Panel of Hawiian Appeals Court Judges Ignores Supreme Court Rulings and Invalidates Alabama's 7-0 Gerrymander, Claiming "Muh Racism"

The Supreme Court did not forbid all judicial scrutiny of gerrymandered districts. However, it made it very clear that only real, demonstrable racism was cause to intervene in a state's legislative maps, and that Democrat Party bullshit about "dilution of minority voting power" wasn't enough. "Republicans are trying to reduce Democrat congressional power and that's racist, in a way, if you think about it" wasn't enough.

An appeals court decided they're The Real Judges Here and ignored the Supreme Court ruling, citing the precedent of Muh Racism v. Muh Midterms.


Alabama Republicans sought to use a previously blocked 2023 congressional map following the Supreme Court's recent ruling curbing the use of race in the drawing of electoral districts that helped minority communities increase their representation in Congress. Under that map, Republicans were slated to gain one electoral seat by erasing a Black-majority seat held by Democrats in the southeastern part of the state.

However, the three-judge panel said Republicans must continue to use a map that has two majority-Black districts where Democrats hold significant advantages.

"Ultimately, we cannot see our way clear to requiring Alabamians to cast their votes in the 2026 elections under a districting plan tainted by intentional race-based discrimination," the federal judges wrote. "We again cannot understand the 2023 Plan as anything other than intentionally discriminatory."


Alabama Attorney General Steve Marshall said he would appeal the ruling to the Supreme Court.

"Know this: In my mind, it is not a matter of whether we win this case, only when," Marshall said.

It is unclear why Alabama officials should comply with the panel's order, given that it is in direct conflict with two rulings from the Supreme Court, a higher authority, and the Voting Rights Act. How can the judges licitly rule that Alabama must use districts that are unconstitutional and violative of the Voting Rights Act from being drawn specifically based on how many black voters there are within the limits? The U.S. Supreme Court resoundingly ruled against such gerrymandering both in Louisiana v. Callais and Allen v. Caster.

As a matter of fact, Allen v. Caster specifically involved Alabama and its black-majority districts. The Voting Rights Act forbids the districts, requiring a redrawing of the map, according to the Supreme Court ruling. Therefore, how can a federal judge panel randomly decide to rule the opposite and demand Alabama officials comply?

The panel of judges claimed that not using the map with the two race-based districts was discriminatory, which is of course nonsense, because drawing congressional maps based on the skin color of voters is inherently discriminatory. And again, the panel's claim directly violates two Supreme Court rulings and the Voting Rights Act.

This is like the supposedly 'Independent Agencies' in the administration. There are not supposed to be independent parts of the Federal Government... they belong to one of the three branches, period.

But there is no mechanism whereby the Supreme Court can actually Fire a Judge, or demote a Judge, for ignoring them. Congress should have, long ago, created such a mechanism, but they gave up creating rules for the Courts in the early 1900s.

It's still going on, even. We have the smallest federal employment in raw numbers since the 60s.

The comparison between the administrative state and the judiciary isn't really strong. The administrative state could always have been fired. No executive would do it, though. The judiciary, though, is protected from termination except through Congress and impeachment (or statute eliminating districts, which is technically possible), and impeachment is a joke. Porsche is actually much more reasonable, in part because there are relatively limited options/configurations. For true exotics, you can pretty much choose the color you want for each swatch of color in the car, plus you have 10x more options for exotic materials like carbon fiber.

Porsche at least has the option prices on its configurator. Ferrari, Lambo, Aston, Bentley, Rollie, etc do NOT.

When I was stationed on Oahu in the late 80's, I had a Native Hawaiian on my Paint Ball Team. Family owned a ranch on North Shore.

Invited me to a 'Locals' bar... and when I walked in alone, it was like the stranger walked into the Old West bar... place went silent... until my friend spotted me, walked up and greeted me... then everything was AOK.

And weirdly enough, I went to that bar a few times after that, and never had a problem.

It's tribal, but if one of the tribe vouches for you... you're OK.

One of the funnier little sub narratives is that CA and VA put the question to their voters which makes their redistricting more valid than TX which did not.

Why did CA and VA have to put it to voters?

Because both CA and VA established processes to make redistricting "non-partisan" and by a separate body...recently, where the original process was just to have things done by the legislatures.

So, both states had to ask their voters to undo the systems that they had recently set up in order to redraw.

My toothbrush uses 1/2AAA (2x) LiNH and my project later will be to add another tube next to it to hold 2x AAA batteries since I can not find 1/2 AAA at decent price and non-chinese brand.

But seriously, a $100 toothbrush should not need to be replaced in 3 years because the batteries died. same with cars.

Chinese is for family style and bringing teen boys. I admit we order a dish per person at my favorite restaurant, and the girls eat 1/2 of one...and the boys eat 1 1/2 of one...so it all works out (our Chinese plate has a great lazy susan on a circular table). Means you can also order a Crispy Beef and not feel awful after from so much fry b/c you can order and eat a nonfried dish, too...yes, I love Crispy Beef, but can't have more than a few bites...

We in Nevada have a "none of these candidates" option on a lot of races. I've never seen it win so I don't know what happens.

Early ballot collection is 12% less Democrat than it was in 2022. 11% more Republican than 2022. Same % of Indies as 2022.

Newsom won the 2022 jungle primary with 55% of the vote. Democrats currently have 54% of returned ballots in 2026.

236 The "war of attrition/stay within the system/hey we're winning some stuff" approach is understandable, but I fear does not take account of the underlying reality.

Which is that the "other side/Dems/'liberals'/progressives", despite their variations, essentially are now totalitarian bots without standards or a shred of the mindset that made a society more/less based on rule of law possible (a rarity in human history).

Not to mention the more fundamental issue of the constitutional collapse in which the judiciary wields legislative and executive power (usurps) without consequence, which long long predates the current day. Congress has long since surrendered, current administration is appeasing when it comes to this stuff. From the very first lawless ridiculous order from the district in WA in the first weeks of the first term ("Muslim ban").

Repudiating in cases where a court is completely out of line, including by their own rules (many examples ongoing) *is* preserving, or rather attempting to restore, the constitutional system. But it requires weathering a few weeks of (typical) unhinged hysteria. Which the Legal Cult simply cannot stomach.
