Supreme Court Grants Motion to Immediately Finalize Gerrymander Decision, Allowing Lousiana to Implement It Now

I guess there's some period of time that usually passes after a decision is announced until it is considered implementable law -- thirty two days before it is "reported" to the lower court.

But this is just a general practice, not a firm rule. The Court has adjusted this clock before when justice demanded it.

The Supreme Court granted Louisiana's motion to speed up that clock and finalize the decision immediately.

The Supreme Court on Monday night granted a request to immediately finalize its opinion in Louisiana v. Callais, in which it struck down that state's congressional map, to allow Louisiana to draw a new map in time for the 2026 elections. That map is expected to favor Republicans, who currently hold four of the state's six seats in the U.S. House of Representatives but could pick up one or even two more under a revised map.

Was it justified to speed up the clock? Yes, for two reasons.

1, the racially discriminatory maps are unconstitutional right now. Not in two years, right now. The citizens of Louisiana are living under racist congressional maps right now. And what's the left's favorite propaganda slogan...? "Justice delayed is justice denied."

2, we now have almost complete confirmation of the rumor that Obama hack Kagan deliberately dragged her heels on submitting her dissent not because she needed seven months to perfectly craft it, but specifically to avoid the ruling taking effect a half year ago, giving southern states plenty of time to adjust without having to scramble right before voting began.

Because it's now revealed that the Supreme Court "conferenced" the case seven months ago -- meaning they debated and voted on the decision.

But Kagan needed Moar Time to craft her perfect dissent.

Unqualified DEI Fake Justice Ketanji-Brown through another one of her racialist hissy-fits. She is appalled that the Court will not allow the leftwing Justice's deliberate seven-month delay to stand. She has no good reason for this -- she says that granting this motion would show "partisanship" but, as Alito says, she does not explain why not granting it would equally show partisanship, but in favor of the Always Racist Democrat Party.

Jackson basically ATTACKED the majority, and argued Louisiana should be required to use an *unconstitutional* racially gerrymandered map in the 2026 midterms -- directly against the majority ruling.

Alito didn't take too kindly to that:

"The dissent goes on to claim that our decision represents an unprincipled use of power...that is a groundless and utterly irresponsible charge."

"What principle has the Court violated? The principle that Rule 45.3's 32-day default period should never be shortened even when there is good reason to do so? The principle that we should never take any action that might unjustifiably be criticized as partisan?"

"The dissent accuses the Court of 'unshackl[ing] itself from 'constraints...' It is the DISSENT'S rhetoric that lacks restraint."

"The dissent in this suit levels charges that cannot go unanswered. The dissent would require that the 2026 congressional elections in Louisiana be held under a map that has been held to be unconstitutional."

"The dissent does not claim that it is now too late for the state legislature or the District Court to adopt a new map that complies with the Constitution."

"Nor does the dissent assert that it is not feasible for the elections to be held under such a map. Instead, the dissent offers two reasons for its proposed course of action."

"One is trivial at best, and the other is baseless and insulting."

Gorsuch signed onto this as well.

Once again, not a single other leftwing justice was willing to sign her name to Ketanji-Brown's pig-ignorant doctrine of "the law must constantly shape-shift to guarantee that blacks, women, gays and Democrats always win" bullshit:

There was a routine Supreme Court procedural order today not to delay fixing Louisiana's unconstitutional gerrymander. Normally these things are handled quietly without revealing who thought what but this time was different because Jackson insisted on writing a bizarre diatribe, which prompted Alito, Thomas, and Gorsuch to respond. And they did not hold back. They described her claims as "baseless and insulting" and "groundless and utterly irresponsible." They really, really cannot stand her.

What really says it all is that the other liberals would not touch it, let alone join Jackson or defend her. She is simply too embarrassing even for them to sign onto. Also interesting, but not surprising, that Roberts, Kavanaugh, and Barrett sat this one out, as usual, because they are too timid to call out someone who, by any sane standard, should not be anywhere near a judge's chambers, especially not this one.

If Biden had put someone halfway smart, there'd be one more loyal vote for the left but who can actually make an argument.

At best, Jackson will be a non-entity, the equivalent of putting a simple machine that goes only asks if good for Dem party or not as the reasoning. At worst, she's going to argue so badly that it'll help keep the right part of the court unified.

Kagan et al are taking advantage of the comity of the court, and the rest of the court are figuring it out.

The only thing holding back Thomas and Alito from demanding such things is Roberts who controls calendars.

I think it's most noteworthy, though, that Gorsuch signed onto the opinion by Alito.

The state was required to create that monstrosity....there would be no other way to get a majority black district any other way in Louisiana. For some reason, this enraged the local crow population, which would announce their displeasure from 3-4 trees on my block. We once setup a motion-sensor video camera to identify neighbors whose dogs were shitting in our front yard without cleaning up after their dogs -- so we could confront them with evidence after they continually denied it.

Anyway, maybe you could rig-up some kind of motion detector in order to snap some good photos. Only problem is, of course, you might get the camera tripped by other movements in the area ... especially on windy days.

