Virginia Supreme Court tosses Dem-backed redistricting map, upending expected 10--1 edge


Republicans in Virginia celebrate a circuit court ruling that the Democrat-led redistricting map was unconstitutional. Salena Zito, a Pittsburgh-based columnist, joined 'Fox & Friends First' to react.

The Virginia Supreme Court on Friday invalidated a new, voter-approved redistricting map, delivering a significant victory for Republicans in the state ahead of the fast-approaching 2026 midterm elections.

"We hold that the legislative process employed to advance this proposal violated Article XII, Section 1 of the Constitution of Virginia," the Virginia Supreme Court said in the ruling. "This constitutional violation incurably taints the resulting referendum vote and nullifies its legal efficacy."

The Virginia Supreme Court heard oral arguments last month over the newly passed congressional map, which voters in the state approved by a narrow 51% to 49% margin.

The ballot measure would have given the Democrat-controlled Virginia legislature -- rather than the state's current nonpartisan commission -- temporary redistricting power through 2030.

It was also expected to yield a 10-1 advantage for Democrats in Virginia's congressional delegation, up from their current 6-5 edge.

This is why I've been saying the 2026 election was actually rather low stakes.

In terms of policy, there'd be almost no change with Dems taking the House (they have no chance of taking the Senate).

We'd get impeachment theater that goes nowhere for 2 years and pretty much nothing else (ICE being fully funded for enforcement through 2028 and the rest of DHS going to be also fully funded like that with the new reconciliation bill will help that along).

100 This is why I've been saying the 2026 election was actually rather low stakes.

In terms of policy, there'd be almost no change with Dems taking the House (they have no chance of taking the Senate).

We'd get impeachment theater that goes nowhere for 2 years and pretty much nothing else (ICE being fully funded for enforcement through 2028 and the rest of DHS going to be also fully funded like that with the new reconciliation bill will help that along).

It matters. Mostly regular procedure in 2026 in budgeting. Doing that again this biennial term means it becomes reestablished more and returns more power to the members than leadership staffs.

It also means fewer and fewer McConnell acolytes in the Senate. Cornyn is likely gone, Cassidy appears to be so. Mitch gone. And Murcow is facing the electorate in 2028, possibly without Ranked Choice voting to save her ass this time.

The massive fraud investigations must continue and that is the heart of corruption that is bankrupting the US. Keeping the Senate while neutering GOPe types helps make sure of that.

Wrong - they have to pass it again AFTER next year's election, so in 2028 after the new folks are seated. There must be an intervening election and the court found that hasn't yet for a 2nd vote to happen yet.

So, 2028. Then the voters vote again.

Gives Dems time to fix any other issues with the current amendment and just revote one that will pass all SC muster in this term, when it's an easy pass.

The Senate is not in play at all.

Dems would have to win NC (50/50), ME ( Platner? HA!), Texas (HA!), and one other, all while holding onto GA (Fulton is being investigated so Ossoff is a darkhorse for losing), and MI (nominating El-Sayed makes it a toss up at least).

And the DOJ won't slow down because of anything Congress does, so real investigations continue no matter what.

They didn't start panicking last year and pushing this til other states had started the process changing their electoral districts (remember, VA voters had voted in a "we are gonna have fair distrcits" amendment, just back in 2020). By then, VA had started early voting for the 2025 state elections b/c thanks to Ds, we have one of the earliest and longest voting period for elections.

AKA - they got what was coming to them by the changes to elections they themselves made.

It either started with Biden's DOJ suing Texas over its maps or Hochul doing the mid-decade redistricting a couple of years ago.

What really set off the rush was Newsom making Texas' new map about himself which led to the reprisals and escalations. The left could have stopped when Indiana stopped their process, but VA just went full lobster.

And now the state level GOPs have an example of what happens when they appease the left on the issue and VA doesn't have a new map.

Court majority based its ruling on the fact that voting had already begun so there could not be the intervening election required by the VA Constitution. There, one proposes an amendment to the Constitution, has to wait an general election before then allowing the public to vote upon it. VA Dems pushed through the referendum last fall DURING the voting for VA state general election so there could not be another intervening general election before passage.

The Dems claimed that it was okay because the 2025 general election day for counting votes had not yet occurred when the special session voted the referendum--thus they would not have to wait until 2027 general election for the referendum to pass. It could be done now.

Since the referendum was unconstitutional on that basis alone, no need to get into other issues.

Also another factor that they ignored. Virginia has always had a very uneasy balance between Northern VA (Fairfax, Arlington, etc) and the rest of the state. For decades it's been an issue. Having something like this referendum shut out all of the rest of the state creates serious stress to that balance. Carpetbaggers don't appreciate it at all.

