Sefton: sefton at cutjibnewsletter.com | Supreme Court Grants Motion to Immediately Finalize Gerrymander Decision, Allowing Lousiana to Implement It NowI guess there's some period of time that usually passes after a decision is announced until it is considered implementable law -- thirty two days before it is "reported" to the lower court. But this is just a general practice, not a firm rule. The Court has adjusted this clock before when justice demanded it. The Supreme Court granted Louisiana's motion to speed up that clock and finalize the decision immediately. The Supreme Court on Monday night granted a request to immediately finalize its opinion in Louisiana v. Callais, in which it struck down that state's congressional map, to allow Louisiana to draw a new map in time for the 2026 elections. That map is expected to favor Republicans, who currently hold four of the state's six seats in the U.S. House of Representatives but could pick up one or even two more under a revised map.Was it justified to speed up the clock? Yes, for two reasons. 1, the racially discriminatory maps are unconstitutional right now. Not in two years, right now. The citizens of Louisiana are living under racist congressional maps right now. And what's the left's favorite propaganda slogan...? "Justice delayed is justice denied." 2, we now have almost complete confirmation of the rumor that Obama hack Kagan deliberately dragged her heels on submitting her dissent not because she needed seven months to perfectly craft it, but specifically to avoid the ruling taking effect a half year ago, giving southern states plenty of time to adjust without having to scramble right before voting began. Because it's now revealed that the Supreme Court "conferenced" the case seven months ago -- meaning they debated and voted on the decision. But Kagan needed Moar Time to craft her perfect dissent.

I really think Jackson is going to be of great value to us on the Court.
She's stupid, opinionated, loud, and genuinely unpleasant by all accounts. If Biden had put someone halfway smart, there'd be one more loyal vote for the left but who can actually make an argument. At best, Jackson will be a non-entity, the equivalent of putting a simple machine that goes only asks if good for Dem party or not as the reasoning. At worst, she's going to argue so badly that it'll help keep the right part of the court unified. Yeah, that footnote is brutal.
It was completely not needed except to say one thing: We are tired of your bullshit and your lies. Not only does it confirm that the Left Bloc were dragging their feet to draft their dissent, it confirms another thing: The majority had acceded to demands--and promises--of the Left Bloc to take the highly unusual step of ordering additional argument and briefing. I don't know what lies and promises the Left Bloc made, but they convinced the majority they were acting in good faith 7 months ago. The footnote makes it clear they have burned all their credibility and good will. Especially Jackson. Every Justice, but Roberts, has now written a specific response to attacks by Jackson. Jackson previously said it was her life goal to perform on a Broadway stage.
The entire federal bench is GAY AF for this kind of nonsense, reflecting the class aspirations of the kind of mid-wits who become lawyers these days. Federal judges still cannot shut the fuck up about Hamilton, like a bunch of Millennials who've only ever read Harry Potter and have made it their touchstone for discussing anything and everything. Judge Ho, a conservative on the Fifth Circuit, littered an opinion with Hamilton references, for example. You know, because that's a sober way to write a judicial opinion and spend the limited time and resources of a federal appellate court. Did anyone argue that these gerrymanders were equivalent to racial ghettos.
Because they are. -- It's not racist to stuff blacks into districts where they can't vote for any other candidate except a Democrat. Who is white. That's literally several of minority-majority districts. Also, those districts segregated blacks from the greater American governance--they have no say in or appeal to the rest of America. And they eradicated any moderate or centrist Dems in the South because, instead of having to appeal to the general constituency and changing voting patterns of the state as a whole, they were safely cocooned inside illegal bubbles of blue. Posted by: TheJamesMadison ==== Rule of Four. Got to have four justices willing to hear a case and then there is the whole strategy around defensive denials. The whole federal courts muddle on the right comes from the wishy washy application of constitutional principles like equal protection clause to the nasty business of election law and process. Same problem with firearm laws. How much 'federal' should the rulings on processes and law be versus states. I don't particularly think that most of the justices really want to be state supervisors of elections so they naturally defer on a lot of state based crap that they really shouldn't. Like states not following their own laws in cases involving federal elections should technically result in reversals by federal courts. But the fact that these often occur most in blue states with blue state judges picked via the blue slip veto by Democrat senators, you get cases with bad facts and little to go by to reverse at higher appellate court levels. We once setup a motion-sensor video camera to identify neighbors whose dogs were shitting in our front yard without cleaning up after their dogs -- so we could confront them with evidence after they continually denied it.
Anyway, maybe you could rig-up some kind of motion detector in order to snap some good photos. Only problem is, of course, you might get the camera tripped by other movements in the area ... especially on windy days. 164 I had a cute little interaction yesterday.
My gym has an elevator. I'm walking by the elevator and a little guy, maybe two years old comes out. He's alone. I glance around and I see his mom coming from the stairway. She has that mom look as she's approaching her son, like, "Don't do that again. You can't do that. It's not safe." Little guy has the biggest grin on his face and he doubles over and dances as he celebrates his adventure. I smiled at the mom and said, "He's so proud of himself!" She agreed. -- Why are they so desperate to hold that single, illegal, extra seat? Folks don't understand how extremely perfected gerrymandering has become. I posted it before but Rs flipped 8 seats in 2024. In what would have been, 20+ years ago, a wave election that would have seen 20-40 House seats flip. That is how precise, and how far, Dems have pushed the limit of gerrymandering--so many seats are safe even in a wave. But that cuts the other way--Rs are isolated in blue states to such safe districts, they can't flip them in a blue wave either. 4 of those flipped in 2024 were by less than 2%. All of those incumbents are running. All the "conventional wisdom" of 2026, that the party out-of-power loses seats never answers "which seats?" Beretta Holding and Ruger Agree to Partnership
by FRANK MINITER posted on May 4, 2026 NEWS, ARMED CITIZEN Sturm, Ruger & Co., Inc. and Beretta Holding S.A. have announced a strategic cooperation agreement. This collaboration began last year as a contentious disagreement between the two companies—as of last March, Beretta Holding S.A., the Luxembourg-based parent of the iconic Italian gunmaker Beretta, had amassed a 9.95 percent stake in Ruger. The shared agreement will allow Beretta to increase its ownership of Ruger to up to 25 percent of the company’s outstanding shares (NYSE: RGR). According to the press release, the minimum partial tender offer price shall be $44.80 per share in cash. Beretta had been promoting four individuals for seats on the Ruger board. But, according to this agreement, Beretta will “nominate up to two independent directors following the 2026 Annual Meeting of Shareholders and regulatory approval. https://tinyurl.com/43y76tvh Posted by: rickb223 at May 05, 2026 12:51 PM (xHq83) 203

