94 Hogarth, for all his talent (look at his straight portraits) is not a lot of laughs or even pleasant. This is a prime example. The colors are dull and give an impression of dank mold. For all the activity of drinking, gambling and flirting, there is no feeling of joy or pleasure, just calculation, waste, and performance. The woman front left getting undressed is knows what she is doing and is preparing for it like an actor getting ready for a role. The drunken men won't even remember the next day.

It is an effective painting in the sense that Hogarth gets his point across but why would anyone want to view it.

Imagine if we had a, oh I don't know, a body of representatives who meet in, let's say a central location where government operates. Now imagine if those representatives took an oath to defend the very documents that give them their authority, and to execute said oath to see to it the laws were upheld.

If we had such a group of representatives, they might recognize with a lesser group of representatives were operating in violation of the laws, and would act to impose the penalties designated in the law. Then you'd have such people as "governors" and "mayors" of entities in open rebellion brought to court to face justice.

Looks like the panel used some procedural grounds for this decision. This is gonna keep getting appealed until someone gives up. And the White House is more likely to give up sooner.

Decisions like these are why ICE move people around so much, so when you appeal with Habeas when you’ve clearly been unconstitutionally detained the appeals courts will say you went to the wrong court and thus have to start over in another district.

Where is he from? If it’s safe for him, I would honestly consider just leaving the US and bringing his family with him, rather than risk being locked up. This admin wants to make an example out of him and I really worry they’ll succeed :/

A 2-1 ruling with a Trump appointee and a W appointee in favor of this decision. We're going to be stuck with these activist judges for a long time. Their plan is to thwart democracy. What the fuck is our plan? Note: This does not mean that the federal government can suddenly re-detain Khalil. This decision isn't a warrant.

We need a clean SCOTUS ruling that:
1) limits the frivolous filings of habeas.
2) flat denial that visa-holders have a 1st Amendment right; they do not.
3) that district judges do not get to second-guess the national security determination of the Secretary of State and the Executive. No matter how much they fluff their opinion up with Constitutional claims and violations of various statutes.

Because that's what will happen.

1) limits the frivolous filings of habeas.
2) flat denial that visa-holders have a 1st Amendment right; they do not.
3) that district judges do not get to second-guess the national security determination of the Secretary of State and the Executive. No matter how much they fluff their opinion up with Constitutional claims and violations of various statutes.

Because that's what will happen.

Court under Roberts is reactive rather than proactive. That is why the lower court judges feel free to YOLO. And that is the problem with selecting judicial restraint types that the traditional conservatives have pushed for decades since Bork got Borked. Only 3 out of the 6 justices (Alito, Thomas, and Gorsuch) are willing to create clear new precedents while Kavanaugh, ACB, and Roberts are the judicial restraint types--focusing on narrow decisions, balancing tests, and other be nice to the opposition style rulings. And the leftist judges take any caveat to go YOLO.

What is needed is simply summary reversals of these judges, no opinion, just grant cert, reverse, and apply as needed.

600,000 in the first 11 months of Trump's second term.

These individual cases matter to the individuals and narrative boosters, but they don't actually matter in terms of policy since they always lose. They make a while to lose, but they do end up losing all while literally hundreds of thousands more get forcibly deported while the processes play out.

3rd circuit is roughly split last time I checked. Either way, I think Khalil gets deported because the panel noted that Khalil's lawyers were required to file an appeal directly with the appellate court from immigration law, district courts do not have jurisdiction by law even under habeas.

So Khalil is asking for extraordinary relief based on being a protester being selectively punished by deportation. That sort of 1st Amendment claim under the liberty clause means Khalil has to prove that he was deported mainly because of his views as punishment, not his past actions in lying on immigration forms, or leading violent protests at Columbia to take over campus buildings.

The problem with Khalil's application is that a) was not entitled to habeas relief so the trial judge's opinion of facts is thrown out, b) he brought himself to the attention of authorities not via speech but the violent takeover of Columbia's campus. Not protected speech nor is his lying on immigration documents. So it is as reasonable gov't punished him for criminal actions not speech.

Actually the first impeachments were of Senator Blount of TN which leaves murky whether members of Congress can be impeached because he resigned before it happened. Second impeachment of cabinet official was Grant's Sec. of War, again he resigned before being impeached.

But the history of impeachment clearly shows that it was intended for any executive official (see how it was used by the Brits from which we derived our take on it).