Virginia’s growth rate has significantly slowed. NOVA is losing population and the gains are being made outside Fairfax and Arlington. One of the main factors maintaining population are illegal immigrants who don’t legally vote.

There’s already scrutiny of the governors race and the referendum vote integrity.

According to the state constitution, any amendment to same must be passed by two successive GAs with an election in between, before going to the voters.

This amendment was raised during a special session at the end of Youngkin's term, that was raised to reconcile the budget.
That's significant, because any business raised in a session NOT having to do with the reason for which it was convened must pass by a supermajority.

A week before the election of spamburglar, the redistricting passed on a simple majority is special session.

They counted that as first GA passage.

A couple months later, when spam and the new GA were sworn in, they immediately passed it again, right before early voting on it began--which didn't meet 90-day notice for special elections.

The whole thing was crap that should be burned in a fire.

I think it was because SCOVA doesn't rule until after elections as a matter of course and precedent. It views an election as part of the legislative process where it's inappropriate to get involved. Same reasoning that the Court can't rule a bill unconstitutional before it's signed into law.

Youngkin did a Schwarzenegger. Arnold ran as a reformer in California but could not get any state legislative seats and win the referendums to get any of his policies in place. So he sat on his ass and let the Dems run the state in his place after his first defeats. Youngkin did something similar after he lost big in the state legislative races in 2023. Last two years were mainly cruising.

VA GOP has been dysfunctional for a long time like some other places like GA GOP or even Indiana. They win races by diminishing margins but keep the corporate spice flowing until the GOP loses control of the state. They refuse to do anything for their base voters, only donors. So the party base shrinks over time to indifference to the state GOP rather than something to vote for.

It shocks me they weren't allowing that. You want something to get there, eventually, just route it via USPS.

I had a piece of hardware that came out of Canada several years ago. Let's call it a "java encoder." It shipped from the source via UPS, where it was routed to the states, then flagged by Customs and never delivered. It was confiscated.

I reached out to the shipper and advised the issue and they sent another one, via Canadian Post which transferred to USPS. I received it 7 days later.

The rest of the state GOPs are not as feckless as West Coast GOPe. GOPe in WA, OR, and CA are basically Stockholm syndrome that sympathize with their Dem oppressors.

Most of this dysfunction is driven by the big party donors that want things that the base voters don't want. Like open borders for cheap labor, government spending fraud to boost real estate development prices and large retailers, free trade so that the GOPe types can sell out American assets or outsource labor to places like India, endless corporate tax breaks, etc.

And those donors are embedded in state political organizations like ticks--they make sure the state parties obey their interests--the state parties in turn then make sure their package of political consultants for candidates (complete finance, campaign, and legal compliance teams) do what the big donors want.

This has flown under the radar but Brad Little, governor of Idaho, is in trouble because a recording of his meeting with Big Ag in his state shows he aims to protect their illegal labor.

It may but what is flying under the radar is that the Conservative party is being gutted. My guess is that the remaining Tories are going to have a shotgun wedding with Reform soon for the next general elections. Labour is probably dead--the smarter voters seemed to migrate toward the Lib Democrats, the Islamists and leftists to the Green party (or ethnic parties in the Scotland and Wales assemblies).

There is really no purpose for a Labour party without its working class and that is what Reform has done--separate the white working class from the Fabian racial and economic socialists that are now looking at the Green Party for their future.

451 It may but what is flying under the radar is that the Conservative party is being gutted. My guess is that the remaining Tories are going to have a shotgun wedding with Reform soon for the next general elections. Labour is probably dead--the smarter voters seemed to migrate toward the Lib Democrats, the Islamists and leftists to the Green party (or ethnic parties in the Scotland and Wales assemblies).

There is really no purpose for a Labour party without its working class and that is what Reform has done--separate the white working class from the Fabian racial and economic socialists that are now looking at the Green Party for their future.

The Gutting of the Tories was Last election - partially self inflicted when they conspired against Reform to keep their national government seats down. But many voters specifically voted to punish the Tories. And a lot of Tories did go to Reform already, which is why Restore is getting such growth, they suspect a watering down is happening. Last election Labor had fewer votes than the election before but won tons of seats due to the collusion and Tory defections.

That's good. Of course, if successful it amounts only to reclaiming a firmly GOP state for the GOP. It's necessary but not at all sufficient. The GOP has to be able to retain the Blue wall states Trump picked up. As far as I know, there's no evidence that Vance, Rubio, or anyone else is likely to do that.