Impeachment is failure theater. And moral victories of the asterisk on her name mean nothing when she gets to go back to work and take her anger out on us.
Posted by: TheJamesMadison ===== Parliament gave that power up because they found it useless themselves. Framers were mixed on it due to the Convention occurring while the famous failed impeachment trial of Hastings was going on in Parliament. That went on for years before it finally ended in failure. With a unitary executive that could fire and hire who they wanted, the only thing impeachment could really be aimed at was the President and VP, despite early attempts to use it (Sen. Blount) for senators and later for a Supreme Court justice, Chase, that they hated. Both of those impeachments failed. It only worked on lower court judges like one that went literally insane, and for those that were convicted of crimes. The major flaw in the Founder's thinking was the universal approbation of political parties but yet these same gentlemen promptly created a party system that is literally extra-constitutional and to have expected otherwise was foolish as a matter of history and political theory (see Why Parties by Aldrich). 199 The 14th Amendment is outdated as there are no longer any freed slaves for it to protect.
Posted by: Operator Error ======= Had not the Scotus before the Civil War interpreted the privileges and immunities provision in the US Constitution properly, there was no need for it. But they didn't, in part because slavery became THE issue for the roughly 50 years before the Civil War. Simply put, privileges and immunities should have been interpreted as the Rights of Englishmen encoded via common law at the time of Independence. And that no state could deny such to its citizens nor legitimate travelers going through the state. The Marshall court ignored rights of citizens for the most part and Barron v. Baltimore refused to apply the Bill of Rights to the states. Taney was no friend of civil rights and liberties either. So we had a civil war because the branches could not come to an agreement to end slavery which contradicted our own statements on independence. The Court in Slaughterhouse and Cruikshank promptly shat on the duplicative and clear language imposing the privileges and immunities clause in the 14th on states as well when they had the chance. What really says it all is that the other liberals would not touch it, let alone join Jackson or defend her. She is simply too embarrassing even for them to sign onto. Also interesting, but not surprising, that Roberts, Kavanaugh, and Barrett sat this one out, as usual, because they are too timid to call out someone who, by any sane standard, should not be anywhere near a judge's chambers, especially not this one.

