House Passes "Stop Insider Trading" Bill to Forbid Congressmen from Trading Individual Stocks (Using Insider Information);
Noted Lifelong Inside-Trader Nancy Pelosi Votes Against It

The bill would allow congresmen to own stocks as part of money markets or indexes -- big groups of stocks traded by managers without input from the customer.

They, and their families, will just be barred from buying and selling individual stocks, where a congressman could make a killing based on insider knowledge of coming government action that could boost, or crush, a specific company's valuation.

But congressmen have been permitted to use their insider information -- either granted to them by their position on a committee or tipped to them as a straight-up bribe by company officials seeking official favor -- for decades. That's why every other congressman is a millionaire in six years.

This bill would stop that.

Except for when Congress starts modifying the bill by adding exceptions.

House passes 'Stop Insider Trading Act' in bipartisan vote

Democrats who opposed the legislation argued that the bill does not go far enough because it prohibits members of Congress and their families from buying new individual stocks, but it doesn't prevent them from owning them.

The House of Representatives in a bipartisan vote on Wednesday passed the "Stop Insider Trading Act," which bans lawmakers and their families from trading individual stocks.

The bill passed in a 232-198 vote, with 13 Democrats supporting the legislation. A similar bill is in the Senate.

Democrats who opposed the bill argued that it does not go far enough because it prohibits members of Congress and their families from buying new individual stocks, but it doesn't prevent them from owning them.

"For too long, Americans struggling to make ends meet have watched as lawmakers have entered office just to leave as multi-millionaires," House Speaker Mike Johnson said in a statement. "This type of behavior is unacceptable and diminishes the American people's trust in this institution.

Nancy Pelosi has been a virulent opponent of such a ban in the past. That's because she's become one of the richest women of the country while "serving" in Congress.

The Democrats voted against this bill with the pretextual excuse "we want the bill to go farther" but one suspects they don't want the bill at all. Democrats have shown that they go into politics to plunder money from the public.

When Trump accused her of insider trading last year, Nancy Pelosi defended herself PERFECTLY by saying it's not her who trades stocks, it's her husband, and the money he makes goes into her accounts, so everything's on the level because she is not her husband.

And she certainly wouldn't tell her husband which stocks to buy up or dump.

It is hard to make the case you should be bound by something someone else does. But if it holds up then you just move to the next relative, or family held trust in line.

I still think their assets should be put in a government held trust which returns an amount equal to the increase in GDP minus the inflation rate. Then all of the incentives would be correct.

Supreme Court already ruled on the issue. We just need Congress to follow laws that fall upon everyone else. "US Supreme Court ruled unanimously to uphold an insider trading conviction of an individual (tippee) who traded while aware of material non-public information (MNPI) received from a friend (tipper) who did not receive a financial benefit for providing the tip. Salman v. United States, No. 15-628, 2016 WL 7078448 (U.S. Dec. 6, 2016). The ruling, written by Justice Samuel Alito, settles a split of authority between the US Court of Appeals for the Second and Ninth Circuits regarding whether a tipper receives a “personal benefit” for purposes of establishing insider trading liability by simply conveying MNPI to a family member or friend."

It’s actually not that hard to prove. Because there’s always a paper trail or pattern that is highly suspicious.

And in the case of congess, it will be easy to prove insider trading when Congresscum X finds out on Monday that there’s gonna be a new regulation that hugely benefits Company Y, and on Wednesday X makes a big buy in Y.

That’s why congress is so afraid of this.

So, call their bluff and be very, very loud about calling their bluff. Make it illegal to own stocks when serving as a House or Senate representative. Make full divestiture a condition of holding national office. I have no problem with that. And, when the hold outs come back with another condition, THEN go full press on showing the public what's going on. Use real numbers of actual accounts via public filings and put some faces on the abuse.

Back when I was at Big Law, it was impossible to trade individual stocks because the firm was always working on some big merger or litigation that wasn’t public. But I would know about it. If I was able to trade on this info, I woulda made millions of dollars a year. Easy.

Congress has access to even more info than I did, but they are free to trade on it. Unreal.

This. See my post above. I forget exactly what the firm’s rules were, but they were so restrictive it made trading individual stocks almost impossible. And they did not fuck around. The last thing they wanted was some news report on how one of their employees traded on attorney-client info. You broke the rules, you were gone. So nobody did. They all invested in managed funds and ETFs.
