But they'll just figure out a way to ignore their judicial superiors. Note that yesterday, Politico was scandalized by left-wing judges complaining to them that the Trump Administration slow-walks and subverts their orders. It's just terrible! We can't have a country in which the duly-elected president and head of the entire executive branch disregards the orders of lowly, one-of-677 district judges!But now, the lowly district court judges are scheming about how to ignore their direct judicial superiors, their "commander ranked" superior officer judges, and Politico thinks that's very clever and nifty! This is an entirely made-up bit of judicial wishcasting that they're creating just to keep giving the same illegal aliens, all eligible for deportation, more and more "bites at the apple." They will keep spinning out novel, fantastical, made-up new theories so that the illegal aliens are perpetually "in the system" awaiting their next hearing. They're contriving a way to keep illegals in the country forever, because they'll just keep making up new theories to sue under, and thus will keep them in the country, always with the next appeal filed for the next judge, until they die. "This conclusion is not changed by the Fifth Circuit's recent decision," Judge Kathleen Cardone, an El Paso based appointee of George W. Bush, ruled late Monday in at least five cases, concluding that the circuit's decision "has no bearing on this Court's determination of whether [the petitioner] is being detained in violation of his constitutional right to procedural due process." Judge David Briones, an El Paso-based Clinton appointee, reached a similar conclusion. "The Court reiterates its original holding that noncitizens who have 'established connections' in the United States by virtue of living in the country for a substantial period acquire a liberty interest in being free from government detention without due process of law," Briones wrote. Oh boy, won't these judges be surprised when they learn that a Due Process "liberty interest" cannot lie for any right that is explicitly enumerated in any other part of the constitution, like the fifth amendments right to "Liberty" itself. As in, you cannot assert a right to have a gun under the 9th amendment, because the second amendment guarantees that right. You cannot get around constitutional precedent by creative pleading. He's ordering them to: - facilitate their return - pay for their flights - grant them entry to the US wherever they present Further, he is giving his court the extra-jurisdictional authority to accept a habeas petition from any of those from over-seas. And keep in mind, he's not doing this by illegally ordering State to conduct foreign affairs, or illegally ordering the Executive to spend money, or illegally ordering the Executive to not enforce immigration law--no! He's doing all this indirectly by threatening to hold DOJ officials in contempt if the others don't do that. As I noted earlier, from my dim recollection of the law, this phrase "liberty interest" is a very specific legal term of art.
And it's only used in discussing whether a law is Constitutional. That is, since this law permits you to be imprisoned, that implicates your right to liberty, and a whole host of other due process rights then come into play. And if the law doesn't grant you those rights, the law is unconstitutional. Yes, this means the judges are implying that immigration law is unconstitutional. But these cartel judge aren't just whoring themselves out for the illegals, they are inverting it's meaning--they're using it to mean the illegal has an interest in remaining free until the government proves beyond all appeals they can be deported. I've been pretty vocal on this site about the judicial coup. I don't have a solution, but I do think the administration should have confronted it on day one. I think they're behind the 8-ball right now because they're being "reactive" to every move they make. Mostly as it relates to the illegals, but they're not very successful in other areas, specifically with regards to the J6 lead up and aftermath.