Sotomayor is as pure an affirmative action situation as the idiot Jackson. Back to her days at Princeton. Dumb.
Will Chamberlain is a darkly unintentionally humorous member of the Legal Cult. "Progressive jurisprudence discredited for a generation". Every word and concept of that idiotic sentence is ridiculous. As if dim totalitarians ("progressives") can be "discredited" when their entire schtick is just ruthless pursuit of power and control for its own sake or to impose their vile racist or ideological atrocities. And as if the little Stalinist oblast secretaries being churned out by law schools would understand or care about actual constitutional principles or intellectual standards or cultural norms. With enough bad breaks, there will be a lone justice with any meaningfully American or non-totalitarian/racist mindset ignored and abused by the mindless Revolutionary Command Council majority on the court as it completes the evisceration of the former constitutional system. Legal Cult cultists are among the dumbest of the non-elite elites. Posted by: rhomboid at May 05, 2026 01:07 PM (U/Byj) 289

Second Amendment.
Posted by: Comrade Flounder ====== That was sort of a revived amendment after being dead from Cruikshank and later Miller decisions. Explicitly in the 14th Amendment discussions, the right of having firearms was mentioned as part of the privileges and immunities clause (see the English Bill of Rights of 1689 as the origin). Thomas noted it early on and has publicly hated on Cruikshank and Slaughterhouse cases for eviscerating the application of the Bill of Rights to the states intended by the privileges and immunities clause in the 14th. Instead, when the court got around to it this century, they used the ridiculous due process approach and selective incorporation of parts of the Bill of Rights to the states instead of incorporating the whole thing. And that is because too many of the elites on the court after the turn of the century disfavored citizens owning firearms as they saw average people as causing mayhem and death needlessly in criminal cases. The Sullivan acts of New York should never had been allowed to be constitutional in the first place. Posted by: whig at May 05, 2026 01:10 PM (E4rtv) 302

You now, if Black people wanted to get more blacks elected, maybe they should become republicans? We are perfectly fine with electing black people to office. That is the funny part here - dems want to gerrymander their states along party lines, and so do republicans. The problem is black people vote 80-90% D, hence they lose seats in republican states. The Ds call this racist, but what the Ds just want more seats. They don't give a crap about black people and never have. Again, simple solution, more blacks become republican. I was at a luncheon where the Chief Judge of the Fifth Circuit spoke (not an impressive figure), and she too trumpeted how non-partisan the federal judiciary is based on how often they all vote together despite who appointed them (something that is more attributable to the weight of existing precedent, the role/status of intermediate appellate judges within the judicial hierarchy, and shared class culture - upper middle class with aspirations, than to lack of political difference between the parties). Federal judges are both so lacking in self-awareness and egocentric enough to believe such myths as the apolitical judiciary (apart from a few bad apples). "Fugacity" is equivalent of "activity," but for gases. Activity is the thermodynamically effective or apparent concentration of a component in solution relative to some reference state; it has the units of concentration. I think fugacity is expressed as units of gas pressure (it's been a while). In both cases, the values can be represented by a coefficient, a dimensionless number. E.g., multiply actual concentration by an activity coefficient, and you get activity, the thermodynamically apparent concentration. Actual gas pressure times fugacity coefficient gives apparent/effective gas pressure. Posted by: Semi-Literate Thug at May 05, 2026 01:19 PM (HLgI3) 334

Posted by: rhomboid ===== I am not as pessimistic as that. History is never a straight line progression as it depends on the unpredictable individuals and actions in the future when an existential crisis appears. Simply put, regimes have to fit the citizenry and society they exist in. When there is a mismatch, you get dysfunction and it is primarily because of the 'elites' in society more than the rank and file. The rank and file are recruited by elites during fights with other elites. John Adams really should be considered higher than James Madison on the scale of political philosopher. His superb 3 volume Defense of the Constitutions of the United States completed just prior to the constitutional convention is an overlooked work of a serious scholar of constitutional law and philosophy. And since he more or less ghostwrote the Massachusetts state constitution post independence, he knew both the practicalities and problems of practice applying theory. Actual gas pressure times fugacity coefficient gives apparent/effective gas pressure.

