To expand a bit on TJM's comments, the rule of 50 is if an incumbent (or someone well known like Cooper as a quasi incumbent is in the race), is drawing less than 50 percent, then the race is winnable for the opponent. A known quantity has their information exposed at the get go, the challenger has their information revealed bit by bit.

Congress critters travel quite a bit and yes, technically they could bring suit if their comms were intercepted in their home states.
