Fifth Circuit Court of Appeals Overrules Lawless Lowly District Court Judges, Rules that Illegal Aliens May Be Held Without Bond While They Fight Their Deportation Orders

The left prefers that the be released on bond, so they can simply abscond and never show up for any deportation hearings. They stay in the US perpetually just by the left releasing them every time they're caught by immigration agents. They just find a new place to live and slip into "the shadows" again, as our left-wing friends the Bushes like to say.

The Fifth Circuit ruled on Friday that illegal aliens have no right release from detention. They can file their worthless objections using the scripted lies that open borders advocates teach them to say, but they'll do that while cooling their heels in stir.

Or they can just leave the country. Their choice.

A federal appeals court on Friday endorsed the Trump administration's policy of holding broad groups of immigration detainees without access to bond hearings, a major legal victory for President Trump and his deportation crackdown.

In a 2-1 decision, a panel of federal judges at the 5th Circuit Court of Appeals said the Trump administration had properly reinterpreted an immigration law last year to disqualify many unauthorized immigrants arrested by Immigration and Customs Enforcement from being able to ask an immigration judge to be released on bond.

Previously, immigrants who had lived in the U.S. unlawfully for years were generally eligible for bond hearings, and the opportunity to persuade an immigration judge that they were not flight risks and should be allowed to fight their deportation outside of a detention center. Mandatory detention had been historically limited to recent border crossers and those convicted of certain crimes.

But the Trump administration took the position that anyone who entered the U.S. illegally, irrespective of how long ago, is subject to mandatory detention during their deportation proceedings. The only mechanism for release under that policy was if ICE decided to parole them out of custody on humanitarian or public interest grounds.

The seismic policy change has led ICE to indefinitely hold detainees who entered the U.S. illegally years or even decades ago and who previously would've been eligible for bond, including those without criminal records.

The mass detention policy has been challenged in federal courts across the country, straining the resources of government lawyers. Most judges have found the policy to be illegal.

But the 5th Circuit panel disagreed and upheld the Trump administration's legal position, reversing two lower court orders.

The majority opinion -- penned by Reagan-nominated Judge Edith Jones and backed by Trump-nominated Judge Stuart Kyle Duncan -- sided with the Trump administration's view that federal law provides for mandatory detention of large numbers of unauthorized immigrants who were apprehended in the interior of the U.S. and deemed "applicants for admission."

"The text says what it says, regardless of the decisions of prior Administrations," the opinion read. "...In any event, that prior Administrations decided to use less than their full enforcement authority...does not mean they lacked the authority to do more."

Judge Dana Douglas, a Biden nominee, dissented from the majority opinion. She wrote that the government's claim that the law calls for mandatory detention ignored "historical precedent" and "wave[d] away" the fact that prior administrations hadn't sought to detain people without bond en masse.

"And for what?" writes Douglas, arguing that the majority opinion was "based on little more than an apparent conviction that Congress must have wanted these noncitizens detained -- some of them the spouses, mothers, fathers, and grandparents of American citizens."

This is all the left does. The fact that they are "spouses, mothers, fathers, etc." is not a legal argument. It's not a logical argument of any kind. It is simply a petulant, child-like demand for the reader's sympathy and a claim that they should be allowed to break the law at will because they are "spouses, mothers, fathers, etc."

The left's other argument is that because previous presidents, like Obama, Biden, and of course the Bushes, let illegals remain in the country while they file frivolous objections to deportation, all future presidents are bound by their non-legislative policy choices.


Weird how the right's policy choices never become stealth law and precedent binding all subsequent presidents. Just the left's.

In fact, these illegals seem to be arguing that while they are, in fact, subject to detention awaiting final deportation orders, they should be "eligible for discretionary release" by the Executive. And they're demanding a judge force the executive to grant them discretionary release.

Hm, in that case, it sounds like the judiciary is usurping the elected President's power to grant release under his own discretion.

If affirmed by the Supreme Court, this would become national law and greatly aid Trump in speedily deporting illegal aliens, or giving them the choice of sitting in ICE detentions for months and months or just leaving the country.

22 I've read that length of detention for those who don't sign waivers (70-80% sign waivers) is down to about 45 days from 150 days or so early last year.

A very small percentage of held immigrants hire lawyers for things like habeus proceedings which, essentially, just put them back on the street during their wait (now complete with ankle monitors).

The administration (headed by Stephen Miller who's doing daily conference calls at 10 am six days a week with heads of departments about hitting deportation numbers) is creating a mesh of incentives for illegal immigrants to choose to leave.

