That means: Did you check the carrier’s safety record? Was the carrier’s FMCSA data available to you? Did the data show elevated crash rates, conditional safety ratings, high out-of-service percentages, or prior enforcement history? Did you have a documented process for evaluating carrier safety? Or did you book the cheapest truck and move on?There is going to be a great deal of confusion in the short term. There is concern that legitimate small carriers will have difficulty booking loads if brokers are scared of not hiring highly-vetted, large-scale carriers. Meanwhile, brokers have generally only had nominal amounts of liability insurance, so they’ll be scrambling in coming weeks to obtain new liability coverage from insurance providers who will also need to sort out just what it is they’ll be insuring. Amidst all this chaos I see a great opportunity for some entity to create a ratings agency for trucking companies. I’ve spent much of my career looking at business reports from Dunn & Bradstreet and credit ratings from Moody’s and the like. If I were an executive at one of those companies, I’d already be organizing a team to create a trucking carrier credit rating system. It would be a one-stop website where trucking companies could upload their organizational and operating histories, and where brokers could subscribe to verify that a carrier meets the broker’s risk appetite. If the big credit agencies aren’t going to create such a clearinghouse, there is an entrepreneurial opportunity waiting there for some tech bro (or gal) with an understanding of the trucking business. Despite the short-term upheaval, this Supreme Court ruling is welcome, since the old system had incentivized the explosion of illegitimate trucking companies using unqualified foreign drivers.

This is a great ruling.
Sadly, serious damage has been done. Legitimate carriers and self-employed were run out of the business by these lawless companies. It will take a long time for the industry to recover. (Likely with massive companies instead of independent truckers.) I have to guess that was part of the plan. Small companies can't be controlled as well as large ones. (That's why COVID was used to kill off as many small businesses as well.) Yet. Lower courts absolutely will look at this ruling (9-0!) and deal with other brokers accordingly. Like in real estate and insurance. It only started with trucking because the abuses were so egregious and deadly, but it is going to trickle elsewhere. I'm fine with this ruling, but it will almost certainly make shipping more expensive, and I know who's going to pay for that. We've essentially been trading safety and quality for low price in many, many ways for a long while now. I'd rather have things be less affordable and have American manufacturing, for example. But I do wonder to what extent the public is willing to have less to achieve these kinds of goals.

I had an Army issued CDL and 30,000 accident free miles. Drivers badge. I hated it when I was in. I was tasked to every driver job that came down the pipe. Driving some bussload of assholes to parade duty or whatever.
I was told when I got out that all I needed to do was go to the DMV and present the paperwork with my licence and I'd get my CDL with all my endorsements. It was a federal CDL. I go the DMV after being offered a local dirt route driving tripples in the evening and hand my shit over. Girl slides me a book and says study this and schedual a test. Bring your truck. --------- My sense reading a couple of articles on this is that trucking used to be a high trust industry where people did not worry about lots of regulations. But then we imported the third world from low trust societies and so now high trust industries are overrun with corruption and fraud, and so all middlemen will end being held to higher standards because the days of self-policing are over as long as Somali pirates are in our midst. Rates, who could enter the job, unionized drivers (Teamsters) etc. Same as the airlines. Deregulation made it cheaper for truckers with non unionized firms springing up to take business from the old unionized firms. I think Yellow Freight was the last to fall of those. But the relatively high trust environment continued as long as Americans were the primary drivers, brokers, etc. Open borders, endless 'refugee' streams, etc. broke that model as it has for other fields. Same as if you substitute yogurt in cooking for other fat (usually seed oils nowadays) binders like in salad dressings. The fat is the binder for the sugar whether in cheese or butter and allows it to be spread easily versus the granular or powdery nature of sugar (confectioners versus processed/raw sugar granules). My only worry about this is that it sounds like it might make it impossible for legit startups to enter the market in any sustainable way. I reason that 'brokered contracts' might be how small LLCs get enough customer history and satisfaction to become medium companies.
But... Somethin's gotta be done. And this is less horrible than many options out there, putting the onus on the (horrible-themselves) middlemen to do due dilligence as the customer is trusting them to do. Dormant commerce clause allows states to regulate even if a federal law exists as long as the state law does not contradict the federal law (see Gibbons v. Ogden and most recently in National Pork Producers v. Ross in 2023). Congress has to be explicit under the Commerce clause of excluding any state role in regulating interstate commerce for the supremacy clause to kick in. Forget the acronym, but brokers were raising this statute as defense claiming that it did not allow lawsuits in state courts (or federal courts using diversity jurisdiction) for liability. The federal law precluded states from applying liability laws to the brokers by the supremacy clause and the commerce clause. So it was an interpretation of a federal law as to whether it actually extended and protected brokers from liability. Scotus interpreted the act that it does not preclude states from making brokers liable as any broker protections were NOT clearly stated in the congressional act. So states can regulate. whig may likely know the answer here, but this is the sort of ruling, as presented in the "press", that seems like the sort of policy-making courts have no business doing.
Was the court applying existing law in a straight-forward manner (the courts' only legitimate function)? Or were they legislating in an area where actual legislatures have failed to do their jobs? And aside from this, as noted by one rando commenter elsewhere I just saw, it's fairly troubling that the massive (expensive, and like all regulatory structures a burden) law enforcement and regulatory superstructure that exists to enforce standards apparently didn't do its job here, so it's left to the shake-down, er, liability bar to do it. I reinstalled it a few months ago and was looking through mods to try. Weapon mods are always a must because Bethesda's grasp of guns is... questionable at best. That is why electing judges is probably a more truthful way than appointing them for a life term and expecting them to be devoid of political impulses. Same with juries, etc. What has been masked in the US for a long time is that a relatively homogeneous society that wanted the same things, etc. has been derailed by dividing society up into to warring factions by immigration, racial and sex based claims, etc. The older divisions in the US were largely economic, the new ones include identity issues that simply cannot be bridged by courts. Let's not overstate it. SCOTUS just ruled that the brokers don't have magic immunity from liability. All it means is that they can't have suits tossed at the get-go. What happens next is TBD, and no particular result is dictated by this ruling, which just says the suits can go forward. Maybe plaintiffs will make persuasive arguments, and maybe they won't.