Rule of Four. Got to have four justices willing to hear a case and then there is the whole strategy around defensive denials. The whole federal courts muddle on the right comes from the wishy washy application of constitutional principles like equal protection clause to the nasty business of election law and process. Same problem with firearm laws. How much 'federal' should the rulings on processes and law be versus states.

I don't particularly think that most of the justices really want to be state supervisors of elections so they naturally defer on a lot of state based crap that they really shouldn't. Like states not following their own laws in cases involving federal elections should technically result in reversals by federal courts.

But the fact that these often occur most in blue states with blue state judges picked via the blue slip veto by Democrat senators, you get cases with bad facts and little to go by to reverse at higher appellate court levels.

I posted it before but Rs flipped 8 seats in 2024.
In what would have been, 20+ years ago, a wave election that would have seen 20-40 House seats flip.

That is how precise, and how far, Dems have pushed the limit of gerrymandering--so many seats are safe even in a wave.
But that cuts the other way--Rs are isolated in blue states to such safe districts, they can't flip them in a blue wave either.

4 of those flipped in 2024 were by less than 2%. All of those incumbents are running.

All the "conventional wisdom" of 2026, that the party out-of-power loses seats never answers "which seats?"

Parliament gave that power up because they found it useless themselves. Framers were mixed on it due to the Convention occurring while the famous failed impeachment trial of Hastings was going on in Parliament. That went on for years before it finally ended in failure.

With a unitary executive that could fire and hire who they wanted, the only thing impeachment could really be aimed at was the President and VP, despite early attempts to use it (Sen. Blount) for senators and later for a Supreme Court justice, Chase, that they hated. Both of those impeachments failed. It only worked on lower court judges like one that went literally insane, and for those that were convicted of crimes.

The major flaw in the Founder's thinking was the universal approbation of political parties but yet these same gentlemen promptly created a party system that is literally extra-constitutional and to have expected otherwise was foolish as a matter of history and political theory (see Why Parties by Aldrich).

Had not the Scotus before the Civil War interpreted the privileges and immunities provision in the US Constitution properly, there was no need for it. So we had a civil war because the branches could not come to an agreement to end slavery which contradicted our own statements on independence.

Explicitly in the 14th Amendment discussions, the right of having firearms was mentioned as part of the privileges and immunities clause (see the English Bill of Rights of 1689 as the origin).

Thomas noted it early on and has publicly hated on Cruikshank and Slaughterhouse cases for eviscerating the application of the Bill of Rights to the states intended by the privileges and immunities clause in the 14th. Instead, when the court got around to it this century, they used the ridiculous due process approach and selective incorporation of parts of the Bill of Rights to the states instead of incorporating the whole thing.

And that is because too many of the elites on the court after the turn of the century disfavored citizens owning firearms as they saw average people as causing mayhem and death needlessly in criminal cases.

The Sullivan acts of New York should never had been allowed to be constitutional in the first place.

I was at a luncheon where the Chief Judge of the Fifth Circuit spoke (not an impressive figure), and she too trumpeted how non-partisan the federal judiciary is based on how often they all vote together despite who appointed them (something that is more attributable to the weight of existing precedent, the role/status of intermediate appellate judges within the judicial hierarchy, and shared class culture - upper middle class with aspirations, than to lack of political difference between the parties). Federal judges are both so lacking in self-awareness and egocentric enough to believe such myths as the apolitical judiciary (apart from a few bad apples). Kind of like how it takes higher education and fancy degrees to believe certain kinds of nonsense.

I am not as pessimistic as that. History is never a straight line progression as it depends on the unpredictable individuals and actions in the future when an existential crisis appears.

Simply put, regimes have to fit the citizenry and society they exist in. When there is a mismatch, you get dysfunction and it is primarily because of the 'elites' in society more than the rank and file.

The rank and file are recruited by elites during fights with other elites.

John Adams really should be considered higher than James Madison on the scale of political philosopher. His superb 3 volume Defense of the Constitutions of the United States completed just prior to the constitutional convention is an overlooked work of a serious scholar of constitutional law and philosophy.

And since he more or less ghostwrote the Massachusetts state constitution post independence, he knew both the practicalities and problems of practice applying theory.

Slaughterhouse is a perfect example of bad facts in the case were compounded by Scotus. Essentially a group of independent butchers did not want to use the mandated state slaughterhouse for meat packing. New Orleans had had multiple times where the offal from the animals was discarded in the river above where the city got its drinking water from. So you got nasty diseases from drinking the water.

The independent butchers were challenging (which goes back to Dr. Bonham's case), the Louisiana legislature creating a monopoly by state action and claiming they had a right to pursue an occupation that the state was hindering by requiring them to use the state slaughterhouse that put its sewage downstream of the drinking water taps for New Orleans.

I would actually use Cruikshank to overturn the privileges and immunities clause jurisprudence. Better facts there. Cruikshank involved blacks and GOP trying to protect the courthouse and voting from Southern Democrat racists. Race riot occurred.
