need for story. I just don't care for stories where Stan wins. Because he doesn't. Posted by: Quarter Twenty at September 01, 2026 01:33 PM (2Ez/1) 384

Except that we aren't God. Also, Christ died while we were yet sinners. Honestly, like I said, the forgiveness is for *us*. Cutting off contact with someone who hasn't repented is valid, but not carrying the weight of that hurt is for our benefit. It's not like the unrepentant person is suffering while we suffer intensely from holding the anger/resentment/shame/whatever.

>>We simply have to accept the fact that some forms of mental illness are terminal.
Larry Niven wrote a story about this. If the individual could be rehabilitated, then that one would suicide after understanding what had happened; if not, then execution is appropriate. Damn it, need to find the name of the story now. Posted by: Nazdar at September 01, 2026 01:35 PM (NcvvS) 389
A real judge on the bench would have called the trial when the four bitches wore pink on the same day. Penalized them and call for a new jury and new trial.

If the state of Massachusetts lets her off, why not bring federal charges? By the way, the state of Massachusetts no longer has the death penalty, but the federal government does.

A major reason for punishment(justice) after a crime is deterrence.

M'Naghten test goes back to 1850s Britain. It was indeed formulated to deal with the incredibly rare circumstance where someone commits a crime while being 100% unable to understand what he or she is doing. Like a completely insane lunatic who thinks he's a milking minotaur or someone sleep-walking.

Obviously *we* can't forgive her since her crime wasn't against us. That would be the height of hubris. I was under the impression it was her husband, who was hurt by this that was under discussion. in your formulation, what happens to the person when the perpetrator has died without apologizing? Yes, this is true too. The two people who should have been most angry and upset at the murder of three defenseless kids instead were giving her a full pardon. I knew that would affect at least one member of the jury.
Posted by: Elric The Blade at September 01, 2026 12:32 PM (iFTx/) The reverse could also be true, if you distort your feelings about her then based on what you think now, you allow all the same types to blame her murders on you having hated her all along. It's a no win situation. Posted by: Oldcat at September 01, 2026 01:49 PM (uhVAy) 398
Having compassion doesn’t excuse the action. Posted by: nurse ratched at September 01, 2026 01:30 PM (W2Pud) ******** It is real, but not at 8mo postpartum as a common diagnosis. I don't doubt that at all. With newborns you are tired and your hormones are whacked for a couple of months. The problem(s) is the age of the baby: 8mo. By then babies are at a wonderful age of sleeping all night, smiling, happy. Two toddler siblings add to the general chaos. I know because I had two boys 2yrs apart. Motherhood is rough. My husband traveled a lot & I managed and did not think of harming them, ever. She was, from what I read,in a psych unit for a brief 5dy stay. Did she fake it was ok, she was just tired, will take her meds and get help, etc? I saw psychotic people of all stripes in the ED: drugs, drunks, mental illness. Not all of these can "fake it." Or are homicidal. Or could premeditate a murder of anyone. A RN would know how to "trick" the shrinks in the psych unit if needed. Correct answers. She checked herself in and then regretted it? They certainly (I would hope) did not see any homocidal tendencies that could not be helped and discharge her. Posted by: ChristyBlinkyTheGreat at September 01, 2026 01:52 PM (hzuYO) 399
128 As soon as the female jurors showed up to deliberations wearing matching pink outfits in solidarity with the pro-satan protesters outside the prosecutor should have lost his fucking mind and the judge should have either replaced those jurors with alternates or declared an immediate mistrial.

Completely off topic: wife (what a treasure!) and I saw Coyote v Acme yesterday. Do yourself a favor and go see this movie. Okay, I am a boomer-lawyer-Looney Tunes fan, so I was predisposed to love the flick, but still. Very well done, with endless sly Looney Tunes jokes in the background. Looks great on the big screen. And nothing woke, which is amazing considering it was actually made about four years ago.
Posted by: Martin Tell at September 01, 2026 12:38 PM (8SnSQ) Saw it over the weekend with a theater full of people. It was great! As a boomer who saw many of the Warner cartoons in the movies in the 50', then on TV in the early 60's, it was a super enjoyable flick. Lots of inside jokes as well, if you were a Loony Tunes fan. My grown son, who grew up watching them on TV was laughing as much as me. Nice to see a movie that left you smiling as you were leaving the theater. The production was very much a labor of love for the people who made the original cartoons.