If they get picked up and fight the deportation order, 99.9% lose, and if you lose, you can never come back to the US for any reason. If you sign the waiver and leave, you may apply for a visa from outside the US. Oh, and there are massive backlogs in the visa systems so that they'll be waiting years.

All while the border is closed.

25 Hmm, I wonder if judicial activists will claim this only pertains to the jurisdiction of the 5th circuit. You can't have a ruling from a lowly circuit court apply to the whole country. Unlike rulings from a still wet behind the ears Hawaiian judge, which apply to the entire country for all of it's history and future, for example.

And, for decades, the Executive just ... ignored that and kept letting them out on bond.
Where the would appeal and delay for decades--if they showed back up at all!

Think about that:
If you follow the law, present at a port of entry to have your due process, your right to entry adjudicated, then you are not entitled to release on bond.

But if you cheat, and sneak in, and you get caught--even if you have no right to entry--then you get released on bond.

No more.

Just like they do when they discuss a policy shooting. It always comes down to whether the person "deserved" to get shot or whether it was "just."

That isn't the issue. That's the issue in *courts* and legal proceedings. The issue in a police shooting is whether the two people involved acted reasonably for the outcome. But they always reframe it as "deserved" or whatever, because it helps with the primary purpose of the press, which is emotional manipulation.

Because there are something like over 300 other district judge opinions around the US that hold the policy choices of past administrations over-rides both the plain text of the law and the current President.

All of these thousands and thousands of habeas petitions cite this policy of letting them out on bond, "no flight risk" as a basis.

This is the lawfare that's been holding back the floodgates of deportation.

Because tens and hundreds of thousands more are going to realize, if they get caught, there's no getting out, not even to go sell their car and have a garage sale--all gone at any time.

The argument being presented by anti-ICE lawyers is trying to focus on the part where those apprehended have a right to a "bond hearing"...but they are purposefully ignoring statutory language that gives the government the right to detain them IF THEY HAVE COMMITTED ANY CRIMES.

As I suggested elsewhere, lawyers KNOW this is a frivolous argument and will get tossed by higher courts. They only need to make the argument to hang the appeals on. Thus, this is only a delaying action intended solely to tie up the government and waste more precious time.

The entire legal strategy was to clog the system, giving people defacto immunity. You had to release people because detention was full. Detention was full because too many people came. Too many people came because you were releasing people from detention.

The new system will create a preference cascade in the opposite direction. Better to self deport under a controlled situation, than get scooped up and stuck in detention. Once in detention, better to agree to be deported, than rot in detention, hoping to win the immigration lottery.

If you voluntarily deport, by the way, you can then apply for citizenship. If you speak English, no criminal record, and have family or business ties in the U.S., there is a very good chance you'll get it. If I were the administration, I'd be really harping on that - you will get a high preference from immigration if you cooperate.

Seriously - Trump may deport 1 million and have another 10 million self deport.

Ironically this was done without Chevron deference. Interpretative rules in administrative law are where an agency interprets congressional statutes granting them authority. So, what the 5th is saying is that the DHS interpretation of its own statutes is the correct interpretation of the law.

My guess is that the next move by the left in the case is try to get it reheard en banc to stave off effects but outside of the 9th and firearm decisions, most circuits do not endorse en banc decisions willy nilly. So then you run the risk if you do a collateral move in another jurisdiction to get the opposite ruling, that it goes to Scotus.

As a matter of the law's text, a policy that is now replaced does not grant 'rights'. The text and the prior legislative history of that statute's wording indicates that the 5th is correct. It was a careful decision.

The left has the constitutional feelz clause and the Democrat clause that anything that the Dems do immediately creates an irreversible change in the law because feelz and Democrat party interests are affected. So we shall see.

Because the plain meaning of the text is clear, and because the dissenting judge essentially gave an opinion refusing to read the plain meaning of the text, wouldn't they do better to adjudicate in another circuit and reason we have lost the 5th for awhile, but if we can get a split in another circuit it will gum everything up until SCOTUS rules, which will take some time, and helps us try and fortify for the midterms?

Scotus Rule 10 for cert petitions but Scotus does not have to wait for other circuits if it desires to affirm the lower appellate court decision. It can, but it does not have to. E.g. Rule 10 part c.

(c) a state court or a United States court of appeals has decided an important question of federal law that has not been, but should be, settled by this Court. . .

Clause a) deals with circuit splits.
