DeCarlos Brown, the Racist Killer Who Slit Iryna Zarutska's Throat for No Reason Other Than Her Race, Found by Psychiatrists to be Too Mentally Incompetent to be Tried for Murder

The judge will now decide whether to accept this report.

If she does accept -- I assume it's a she because that's how these things I always go -- at some point, we're just going to "bypass" the judges and juries.

This will not be allowed to go on forever.

The deranged homeless man accused of savagely butchering Iryna Zarutska, a 23-year-old Ukrainian refugee, on a Charlotte light rail train has been found "incapable to proceed" on state murder charges.
According to a motion filed April 7, Decarlos Brown Jr. was evaluated Dec. 29 at Central Regional Hospital, and the subsequent report determined he was not competent to stand trial, according to WBTV.

This article is written vaguely, so I'm forced to guess at the procedural aspects here. What I'm guessing is that a defense "expert" found he was incapable of standing trial, just as the client, the defense, wanted.

I'm not sure though. This whole report is sketchy and, frankly, amateurish.

The results were previously sealed in state court, and were only revealed as the motion was filed.
A judge must now determine whether to accept the report's findings, and the case against him will likely be delayed until his capacity is determined to be "restored" by the court, the station reported.
In the motion filed by Brown's public defender, he claimed the court-required capacity hearing cannot take place with the accused killer in federal custody, and that the court also can't order to have his capacity restored.
Brown has been in federal custody in Chicago since a grand jury indicted him on Oct. 22 for violence against a railroad carrier and mass transportation system causing death.
He's been ordered to undergo a psychiatric evaluation pursuant to his federal case, but court filings viewed by the outlet last month show it hasn't been completed and that the evaluation period has been extended.

See? There the article says the evaluation hasn't been completed, but it also claims some report -- maybe this one, maybe another one -- was completed and found him too incapable to be tried.

This is why I'm forced to guess that there are two separate reports, the official one which is incomplete, and one performed by a psychiatrist hired by the defense, which, of course, found him incompetent.

The outlet reports that restoring competency can take a long time in North Carolina because of limited space in state psychiatric facilities, and said it's not uncommon for defendants to wait a year or more for a bed to open up.
Brown, 35, whose mother told The Post is schizophrenic, was arrested at least 14 times in North Carolina for crimes ranging from assault and firearms possession to felony robbery dating back to 2007.

At the time of the senseless attack in late August, he was free on cashless bail after a magistrate released him with a "written promise" to show up for court after placing a bogus 911 call.

What complicates matters is that most of these street assholes 'medicate' themselves into insanity via whatever shit they can pickup on the street. As a matter of law, if you take drugs/alcohol before doing some heinous act, you are still culpable. Being a drug/alcohol abusing piece of shit is a mitigation for sentencing, not for whether you can be declared insane.

The stabbing happened on North Front Street in downtown Wilmington, shortly after 2 a.m. on Sunday, April 5.

Civil Involuntary Commitment is available in SC.

If the defendant is unfit and not likely to become fit, the criminal charges are not automatically dismissed. The Solicitor initiates commitment proceedings in Probate Court. Probate Court holds a hearing to determine if the person is mentally ill and meets civil commitment criteria. If criteria are met, the defendant is involuntarily committed to a DMH facility for treatment.

145 My understanding is in NC if you are found incompetent to stand trial, you are just sent home. You are held and you get treatment with the goal of getting you competent to actually stand trial. If that never happens, you can be held indefinitely in a mental institution, but charges aren’t dropped.

There is an option for charges to be dismissed, but I am hopeful this is rare and in the case of someone who is incapacitated to the point of not being a risk any longer. Lawyers can weigh in here.

Again, I know we want a justice system, but what we have is a legal system. That legal system seems to be fraying a bit around the edges, though, but I am not sure this guy really is capable of understanding right from wrong.

Yep and hospitals that do have facilities to lock these guys up only have a few beds and they can't keep anyone longer than 24 hours without a judge stepping in to order a longer psych hold.

Plus there is a negative financial incentive for the hospital to hold these guys because the vast majority do not have any insurance and they rely upon the state to reimburse them for any care they give. Reimbursement does not always happen.

We jail (+) people for lots of reasons - punishment, retribution, establish sense of justice, make society more safe, deterrence,...

One thing that pisses me off is that we evaluate for mental incapacity before the trial/conviction/sentencing takes place. I don't have a problem with doing the evaluation after sentencing to figure out where the sentence should be carried out. But they still committed the crime, so it's a matter of deciding whether they spend 30 years in a mental institution or a prison. They still need to serve their 30 years.

When you do the math, I believe that it means that 1 lb of the new stuff is equal around 1600 lbs of raw heroin.

It's possible to climb out of poverty. But every single break has to go your way. It takes self-discipline. Screw up and you're back where you started.

So what do Leftoids do? From their towers in academia, espouse policies and positions that almost guarantee life-long and generational poverty for those with little to begin with and no margin for error. No-fault divorce. M'Naughton's rule dates from the 1840's after the assassination (only successful one) of a British Prime Minister. Adopted by most states in the US shortly after. Some countries and states have guilty but insane and require for a heinous murder that the person serve their sentence out in a state mental hospital rather than prison gen pop.

It is actually a lot tougher standard than most people figure and the burden of proof flips to the defendant and requires the defendant to admit guilt to apply the justification defense that they were mentally ill. Plus, state gets their forensic psychologist/psychiatrist to evaluate the patient because the patient is 'evidence'. That abrogates the 5th amendment as the defendant must answer questions as they have already had to admit guilt to claim insanity in the first place.