By the way, I have a friend who is a lawyer and reads the supreme court arguments and decisions. He's also a lefty.
He says Kagan is PhD law, Sotomayor is first year law, and Ketanji Brown is a liberal arts major pretending to know the law. He is very embarrassed about this. Posted by: The Whine Guy at May 05, 2026 01:23 PM (k8xm0) 347

The fact that KBJ graduated high school, let alone got a bachelor's degree then a JD, passed the bar and eventually became a judge and eventually a Supreme Court Justice is a wild indictment of our educational system, justice system as a whole, the practice of Law in general, and of Joe Biden's Autopen.
The woman is a fucking retard. I would just as soon go deep into Appalachia and find a person who can barely write their own name and install them on the highest court in the land, because at least that illiterate rube probably has some basic, foundational sense of right and wrong without trying to bend everything to fit a racist, sexist, Marxist worldview. 284 A semi truck with a full load made a delivery from Houston to Dallas yesterday. No big deal except it was fully autonomous with no observer or back up driver or any human involvement. It was not a test run.
That is kind of scary and awesome at the same time. Posted by: Harry Vandenburg at May 05, 2026 01:06 PM (kxLc1) Scary. Eventually as more are in operation, there will be two in approximately the same location, on an interstate in the same direction. Eventually they will end-up side-by-side due to occasional single-lane traffic at reduced speed due to construction or accidents. They will both run at the speed limit in their GPS database, making passing impossible. No. Thanks. Posted by: Ketanji! at May 05, 2026 01:26 PM (5rh/l) 354

Thing is, though, Chief Justice Johnny Cartel allowed her to stall for seven months to Rig the Election.
Just like he let night court judges block the President until he was forced to rule against it–but still lets them ignore it. Just like he sicced the FISA Court on the President. Just like he lets CIA Enforcer Boasberg protect Money Launderer Powell. Just like he stocks the courts with foreigners who apologize to assassins and impose #SwaziLaw on Americans. If John Roberts had been the deciding vote, he would have voted against the redistricting repeal. But since he couldn’t stop it, he went along for the conservative street cred, like John Thune in a black dress. Posted by: The Gipper Lives at May 05, 2026 01:32 PM (JuQSv) 357
Reminder:
Thomas is on record for decades now, that he wants to overturn Slaughterhouse. I think that will be his grand farewell majority opinion. Posted by: People's Hippo Voice ====== Slaughterhouse is a perfect example of bad facts in the case were compounded by Scotus. Essentially a group of independent butchers did not want to use the mandated state slaughterhouse for meat packing. New Orleans had had multiple times where the offal from the animals was discarded in the river above where the city got its drinking water from. So you got nasty diseases from drinking the water. The independent butchers were challenging (which goes back to Dr. Bonham's case), the Louisiana legislature creating a monopoly by state action and claiming they had a right to pursue an occupation that the state was hindering by requiring them to use the state slaughterhouse that put its sewage downstream of the drinking water taps for New Orleans. I would actually use Cruikshank to overturn the privileges and immunities clause jurisprudence. Better facts there. Cruikshank involved blacks and GOP trying to protect the courthouse and voting from Southern Democrat racists. Race riot occurred. Posted by: whig at May 05, 2026 01:35 PM (E4rtv) 358

Posted by: The Whine Guy at May 05, 2026 01:26 PM (k8xm0) That's KBJ's Super Power, and why she's so ineffective for and damaging to the left. The other members adore their Grand and Mighty Intellects Which Allow Them to (Inessense) Rule Over Us Without Recourse. KBJ makes it clear that any retard can rule in that position, so her fellow libs have to make sure that she's looked upon as a freak accident of some sort, to agree with KBJ is to self-proclaim your self to be aligned with and at the same level of a witless retard.
